Samsung Art Store Promotion Terms and Conditions

§ 1. Definitions

Terms used in these Regulations and written with a capital letter have the following meanings:

§ 2. General Provisions

  1. The Regulations define:
    • The purpose of the Promotion;
    • The duration of the Promotion;
    • The conditions for participation in the Promotion;
    • The procedure for submitting complaints related to participation in the Promotion.
  2. The purpose of the Promotion is to promote selected Samsung televisions.
  3. The Promotion consists in awarding Participants who have met the conditions specified in the Regulations, a material prize specified in the Regulations ("Prize") under the conditions described therein.
  4. The Promotion is conducted in the territory of the Republic of Poland.
  5. The Promotion is conducted from June 17, 2025 (the first day on which it is possible to purchase the Product) to August 31, 2025 (the last day on which it is possible to purchase the Product), or until the Prize pool specified in §5 para. 2 of the Regulations is exhausted, whichever occurs first.
  6. The Promotion schedule is as follows:
    • Period for purchasing the Product: according to the definition in § 1 para. 13 (June 17, 2025 – August 31, 2025, or until the Prize pool is exhausted);
    • Registration for the Promotion: according to the definition in § 1 para. 12 above;
    • Verification of the correctness of the submission: up to 21 working days from the date of submission receipt on the server handling the traffic of submissions made via the Website; however, no later than October 13, 2025;
    • Prize dispatch: no later than 14 working days from the date of confirmation of the correctness of the submission, to the Participant's email address provided in the submission form, but no later than October 31, 2025;
    • Submission of complaints: by November 14, 2025, except for complaints regarding submissions to the Promotion, which should be submitted by September 30, 2025;
  7. Participants who:
    • at the time of submitting the application for the Promotion have a Samsung Account (it can be created at https://account.samsung.com);
    • submit an Opinion and grant the Organizer a license to the Opinion (under the terms specified in §9 below);
    • purchase the Product during the Purchase Period;
    • register their participation in the Promotion during the Registration Period;
    • accept the Regulations;
    • meet other conditions specified in the Regulations.
  8. The following cannot be Participants:
    • Individuals running sole proprietorships, unless they purchase the Product for purposes not related to their business activity;

§ 3. Purchase of Products Covered by the Promotion

  1. All Products submitted for the Promotion must be purchased by the Participant:
    • during the Purchase Period; and
    • at a Retail Outlet or Retail Chain indicated in Appendix 2.
  2. The Participant loses the right to participate in the Promotion and the Prize (in the event of exercising the statutory or contractual right of withdrawal from the Product sales agreement). A Participant who has registered for the Promotion and subsequently withdrawn from the purchase is obliged to report this to the Organizer at the email address promocja-tv@promo.smolar.pl.
  3. The Organizer has the right to request a written statement from the Participant that they have not withdrawn from the Product purchase agreement.

§ 4. Promotion Registration

  1. Participant's registration for the Promotion takes place via the Website.
  2. To register for the Promotion, the Participant must complete and submit the registration form available on the Website after logging into the Samsung Account belonging to the Participant. A Samsung Account can be created at https://account.samsung.com.
  3. Participation in the Promotion and receiving the Prize is decided by the order of submissions. Registration for the Promotion is made upon registration of the Participant's submission on the Organizer's server. Prizes will be awarded until the prize pool specified in §5 para. 2 of the Regulations is exhausted.
  4. Each Participant can receive a maximum of 1 (one) Prize in the Promotion, regardless of the number and type of Products purchased in the Promotion. The registration form allows for the registration of only one Product.
  5. A correctly completed registration form includes:
    • Participant's personal data, i.e., name, surname, address for Prize delivery;
    • Participant's email address;
    • Participant's phone number;
    • Model and serial number of the Product purchased by the Participant;
    • Date of purchase;
    • Seller from whom the Product was purchased, i.e., Retail Outlet or Retail Chain where the product was purchased;
    • Opinion;
    • Required attachments (described below).
  6. The following must be attached to the registration form:
    • A scan of the proof of purchase confirming the Product purchase, containing the full product name,
    • A photo of the product's rating plate. Information on the location of the rating plate on the Product is provided in Appendix No. 3 to the Regulations,
    • A photo or screenshot confirming the submission of the Opinion. The screenshot/photo must show the content of the Opinion (including hashtags as referred to in § 9 para. 3 below) and the address of the website where the Participant left the Opinion,
    • A photo of the cut-out serial number from the Product's cardboard packaging,
    • A photo of the Product's cardboard packaging with the area where the serial number fragment was cut out visible.
  7. All attached photos must be legible, i.e., not blurred, fully visible, not cropped.
  8. The proof of purchase must concern the purchase of the device for the Participant's own use, i.e., it must be a fiscal receipt or an invoice issued to the Participant, and the Participant's NIP number must not appear on it. The proof of purchase cannot be related to business activity, meaning the cost incurred cannot be included in business expenses, and the VAT from the purchase invoice cannot be settled in the VAT return.
  9. Original proofs of purchase must be retained until the decision on awarding the Prize is made, for the purpose of verifying the Participant's compliance with the Promotion conditions.
  10. The Participant will receive an email confirmation of the submitted registration form.
  11. The date and time of Product purchase, shown on the scan of the attached proof of purchase, cannot be later than the registration date of the registration form via the Website.
  12. Personal data of the Participant in the form of email address, mobile phone number, as well as data in the form of the Product's serial number are unique. Re-registration using the mentioned data is not possible.

§ 5. Prize

  1. Subject to the remaining provisions of the Regulations, including § 4 para. 3 and § 5 para. 2, the Participant who meets the conditions specified in the Regulations will receive the Prize indicated in § 1 para. 15.
  2. The prize pool is limited and amounts to 1000 (in words: one thousand) units.
  3. A Participant may not participate in the Promotion more than once. The right to a prize is granted provided that the Participant meets the conditions specified in the Regulations for each promotion submission.
  4. The Prize cannot be exchanged for another gratification, especially for a monetary equivalent.
  5. The Prize will be sent within 14 working days of confirming the correctness of the submission, via electronic mail to the Participant's email address provided in the submission form.
  6. To use the Prize, the Participant should:
    • Select the "Art Mode" icon on their TV,
    • Register in the application,
    • In the application, go to Payment Settings,
    • Select the payment option and save the credit card details. Then select the voucher addition button and register the promotional code,
    • Select the "Add coupon" option.
    • Enter the received voucher number.
    • Click the "Confirm" button.
    After entering the code, the Voucher is added to the account, and the user can use the free version of Art Store.
  7. The Organizer will inform on the Website about the exhaustion of the Prize pool.
  8. The Organizer is not responsible for the inability or delay in delivering the Prize due to the Participant providing incorrect data (incorrect email address).
  9. The value of the Prize as of June 4, 2025, is PLN 154.92 (in words: one hundred fifty-four zlotys and ninety-two groszy). Price as of April 5, 2025, in the Art Store application.
  10. The Prize is exempt from income tax for individuals not conducting business activity, based on art. 21 para. 1 item 68 of the Act of July 26, 1991, on Personal Income Tax (i.e., Journal of Laws of 2025, item 163).

§ 6. Verification

  1. Based on the data provided by the Participant in the submission, the Organizer will verify the correctness of all submissions. Submissions sent after the deadline, incorrect, incomplete, not in accordance with the Regulations, containing false data or containing illegible scans/photos of proof of purchase or illegible, unclear photos – will disqualify the Participant from receiving the Prize.
  2. The Organizer has the right to additional verification of submissions, i.e., the right to request the presentation of the original document confirming the purchase of Products or other documents required for the submission. In the event of the need for additional verification of the submission, the Organizer will notify the Participant by email. The Participant will be obliged to deliver the requested documents and data to the address indicated by the Organizer in Poland at their own expense within 5 (five) Working Days from the date of the request. The deadline is considered met if the registered letter is sent to the Organizer's address. In the absence of clarification from the Participant within the deadline, the Organizer will exclude the Participant from the Promotion.
  3. The Organizer will verify the submissions sent by Participants and will inform the Participant about the awarding or refusal of the Prize no later than within 21 Working Days from the date of submission receipt on the server handling the traffic of submissions made via the Website.
  4. Each proof of purchase of a Product may be submitted within the Promotion only once.

§ 7. Complaints

  1. The Participant has the right to submit a complaint.
  2. Complaints related to the Promotion may be submitted by September 30, 2025, except for complaints regarding submissions to the Promotion, which should be submitted by September 14, 2025.
  3. A complaint must include:
    • Participant's name and surname;
    • Correspondence address or email address for contact;
    • Description of the circumstances forming the basis of the complaint.
  4. Complaints should be sent:
    • in writing to the address: SMOLAR AGENCJA PROMOCYJNO-REKLAMOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (ul. INŻYNIERSKA 15, ŁÓDŹ, code 93-569) with the note Promotion "Samsung x Art Store Promotion - Complaint"; or
    • by electronic mail to the address: promocja-tv@promo.smolar.pl with the subject line Promotion "Samsung x Art Store Promotion - Complaint".
  5. Complaints related to the inability to send the Form should be reported by September 14, 2025, or in case of the end of the Purchase Period due to the exhaustion of the Prize pool, within 7 (seven) days from the date of the announcement of the prize pool exhaustion.
  6. Submitted complaints will be processed within a maximum of 14 Working Days from the date of receipt of the complaint. Interested parties will be notified of the manner of complaint processing in the same form in which the complaint was submitted, immediately after its processing.
  7. Complaints submitted after the deadline for submitting complaints will not be processed under the procedure provided by the Regulations and should be submitted directly to the Organizer (in writing with the note Promotion "Samsung x Art Store Promotion - Complaint".
  8. The deadline for submitting a complaint, which is provided for in the Regulations, does not exclude or limit the rights of the Participant under the law, in particular the provisions on the statute of limitations for claims.
  9. The complaint procedure does not exclude or limit the Participant's right to pursue their rights before common courts.

§ 8. Personal Data Protection

  1. Information on the processing of Participants' personal data in connection with participation in the Promotion is attached as Appendix No. 4 to the Regulations.
  2. Detailed information on the processing of personal data by the Organizer can be found in the Privacy Policy available at: https://www.samsung.com/pl/info/privacy.

§ 9. Opinion and License to Opinion

  1. The Participant should leave an Opinion, at their choice, on the Organizer's Website (artstore.samsung.pl) or on the website of the seller from whom the Participant purchased the Product, or on the price comparison website.
  2. The Opinion must be left no earlier than the time of Product purchase by the Participant and no later than at the time of submitting the registration form for the Promotion.
  3. The Opinion must clearly indicate its connection with the Promotion by adding the following designations (so-called hashtags): #KupNapiszOpinieOtrzymajVoucherArtStore and #PromocjaSamsungxArtStore, and also (if the Retail Partner's website provides for such a requirement) it should be added or marked in accordance with the rules for adding opinions on the Retail Partner's website. The Opinion may express the Participant's independent feeling towards the purchased Samsung Product (e.g., as a negative or positive opinion).
  4. The Participant, who fills out the registration form for the Promotion, grants the Organizer a free, non-exclusive, territorially unlimited license to the Opinion in all fields of exploitation known at the time of filling out the registration form for the Promotion, in particular in the following fields of exploitation specified in art. 50 of the Act of February 4, 1994, on Copyright and Related Rights:
    • manufacturing copies by a given technique, including printing, reprography, magnetic recording and digital recording;
    • putting into circulation, lending or renting the original or copies;
    • public performance, exhibition, display, playback and broadcasting, and public making available of the work in such a way that everyone can access it at a place and time chosen by them.
  5. License to the Opinion:
    • includes the right to grant further licenses (sublicenses);
    • includes the authorization of the Organizer to dispose of and use adaptations of the Opinion and to grant permission to dispose of and use adaptations of the Opinion by the Organizer, as well as to create adaptations of the Opinion by the Organizer;
    • is granted for a fixed period of 5 (five) years, and after this period automatically (without the need for additional declarations in this regard) transforms into an indefinite license, which may be terminated with a one-year notice period effective at the end of the calendar month.
  6. By adding an Opinion, the Participant declares and guarantees that:
    • it is entirely original, i.e., it was created solely by the Participant and has not been published anywhere before by the Participant;
    • The Participant is the sole author of the Opinion and holds all copyrights to it;
    • The Participant has not authorized any third party to use the Opinion or to exercise any rights (including personal and dependent rights) to the Opinion on behalf of the Participant.
  7. Participant:
    • authorizes the Organizer to exercise personal rights to the Opinion, in particular to not attribute the Opinion with the name, surname, or pseudonym of the Participant;
    • undertakes not to exercise personal rights to the Opinion in relation to the Organizer or third parties authorized by the Organizer to use the Opinion.

§ 10. Change of Regulations

  1. The Organizer reserves the right to change the Regulations for a justified reason. A justified reason for changing the Regulations is considered any of the following reasons (collectively):
    • introduction of new or amendment of existing generally applicable legal provisions, if it directly affects the content of the Regulations and necessitates their amendment;
    • change or emergence of new interpretations of generally applicable legal provisions as a result of court rulings or decisions of public authorities or administration bodies that directly affect the provisions of these Regulations and necessitate their amendment;
    • ruling, decision, recommendation or recommendation of a competent public authority, relating to the Regulations and resulting in the necessity of adapting them to such a ruling, decision, recommendation or recommendation;
    • change in the portfolio of products, including Samsung televisions covered by the promotion;
    • adaptation of the Regulations to market conditions related to technological, technical and IT progress, affecting the provisions of these Regulations;
    • elimination of any interpretational ambiguities of the Regulations;
    • necessity to counteract violations or abuses of the Regulations;
    • increase in the prize pool;
    • change of company data, tele-addresses or URL addresses included in the Regulations.
  2. The announcement of changes to the Regulations will be made public on the Website at least 7 (seven) calendar days in advance. Information on the changes to the Regulations will be kept on the Website for 30 (thirty) days from the date the changes come into effect.
  3. Users who have registered for the Promotion but have not yet received the Prize will be additionally notified of the changes to the Regulations by email to the address provided during registration for the Promotion.
  4. Changes to the Regulations cannot negatively affect the rights previously acquired by Participants.

§ 11. Final Provisions

  1. The Organizer is not responsible for the Participant's failure to receive email messages sent to them in connection with the Promotion, resulting from the Participant providing incorrect personal data or from the Participant using anti-spam tools and settings. In the case of using anti-spam tools and settings, the Participant is obliged to regularly check if messages from the Organizer have not ended up in the inbox containing messages classified as spam.
  2. The Regulations will be available for inspection on the Website throughout the duration of the Promotion. The Participant may retain the content of the Regulations by downloading it from the Website.
  3. The following appendices to the Regulations constitute their integral part:
    • Appendix No. 1 – List of Samsung television models covered by the Promotion
    • Appendix No. 2 – List of stores covered by the Promotion
    • Appendix No. 3 – Location of the rating plate – back of the TV
    • Appendix No. 4 – Information on the processing of Participants' personal data by the Organizer in connection with participation in the Promotion

Appendix No. 4

Clause on the processing of personal data by the Organizer

1. Administrator of personal data of the Participant: Organizer of the Promotion, which is Samsung Electronics Polska Sp. z o.o. with its registered office in Warsaw (ul. Postępu 14, 02-676 Warsaw).

2. Personal data of Participants are processed for the purpose of:

3. In connection with the processing of the Participant's personal data for the purposes indicated in point 2, personal data may be made available to the following recipients or categories of recipients:

4. Samsung will store Participants' personal data for the duration of the Promotion and for the period necessary to fulfill the Organizer's legal obligations. The period of storage of Participants' personal data may be extended each time by the statute of limitations for claims.

5. Participants have the right to access their data, rectify it, erase it or restrict its processing and to object to the processing of data due to their particular situation. Samsung ensures the exercise of these rights within the scope resulting from art. 15-22 GDPR. The Participant has the possibility to submit a request for the exercise of rights referred to above by filling out the form available at samsung.pl, in accordance with the instructions provided.

6. In cases justified by Samsung group's corporate requirements, personal data may be transferred outside the European Economic Area (EEA). In such cases, we guarantee that a similar level of protection for your data in the third country is ensured by implementing one of the following safeguards:

7. As part of exercising the Participant's rights, the Organizer also provides the possibility to obtain a copy of the appropriate safeguards for personal data in case of transfer to third countries.

8. The Participant has the right to lodge a complaint with the competent supervisory authority, which is the President of the Personal Data Protection Office.

9. Personal data is provided by Participants voluntarily, but providing the data is necessary to participate in the Promotion.
