Service Features and Risks

What is the Nexi Prepaid Card?

The Nexi Prepaid Card is a rechargeable prepaid card that can be issued to consumers who have a current account with illimity Bank. The card allows the holder to:

Card transactions reduce the available balance. The card may be associated with additional services such as a multi-risk insurance policy, 3D Secure anti-fraud protection, and SMS Alert services.

Principal Risks

The use of a blocked, expired, revoked, or reported lost/stolen card, or one that is otherwise unusable, is illegal. The Bank and/or Nexi reserve the right to pursue such illicit behavior, including criminal prosecution.

Exchange Rate for Non-Euro Transactions:

The exchange rate is determined at the time of conversion according to international agreements with Visa and MasterCard. The Euro amount debited will be calculated by applying the exchange rate defined by the circuits, plus a 2% commission charged by Nexi Payments.

Additional Services

Disclaimer for Unauthorized or Incorrectly Executed Transactions

In case of an unauthorized or incorrectly executed payment or cash withdrawal operation, the Customer must notify Nexi without delay via Customer Service or the dedicated card blocking number. Notification must be made within 13 months of the transaction debit date. An operation is considered incorrectly executed if its execution does not conform to the order or instructions given by the Customer.

Right of Withdrawal and Complaints

Customer's Right of Withdrawal:

Consumers have the right to withdraw from the contract within 14 days of its conclusion, or from the day they receive the contractual conditions and required information, if later. Written withdrawal notices should be sent via registered mail with return receipt to the Bank's registered office or via certified email (PEC) to illimity@pec.illimity.com. Withdrawal is effective upon the Bank's acknowledgment.

The Customer must also invalidate the card by cutting it vertically into two parts. Failure to do so will result in the card being blocked by Nexi, and any subsequent use will be considered illicit.

The Bank may withdraw from the contract with prior written notice to the Customer in the following cases:

Customer Obligations in Case of Withdrawal:

All obligations incurred by the holder prior to the withdrawal's effective date remain valid. Within 30 days of the withdrawal's effective date, the Customer must pay any outstanding credit amounts owed to the Bank. If the Customer possesses the card, they must invalidate it by cutting it vertically. Failure to do so will result in the card being blocked by Nexi, and any subsequent use will be considered illicit.

The Bank is authorized to retain any amounts due from the remaining balance on the card or other cards held by the Customer.

Further Effects of Withdrawal:

Withdrawal also extends to any additional services associated with the contract, notwithstanding any provisions to the contrary in sector regulations.

Complaints

Holders can submit complaints to the Bank via registered mail with return receipt to: illimity Bank S.p.A., Ufficio Reclami, via Soperga n. 9, 20124 Milan, or via email: reclami@illimity.com; PEC: illimity@pec.illimity.com, or through the digital form available in the Area, or other methods made available from time to time.

The Bank will respond to complaints within 15 working days of receipt. If the complaint is accepted, the response will indicate the expected resolution time. If the Bank cannot respond within 15 working days, it may provide an interim response detailing the reasons for the delay. Such delays must not be due to the Bank's will or negligence. In case of an interim response, a final response must be provided within 35 working days.

If the Bank does not respond within the stipulated timeframe, or if the complaint is not accepted or the holder is not satisfied with the response, the holder may, before resorting to legal action, contact the Banking and Financial Arbitrator (“ABF”). Information on how to contact the ABF is available on the Bank's website, at Bank of Italy branches, or at www.arbitrobancariofinanziario.it.

In accordance with Italian Legislative Decree 4 March 2010, n. 28, regarding mediation for civil and commercial disputes, before initiating legal proceedings, and even without a prior complaint, the Customer and the Bank must undertake a mediation procedure as a condition for the admissibility of legal action. This can be done through the Banking Conciliation Body or other specialized mediation bodies registered with the Ministry of Justice.

Compliance with the mediation procedure as per Legislative Decree 4 March 2010, n. 28 is considered fulfilled if the Customer has initiated the procedure before the ABF.

Additionally, in case of violation of Title II of Legislative Decree 11/2010, the holder may submit a report to the Bank of Italy.

Violations of payment services regulations, the Consolidated Banking Act, and Legislative Decree 27 January 2010, n. 11 may result in administrative sanctions, including monetary penalties, interdictory measures, and accessory sanctions (such as publication of imposed measures) against the Bank, its outsourced service providers, auditors, and management personnel.

Contract Language, Applicable Law, and Competent Court

The Contract is written in Italian and governed by Italian law.

If the Customer is a consumer, any dispute regarding the validity, effectiveness, interpretation, or execution of the Contract shall be exclusively under the jurisdiction of the court in the Customer's place of residence or domicile.

If the Customer is not a consumer, any dispute shall be exclusively under the jurisdiction of the Court of Milan.
