Yamaha Booster Easy Edition 70th Anniversary Game Rules

Article 1. Organization

YAMAHA MOTOR EUROPE NV, a foreign company with a capital of €347,787,000, headquartered at KOOLHOVENLAAN 101 - 1119 NC - SCHIPHOL-RIJK (Netherlands), registered with the Netherlands Chamber of Commerce under number 34084613, and with an establishment in France under the name YAMAHA MOTOR EUROPE NV - SUCCURSALE France, registered with the RCS of Pontoise under number 808 002 158, and whose registered office is located at 98 Bis Boulevard Héloïse – 95100 ARGENTEUIL (hereinafter referred to as "YMF"), is organizing a commercial animation. As part of this animation, YMF is organizing a contest to celebrate Yamaha's 70th anniversary (July 1, 2025). The prize to be won is a BOOSTER EASY featuring a special "Yamaha 70 ans" sticker.

Any person who has rented a vehicle through the Yamaha Rent network between July 1, 2025, and August 31, 2025, and has registered for the contest, will be eligible to participate in the prize draw. A dedicated page will be available on the website https://jeu.yamaha-motor-rent.fr for registrations. The winner will be drawn and announced in early September.

Article 2. Conditions of Participation

The Game is open to any individual customer residing in metropolitan France who has rented a motorcycle, scooter, or e-bike for a minimum of one day at the "leisure" rate between July 1 and August 31, 2025, with YAMAHA RENT.

Registration for the Game is exclusively electronic, via the website https://jeu.yamaha-motor-rent.fr (hereinafter referred to as "the Site").

Participants wishing to enter the Game are invited to check the terms of use of their personal data on the Site (which can be modified at any time) so that YAMAHA may use this information to offer them registration. To enter the Game, all requested information fields must be completed; any incomplete, erroneous, or false information will result in the disqualification of the participant. Candidates are informed that the data provided in the registration form is necessary for their participation and for the awarding of prizes. Candidates are therefore invited to ensure the accuracy of this information.

Any participant under 18 years of age must obtain prior authorization from a parent or guardian to participate in the game and accept these rules. The organizer may ask any minor participant to provide proof of this authorization and, if necessary, disqualify a participant who cannot provide proof of this authorization.

Registration must be completed before August 31, 2025, at 11:59 PM.

The personnel of YAMAHA MOTOR EUROPE, including their family and partners (by marriage, PACS, or recognized de facto union), are excluded from all participation in the Game and from receiving any prize, whether directly or indirectly.

Participation in the Game implies full and unreserved acceptance of these rules.

Article 3. Winner Selection

The prize draw will be conducted by random draw from all entries. Only participants who meet the conditions stated above will be eligible for prizes. Winners will be selected after verification of their eligibility to win.

Participants authorize all verifications concerning their identity, age, postal address, or the loyalty and sincerity of their participation. To this end, the Organizer reserves the right to request a copy of the winner's identity document before sending the prize. Any false declaration, indication of identity, or address will result in the immediate disqualification of the participant.

The winner will be announced in early September on Yamaha's social media channels. The winner will be informed by email within 15 days of the draw. This email will contain all the necessary information for the delivery of the prize. If the prize is not claimed (under conditions to be specified in the email), YAMAHA may, at its discretion, select another winner.

Article 4. Prizes

The Game includes the following prize: One Yamaha BOOSTER Easy model 2023 with a value of €1,999.00 including tax (TTC) and a YAMAHA 70th Anniversary decoration kit by Yamaha-Rent with a value of €202.24 including tax (TTC), making a total prize value of €2,201.24 including tax (TTC).

The prize cannot be contested in any way by the winner, nor can its cash equivalent be awarded, nor can it be partially or fully reimbursed, nor can it be replaced or exchanged for any reason whatsoever.

YAMAHA may freely change the prizes for others of equal value.

Unclaimed, unawarded, or awarded prizes to a person who does not meet the Game's conditions may not be re-awarded; this is at YAMAHA's discretion, who may freely decide to re-award them.

YAMAHA reserves the right to replace a prize with one or more prizes of equal value.

The prize is nominative and cannot be awarded to anyone other than the person designated in the context of this Game.

Article 5. Personal Data

The following data will be collected: Name, First name, email address, phone number, purchase invoice, and dealer name.

How will personal data be used?

For multiple participations (multiple invoices), the email address will be used as a reference to aggregate the quantities purchased during the period.

The data collected through the GAME platform are all necessary. They will be used so that YMF, the data controller, can ensure: the proper conduct of the Game, the registration and eligibility of participants, and the provision of prizes.

The data will be processed based on the consent of the winners and the contract arising from participation in the Game.

They may be transmitted to all service providers (some of whom may be located outside the European Union) involved in the execution of the Game and the shipment of prizes.

If the conditions for collecting or using data are modified, the notice on the platform through which the data will be collected will apply.

Data retention

Data will be kept in electronic format and will be deleted at the latest 6 months after the designation of the winner(s), unless an event justifies their retention for longer for the legitimate interest of YMF (litigation, accident, etc.).

Your rights

Participants have the right to access, modify, delete, limit, object to, and port their personal data.

After contacting us, if you believe your rights are not respected, you may submit a complaint to the CNIL.

Article 6. Liability

YAMAHA may, for any reason whatsoever, cancel, postpone, interrupt, or extend the Game or modify all or part of the terms of these rules. If, particularly as a result of a fortuitous event, force majeure, or an event beyond its control (including technical issues), it is forced to exercise this right, its liability cannot be engaged.

Participation in this Game implies the participant's knowledge and acceptance of the characteristics and limitations of the internet, particularly concerning technical performance, response times for consulting, querying, or transferring information, risks of interruption, and more generally, the risks inherent in any connection and transmission over the internet, the absence of protection of certain data against possible misuse, and the risks of contamination by viruses circulating on the internet.

It is specified that YMF cannot be held liable for any direct or indirect damage resulting from an interruption, a malfunction of any kind whatsoever and for any reason whatsoever, or for any direct or indirect damage resulting, in any way, from an internet connection, or from any equipment used by the participant in the context of these rules, which could affect the proper conduct of the Game.

YAMAHA MOTOR EUROPE NV succursale France disclaims all liability for any incidents and/or accidents that may occur during the enjoyment of the awarded prize and/or due to its use, except within the framework of the application of the legal guarantee.

Article 7. Participation Costs

Any participant has the possibility to be reimbursed for internet connection costs incurred to participate in the Game. The request must be made on plain paper and sent by postal mail no later than thirty (30) days following the end date of the Game, with the postmark serving as proof, to the following address: YAMAHA MOTOR EUROPE NV, succursale France - Service Marketing YAMAHA - 98 Bis Boulevard Héloïse - CS 60293 - 95815 ARGENTEUIL CEDEX.

It must imperatively include: the participant's name, first name, postal address, and email address, a photocopy of their identity card, the date and time of their participation, and, as soon as available, a photocopy of the detailed invoice from the telephone operator and/or internet service provider. It is expressly stated that no reimbursement request sent by email will be considered.

The participant, having made the request under the conditions defined in this article, will be reimbursed a flat rate of: €0.10 TTC per minute, up to a maximum of 5 minutes of connection, i.e., €0.50 TTC. Connection and postage costs for this request will be reimbursed within thirty (30) days of receipt of the request, based on the standard "letter" rate in effect in France and Europe. However, any access to the Game made on a free or flat-rate basis (via cable, ADSL, Wi-Fi, or specialized connection, etc.) will not give rise to any reimbursement, as the act of connecting to the Game address and participating in the Game did not incur any specific costs or expenses for the participant. Any reimbursement can, by definition, only occur if there has been an actual expense incurred by the participant, under penalty of prosecution for fraud.

Article 8. Deposit of Rules

From the date of its implementation, this Game is subject to these rules, deposited with Maître Samuel CRAPOULET, Bailiff, located at: 16 Rue Traversière, 95000 Cergy.

The rules are available free of charge to anyone who requests them from the Game Organizer at the following address: YAMAHA MOTOR EUROPE NV – Succursale France - Service Marketing / Jeu concours / 98 Bis Boulevard Héloïse - 95100 ARGENTEUIL.

Article 9. Disputes

These rules are subject to French law. To be considered, any disputes relating to the Game must be submitted in writing to the following address: YAMAHA MOTOR EUROPE NV, succursale France – Service Marketing YAMAHA – 98 Bis Boulevard Héloïse - CS 60293 - 95815 ARGENTEUIL CEDEX, and no later than thirty (30) days after the participation deadline for the Game as indicated in these rules. In case of persistent disagreement regarding the application or interpretation of these rules, and in the absence of an amicable agreement, any dispute will be submitted to the competent court of the rightful claimant, to which exclusive jurisdiction is attributed.
