General Warranty Overview
This document outlines the limited warranty provided by Daikin Comfort Technologies Manufacturing, Inc. (“Daikin”) for its thermostat controls. Unless otherwise specified, references to “the warranty” or “this warranty” refer to the Initial Term Warranty. If the control is properly registered and conditions are met, it may also include the Registered Additional Term Warranty.
Who Provides The Warranty?
Daikin Comfort Technologies Manufacturing, Inc. (“Daikin”) provides this warranty for all parts of the thermostat (“control”).
What Problems Does This Warranty Cover?
This warranty covers controls that fail under normal use and maintenance.
Other Warranties
This warranty is provided in lieu of all other express warranties. Any implied warranties, including warranties of merchantability and fitness for a particular purpose, are limited to the duration of this warranty. Some states and provinces may not allow limitations on implied warranty duration.
What Problems Does This Warranty Not Cover?
Daikin is not responsible for:
- Damage or need for repairs due to faulty installation or application.
- Damage from floods, fires, winds, lightning, natural disasters, accidents, corrosive atmosphere, or other conditions beyond Daikin's control.
- Damage or need for repairs from using incompatible components or accessories.
- Normal maintenance as described in the installation and operating manual.
- Parts or accessories not supplied or designated by the manufacturer.
- Damage or need for repairs from improper use, maintenance, operation, or servicing.
- Damage or failure due to electrical service interruption, surge, fluctuation, or inadequacy.
- Damage caused by frozen or broken water pipes, water damage, moisture intrusion, mold, or other biological growth.
- Changes in the control's appearance that do not affect its performance.
- Replacement of fuses and resetting of circuit breakers.
Warranty Applicability and Registration
Applicability to Installations
- Owner-Occupied Residences: This warranty applies to controls installed in owner-occupied residences.
- Non-Owner Occupied Residences: A separate warranty applies to controls installed in residences not occupied by the owner. This includes non-residential buildings or residences not occupied by the owner.
- Commercial Properties: A separate warranty applies to controls installed in commercial properties.
Registration Requirements
Registration is strongly urged. Initial Term Warranty coverage is available without registration, but Registered Additional Term Warranty coverage requires registration. To register, visit www.daikincomfort.com and click "PRODUCT REGISTRATION." Some states/provinces may not condition warranty coverage on registration.
When Does Warranty Coverage Begin?
Warranty coverage begins on the “installation date.” The installation date is determined as follows:
- Newly Constructed Residence: Date the owner purchases the residence from the builder.
- Existing Residence: Date the control is originally installed.
- Unverified Dates: For California residents, if the purchase or installation date cannot be verified, the installation date is three months after the manufacture date. For others, if dates cannot be verified, it's three months after the manufacture date. The manufacture date can be found in the serial number (YYMM).
How Long Does Warranty Coverage Last?
- Initial Term Warranty: Up to 5 YEARS after the installation date.
- Registered Additional Term Warranty: If registered within 60 days of installation, coverage extends for up to 12 YEARS (owner-occupied) or up to 10 YEARS (non-owner-occupied) after the installation date, as long as the original registered owner or their spouse owns the residence. This extended warranty may transfer under specific state laws.
Warranty coverage ceases if the control is removed from its original installation location. Replacement controls are warranted only for the remaining period of the original warranty.
Daikin's Responsibilities and Limitations
What Daikin Will Do To Correct Problems
Daikin will furnish a replacement control, without charge for the control itself, for any control that fails under normal use and maintenance during the warranty period. This is Daikin's sole responsibility.
What Daikin Will Not Do To Correct Problems
Daikin will not pay for:
- Labor, freight, or any other costs associated with service, repair, deinstallation, or installation of a replacement control.
- Electricity or fuel costs, or increases thereof, for any reason.
- Lodging or transportation charges.
Limitation of Liability
Neither Daikin nor its affiliates shall be liable for incidental or consequential damages, including lost profits, loss of use, extra utility expenses, or damages to property, regardless of the theory of claim (negligence, tort, contract, etc.). Some states/provinces may not allow these limitations.
Receiving Warranty Service and Legal Remedies
How to Receive Warranty Service
If there is a problem with the control, contact a licensed contractor. The contractor must bring the failed control to a Daikin heating and air conditioning products distributor for replacement.

Legal Remedies and Arbitration
This warranty provides specific legal rights, which may vary by state or province. For residents of Quebec, the arbitration provisions do not apply.
Arbitration Clause: Disputes are generally decided by neutral, binding arbitration rather than court or jury trial. This applies to claims in contract, tort, or statute. Both parties waive the right to participate in class-action lawsuits or representative actions. Discovery and appeal rights may be more limited in arbitration. A small claims court option is available if the dispute meets requirements.
Governing Law: For U.S. residents, the Federal Arbitration Act governs. For Canadian residents, provincial arbitration law applies. Substantive warranty rights are governed by the law of the state or province where the control was installed.
Arbitration Rules: For disputes under $250,000, a single arbitrator is used. For disputes of $250,000 or more, a panel of three arbitrators is used. Arbitrators are chosen per administering organization rules (e.g., JAMS for U.S., ADR Institute of Canada for Canada). The award is final and binding.
Arbitration Hearing Location: Generally in the federal judicial district or province of residence.
Costs of Arbitration: Each party covers its own costs. For consumers under JAMS rules, Daikin may cover costs beyond $200 if Daikin initiates arbitration, or share costs if the consumer initiates. Specifics apply.
Survival and Enforceability: This arbitration clause survives warranty expiration or transfer. If any part is found unenforceable, the remainder remains enforceable. Unenforceable class-action waivers will be severed.
