Samsung Galaxy Watch Pre-order Promotion Terms and Conditions

1. Organizer of the Promotion

The organizer of the "SAMSUNG GALAXY WATCH8, GALAXY WATCH8 CLASSIC AND GALAXY WATCH ULTRA (2025) PRE-ORDER PROMOTION" (hereinafter: "Promotion") is Samsung Electronics Magyar Zártkörűen Működő Részvénytársaság (branch office and correspondence address: 1138 Budapest, Dunavirág u. 2. 7th floor; company registration number: 16-10-001767; tax ID: 10276451-2-16; contact: https://www.samsung.com/hu/support/email/) (hereinafter: "Organizer").

The tasks related to the purchase and handover of the Promotion Products participating in the Promotion are carried out independently by the various Participating Stores, and the Organizer does not participate in these processes.

2. Eligibility Requirements

Only natural persons who are at least 18 years of age, have a place of residence or stay in Hungary, or are Hungarian citizens, and are legally capable (hereinafter: "Participant") can participate in the Promotion, provided they purchase one of the following products during the Promotion Period specified in Section 4.1 of these Terms:

• Samsung Galaxy Watch8
• Samsung Galaxy Watch8 Classic
• Samsung Galaxy Ultra (2025)
• smartwatch

(hereinafter collectively: "Promotion Participating Products", individually: "Promotion Participating Product")

Samsung Experience Store stores and online stores according to the following breakdown (hereinafter collectively: "SES Stores"). Only benefits 1, 2, 3, 4 specified in Annex 1 are available in the SES Stores.

If the Participant is a natural person aged 18 or over with limited legal capacity, they are only entitled to use the Benefits together with their legal representative, after the legal representative has proven their identity.

If the Participant is a natural person who is legally incapable and over 18 years of age, only their legal representative can act on their behalf, after the legal representative has proven their identity.

Further information on issues not regulated in these Terms can be requested from the Participating Stores. The Organizer expressly draws the attention of the Participants that the Participating Stores may differ in matters not regulated by these Terms.

The Organizer expressly draws the Participant's attention to the fact that the Benefits available in the individual Participating Stores may differ, about which the Participant can find information in these Terms and from the Participating Stores.

3. Subject of the Promotion

Within the framework of this Promotion, the Participant is entitled to choose from the 4 (four) Benefits specified in Annex 1 of these Terms (hereinafter: "Benefits" or individually: "Benefit"), and may become eligible for a bonus product (hereinafter: "Bonus Product") during the promotion period specified in Section 4.1 of these Terms, according to the conditions specified for the respective Benefit in Annex 1.

The Promotion is valid only for purchases made in the Participating Stores specified in Section 2.1.2. of these Terms and cannot be combined with other benefits or promotions.

The prices of the Promotion Participating Products may differ in the various Participating Stores. The Participant can inquire about the current price of the Promotion Participating Product from the Participating Store of their choice.

The Organizer can only ensure the Promotion to the extent of the stock of the Promotion Participating Products in the Participating Stores, according to the processes of the Participating Stores.

Benefits are non-transferable and cannot be exchanged for cash or other products.

The Organizer draws the Participant's attention to the fact that one (1) Participant can purchase a maximum of five (5) Promotion Participating Products under the conditions specified in these Terms.

Further information on issues not regulated in these Terms can be requested from the Participating Stores. The Organizer expressly draws the attention of the Participants that the Participating Stores may differ in matters not regulated by these Terms.

The Organizer and the Administrator disclaim liability for any defects or deficiencies of the Bonus Product, and do not provide warranty or guarantee for the Bonus Product, unless the exclusion of liability is expressly prohibited by Hungarian law.

4. Promotion Period

The duration of the Promotion is from July 9, 2025, 4:00 PM to July 24, 2025, 11:59 PM, or until the stock of Promotion Participating Products lasts, or until withdrawal (hereinafter: "Promotion Period"). The Participant can find more detailed information about the duration of the Benefits in Annex 1.

The Organizer expressly draws the Participants' attention to the fact that the Promotion Period may differ in the individual Participating Stores, about which the Participant can find information in Annex 1 of these Terms.

5. Prices and Collection/Delivery of Promotion Participating Products

The prices of the Promotion Participating Products may differ in the various Participating Stores. The Participant can inquire about the current price of the Promotion Participating Product from the Participating Store of their choice.

The time and method of collection or delivery of the Promotion Participating Products, and the rules related thereto, may differ in the various Participating Stores. The Participant can inquire about the method of collection or delivery of the Promotion Participating Products from the Participating Store of their choice.

6. Taxation, Costs

Any tax liability related to the Benefits shall be borne by the Organizer. The Organizer shall not be liable for anything other than providing the Benefits and settling their tax implications.

7. Personal Data

Information regarding data processing related to this Promotion can be found in the Organizer's data protection notice available at https://www.samsung.com/hu/legal/privacy/, or in the document titled "Data protection notice for the 'SAMSUNG GALAXY WATCH8, GALAXY WATCH8 CLASSIC AND GALAXY WATCH ULTRA (2025) PRE-ORDER PROMOTION'" (hereinafter: "Data Protection Notice").

For data processing during the purchase of Promotion Participating Products, the Organizer does not process personal data; data processing is carried out by the Participating Stores according to their respective data protection notices.

8. Miscellaneous Provisions

The Organizer shall not be liable for any failure or delay in providing the Benefits due to reasons beyond the Organizer's control, nor for any damage incurred during handover.

The Organizer reserves the right to modify the terms of the Promotion without justification, including the right to terminate the Promotion. The Organizer will publish information about such modifications in the same manner as other announcements related to the Promotion, and any modifications will be effective from the date of notification. Following the modification, Participants will be able to fully exercise their rights acquired up to the date of modification. Before participating in the Promotion, please read these terms and conditions carefully, paying particular attention to any modifications, to ensure you are always aware of the terms of the Promotion. Participation in the Promotion is voluntary. The limitations and exclusions of liability related to the Promotion apply to the extent permitted by applicable laws.

The Organizer excludes its liability for any external attacks, such as SQL attacks, on the Samsung online store or the server operating it. Therefore, if the Samsung online store or its server is attacked, resulting in Participants receiving incorrect system messages regarding the promotion, the Organizer shall not be liable for such cases.

The Organizer excludes its liability for malfunctions of the Samsung online store and the usability of the Benefits due to reasons beyond its control, during which time the website is not or is only partially accessible, however, it will take all necessary measures without delay to identify and rectify the cause of the error as soon as possible.

The Organizer reserves the right to exclude any Participant from the promotion with immediate effect if any (computerized) manipulation, mass creation of email addresses, or behavior that is incompatible with or violates the spirit of the Promotion is detected or reasonably suspected.

If the Participant closes the browser window before finalizing the purchase, or if the connection is interrupted for any reason with the hosting server, the Organizer shall not be liable for the loss of data.

The Organizer shall not be liable for the erroneous announcement of the Promotion if it occurs without its approval.

Furthermore, the Organizer shall not be liable for any non-pecuniary, indirect, or consequential damages, costs, expenses, including but not limited to loss of data, loss of revenue, loss of profit, loss of earnings, damage to commercial and other reputation, or loss thereof, or claims from third parties, incurred by the Participant or third parties in connection with or based on these Terms.

These Terms are governed by Hungarian law, and any legal disputes arising from participation in the Promotion shall fall under the exclusive jurisdiction of Hungarian courts, taking into account the restrictions set forth in the relevant legal provisions.

If any provision of these Terms is invalid, illegal, or unenforceable under Hungarian law, all other provisions of these Terms shall remain in full force and effect, and the invalid, illegal, or unenforceable provision (as long as it remains invalid, illegal, or unenforceable) shall be severed from these Terms. The Participant and the Organizer shall make every reasonable effort to replace the invalid, illegal, or unenforceable provision (severed) with a valid, legal, and enforceable provision that achieves the intended legal effect of the severed provision to the greatest extent possible.

Annex 1: Benefits

1. Benefit:

If the Participant purchases a 44 mm Samsung Galaxy Watch 8 smartwatch from SES and Media Markt stores or online stores during the Promotion Period, they will be eligible for one of the following Samsung fabric straps as a Bonus Product, subject to the availability of Promotion Participating Products or Bonus Products, or until withdrawal.

2. Benefit:

If the Participant purchases a 40 mm Samsung Galaxy Watch 8 smartwatch from SES and Media Markt stores or online stores during the Promotion Period, they will be eligible for one of the following Samsung fabric straps as a Bonus Product, subject to the availability of Promotion Participating Products or Bonus Products, or until withdrawal.

3. Benefit:

If the Participant purchases a Samsung Galaxy Watch 8 Classic smartwatch from SES, Media Markt stores or online stores, Samsung online store and Shop App, they will be eligible for a Samsung fabric strap as a Bonus Product, subject to the availability of Promotion Participating Products or Bonus Products, or until withdrawal.

4. Benefit:

If the Participant purchases a Samsung Galaxy Watch Ultra (2025) smartwatch from SES and Media Markt stores or online stores during the Promotion Period, they will be eligible for a Samsung Galaxy Watch Ultra trail strap as a Bonus Product, subject to the availability of Promotion Participating Products or Bonus Products, or until withdrawal.

Data Processing Information

2. Description of Data Processing and Data Processors

Samsung, as the data controller, processes the personal data of the participants (hereinafter: "Participant") for the purpose of carrying out the "SAMSUNG GALAXY WATCH8, GALAXY WATCH8 CLASSIC AND GALAXY WATCH ULTRA (2025) PRE-ORDER PROMOTION" (hereinafter: "Promotion"). Certain tasks related to the execution of the Promotion are carried out by MGCargo Márton és Gábor Kft., a logistics company commissioned by the Organizer (registered office: H-1094 Budapest, Mihalkovics u. 16.; company registration number: 01-09-566062; tax ID: 12218871-2-43; hereinafter: "Data Processor"). Such tasks include, for example: communication with the Participant and organizing the delivery of the Benefit to the Participant. Samsung, as the data controller, informs Participants that it may request the IMEI list of sold Promotion participating products from its retail partners, who act as data providers, to verify whether the Promotion participating product indicated for claiming the Benefit was indeed purchased. The Participating Stores process personal data provided during device purchase in accordance with their respective data processing notices.

3. Legal Basis for Data Processing

The legal basis for data processing is Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, "GDPR"), as the data processing is necessary for the performance of a contract (the Promotion) to which the Participant is party.

4. Categories of Data Processed

Samsung processes the following data of Participants in connection with the Promotion:

• Participant's full name;
• Participant's date of birth (to verify that the Participant is over 18 years of age);
• Participant's address or postal address;
• Participant's phone number;
• Copy of the invoice proving the purchase of the Promotion Participating Product, which may include the following data in addition to the above:
• Invoice number and issue date proving the purchase of the Promotion participating product;
• Name and address of the retail unit where the Participant purchased the Promotion Participating Product;
• Name, identification number, and quantity of the Promotion participating product, IMEI number, model code, serial number, net and gross purchase price;
• Time of purchase of the Promotion Participating Product.

5. Persons Authorized to Access Data

Individuals involved in the execution of the Promotion within Samsung and the Administrator organization can access personal data.

6. Data Transfer to Third Countries and Automated Decision-Making

• Personal data of Participants are not transferred to data controllers or data processors in third countries.
• Samsung does not perform automated decision-making, including profiling, with the personal data of Participants.

7. Rights and Legal Remedies Related to Data Processing

Data Protection Rights and Legal Remedies

The rights and legal remedies of data subjects are detailed in the relevant provisions of the GDPR (specifically, Articles 15, 16, 17, 18, 19, 20, 21, 22, 77, 78, 79, 80, and 82 of the GDPR). The following summary outlines the most important provisions, and Samsung provides information to data subjects regarding their rights and legal remedies related to data processing accordingly. Samsung shall inform the data subject without undue delay, and in any event within one month of receipt of the request for the exercise of data subject rights (see Articles 15-22 of the GDPR), about the actions taken in response to the request. If necessary, taking into account the complexity of the request and the number of requests, this deadline may be extended by a further two months. Samsung will inform the data subject about the extension of the deadline within one month of receipt of the request, stating the reasons for the delay.

Samsung will provide the information requested by the data subject in writing, or electronically if the data subject submitted the request electronically. Oral information may also be provided to the data subject, provided that the data subject proves their identity to Samsung.

Right of Access

(1) The data subject has the right to receive confirmation from Samsung as to whether or not their personal data are being processed. If such data processing is ongoing, the data subject has the right to access the personal data and the following information:

• a) the purposes of the data processing;
• b) the categories of personal data concerned;
• c) the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
• d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
• e) the right of the data subject to request from the controller rectification, erasure or restriction of processing of personal data relating to him or her or to object to such processing;
• f) the right to lodge a complaint with a supervisory authority;
• g) where the personal data are not collected from the data subject, any available information as to their source;

(2) Where personal data are transferred to a third country, the data subject shall have the right to be informed of the appropriate safeguards relating to the transfer.

(3) Samsung shall make a copy of the personal data undergoing processing available to the data subject. Samsung may charge a reasonable fee based on administrative costs for further copies requested by the data subject. If the data subject has requested the information electronically, the information shall be provided in a commonly used electronic format, unless the data subject requests otherwise.

Right to Rectification

The data subject has the right to obtain from Samsung without undue delay the rectification of inaccurate personal data concerning him or her. In addition, taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

Right to Erasure ('right to be forgotten')

(1) The data subject shall have the right to obtain from Samsung the erasure of personal data concerning him or her without undue delay, and Samsung shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

• a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
• b) the data subject withdraws consent to the processing, and where there is no other legal ground for processing;
• c) the data subject objects to the processing pursuant to Article 21(1) and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2);
• d) the personal data have been unlawfully processed;
• e) the personal data have to be erased for compliance with a legal obligation to which Samsung is subject under Union or Member State law;
• f) the personal data have been collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR.

(2) If Samsung has made the personal data public and is obliged pursuant to paragraph 1 to erase the personal data, Samsung, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform the controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

(3) Paragraphs (1) and (2) shall not apply to the extent that processing is necessary:

• a) for exercising the right of freedom of expression and information;
• b) for compliance with a legal obligation which requires processing by Union or Member State law to which Samsung is subject;
• c) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1) in so far as the right referred to in paragraph 1 is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
• d) for the establishment, exercise or defence of legal claims.

Right to Restriction of Processing

(1) The data subject shall have the right to obtain from Samsung the restriction of processing where one of the following applies:

• a) the accuracy of the personal data is contested by the data subject, for a period enabling Samsung to verify the accuracy of the personal data;
• b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use;
• c) Samsung no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims; or
• d) the data subject has objected to processing pursuant to Article 21(1) pending the verification whether the legitimate grounds of Samsung override those of the data subject.

(2) Where processing has been restricted under paragraph 1, such personal data shall, with the exception of storage, only be processed with the data subject's consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

(3) Samsung shall inform the data subject before the restriction of processing is lifted.

Obligation to Notify Regarding Rectification, Erasure, or Restriction of Processing of Personal Data

Samsung shall communicate any rectification or erasure of personal data or restriction of processing carried out in accordance with Article 16, Article 17 or Article 18 to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. Samsung shall inform the data subject about these recipients if the data subject requests it.

Right to Object

(1) The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on legitimate interests of Samsung. In this case, Samsung shall cease to process the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

(2) Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.

(3) If the data subject objects to the processing of personal data for direct marketing purposes, the personal data shall no longer be processed for such purposes.

(4) In connection with the use of information society services and deviating from Directive 2002/58/EC, you may exercise your right to object using automated processes based on technical specifications.

(5) Where personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89(1), the data subject shall have the right to object, on grounds relating to his or her particular situation, to processing of personal data concerning him or her, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

Right to Lodge a Complaint with a Supervisory Authority

The data subject shall have the right to lodge a complaint with a supervisory authority – in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement – if the data subject considers that the processing of personal data concerning him or her infringes the GDPR. Right to an Effective Judicial Remedy Against a Supervisory Authority

(1) The data subject shall have the right to an effective judicial remedy against a legally binding decision of a supervisory authority concerning him or her.

(2) The data subject shall have the right to an effective judicial remedy if the competent supervisory authority does not handle the complaint or does not inform the data subject within three months about the progress or outcome of the procedure concerning the complaint lodged.

(3) Proceedings against a supervisory authority shall be instituted before the courts of the Member State in which the supervisory authority has its seat.

Right to an Effective Judicial Remedy Against Samsung or the Data Processor

(1) The data subject shall have the right to an effective judicial remedy, without prejudice to any other administrative or non-judicial remedy available, including the right to lodge a complaint with a supervisory authority, if he or she considers that his or her rights have been infringed as a result of the processing of personal data not complying with the GDPR.

(2) Proceedings against Samsung or the data processor shall be instituted before the courts of the Member State in which Samsung or the data processor has its seat. Such proceedings may also be instituted before the courts of the Member State of the data subject's habitual residence.
