Goodman Air Conditioning & Heating Warranty Information for RXNG/FTXNG Series

Limited Warranty (Owner-Occupied Residences)

This warranty is provided by Daikin Comfort Technologies Manufacturing, L.P. ("Daikin") for heating and air conditioning units installed in owner-occupied residences.

What This Warranty Covers

Defects in materials and workmanship appearing under normal use and maintenance.

What This Warranty Does Not Cover

Units ordered or installed via non-authorized electronic means unless installed by an adhering dealer.
Units installed outside the United States, its territories, or Canada.
Units operated in incomplete structures.
Units installed in non-owner-occupied residences or commercial buildings.
Damage or repairs required as a consequence of faulty installation or application.
Damage as a result of floods, fires, winds, lightning, accidents, corrosive atmosphere, or other conditions beyond Daikin's control.
Damage or the need for repairs arising from the use of components or accessories not compatible with this unit.
Damage or the need for repairs resulting from any improper use, maintenance, operation, or servicing.
Damage or failure of the unit to start due to interruption in electrical service or inadequate electrical service.
Any damage, or the need for any repairs, caused by frozen or broken water pipes, water damage, moisture intrusion, mold or other biological growth.
Changes in the appearance of the unit that do not affect its performance.
Replacement of fuses and replacement or resetting of circuit breakers.
Damage or the need for repairs resulting from the use of unapproved refrigerant types or used or recycled refrigerant.
Normal maintenance as described in the installation and operating manual (e.g., cleaning coils, filter cleaning/replacement, lubrication).
Parts or accessories not supplied or designated by the manufacturer.

Warranty Duration and Start Date

Coverage Duration: Up to 5 YEARS on all parts after the installation date.
Coverage Start Date: The "installation date," determined by:
- For new construction: The date the owner purchases the residence from the builder.
- For existing residences: The date the unit is originally installed.
- If dates cannot be verified: Three months after the manufacture date.
The warranty period does not extend if the unit is removed from its original installation location. Replacement parts are covered only for the remaining duration of the original warranty.

Daikin's Responsibility

Daikin will furnish a replacement part, free of charge for the part, for any part found defective due to workmanship or materials under normal use and maintenance during the warranty period. This is Daikin's sole responsibility.

Other Warranties

This warranty is in lieu of all other express warranties. Any implied warranties (including merchantability and fitness for a particular purpose) are limited to the duration of this warranty. State/province laws may provide additional rights.

Non-Owner Occupied Residence Warranty

This warranty applies to heating and air conditioning units installed in residences not occupied by the owner.

What This Warranty Covers

Defects in materials and workmanship appearing under normal use and maintenance.

What This Warranty Does Not Cover

Similar exclusions apply as listed under the Limited Warranty, including units ordered/installed improperly, units outside the US/Canada, incomplete structures, and non-residential buildings.

Where Can Any Legal Remedies Be Pursued?

ARBITRATION CLAUSE (IMPORTANT - READ CAREFULLY)

This clause affects your legal rights.

Parties: This arbitration clause affects your rights against Daikin Comfort Technologies North America, Inc. and its subsidiaries (referred to as "we" or "us").
Arbitration Requirement: Except as stated below, any dispute between you and us shall be decided by neutral, binding arbitration rather than in court or by jury trial. "Dispute" is broadly defined to include any claim arising from or relating to your purchase of the unit, its warranty, or its condition.
Class-Arbitration Waiver: Arbitration is handled individually. You and we expressly waive any right to participate as a class representative or member in any class claim, or as a private attorney general. You and we also waive any right to class arbitration or consolidation of individual arbitrations.
Discovery and Other Rights: Discovery and appeal rights in arbitration are generally more limited than in a lawsuit.
Small Claims Court Option: You may choose to litigate any dispute in small claims court if it meets all requirements, rather than arbitration.
Governing Law: For US residents, the Federal Arbitration Act governs. For Canadian residents, the applicable provincial arbitration law governs. The law of the state or province where you purchased the unit will govern your substantive warranty rights and other claims.
Rules of Arbitration: Disputes under $250,000 are decided by a single arbitrator; disputes $250,000 or greater are decided by a panel of three arbitrators. Arbitrators are chosen per the rules of administering organizations like JAMS (US) or ADR Institute of Canada (Canada). If rules conflict with this clause, this clause prevails. The award is final and binding.
Location of Arbitration Hearing: For US residents, hearings are in your federal judicial district or hometown area. For Canadian residents, hearings are in your province. Hearings can be in person if chosen.
Costs of Arbitration: Each party pays its own costs, unless applicable law requires otherwise. If you are a consumer under JAMS rules, Daikin pays costs beyond the first $200 if you initiate arbitration, and all costs if Daikin initiates arbitration.
Survival and Enforceability: This Arbitration Clause survives warranty expiration or transfer. If any part is found unenforceable (except class-action waivers), the remainder remains enforceable. If class-action waivers are found unenforceable, those specific dispute parts proceed in court, while others proceed in arbitration.
