Pre-sale of the Samsung Galaxy Z Flip6, Z Fold6 family in the Samsung Store

§ 1 Definitions

  1. Organizer: Samsung Electronics Polska Sp. z o.o., based in Warsaw, ul. Postępu 14, 07-676 Warsaw, registered under KRS 0000128080, share capital 52,759,500 PLN, NIP 526-10-44-039, REGON 011612810. The Organizer is the founder of Benefits in the Promotion. For clarity, this does not apply to the amount for the sale of the device offered to the Participant by Foxway in connection with the Participant's participation in the Buy-Back Program.
  2. Amtrust: Amtrust International Underwriters DAC, a company established and existing under Irish law, based in Dublin, Ireland, at 6-8 College Green, Dublin 2, D07 VP48, registered under number 169384, operating under authorization number CBI C33525 issued by the Central Bank of Ireland (CBI) and subject to its regulations.
  3. Foxway: Foxway OÜ, based in Estonia, at Killustiku põik 1, Vahi, Tartu municipality, 60534, Estonia, registered under No. 12703942.
  4. Smolar: Smolar Agencja Promocyjno-Reklamowa Sp. z o.o., based in Łódź, ul. Inżynierska 15, 93-569, registered under KRS 0000444211, share capital 10,000 PLN, NIP: 72727885, REGON: 101524274, acting on behalf of the Organizer to support the Organizer in handling the Promotion (and also acting as a processor for the Organizer), including handling the complaint process.
  5. SSCE: Samsung Electronics Romania S.R.L., registration number: J40/7668/2012, VAT: RO 22694272, address Sos. Bucuresti-Ploiesti, 172-176, building A, Bucharest, district 1, postal code 015016, acting on behalf of the Organizer to support the Organizer in handling the Promotion.
  6. Promotion: A premium sale of Samsung Galaxy Z Flip6, Z Fold6 smartphones (all models) organized and conducted according to the rules described in these Regulations in the territory of the Republic of Poland from July 10, 2024, at 3:00 PM to July 23, 2024, at 11:59 PM. Due to the pre-sale nature of the Promotion, delivery/pickup dates for Products depend on the individual offer of the Samsung Store.
  7. Regulations: These Promotion Regulations defining the terms of participation in the Promotion, its duration, how to inform about the Promotion and its terms, and how to submit complaints related to the Promotion.
  8. Product or Device: Samsung Galaxy Z Flip6, Z Fold6 smartphone. Device availability, retail price, and delivery dates depend on the individual offer of the Samsung Store.
  9. Pre-sale: The period from July 10, 2024, at 3:00 PM to July 23, 2024, at 11:59 PM (order and product purchase dates), during which the Participant can order and purchase the Device in the Samsung Store. Due to the pre-sale nature of the Promotion, delivery/pickup dates for Products depend on the individual offer of the Samsung Store indicated directly in the Samsung Store.
  10. Client or Participant: (i) an adult natural person with full legal capacity, (ii) a natural person conducting a sole proprietorship and not participating in the Promotion as part of their non-agricultural business activity, with full legal capacity, who purchases the Product in the Samsung Store (under the conditions specified in these Regulations), who has read and accepted the provisions of these Regulations and has met all conditions specified therein. Legal entities cannot be Participants.
  11. Samsung Store: An ICT platform available via the website www.samsung.com/pl/ and the Samsung Shop mobile application, administered by Samsung, allowing users to view Products, including their price and availability, place orders, and conclude Product sales agreements, in accordance with the rules specified in the Samsung online store regulations: https://www.samsung.com/pl/shop-faq/service-and-warranty/regulamininternetowego-sklepu-samsung/.
  12. Samsung Members Application: A mobile application, Samsung Members, through which the Client has access to forms enabling them to use the Benefits offered within the Promotion.
  13. Samsung Account: An individual Client account, through which the Client registers the Device and gains access to services provided by the Organizer.
  14. Website: A website with the address przedsprzedaz-foldy.samsung.pl, where information about the Promotion, including the Regulations, is published.
  15. Proof of Purchase: A document in the form of a fiscal receipt or VAT invoice.
  16. Benefits in the Promotion / Benefits: A Participant meeting the conditions specified in the Regulations will receive:
    1. One-year Samsung Care+ insurance without theft coverage worth 1075.00 PLN for the Galaxy Z Fold6 purchased in the promotion or 1025.00 PLN for the Galaxy Z Flip6. To receive insurance, it is required to fill out the SC+ Form and meet other conditions specified in these Regulations. Exchanging a Galaxy Z Fold6 or Galaxy Z Flip6 device for a new one (if repair is not possible) involves a cost for the Client of 699.00 PLN for Galaxy Z Fold6 or 529.00 PLN for Galaxy Z Flip6 (own contribution). General insurance conditions are available at przedsprzedaz-foldy.samsung.pl. The insurer is Amtrust.
    2. Option to use the Buy-Back Program for selected devices conducted by Foxway and receive a sales amount, the value of which depends on the condition and model of the device sold by the Participant to Foxway, plus an additional bonus funded by Samsung of 450 PLN (Bonus). Foxway will pay participants the buy-back amount (minimum 150 PLN for the Device) in the form of a bank transfer, which consists of the amount for the sale of the device offered by Foxway as part of Foxway's business activities. The Samsung bonus is independent of the amount received from Foxway due to participation in the Buy-Back Program. The price for the sale of the device offered by Foxway under the buy-back program is determined solely by Foxway based on its price list, taking into account the model and condition of the device. The price is valid on a given day and may change according to Foxway's decision, with the reservation that, according to Foxway's decision, the Client and Foxway are bound by the sales price of the device valid on the day the Client sent the correctly completed Buy-Back Form to Foxway. As part of the Buy-Back Program, Foxway enables the sale of selected device models. The Organizer recommends that the Participant verify directly on the Buy-Back Program website whether their device can be sold under the Buy-Back Program and for what price. These prices may change according to Foxway's decision, so it is recommended that the Client ensure the price offered by Foxway for the specific model of their device immediately before sending the Buy-Back Form. The Participant cannot use the Buy-Back Program if the device being sold is not working and/or has a damaged screen, which means that the device: does not turn on, does not turn off, fails to launch the main screen or settings menu or charging port (if present) is damaged, the device does not work without a connected charger, the device has a damaged screen (screen burn-in, damaged pixels or touch screen not working), the device is locked. To use the Buy-Back Program, it is necessary to fill out the Buy-Back Form. Detailed buy-back conditions are available on the Foxway website: https://samsungodkup.foxway.tech/.
    3. Cash back to account in the amount of 450 PLN ("Cash Back to Account") if the Participant does not use the Buy-Back Program. To receive the 450 PLN cash back, it is required to first fill out the Promotional Form (to receive the appropriate promotional code) and then use the promotional code to fill out the Cash Back Form. The Participant can either use the Buy-Back Program or apply for a 450 PLN Cash Back to the account. Using the Buy-Back Program excludes the possibility of receiving a 450 PLN Cash Back to the account and vice versa. Using the Buy-Back Program is only possible when placing an order in the Samsung Store. After placing an order, the Participant cannot apply for the Buy-Back Program.
    4. One-year Samsung Care+ insurance without theft coverage - a prize in the Promotion in the form of insurance coverage granted by Amtrust based on a group insurance contract, to which the general insurance conditions available at przedsprzedaz-foldy.samsung.pl apply. Insurance coverage includes protection of the insured Device specified in the policy against Accidental Damage, Liquid Damage (according to the definitions in the general insurance conditions above) for a period of 12 months from the date the Device is covered by insurance. Insurance coverage allows for an unlimited number of insurance events during the insurance period, however, in case of replacement of the insured device with a new one in accordance with the applicable general insurance conditions, only a maximum of 2 such replacements are possible for a 12-month insurance contract. Exclusions and limitations of insurance coverage are described in detail in points 5, 6, 7, and 9 of the general insurance conditions above. In case of Device replacement with a new one under insurance, the Client must pay a deductible of 699 PLN for Galaxy Z Fold6 or 529 PLN for Galaxy Z Flip6.
    5. Buy-Back Program - a program organized by Foxway, under which a Participant of the Promotion who meets its conditions can sell their current device to Foxway and, along with the amount from the sale of the device, the value of which depends on the condition and model of the device, receive an additional refund funded by Samsung of 450 PLN (Bonus) for Samsung Galaxy Z Fold6 and Galaxy Z Flip6, which will reduce the value of the Product in the Cart by the Bonus amount. The amount received from Foxway for the sold device (minimum 150 PLN for the Device) will be transferred in accordance with the Buy-Back Program regulations. Only Clients who have purchased a Promotion Device ordered in the Samsung Store within the deadlines specified in the Regulations, confirmed by Proof of Purchase, can participate in the Buy-Back Program. The Participant cannot use the Buy-Back Program if the device being sold: does not turn on, does not turn off, fails to launch the main screen or settings menu or charging port (if present) is damaged, the device does not work without a connected charger, the device has a damaged screen (screen burn-in, damaged pixels) or touch screen not working; the device is locked. Please read the terms of the Buy-Back Program available at https://samsungodkup.foxway.tech/ before participating in the Buy-Back Program.
    6. Promotional Form - an online form to which the Client is redirected from the Samsung Members Application and fills out to obtain a promotional code necessary to fill out the Cash Back Form. The Promotional Form is used to verify whether the Client has previously used the Buy-Back Program and whether they are entitled to a Cash Back to the account. After filling out the Promotional Form and positive verification of the Device purchase, the Client receives an individual promotional code via e-mail, which enables subsequent filling out of the Cash Back Form and receiving the Benefit in the form of participation in the Cash Back to Account.
    7. Buy-Back Form - an online Foxway form available in the Samsung Store, which the Client fills out before purchasing the Device to use the Buy-Back Program. Please read the terms of the Buy-Back Program available at https://www.samsung.com/pl/trade-in/ before participating in the Buy-Back Program. Using the Buy-Back Form is only possible when placing an order in the Samsung Store. After placing an order, the Participant cannot apply for the Buy-Back Program.
    8. SC+ Form - an online form to which the Client is redirected from the Samsung Members Application and fills out to obtain the Benefit in the form of one-year Samsung Care+ insurance without theft coverage for the Product purchased in the Promotion. Please read the general terms and conditions of Samsung Care+ Amtrust insurance before applying for one-year Samsung Care+ insurance without theft coverage under the Promotion.
    9. Cash Back Form - an online form to which the Client is redirected from the Samsung Members Application and fills out after receiving an individual promotional code to obtain a Cash Back to the account.

§ 2 General Provisions

  1. To participate in the Promotion, the Client must:
    1. Order and purchase the Product (Samsung Galaxy Z Flip6, Z Fold6 (all models)) in the Samsung Store between July 10, 2024, at 3:00 PM and July 23, 2024, at 11:59 PM (order submission date - date and time of order submission to the Samsung Store server). Using the Buy-Back Program is only possible when placing an order in the Samsung Store. After placing an order, the Participant cannot apply for the Buy-Back Program;
    2. Activate the Samsung Galaxy Z Flip6, Z Fold6 Device (all models) by August 11, 2024, at 11:59 PM; Device activation means launching the Device with an active SIM card from a Polish telecommunications service provider for at least 5 minutes and accepting the End User License Agreement (EULA);
    3. Log in to the Samsung Members Application on the Device within the Samsung Account.
    4. Fill out the following forms (filling out forms is only possible in Poland):
      1. By August 18, 2024, fill out the SC+ Form available after logging in to the Samsung Members Application on the Device and attach the Proof of Purchase of the Device and the Product order in the Promotion;
      2. By August 18, 2024, fill out the Promotional Form (if not using the Buy-Back Program) available after logging in to the Samsung Members Application on the Device and attach the Proof of Purchase of the Device and the Product order in the Promotion, and then after positive verification of the application and receiving the promotional code: By September 15, 2024, fill out the Cash Back Form available after logging in to the Samsung Members Application on the Device and attach the Proof of Purchase of the Device and the Product order in the Promotion. In the Cash Back Form, you must provide the individual promotional code received after verification of registration in the Promotional Form. The promotional code is individual and should not be shared with third parties. Using the Buy-Back Program excludes the possibility of receiving a Cash Back to the account and vice versa.
  2. To activate the Device, as referred to in point 1, sub-point 2) above, it is necessary to launch the Device with an active SIM card from a Polish telecommunications service provider in Poland and have access to the Internet or mobile network. Device activation is free, with the reservation that it does not include the cost of connecting to the Internet or mobile network used by the User. The cost of connecting to the Internet corresponds to the rates of the network operator used by the User.
  3. Only Clients who have purchased a Promotion Device ordered in the Samsung Store within the deadlines specified in the Regulations can participate in the Promotion.
  4. A condition for participation in the Promotion for Clients who do not have a Samsung Account is to create a Samsung Account by filling out the registration form, available at https://account.samsung.com or via the Samsung Members application. The Client is obliged to provide true and up-to-date personal data during the Samsung Account registration procedure. Providing false, incorrect, or incomplete personal data may result in the inability to participate in the Promotion.
  5. If the Benefits transferred to Promotion Participants are subject to flat-rate income tax for natural persons, as referred to in Article 30, paragraph 1, point 2 of the Act of July 26, 1991, on personal income tax, the benefits granted to Participants will be increased by an additional cash prize of 11.11% of the Benefit value. The additional cash prize will not be paid out and will be deducted to pay the flat-rate tax, which will be remitted to the appropriate tax authority. Participants agree to such deduction.
  6. Participation of Clients in the Promotion is voluntary. Anyone who has participated in the Promotion has the full right to withdraw from participation at their own discretion and without incurring any costs.
  7. Please read the general terms and conditions of Samsung Care+ Amtrust insurance before applying for one-year Samsung Care+ insurance without theft coverage under the Promotion and the terms of the Foxway Buy-Back Program before filling out the Buy-Back Form.
  8. Benefits in the Promotion are not exchangeable for other gratuities.
  9. The Promotion applies only to Products purchased in the Samsung Store.
  10. The Organizer has the right, in particular, to demand the presentation of the original Proof of Purchase of the Device or additional verification, including confirmation of the fact of placing an order during the Promotion and purchasing the ordered Device in the Samsung Store.
  11. Using the Buy-Back Program excludes the possibility of receiving a 450 PLN Cash Back to the account and vice versa. To avoid doubt, the Organizer clarifies that the Participant is entitled to fill out the Cash Back Form only if the User did not use the Buy-Back Program when placing the order. The SC+ Form can be filled out regardless of whether other Benefits were used.
  12. In case of non-fulfillment of the Buy-Back Program conditions, the Participant may apply for a Cash Back, but only after returning the Bonus from the Buy-Back Program. To participate in the Cash Back promotion, after prior rejection of participation in the Buy-Back promotion, an application must be sent to the e-mail address: premiera-samsung@smolar.pl. After verification of the application, the Participant will receive an individual promotional code enabling them to fill out the Cash Back Form within the period specified by the Organizer (the period will be specified in the return message containing the promotional code).
  13. Within:
    1. 21 calendar days from sending the Participant confirmation of positive verification of the application based on the SC+ Form and confirmation of the Participant meeting all conditions for participation in the Promotion, the Participant will receive the insurance policy by email.
    2. 21 calendar days from sending the Participant confirmation of positive verification of the application based on the Cash Back Form and confirmation of the Participant meeting all conditions for participation in the Promotion, the Organizer will transfer the amount of 450 PLN to the Participant's bank account indicated in the Cash Back Form;
    3. 21 calendar days from the completion of the valuation process of the sold device (confirmed by email sent to the address provided by the Participant), Foxway will pay the Client in the form of a single transfer, to the bank account indicated by the Participant, the amount from the sale of the device offered by Foxway as part of Foxway's business activities (according to the final valuation).

§ 3 Rules for Receiving Benefits

  1. To register for the Promotion, after activating the Device (i.e., no later than 24 hours after activation), the Client will be provided with a banner in the Samsung Members Application on the Device directing them to the SC+ Form, Promotional Form (to obtain an individual code for the Cash Back Form), and Cash Back Form. In case of purchasing Samsung Galaxy Z Flip6, Z Fold6 (all models) after activating the Device, to participate in the Promotion and receive Benefits, i.e.:
    1. One-year Samsung Care+ insurance without theft coverage
      1. From July 24, 2024, to August 18, 2024, the Client is obliged to send the Organizer a correctly filled SC+ Form, which they fill out after logging in to the Samsung Members application;
      2. A correctly filled SC+ Form means providing true data in the form of:
        • Device IMEI number;
        • Participant's first and last name; in the case of individuals conducting sole proprietorship - additionally, the company name must be indicated;
        • Participant's residential address (street, house/apartment number, city, postal code);
        • Participant's phone number;
        • Participant's e-mail address;
        • Device purchase date;
        • Attachment of Proof of Purchase of the Device;
        • Attachment of Proof of Product Order in the Promotion;
        • Confirmation of reading the Regulations by checking the box "I have read the Regulations of the Promotion".
        The Organizer clarifies that merely filling out the SC+ Form is not sufficient to receive a Cash Back or participate in the Buy-Back Program; to apply for one of the Benefits, the following additional steps must be met:
    2. Cash Back to account
      1. From July 24, 2024, to August 18, 2024, the Client is obliged to send the Organizer a correctly filled Promotional Form, which they fill out after logging in to the Samsung Members application;
      2. After verification of the Promotional Form and receiving the promotional code, the Participant is obliged to send the Organizer a correctly filled Cash Back Form, which they fill out after logging in to the Samsung Members application, between July 24, 2024, and September 15, 2024;
      3. A correctly filled Promotional Form means providing true data in the form of:
        • Device IMEI number;
        • Participant's first and last name;
        • In the case of individuals conducting sole proprietorship - additionally, the company name must be indicated;
        • Participant's e-mail address;
        • Device purchase date;
        • Indication of the Samsung platform on which it was purchased;
        • Confirmation of reading the Regulations by checking the box "I have read the Regulations of the Promotion";
        • Photos of the box with visible IMEI number;
        • Attached Proof of Purchase of the Device;
        • Attached Proof of Device Order during the Promotion period.
    3. Buy-Back Program
      1. When purchasing the Device in the Samsung Store during the Promotion (in the cart or on the product card), you must fill out the Buy-Back Form and perform all necessary steps resulting from the Buy-Back Program regulations (including sending the device to the address indicated by Foxway). After filling out the Buy-Back Program form and accepting the Buy-Back Program Regulations and adding the Device to the cart, the Participant will receive a Bonus from Samsung in the amount of 450 PLN (Bonus) for Samsung Galaxy Z Fold6 and Galaxy Z Flip6, which will reduce the value of the Product by the Bonus amount. The Bonus from Samsung is independent of the amount received from Foxway due to participation in the Buy-Back Program. The amount received from Foxway (minimum 150 PLN for the Device) for the sold device will be transferred in accordance with the Buy-Back Program regulations. The Participant cannot use the Buy-Back Program if the device being sold is not working and/or has a damaged screen, which means that the device: does not turn on, does not turn off, fails to launch the main screen or settings menu or charging port (if present) is damaged, the device does not work without a connected charger, the device has a damaged screen (screen burn-in, damaged pixels) or touch screen not working; the device is locked. The device sales agreement is concluded exclusively between Foxway and the Client. The price for the sale of the device offered by Foxway under the Buy-Back Program is determined solely by Foxway based on its price list, taking into account the model and condition of the device. The price is valid on a given day and may change according to Foxway's decision, with the reservation that, according to Foxway's decision, the Client and Foxway are bound by the sales price of the device valid on the day the Client sent the correctly completed Buy-Back Form to Foxway.
      2. The Buy-Back Form must be filled out only when placing an order, i.e., from July 10, 2024, at 3:00 PM to July 23, 2024, at 11:59 PM. After filling out the Buy-Back Form, the Client is obliged to send the sold device (previously valued under the Buy-Back Program) to Foxway at Foxway's expense, according to the shipping options indicated on the website https://www.samsung.com/pl/trade-in/, within 7 calendar days from the date of receiving the shipping instructions by email. If devices are sent to Foxway after 7 calendar days from the date of receiving the shipping instructions by email, Foxway has the right to re-evaluate the purchase amount of the device in accordance with point 4 of the Foxway Buy-Back Program Regulations. General terms and conditions are available at: https://images.samsung.com/is/content/samsung/assets/pl/regulaminy_2022/Regulamin_Programu_Odkup.pdf. In case of not receiving confirmation of registration of the application under the Buy-Back Program within 7 calendar days from the moment of placing the order, the Organizer will contact the Participant to verify the correctness of the application, in particular the data provided in the Buy-Back Form, and provide further instructions regarding the application to the Buy-Back Program. In such a case, Samsung reserves the right to provide a link to fill out an additional external Buy-Back Program form available at https://samsungodkup.foxway.tech/odkup500-hidden to enable filling out the form again. The device should be sent to Foxway without additional accessories (charger, headphones). Foxway does not return headphones, chargers, or the sent box (including the original one). The mentioned items are disposed of immediately after opening the package delivered to Foxway.
      3. Within 21 calendar days from the delivery of the sold device to the INPOST warehouse, Foxway will verify the device and make a final valuation of the sold Device (final valuation means Foxway's determination of the model and condition of the device and its assignment to the buy-back price for the sale of the device valid on the day the Client sent the correctly filled Buy-Back Form to Foxway, which price is communicated by Foxway in the form available in the Samsung Store). If the Participant does not agree with the final valuation of the sold device, they must report this fact in response to the valuation email.
      4. Within 21 calendar days from the completion of the valuation process of the sold device (confirmed by email sent to the address provided by the Participant), Foxway will pay the Client the buy-back amount, to the bank account indicated by the Participant, which consists of the amount from the sale of the device offered by Foxway as part of Foxway's business activities (according to the final valuation). After the completion of the valuation process of the sold device and the conclusion of the sales agreement, the Client no longer has the possibility to withdraw from the concluded sales agreement, even if they decide to withdraw from the Promotion in accordance with § 2, paragraph 6 above.
      5. The price for the sale of the device offered by Foxway under the Buy-Back Program is determined solely by Foxway based on its price list, taking into account the model and condition of the device. The price is valid on a given day and may change according to Foxway's decision, with the reservation that, according to Foxway's decision, the Client and Foxway are bound by the sales price of the device valid on the day the Client sent the correctly completed Buy-Back Form to Foxway.
      6. The Organizer has the right at any time to contact the Participant to confirm possession of their old device, which they indicated in the Buy-Back Program Form. Additionally, in case of non-fulfillment of the Promotion requirements described in §3 point 1. 3), including in particular the failure to send the old device within 7 calendar days from the date of receiving the shipping instructions by email, Samsung has the right to demand from the Participant the return of the received Bonus in the amount of 450 PLN (Bonus) for Samsung Galaxy Z Fold6 and Galaxy Z Flip6. Failure to voluntarily return the financial benefits (Bonus) received by the participant may result in the collection of the funds in question.
      7. Within one Order in the Samsung Store, a Participant can use the Buy-Back Program for the same Device model only once. If more than one Device of the same model is added to the cart, the discount will be applied only to one Device due to system limitations. If a Participant wants to buy two identical Device models and use the Buy-Back Program for both, they must do so in two separate orders in the Samsung Store. If different Device models are added to the cart, the Buy-Back Program can be used for each of them and a Bonus received.
      8. If the Participant wishes to exercise their statutory right to withdraw from the Product sales agreement without stating a reason, the amount Samsung will be obliged to refund for such Device will be the amount the Participant actually paid for the Device after receiving the Bonus from Samsung.
    4. The Participant is obliged to provide true and complete data.
    5. One Participant can receive 2 sets of Benefits in the Promotion (a set of Benefits means one-year Samsung Care+ insurance without theft coverage and a choice of Buy-Back Program or Cash Back to account) for a given Device model (e.g., when purchasing 2 units of Galaxy Z Fold6 and 1 unit of Galaxy Z Flip6, the participant will receive 3 sets of Benefits, i.e., 2 sets of Benefits for Galaxy Z Fold6, i.e., 2 times one-year Samsung Care+ insurance without theft coverage and 2 times a choice of Buy-Back Program or Cash Back to account, and 1 set of Benefits for Galaxy Z Flip6, i.e., one-year Samsung Care+ insurance without theft coverage and a choice of Buy-Back Program or Cash Back to account). The total limit of Benefit sets for one Participant is 4 sets.
    6. Providing incorrect data by the Participant may result in the inability or delay in transferring the Benefit.
    7. In case of withdrawal from the sales agreement for the purchased Product (exercising the statutory or contractual right of withdrawal granted by the seller), the Participant is obliged to immediately send such information to the Organizer at the email address: support_sepol@email.support.samsung.com and return the Benefits received under the Promotion.

§ 4 Verification. Complaints related to the Promotion

  1. Based on the data provided by the Participant in the application, Smolar/SSCE will verify the correctness of applications made using the SC+ Form/Promotional Form/Cash Back Form. Applications sent after the deadline for applying to the Promotion, incorrect, incomplete, non-compliant with the Regulations, containing false data, or illegible or unclear scans/photos of the Proof of Purchase, or not containing proof of Product order in the Promotion, will exclude the possibility of receiving Benefits.
  2. SSCE/Smolar has the right to additional verification of applications, which in particular cases may require re-submission of the application (filling out the form). SSCE/Smolar also has the right, for example, to demand the presentation of the original document confirming the purchase of the Product. In case of additional verification of the application, SSCE/Smolar will notify the Participant by email. The Participant will be obliged to provide the requested documents or data within 5 (five) working days from the date of receiving the request to the email address: premiera-samsung@smolar.pl (for SC+ Form and Promotional Form) or via a link sent in the message (for Cash Back Form). If the Participant fails to provide explanations within the deadline, the Organizer will exclude the Participant from participation in the Promotion.
  3. Subject to the possibility of additional verification of applications, SSCE/Smolar will verify applications sent by Participants no later than within 21 calendar days from the date of receipt of the application on the server handling application traffic. In case of additional verification of applications, the above deadline may be appropriately extended.
  4. Each Proof of Purchase of the Product can be submitted under the Promotion only once to obtain a Benefit, unless the Proof of Purchase contains different Product models.
  5. Complaints and questions related to the Buy-Back Program are verified and handled by Foxway. Complaints regarding the Buy-Back Program should be directed to Foxway at the email address: samsung.pl@foxway.com no later than November 13, 2024. Foxway, acting on behalf of Samsung in this regard, may directly provide answers to complaints.
  6. Complaints regarding the implementation of the Regulations concerning one-year Samsung Care+ insurance without theft coverage and Cash Back to the Account should be reported to the Organizer no later than November 13, 2024, and the Organizer recommends reporting complaints regarding registration problems for the Promotion as soon as possible in the form of:
    1. Electronic, in the form of an e-mail message to the address: premiera-samsung@smolar.pl
    2. In person at the Smolar office at: ul. Inżynierska 15, 93-569 Łódź
    3. By post to the address: Smolar Agencja Promocyjno-Reklamowa Sp. z o.o., ul. Inżynierska 15, 93-569 Łódź with the note "Pre-sale of the Samsung Galaxy Z Flip6, Z Fold6 family in the Samsung Store". The complaint should contain data enabling identification of the Client. For efficient complaint processing, please also indicate the circumstances justifying the complaint, proof of Product order in the Promotion, and Proof of Purchase (in paper or scanned form).
  7. The Organizer processes complaints and provides answers within 14 calendar days from the date of receipt. The Client submitting the complaint will be notified of how the complaint was handled in the same form in which it was submitted, i.e., by email or in writing.
  8. The deadline for submitting complaints provided in the Regulations does not exclude or limit the rights of the Participant under the provisions of law, in particular the provisions on limitation periods for claims.
  9. The complaint procedure does not exclude or limit the Participant's right to pursue their rights before common courts.

§ 5 Personal Data

  1. The administrator of Clients' personal data is Samsung Electronics Polska Sp. z o.o. with its registered office in Warsaw (address: ul. Postępu 14, 07-676 Warsaw).
  2. Samsung processes Clients' personal data in connection with participation in the Promotion (Article 6, paragraph 1, letter f of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC; hereinafter "GDPR").
  3. Samsung processes Clients' personal data in connection with participation in the Promotion, for the purpose of:
    1. Organizing and conducting the Promotion,
    2. Communication with Users;
    3. Providing Benefits and services specified in the Regulations;
    4. Handling complaints.
  4. Samsung also processes Participants' personal data for purposes related to Samsung's fulfillment of legal obligations, including tax and accounting obligations (the legal basis for processing is the necessity of data to fulfill a legal obligation incumbent on the administrator, i.e., Article 6, paragraph 1, letter c of GDPR).
  5. Samsung may also use Clients' personal data for marketing purposes consisting of promoting goods and services and products and services of Samsung's business partners. The legal basis for processing personal data for marketing purposes is the legitimate interest of the administrator (Article 6, paragraph 1, letter f of GDPR) consisting of conducting marketing activities.
  6. As part of its marketing activities, Samsung may send Clients messages containing information about new products or services. Such information may be sent only if Users have given separate consent to marketing communication, which can be withdrawn at any time. Consent can be withdrawn by contacting Samsung or by using the link in any electronic message containing marketing communications.
  7. Samsung may use collected personal data to create so-called Client profiles, based, among other things, on their interests, purchase history, and activity within the Platform. Based on created profiles, Samsung may send more tailored marketing communications informing about goods and services.
  8. Additionally, in some situations, it is or may be necessary to process Clients' personal data for purposes other than those indicated above, and which are necessary due to the realization of the Organizer's legally justified interests (Article 6, paragraph 1, letter f of GDPR), in particular:
    1. For purposes related to monitoring and improving the quality of services provided;
    2. If applicable, for internal reporting within Samsung and the Samsung Group;
    3. For purposes of preventing and combating abuses and using Samsung's activities for purposes related to violating the law;
    4. If applicable, for purposes related to conducting disputed proceedings, as well as proceedings before public authorities and other proceedings, including for the purpose of pursuing and defending claims.
  9. In cases other than those indicated above, Clients' personal data will be processed only on the basis of previously granted consent, to the extent and for the purpose specified in the content of the consent.
  10. Failure to provide all required personal data by the Client may constitute an obstacle to participation in the Promotion and the provision of services by Samsung to them.
  11. To the extent that personal data is collected on the basis of consent, the provision of personal data is voluntary.
  12. Personal data processing will include the scope of data indicated in the application form for the Promotion, as well as other data provided by the User in connection with participation in the Promotion.
  13. In connection with the processing of Clients' personal data for the purposes indicated in point 1 above, their personal data may be disclosed to the following recipients or categories of recipients:
    1. Entities participating in processes necessary for the implementation of the Promotion and the provision of services under the Promotion; for the purpose of handling complaints and delivering the Prize, Clients' personal data has been entrusted to Smolar for processing;
    2. Entities from the Samsung capital group;
    3. Entities supporting Samsung in its business processes, including entities processing data on behalf of Samsung (so-called data processors);
    4. Public administration bodies and entities performing public tasks or acting on behalf of public administration bodies, to the extent and for the purposes resulting from legal provisions;
    5. The insurer - acting as an independent personal data administrator, Amtrust International Underwriters DAC, a company established and existing under Irish law, based in Dublin, Ireland, at 6-8 College Green, Dublin 2, D07 VP48, registered under number 169384, operating under authorization number CBI C33525 issued by the Central Bank of Ireland (CBI) and subject to its regulations;
    6. The insurance agent - acting as an independent personal data administrator, Servify (Europe) B.V., a company established and existing under Dutch law, registered under number KVK 24155721, with its registered office at Aert van Nesstraat 45, 3012 CA Rotterdam, Netherlands.
  14. Clients' personal data will be processed for the period necessary to provide services under the Promotion.
  15. After the above period, Clients' personal data may still be processed to the extent required by law or for the realization of Samsung's legally justified interest as specified in point 3 above (subject to deadlines provided by tax law), and if the Client has given consent to data processing after the termination or expiration of the agreement, until this consent is withdrawn.
  16. Profiling means any form of automated processing of personal data that involves using personal data to prepare and send personalized services/offers tailored to the User's needs. Offers are developed based on the Client's activity within the services provided by Samsung. Offers will be sent to Clients only if they have given their consent.
  17. Samsung ensures that all persons whose personal data is processed have the appropriate rights under GDPR, namely:
    1. The right to access personal data, including the right to obtain a copy of such data;
    2. The right to request rectification (correction) of personal data - if the data is incorrect or incomplete;
    3. The right to request erasure of personal data (the "right to be forgotten") - if (i) the data is no longer necessary for the purposes for which it was collected, (ii) the data subject has objected to the processing of personal data, (iii) the data subject has withdrawn consent on which the processing is based and there is no other legal basis for processing, (iv) the data is processed unlawfully, (v) the data must be erased to comply with a legal obligation;
    4. The right to request restriction of personal data processing - (i) the data subject disputes the accuracy of the personal data, (ii) the processing is unlawful and the data subject objects to the erasure of the data, requesting instead the restriction of its use, (iii) the administrator no longer needs the data for their purposes, but the data subject needs it for the establishment, exercise or defense of legal claims, (iv) the data subject has objected to the processing of personal data - pending verification whether the legitimate grounds of the administrator override those of the objection;
    5. The right to data portability if: (i) processing is based on a contract with the data subject or on consent given by such person, and (ii) processing is carried out by automated means;
    6. The right to object to the processing of personal data, including profiling, if (i) there are reasons related to the Client's particular situation, and (ii) the processing is based on the necessity for purposes resulting from Samsung's legitimate interest.
  18. The Client is entitled to submit a request to exercise the rights mentioned above and below by filling out the form available at www.samsung.com/pl (https://www.europe-samsung.com/gdpr/webform/pl), according to the instructions available on the website.
  19. To the extent that the Client has given consent to the processing of personal data, they have the right to withdraw consent to the processing of personal data at any time.

§ 6 Final Provisions

  1. The content of these Regulations is provided to Clients on the Website. The Client can download and save the Regulations on their end device.
  2. In matters not regulated by these Regulations, generally applicable provisions of Polish law shall apply. All communication regarding the Promotion will be conducted in Polish.
  3. The Organizer reserves the right to change the Regulations in connection with and in case of at least one of the following important reasons (disjunctively):
    1. Introduction of new or change of existing generally applicable legal provisions, if this directly affects the content of these Regulations and necessitates its change;
    2. Ruling, decision, recommendation, or recommendation of an authorized public authority, relating to the Regulations and necessitating its adaptation to such ruling, decision, recommendation, or recommendation;
    3. Adaptation of the Regulations to market conditions related to technical, technological, and IT progress, affecting the provisions of these Regulations;
    4. Change of company data, teleaddress data, or URL addresses included in the Regulations;
    5. Necessity to introduce changes other than those mentioned above, provided that they jointly meet the following conditions: i) they are compliant with the law (including in particular not violating individual or collective consumer interests); ii) they are beneficial for current and potential Participants; iii) their introduction is necessary for the proper implementation of the Promotion in a manner that is beneficial for current and potential Participants.
  4. No change to the Regulations may negatively affect rights previously acquired by Participants.
  5. The announcement of changes to the Regulations will be provided with one day's notice on the Website.
