Nespresso Summer GWP Promotion Terms and Conditions

The organizer of this promotion is Nestlé Polska S.A. with its registered office in Warsaw (NESPRESSO Warsaw Branch), address: 02-672 Warsaw, ul. Domaniewska 32, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, KRS 0000025166, NIP 527-020-39-68, BDO 000016180, share capital PLN 42,459,600 fully paid up (hereinafter referred to as the Organizer). The Organizer has the status of a large entrepreneur.

This promotion will be valid from 01.07.2025 to 13.08.2025 or until stocks of products designated by the Organizer for gift distribution are exhausted, whichever occurs first.

The promotion is addressed to NESPRESSO Club Members, i.e., registered NESPRESSO customers who are consumers or entrepreneurs, who during its duration make a purchase from the Organizer in accordance with point 4 below (hereinafter referred to as Participants). Entrepreneurs who conduct business in the HORECA channel (hotels, restaurants, cafes) cannot participate in this promotion.

This promotion allows the Participant to receive one Barista Ice Tray (SKU: 144470), two Barista Creations Glasses (SKU: 133239), and one Cooler Bag (SKU: 143887) as a gift from the Organizer, provided that at the same time they purchase any 260 NESPRESSO coffee capsules from the Vertuo line at the regular price from the Organizer.

The promotion does not combine with subscription discounts and gifts. A subscriber can choose a purchase with GWP without subscription benefits or use the benefits due from the subscription. This promotion does not combine with other promotions conducted during the same period by the Organizer and does not apply to the order that activates the NESPRESSO Coffee Plan.

In the event that a Participant who is a consumer, who has made a purchase as referred to in point 4 above, remotely, e.g. via the Internet, and who subsequently exercised the right to withdraw from the contract for the sale of NESPRESSO coffee capsules, for reasons other than a product defect (thereby ceasing to meet the promotion condition), they will be obliged to return the received gift to the Organizer in its original and undamaged packaging, i.e., the returned gift must be originally packaged, must not show signs of use, and must not be damaged. The return should be made to the address Logwin Poland Sp. Z o. o., Al. Katowicka 66, 05-830 Nadarzyn, Poland. The provisions of this point also apply to natural persons placing orders within the framework of this promotion, if these orders are directly related to their economic activity, but do not have the character of professional activity for these persons.

In the event that the participant of this sales promotion is a natural person conducting economic activity, an additional monetary benefit amounting to 11.11% of the gift's value will be added to the value of each gift, intended to cover the advance payment of income tax on the award. The Organizer, as a payer of lump-sum income tax on income from natural persons, before issuing the additional award to the participant, will calculate, collect, and remit the lump-sum income tax due from the winnings to the competent Tax Office.

The Organizer reserves the right to change this regulation in the following cases: (i) changes in the law, changes in case law, changes in the approach of public administration bodies, as far as they concern the regulation, (ii) significant changes in market practices, as far as they concern the regulation, (iii) removal of any ambiguities in the interpretation of the regulation, (iv) the need to counteract violations of the regulation, (v) justified changes in business circumstances that objectively make the implementation of the regulation impossible or significantly difficult. The change will be made by publishing a new version of the regulation. Changes to the regulation will always take effect for the future, from the moment the change is published. Rights acquired before the change remain unchanged.

This regulation has been prepared in Polish and English. In case of discrepancies between the two versions, the Polish version shall prevail.
