Nespresso Summer GWP Promotion Terms and Conditions

1. Organizer

The organizer of this promotion is Nestlé Polska S.A., with its registered office in Warsaw (NESPRESSO Division in Warsaw), at ul. Domaniewska 32, 02-672 Warsaw. The company is registered in the entrepreneurs' register maintained by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Department of the National Court Register, under KRS number 0000025166, NIP 527-020-39-68, BDO 000016180, with a share capital of PLN 42,459,600 fully paid up (hereinafter referred to as the "Organizer"). The Organizer has the status of a large entrepreneur.

2. Promotion Period

This promotion will be valid from 01.07.2025 to 13.08.2025, or until the stock of products provided by the Organizer for the gift runs out, whichever comes first.

3. Eligibility

This promotion is addressed to NESPRESSO Club Members, i.e., registered NESPRESSO customers who are consumers or entrepreneurs and who, during the promotion period, make a purchase from the Organizer in accordance with point 4 below (hereinafter referred to as "Participants"). Entrepreneurs operating in the HORECA channel (hotels, restaurants, cafes) cannot participate in this promotion.

4. Promotion Details

This promotion allows a Participant to receive from the Organizer one Barista Ice Tray (SKU: 144470), two Barista Creations Glasses (SKU: 133239), and one Cooler Bag (SKU: 143887) as a gift, provided that at the same time they purchase any 350 Nespresso coffee capsules from the Original and/or Vertuo line at the regular price from the Organizer.

5. How to Participate

To take advantage of this promotion, the Participant, when making the aforementioned purchase, must provide the promotional code: 25SM350.

7. Participation Limit

Participants of this promotion can take advantage of the offer 2 times.

8. Promotion Exclusions

The promotion cannot be combined with subscription discounts and gifts. A subscriber may choose to purchase with the GWP without subscription benefits or utilize benefits due to their subscription. This promotion cannot be combined with other promotions conducted by the Organizer during the same period and does not apply to orders that activate the NESPRESSO Coffee Plan.

9. Return of Gifts

In the event that a Participant, who is a consumer, has made a purchase as described in point 4 above, remotely (e.g., via the Internet) and subsequently exercises their right to withdraw from the contract for the sale of Nespresso coffee capsules for reasons other than a product defect (thus ceasing to meet the promotion's conditions), they will be obliged to return the received gift to the Organizer in its original and undamaged packaging. The returned gift must be in its original packaging, show no signs of use, and must not be damaged. Returns should be sent to Logwin Poland Sp. Z o. o., Al. Katowicka 66, 05-830 Nadarzyn, Poland. The provisions of this point also apply to individuals placing orders within this promotion, if these orders are directly related to their economic activity but do not have a professional character for these individuals.

10. Tax Implications for Business Participants

If a participant in this sales promotion is an individual conducting economic activity, an additional cash benefit constituting 11.11% of the gift's value will be added to the value of each gift, intended to cover the advance payment of income tax on the award. The Organizer, as a payer of lump-sum income tax for individuals, will calculate, deduct, and remit the lump-sum income tax due from the winnings to the relevant Tax Office before issuing the additional award to the participant.

11. Amendments to the Regulations

The Organizer reserves the right to amend these regulations in the following cases: (i) changes in law, changes in case law, changes in the approach of public administration bodies, as they relate to the regulations; (ii) significant changes in market practices, as they relate to the regulations; (iii) clarification of any ambiguities in the interpretation of the regulations; (iv) the need to counteract violations of the regulations; (v) justified changes in business circumstances that objectively make the implementation of the regulations impossible or significantly difficult. Amendments will be made by publishing a new version of the regulations. Amendments to the regulations will always take effect prospectively, from the moment of publication of the amendment. Rights acquired before the amendment remain unchanged.

12. Language Versions

These regulations have been prepared in Polish and English versions. In case of discrepancies between the two versions, the Polish version shall prevail.
