Nespresso Summer GWP Promotion Terms and Conditions

The organizer of this promotion is Nestlé Polska S.A. with its registered office in Warsaw (Nespresso Division in Warsaw), address: 02-672 Warsaw, ul. Domaniewska 32, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, KRS 0000025166, NIP 527-020-39-68, BDO 000016180, share capital PLN 42,459,600 fully paid up (hereinafter the Organizer). The Organizer has the status of a large entrepreneur.

This promotion will be valid from 01.07.2025 to 13.08.2025 or until the stocks of products provided by the Organizer for the gift are exhausted, whichever comes first.

The promotion is addressed to Nespresso Club Members, i.e., registered Nespresso customers who are consumers or entrepreneurs, who during its duration make a purchase from the Organizer in accordance with point 4 below (hereinafter Participants). Entrepreneurs who conduct business in the HORECA channel (hotels, restaurants, cafes) cannot participate in this promotion.

This promotion consists of the possibility for the Participant to receive one Barista Ice Tray (SKU: 144470) as a gift from the Organizer, provided that at the same time a purchase of any 70 Nespresso Vertuo capsules at the regular price is made from the Organizer.

Participants of this promotion can take advantage of the offer once.

The promotion cannot be combined with subscription discounts and gifts. A subscriber can choose to purchase with the GWP without subscription benefits or use the benefits due from the subscription. This promotion does not combine with other promotions conducted during the same period by the Organizer and does not apply to the order activating the Nespresso Coffee Plan.

In the event that a Participant who is a consumer, who has made a purchase as referred to in point 4 above, remotely (e.g., via the Internet) and subsequently exercises the right to withdraw from the contract for the sale of Nespresso capsules, for reasons other than a product defect (thereby ceasing to meet the promotion condition), they will be obliged to return the received gift to the Organizer in its original and undamaged packaging, i.e., the returned gift must be originally packaged, show no signs of use, and must not be damaged. The return should be made to the address: Logwin Poland Sp. Z o. o., Al. Katowicka 66, 05-830 Nadarzyn, Poland. The provisions of this point also apply to natural persons placing orders within the framework of this promotion, if these orders are directly related to their economic activity, but do not have a professional character for these persons.

In the event that the participant in this sales promotion is a natural person conducting economic activity, an additional monetary benefit amounting to 11.11% of the gift's value will be added to the value of each gift, intended to cover the advance payment of income tax on the prize. The Organizer, as a payer of lump-sum income tax from natural persons, before issuing the additional prize to the participant, will calculate, collect, and remit the lump-sum income tax due from the winnings to the relevant Tax Office.

The Organizer reserves the right to change these regulations in the following cases: (i) changes in legal provisions, changes in case law, changes in the approach of public administration bodies, as far as they concern the regulations, (ii) significant changes in market practices, as far as they concern the regulations, (iii) clarification of any ambiguities in the interpretation of the regulations, (iv) the need to counteract violations of the regulations, (v) justified changes in business circumstances that objectively make it impossible or significantly difficult to implement the regulations. The change will take effect through the publication of a new version of the regulations. Changes to the regulations will always take effect prospectively, from the moment of publication of the change. Rights acquired before the change remain unchanged.

These regulations have been prepared in Polish and English versions. In case of discrepancies between the two versions, the Polish version shall prevail.
