Register to the Philips Community 2025 Campaign

Campaign Period: January 1, 2025, 12:00 PM - December 31, 2025, 11:59 PM

Section 1. Campaign Organizer

The "Register to the Philips Community 2025 - January-December" campaign is organized by Philips Romania SRL (hereinafter referred to as "the Organizer"), located at Soseaua Pipera 46D-46E48, Office Oregon Park, Building C, 2nd floor, Sector 2, 020112, Bucharest. Philips Romania SRL acts as the personal data operator, registered with the Trade Register under no. J40/19792/1999, C.U.I. 2593699. The campaign is managed through Below-the-line International SRL (Romania, Str. General Ion Culcer, nr. 45, sector 6, Bucharest, registered with the Trade Register under no. J40/12751/2004, Unique Registration Code RO16660631) and MEDIAPOST HIT MAIL SA (Str. Siriului, nr 42-46, 3rd floor, sector 1, Bucharest, tel. 021.224.40.20, fax. 021.224.57.31, Fiscal Code RO13351917, registered with the Trade Register under no. J40/8295/2000) as "Authorized Agents".

The campaign will be conducted in accordance with this official regulation ("Regulation"), which is mandatory for all Participants. It complies with the provisions of the Romanian Government Ordinance no. 99/2000 on market products and services, and with Regulation (EU) 2016/679 on the protection of natural persons regarding the processing of personal data.

The Regulation is drafted and made public according to applicable Romanian legislation and is available free of charge to any participant on the website https://www.philips.ro/c-w/regulament/campanii.html or upon written request to the Organizer's address.

Philips Romania may use advertising and informational materials to publicize the campaign. Information in such materials will be interpreted in accordance with this Regulation.

The Organizer reserves the right to modify and/or supplement the Regulation, as well as to suspend and/or terminate/interrupt/extend the Campaign, provided participants are notified in advance of any such changes.

The Campaign may be interrupted at any time during its duration in the following cases: (i) adoption of legal provisions that impede the campaign, such as severe circulation restrictions or locality closures; (ii) intervention of a force majeure event, meaning any unforeseeable, invincible, and inevitable event occurring after the campaign start date, including but not limited to those related to the COVID-19 pandemic; or (iii) intervention of any other situation affecting Philips Romania's activities or its contractual partners, making its obligations under the Regulation more onerous, difficult, or impossible to fulfill. In such cases, Philips Romania will communicate the decision to all interested parties via the website https://www.philips.ro/c-w/regulament/campanii.html, without assuming any liability.

Any modifications or additions to this Regulation will be included in additional acts, communicated to the public by updating and publishing the Regulation in its updated form on the website https://www.philips.ro/c-w/regulament/campanii.html at least 24 hours before they take effect.

By participating in this Campaign, participants are presumed to know and agree to the Regulation. Participants undertake to comply with all terms, conditions, and provisions of this Regulation.

Section 2. Campaign Period and Zone

The campaign is organized and will take place from January 1, 2025, 12:00 PM to December 31, 2025, 11:59 PM.

The campaign will be conducted exclusively through the website www.philips.ro, the Facebook page https://www.facebook.com/PhilipsRomania/, and the TikTok channel https://www.tiktok.com/@philipsromania, all owned and administered by the Organizer.

Section 3. Right to Participate

Only individuals aged 18 years or older by the registration date, residing in Romania, and who accept the terms of this regulation may participate. Minors cannot participate.

Registration for the Campaign implies implicit, integral, express, and unequivocal acceptance of the provisions of this Regulation.

The following categories of persons are not eligible to participate:

If individuals are identified who have influenced or facilitated participation in the Campaign in violation of this Regulation, Philips Romania has the right to take legal action against them, both civilly and criminally, to recover damages.

Philips Romania reserves the right to cancel any participation (including any order placed based on benefits obtained from participation) that violates this Regulation.

Refusal to provide the necessary or complete data for registration will result in the impossibility of participating in the Campaign, applying the campaign mechanism, and awarding the associated prizes.

Section 4. Campaign Mechanism

Conditions for Valid Registration in the Campaign:

For a valid registration to participate in the Campaign, the following cumulative conditions must be met:

  1. The Participant must be eligible according to the provisions in Section 3. Right to Participate.
  2. The Participant can participate exclusively through the method described in this Regulation, respecting the conditions set forth in Art. 4.2 Campaign Registration Methods.
  3. Participation will take place exclusively during the Campaign period mentioned in point 4.2.1 below.

Campaign Registration Methods:

  1. Participants can register anytime, starting from January 1, 2025 (12:00 PM) until January 31, 2025 (11:59 PM).
  2. The Campaign is open to all interested individuals, provided they meet the conditions of this Regulation.
  3. To participate and register validly, and to be eligible to win prizes, interested persons must follow these steps:
    1. Access one of the newsletter subscription forms available on:
      • The pages of the website https://www.philips.ro/, excluding pages in Annex 2.
      • The Facebook page https://www.facebook.com/PhilipsRomania/.
      • The TikTok page https://www.tiktok.com/@philipsromania.
    2. Complete the registration/subscription form entirely with the following mandatory information:
      • Participant's name and/or surname.
      • Email address.
    3. Confirm agreement to receive commercial communications from Philips Romania by checking the relevant box.
    4. Click the "Subscribe" / "Register" / "Submit" button.

Registration will be accompanied by either a confirmation of data validity displayed on the website or a message explaining why the data is invalid and the registration was not recorded. A participant can register only once and win only one prize.

Entries submitted via the electronic form that do not include all requested information, or where participants provide incomplete/incorrect data, or communicate information other than what is requested, or are made outside the period specified in Section 4.2.1, will not be considered.

Section 5. Prize Description and Winner Selection

All participants who register according to the mechanism presented in Section 4 are entered into prize draws for products described in art. 5.3.

Prizes Offered by Draw:

All participants automatically enter the draw to win one of the prizes below:

Total prize value for the entire campaign period (January 1, 2025 – December 31, 2025): 32,812.67 lei (VAT included).

The Philips products described above will be awarded to participants through electronic draws, ensuring the randomness of winner selection. Winners cannot receive the prize value in cash or other items, nor can they request exchanges. The awarded prize cannot be transferred to another person.

Prize Awarding: Prizes will be awarded through electronic draws as follows:

Each draw will be conducted randomly via electronic means, in the presence of a public notary. For each prize, one potential winner will be drawn, followed by three reserves. Reserves will be contacted in order if the primary winner cannot be contacted or validated.

If the number of validated winners is less than the number of allocated prizes, the Organizer reserves the right not to award the remaining prizes.

The Organizer is not responsible for cases where a winner provides incorrect data or information leading to the impossibility of awarding prizes.

Section 6. Winner Announcement and Prize Validation

After each draw, the Organizer, through its Authorized Agents, will send an email to the potential winner's registered email address, announcing their status and the prize won. The email will include a secure link to a form for validation. Each winner will be contacted by email for validation within a maximum of 3 working days from the draw date.

For validation and prize delivery, the contacted participant must access the link within 3 calendar days of receiving the email and complete the form with: name, surname, age, CNP (if required for prizes exceeding the threshold according to the Fiscal Code), delivery address, and phone number.

If a winner cannot be contacted or fails to submit the necessary information within the specified deadlines, they will be disqualified, and the Organizer will contact the reserves sequentially. If, after exhausting the reserves, the number of validated prizes is less than the allocated number, the remaining prizes will not be awarded.

Philips prizes will be delivered to validated winners within a maximum of 30 calendar days from the final validation date. Delivery is handled by MEDIAPOST HIT MAIL S.A. to the address provided by the winner. Upon delivery, the winner must provide the Organizer's representative or courier with a signed copy of the delivery-receipt protocol.

The names of validated winners and their prizes will be published on the website https://www.philips.ro/c-w/regulament/campanie-comunitatea-philips-2025.html within 30 calendar days of winner validation.

Section 7. Taxes and Duties

Where applicable, the Organizer is obliged to calculate, withhold, and pay the tax due on prizes awarded to winners in accordance with current legislation on income tax from winnings.

Section 8. Errors, Misleading Advertising, Limitation of Liability

The Organizer shall not be held responsible for any of the following situations that may lead to prizes not being awarded:

By registering for the "Register to the Philips Community!" Campaign, participants agree to and undertake to comply with the mandatory provisions of this Regulation.

By participating in the Campaign, participants express their consent for their personal data to be processed by Philips Romania SRL, in its own name and through its authorized agents Mediapost Hit Mail SA, under the conditions of Annex 1 to this Regulation.

Section 10. Force Majeure

For the purpose of this Regulation, Force Majeure means any external event that cannot be controlled, remedied, or foreseen by the Organizer, and whose occurrence makes the latter unable to fulfill its obligations assumed under the Regulation, in accordance with Article 1351 of the Civil Code. If the Organizer invokes force majeure, it is obliged to communicate its existence to the campaign participants within 5 working days of the force majeure event occurring.

Section 11. Disputes

Any disputes arising between the Organizer and participants in this Campaign shall be resolved amicably or, if that is not possible, the disputes shall be settled by the competent Romanian judicial courts at the Organizer's headquarters.

Section 12. Campaign Regulation

The Official Campaign Regulation is made available free of charge to any participant and is posted on the website: https://www.philips.ro/c-w/regulament/campanii.html. It can also be requested free of charge, in copy, by any interested person, via written request addressed to Philips Romania SRL, located at Soseaua Pipera 46D-46E48, Office Oregon Park, Building C, 2nd floor, Sector 2, 020112, Bucharest. Participation in this Campaign implies the obligation to comply with all provisions of this Regulation.

Participants who have lost their winner status are not entitled to claim prizes by any other means. This Regulation has been drafted in compliance with the provisions of Government Ordinance no. 99/2000 on market products and services, republished with subsequent amendments and additions.

Annex 1: Information on Personal Data Processing

Philips Romania, Below-the-line International, and Mediapost Hitmail undertake to comply with the provisions of Regulation 2016/679 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), applicable from May 25, 2018. Participants' personal data are processed by Philips Romania as data operator and by the agencies Below the Line International SRL and Mediapost Hitmail SA as "Authorized Agents" for the processing of personal data, under the conditions and for the purposes presented below:

I. Categories of personal data processed within the Campaign:

For the purpose of organizing the Campaign, participation of interested persons, validation of registrations, and prize delivery, the following categories of personal data will be processed:

  1. For participants registered in the Campaign:
    • Participant's name and/or surname.
    • Email address.
  2. In addition, for participants drawn as winners:
    • Age (participants must be at least 18 years old at the start of the Campaign).
    • Delivery address (necessary for prize delivery).
    • Phone number (necessary for prize delivery).
    • CNP (only for winners whose prizes exceed the threshold value according to the Fiscal Code, as necessary for tax payment).

Depending on the case, winners' personal data will be stored for the duration of the campaign, according to applicable legal provisions, including financial-accounting matters, for a maximum period of 5 years, necessary for fulfilling legal, fiscal, or accounting obligations. Upon expiry of the data storage period, these data will be deleted/destroyed from processing and storage media, with identical obligations imposed on the Authorized Agent(s).
