Service Features and Risks
What is the Nexi Prepaid Card?
The Nexi Prepaid Card is a rechargeable prepaid card that can be issued to consumers who have a current account with illimity Bank. The card allows the holder to:
- Purchase goods and/or services from affiliated merchants (excluding tolls).
- Withdraw cash from affiliated banks in Italy and abroad, including ATMs.
Card transactions reduce the available balance. The card may be associated with additional services such as a multi-risk insurance policy, 3D Secure anti-fraud protection, and SMS Alert services.
Principal Risks
- Unfavorable changes in economic conditions (fees and service charges) if contractually agreed.
- Fraudulent use by third parties if the card or PIN is lost or stolen. Holders must take extreme care in safeguarding the card and PIN and maintain strict confidentiality in their use.
- Use of the card on websites lacking security protocols.
- Exchange rate variations for transactions in currencies other than the Euro.
- Inability to revoke payment operations once authorized by the holder, except within the terms specified in the contract.
- Non-crediting of funds due to incorrect IBAN communication for top-ups or balance refunds upon termination.
The use of a blocked, expired, revoked, or reported lost/stolen card, or one that is otherwise unusable, is illegal. The Bank and/or Nexi reserve the right to pursue such illicit behavior, including criminal prosecution.
Economic Conditions
Maximum Issuance Fee:
- €15 for "Conto illimity" and "Conto Azimut Premium" accounts.
Maximum Renewal Fee:
- €15.00
Maximum Card Availability:
€12,500.00 (total of all recharges made simultaneously).
Maximum Cash Withdrawal Fees:
- €2.00 per withdrawal at any bank ATM in Italy and abroad (Eurozone).
- €2.00 per withdrawal at any bank ATM abroad (non-Eurozone).
Note: ATMs may charge additional fees, which will be displayed before transaction completion.
Minimum and Maximum Cash Withdrawal Amounts:
Maximum of 2 withdrawals per day, with a total maximum of €250.00.

Maximum Top-up Fees:
- €1.00 for top-ups via Home Banking.
- €2.50 for top-ups at Mooney retail points in Italy.
- €2.00 for top-ups via the Nexi Pay website/app or Customer Service.
Minimum and Maximum Top-up Amounts:
- Home Banking: Minimum €25.00, Maximum €2,500.00 per day.
- Mooney retail points: Minimum €25.00, Maximum €200.00 per top-up (max two top-ups per day).
- Nexi Pay website/app/Customer Service: Minimum €25.00, Maximum €250.00 per top-up (max two top-ups per day, total not exceeding €500).
Exchange Rate for Non-Euro Transactions:
The exchange rate is determined at the time of conversion according to international agreements with Visa and MasterCard. The Euro amount debited will be calculated by applying the exchange rate defined by the circuits, plus a 2% commission charged by Nexi Payments.

Fees for Unauthorized Transactions
No fees apply for the recovery of funds related to unauthorized, unexecuted, or incorrectly executed payment or cash withdrawal operations.

- Security Alerts: Automatic enrollment for SMS messages for transactions equal to or exceeding €200 (customizable down to €50). Cost: €0.00.
- ioSICURO Alert Service: Automatic SMS service from Nexi to notify the holder of suspicious transactions, allowing a response. Cost: €0.00.
- Service SMS: Optional service for account status checks. SMS costs are borne by the holder based on their mobile provider's rates.

Disclaimer for Unauthorized or Incorrectly Executed Transactions
In case of an unauthorized or incorrectly executed payment or cash withdrawal operation, the Customer must notify Nexi without delay via Customer Service or the dedicated card blocking number. Notification must be made within 13 months of the transaction debit date. An operation is considered incorrectly executed if its execution does not conform to the order or instructions given by the Customer.
Right of Withdrawal and Complaints
Customer's Right of Withdrawal:
Consumers have the right to withdraw from the contract within 14 days of its conclusion, or from the day they receive the contractual conditions and required information, if later. Written withdrawal notices should be sent via registered mail with return receipt to the Bank's registered office or via certified email (PEC) to illimity@pec.illimity.com. Withdrawal is effective upon the Bank's acknowledgment.
The Customer must also invalidate the card by cutting it vertically into two parts. Failure to do so will result in the card being blocked by Nexi, and any subsequent use will be considered illicit.
Bank's Right of Withdrawal:
The Bank may withdraw from the contract with prior written notice to the Customer in the following cases:
- With a 2-month notice period, without charge to the Customer, communicated via registered mail or email/PEC. Withdrawal is effective after the notice period.
- For justified reasons, communicated to the Customer, with a maximum of 5 days' notice, without charge. Justified reasons include deterioration of creditworthiness, insolvency, protests, civil/criminal seizures, injunctions, issues related to card operations or payment circuits, or any other reason that prejudices the trust relationship between the Bank and the Customer.
Customer Obligations in Case of Withdrawal:
All obligations incurred by the holder prior to the withdrawal's effective date remain valid. Within 30 days of the withdrawal's effective date, the Customer must pay any outstanding credit amounts owed to the Bank. If the Customer possesses the card, they must invalidate it by cutting it vertically. Failure to do so will result in the card being blocked by Nexi, and any subsequent use will be considered illicit.
The Bank is authorized to retain any amounts due from the remaining balance on the card or other cards held by the Customer.
- Periodic fees are due proportionally for the period prior to withdrawal; prepaid fees will be refunded proportionally.
- The Customer is entitled to a refund of the remaining balance as per the contract terms.
Further Effects of Withdrawal:
Withdrawal also extends to any additional services associated with the contract, notwithstanding any provisions to the contrary in sector regulations.
Complaints
Holders can submit complaints to the Bank via registered mail with return receipt to: illimity Bank S.p.A., Ufficio Reclami, via Soperga n. 9, 20124 Milan, or via email: reclami@illimity.com; PEC: illimity@pec.illimity.com, or through the digital form available in the Area, or other methods made available from time to time.
The Bank will respond to complaints within 15 working days of receipt. If the complaint is accepted, the response will indicate the expected resolution time. If the Bank cannot respond within 15 working days, it may provide an interim response detailing the reasons for the delay. Such delays must not be due to the Bank's will or negligence. In case of an interim response, a final response must be provided within 35 working days.
If the Bank does not respond within the stipulated timeframe, or if the complaint is not accepted or the holder is not satisfied with the response, the holder may, before resorting to legal action, contact the Banking and Financial Arbitrator (“ABF”). Information on how to contact the ABF is available on the Bank's website, at Bank of Italy branches, or at www.arbitrobancariofinanziario.it.
In accordance with Italian Legislative Decree 4 March 2010, n. 28, regarding mediation for civil and commercial disputes, before initiating legal proceedings, and even without a prior complaint, the Customer and the Bank must undertake a mediation procedure as a condition for the admissibility of legal action. This can be done through the Banking Conciliation Body or other specialized mediation bodies registered with the Ministry of Justice.
Compliance with the mediation procedure as per Legislative Decree 4 March 2010, n. 28 is considered fulfilled if the Customer has initiated the procedure before the ABF.
Additionally, in case of violation of Title II of Legislative Decree 11/2010, the holder may submit a report to the Bank of Italy.
Violations of payment services regulations, the Consolidated Banking Act, and Legislative Decree 27 January 2010, n. 11 may result in administrative sanctions, including monetary penalties, interdictory measures, and accessory sanctions (such as publication of imposed measures) against the Bank, its outsourced service providers, auditors, and management personnel.
Contract Language, Applicable Law, and Competent Court
The Contract is written in Italian and governed by Italian law.
If the Customer is a consumer, any dispute regarding the validity, effectiveness, interpretation, or execution of the Contract shall be exclusively under the jurisdiction of the court in the Customer's place of residence or domicile.
If the Customer is not a consumer, any dispute shall be exclusively under the jurisdiction of the Court of Milan.
Glossary
- ATM (Automated Teller Machine): A machine, usually located at bank branches, that allows the holder to withdraw cash and check account status.
- BANK: illimity Bank S.p.A., acting as the treasury bank and card issuer, responsible for the Card's terms of use and electronic money, and which has entrusted Nexi Payments with certain activities related to card operations and payment circuits.
- MANAGER: Nexi Payments SpA, based in Milan, responsible for certain activities related to card operations and payment circuits, and managing relationships with international payment circuits under a license agreement.
- REMAINING BALANCE: The amount of electronic money remaining on the card, calculated as the difference between amounts loaded and payments/withdrawals made, plus fees and other accounted sums.
- PIN (Personal Identification Number): The code required at a POS or ATM to complete a payment or cash withdrawal operation.
- HOLDER OR CUSTOMER: The applicant for the Card, whose signature appears on the back of the Card.
