Philips 'Money Back' Campaign Regulation

Campaign Period: July 14, 2025, 11:00 AM – August 31, 2025, 11:59 PM

Section 1: Campaign Organizer, Objectives, and Regulation

1.1 Organizer: The campaign is organized by Philips Romania S.R.L., located at Soseaua Pipera 46D-46E, Office Oregon Park, Building C, 2nd Floor, Sector 2, Bucharest. Philips Romania is registered with the Bucharest Trade Register under no. J40/19792/1999, C.U.I. 2593699.

1.2 Objective: To promote the sales of participating Philips epilator products by offering consumers a refund of up to [...] lei from the product price, as detailed in Section 4.

1.3 Compliance: The campaign operates under this regulation, which is binding for all participants. It complies with applicable legislation, the Civil Code, and European Regulation 679/2016 on personal data protection.

1.4 Availability: This regulation is publicly available on www.philips.ro/regulamente or upon written request to the organizer's address.

1.5 Media: The campaign may be publicized through advertising and informational materials, interpreted in accordance with this regulation.

1.6 Modifications: The organizer reserves the right to modify or supplement the regulation, or to suspend or terminate the campaign, with prior written notice to participants at least 24 hours in advance.

1.7 Termination: The campaign may be terminated by the organizers in cases of force majeure or any other situation that affects the campaign's activity or makes the organizer's obligations significantly more difficult or impossible to fulfill.

1.8 Participant Agreement: By participating, each individual agrees to comply with all terms and conditions of this regulation.

Section 2: Campaign Period and Zone

2.1 Period: The campaign runs from July 14, 2025, 11:00 AM to August 31, 2025, 11:59 PM.

2.2 Zone: The campaign is exclusively conducted through the website www.philips.ro, owned and administered by the organizer.

Section 3: Right to Participate

3.1 Eligibility: Refunds are available only to individuals aged 18 or older at the time of product registration on the MyPhilips platform, who are Romanian citizens with a stable domicile/residence in Romania. Participants must accept the terms and conditions and register their purchased product on www.philips.ro via the MyPhilips platform as per Section 4.

3.2 Exclusions: Minors and legal entities are not eligible for the refund.

3.3 Legal Action: Philips Romania reserves the right to take legal action against individuals who influence or facilitate campaign participation in violation of this regulation.

3.4 Cancellation: Philips Romania may cancel any participation that violates this regulation.

3.5 Data Provision: Failure to provide necessary or complete registration data will result in disqualification from the campaign and forfeiture of benefits.

Section 4: Campaign Mechanism

4.1 Registration Requirements: To register validly, participants must:

  1. Meet the participation criteria outlined in Section 3.
  2. Participate exclusively through the method described in this regulation, adhering to the conditions in Section 4.2.
  3. Participate only within the campaign period specified in Section 4.2.1.
  4. Not have returned the purchased product.

4.2 Participation Process:

  1. Product Purchase: Products must be purchased directly from www.philips.ro and paid for online via bank card between July 14, 2025, and August 31, 2025.
  2. Product Registration: After purchase, the product must be registered on http://www.philips.ro/myphilips no later than September 7, 2025, following the steps below.
  3. MyPhilips Account: Consumers without a MyPhilips account must create one at https://www.philips.ro/myphilips.
  4. Registration Steps:
    • Access https://www.philips.ro/myphilips/#tab=register-product and log in to your MyPhilips account.
    • Register the participating Philips product(s) under the "Register product" section.
    • Search for the product and enter required information: product model, purchase date.
    • Click the "Register" button.
    • Confirmation will be received on-page and via email. This email summarizes provided data but does not guarantee campaign participation.
    • After registration, activate the cashback offer by clicking the "Activate now" button in your MyPhilips account. Complete the refund form with the requested details. Attach a copy of the proof of purchase (receipt or fiscal invoice).
    • Upon clicking "Register and activate," confirmation will be received on-page and via email, indicating that participation is pending validation.
  5. Incomplete/Incorrect Data: Failure to complete mandatory fields or providing non-existent/incorrect information will invalidate the registration.
  6. Returns: Participants will not receive refunds for products that have been returned.
  7. Multiple Entries: Participants can enter multiple times by purchasing different eligible products, provided each purchase is registered with a distinct proof of purchase under the same MyPhilips account.
  8. Lumea App: Registrations initiated and completed within the Philips Lumea app are eligible only if the participant subsequently activates the offer in their MyPhilips account as per steps 4.2.3 (6) and (7).
  9. Fraud Prevention: Any attempt at fraud, including submitting fictitious receipt/invoice numbers, duplicate invoice numbers, or registrations by individuals with the same surname using the same receipt/invoice, will lead to disqualification and forfeiture of the refund.

Section 5: Participating Products and Benefit Allocation

5.1 Participating Products: Products sold directly by the organizer via www.philips.ro with the "Add to cart" button active are eligible.

5.2 Product Categories and Refunds:

5.3 Refund Process: Eligible participants will receive refunds within 30 business days from product registration in MyPhilips, but not before the product return period expires. Refunds will be processed by Philips Romania to the account used for the online payment at the time of purchase, as recorded in the uploaded proof.

5.4 Non-Transferable Benefits: Refunds cannot be exchanged for other items or transferred to another person, except as specified in Section 4.

Section 7: Commitments, Data Confidentiality

7.1 Agreement: By registering their product on http://www.philips.ro/myphilips, participants agree to and undertake to comply with the mandatory provisions of these terms and conditions, accepting that refunds are granted within the limits specified.

7.2 Data Processing Consent: Participants consent to the processing of their personal data by Philips Romania S.R.L. for registration and refund purposes, as detailed in Annex 1.

Section 8: Force Majeure

8.1 Definition: Force majeure refers to any external event that cannot be controlled, remedied, or foreseen by the organizers, which prevents them from fulfilling their obligations under this regulation, as per Article 1351 of the Civil Code.

8.2 Notification: If invoking force majeure, the organizer must notify participants within 5 business days of the event's occurrence.

Section 9: Disputes

9.1 Resolution: Any disputes arising from this campaign will be resolved amicably. If an amicable resolution is not possible, disputes will be settled by the competent Romanian courts in accordance with applicable legal provisions.

Section 10: Errors, Advertising Communications, Limitation of Liability

10.1 Organizer's Non-Liability: The organizer is not responsible for:

Annex 1: Personal Data Processing Information

Data Controller: PHILIPS ROMANIA S.R.L., Soseaua Pipera 46D-46E-48, Office Oregon Park, Building C, 2nd Floor, Sector 2, 020309, Bucharest. Registered with the Bucharest Trade Register under no. J40/19792/1992, C.U.I. 2593699.

1. Categories of Personal Data: Name, surname, address, phone number, proof of purchase, IBAN (for online purchases).

2. Purpose of Processing: To process personal data for refund purposes as per this document.

3. Legal Basis: Processing is based on the necessity of executing the sales contract for participating products and providing the refund, or legitimate interest/legal obligation, through participant acceptance of terms and conditions. Consent is considered given upon participation and product registration in MyPhilips.

4. Data Retention Period: Personal data will be stored according to applicable financial-accounting legal provisions, for the refund period, or as long as legally, fiscally, or accounting-wise necessary. Data will be deleted/destroyed upon expiry of the storage period.

5. Data Subject Rights: Participants have the right to withdraw consent, request access, rectification, deletion, restriction, or object to data processing, except where legally prohibited. They also have the right to data portability and to lodge a complaint with the National Supervisory Authority for Personal Data Processing. For inquiries, contact privacy@philips.com.

Protection of Children's Personal Data: Only individuals aged 18+ can participate. Data of individuals under 18 will be immediately deleted/destroyed if received. Parents or legal guardians notifying the processing of such data will result in immediate deletion/destruction.

6. Data Security: The operator will implement appropriate technical and organizational measures to ensure a level of security corresponding to the personal data of participants. This includes imposing similar obligations on processors and considering risks related to data processing.

7. Policy Modification: The operator may modify this Annex at any time during the campaign if more efficient data protection measures are discovered, without affecting data subject rights. Modifications will be published on the operator's website and communicated to participants.

8. Other Provisions: Personal data will be processed in accordance with Regulation (EU) 679/2016.
