General Warranty Details
What Units Does This Warranty Not Cover?
- Units ordered over the Internet, by telephone, or by other electronic means, unless installed by a dealer adhering to all applicable federal, state, and local codes, policies, and licensing requirements.
- Units installed outside the United States, its territories, or Canada.
- Units operated in incomplete structures.
- Units installed in buildings other than the specific type covered by each warranty (e.g., owner-occupied for Limited, non-owner multi-family for Multi-Family, non-residential for Commercial).
What Problems Does This Warranty Not Cover? (Exclusions)
Goodman is not responsible for:
- Damage or repairs required as a consequence of faulty installation or application.
- Damage as a result of floods, fires, winds, lightning, accidents, corrosive atmosphere, or other conditions beyond Goodman's control.
- Damage or the need for repairs arising from the use of components or accessories not compatible with this unit.
- Normal maintenance as described in the installation and operating manual (e.g., cleaning coils, filter cleaning/replacement, lubrication).
- Parts or accessories not supplied or designated by the manufacturer.
- Damage or the need for repairs resulting from any improper use, maintenance, operation, or servicing.
- Damage or failure of the unit to start due to interruption in electrical service or inadequate electrical service.
- Any damage caused by frozen or broken water pipes in the event of equipment failure.
- Changes in the appearance of the unit that do not affect its performance.
- Replacement of fuses and replacement or resetting of circuit breakers.
- Damage or the need for repairs resulting from the use of unapproved refrigerant types or used or recycled refrigerant.
When Does Warranty Coverage Begin?
Warranty coverage begins on the "installation date." The installation date is determined as follows:
- For units in newly constructed residences: The date the owner purchases the residence from the builder.
- For units in existing residences: The date the unit is originally installed.
- If the purchase or installation date cannot be verified: Three months after the manufacture date. The first four digits of the serial number (YYMM) indicate the manufacture date (e.g., "1306" means June 2013).
How Long Does Warranty Coverage Last?
Registration is strongly urged as it extends warranty length.
- If Not Registered: Up to (1) 20 YEARS for the heat exchanger and (2) 5 YEARS for all other parts.
- If Registered Online within 60 days of installation: For as long as the original registered owner or their spouse owns and resides in the home: (1) Up to 20 YEARS for the heat exchanger and (2) Up to 10 YEARS for all other parts.
Warranty periods do not continue after the unit is removed from its original installation location. Replacement parts are warranted only for the remaining period of the original warranty.
What Will Goodman Do To Correct Problems?
Goodman will furnish a replacement part, without charge for the part only, for any part found to be defective due to workmanship or materials under normal use and maintenance. This is Goodman's sole responsibility, and the replacement part is the owner's sole remedy.
What Won't Goodman Do To Correct Problems?
Goodman will not pay for:
- Labor, freight, or any other cost associated with service, repair, or operation.
- Electricity or fuel costs, or increases thereof, for any reason.
- Lodging or transportation charges.
- Refrigerant.
Goodman and its affiliates shall not be liable for incidental or consequential damages, including lost profits, loss of use, extra utility expenses, or property damages.
How Can The Owner Receive Warranty Service?
If there is a problem with the unit, contact a licensed contractor. The contractor must bring the defective part to a Goodman heating and air conditioning products distributor to receive a replacement part.
Legal and Arbitration
Where Can Any Legal Remedies Be Pursued?
ARBITRATION CLAUSE: This clause affects your legal rights.
- Parties: This clause applies to disputes between you and Goodman, its affiliates, employees, agents, successors, or assigns ("we" or "us").
- Arbitration Requirement: Except as stated below, any dispute shall be decided by neutral, binding arbitration rather than court or jury trial. "Dispute" has the broadest possible meaning, including claims arising from or relating to the unit purchase, warranty, or condition. This includes determining the scope of this clause. Claims can be in contract, tort, or pursuant to statute.
- Class-Arbitration Waiver: Arbitration is handled individually. You and Goodman waive the right to participate as a class representative, class member, or private attorney general in any class claim or class arbitration.
- Discovery and Other Rights: Discovery and appeal rights in arbitration are generally more limited than in a lawsuit.
- Small Claims Court Option: You may choose to litigate any dispute in small claims court if it meets all requirements, rather than in arbitration.
- Governing Law: For U.S. residents, the Federal Arbitration Act governs. For Canadian residents, the applicable arbitration law of the province of purchase governs. The law of the state or province of purchase governs substantive warranty rights and other claims. Any court with jurisdiction may enter judgment on an arbitration award.
- Rules of the Arbitration: For disputes under $250,000, a single arbitrator decides. For disputes $250,000 or greater, a panel of three arbitrators decides. Arbitrators are chosen per the rules of administering organizations like the American Arbitration Association (www.adr.org) or JAMS (www.jamsadr.com) for U.S. residents, or the ADR Institute of Canada (www.amic.org) for Canadian residents. If rules conflict with this clause, this clause controls. The award is final and binding.
- Location of the Arbitration Hearing: For U.S. residents, the hearing is in the federal judicial district of residence. For Canadian residents, it's in the province of residence.
- Costs of the Arbitration: Each party pays its own fees, unless law requires otherwise. Goodman pays your share of arbitration organization and arbitrator fees beyond the first $200. Reimbursement may be required by arbitrator decision.
- Survival and Enforceability: This Arbitration Clause survives warranty expiration or transfer. If any part is found unenforceable (except class-action waivers), the remainder remains enforceable. If class-action waivers are found unenforceable, those parts proceed in court; remaining parts proceed in arbitration.
