Samsung Galaxy S25, S25+, S25 Ultra, and A36 Promotion: July Card Rebate

This document outlines the terms and conditions for the "Galaxy S25, S25+, S25 Ultra, and A36 Promotion - July Card Rebate" (hereinafter referred to as the "Promotion").

§ 1. Definitions

The terms used in these Regulations and written in capital letters have the following meanings:

  1. Product Activation: The activation of the Product with a Polish telecommunications provider's SIM card for at least 5 minutes and acceptance of the End-User License Agreement (EULA).
  2. Organizer: Samsung Electronics Polska spółka z ograniczoną odpowiedzialnością, located in Warsaw (ul. Postępu 14, 02-676 Warszawa), registered in the National Court Register under KRS number 0000128080, NIP 526-10-44-039, REGON 011612810, with a share capital of PLN 52,759,500.
  3. SSCE: Samsung Electronics Romania S.R.L., registration number J40/7668/2012, VAT: RO 22694272, located at Sos. Bucuresti-Ploiesti, 172-176, building A, Bucharest, district 1, postal code 015016, acting on behalf of the Organizer to support the Promotion.
  4. Smolar: Smolar Agencja Promocyjno-Reklamowa spółka z ograniczoną odpowiedzialnością, located at ul. Inżynierska, nr 15, Łódź, postal code 93-569, registered in the National Court Register under number 0000444211, with a share capital of PLN 10,000, NIP: 7272788075, REGON: 101524274, acting on behalf of the Organizer to support the Promotion (and also acting as a data processor for the Organizer), including in the scope of handling the complaint process.
  5. Planet Pay: Planet Pay spółka z ograniczoną odpowiedzialnością, located in Warsaw (ul. Jutrzenki 139, 02-231 Warszawa), registered in the National Court Register under number 0000427567, with a share capital of PLN 9,676,750.00, NIP: 6793083313, REGON: 122603652, holding a license to operate as a national payment institution, acting as an entity authorized to issue and service Cards.

All activities performed by Planet Pay in relation to the Customer, which are related to the Promotion, are performed by Planet Pay to conclude or based on the Card Agreement concluded with the Customer. These activities are performed as Planet Pay's own contractual or statutory obligations. In no case, in performing the aforementioned activities, is Planet Pay a subcontractor of the Organizer, which in particular means that Planet Pay is responsible for the faulty performance of its own obligations.

6. Point of Sale: Also referred to as a Partner Handlowy; a point of sale (physical or online) operated by or belonging to:

7. Product: Smartphone: Samsung Galaxy S25 Ultra, S25+, S25, A36.

8. Promotion: The availability of Products and their retail prices depend on the individual offers of Partner Handlowy; the promotion under the name "Galaxy S25, S25+, S25 Ultra and A36 Promotion - July Card Rebate", conducted according to the principles and conditions described in these Regulations.

9. Regulations: These regulations, which the Customer can familiarize themselves with on the Promotion Website.

10. Promotion Website: The promotion website available at: galaxyzwrot.samsung.pl

11. Product Activation Period: From 14.07.2025 to 03.08.2025, 23:59.

12. Registration Period: In the promotional form: from 14.07.2025 to 10.08.2025, 23:59; in the Samsung Card Rebate application: from 14.07.2025 to 10.09.2025, 23:59.

13. Purchase Period: From 14.07.2025 to 27.07.2025, 23:59 (being the date and time of order submission to the online store server of the Point of Sale or purchase at the Point of Sale, indicated on the proof of purchase).

14. Participant/Customer: (i) an adult individual with full legal capacity; (ii) who has purchased the Product from a Partner Handlowy (under the conditions specified in these Regulations); (iii) who possesses a valid Polish identity card, and also (iv) who has read these Regulations and accepted their provisions and fulfilled all conditions specified therein. A legal entity cannot be a Participant.

15. Card Rebate: A one-time bonus financed by the Organizer in the form of a monetary amount, as specified in § 5 para. 1 of the Regulations, which credits the Card. The Customer can use the funds on the Card and make transactions with it on the terms specified in these Regulations, the Card Agreement, and the documents attached to it. The Customer is advised of the rules and restrictions related to the use of the Card, as specified in particular in §1 point 16 of the Regulations, § 4 of the Card Agreement, and chapter 4 §2 of the Regulations for Issuing and Servicing Cards, which is an attachment to the Card Agreement. One Participant may receive a maximum of one Card Rebate in the Promotion for the purchase of a given Product model (in the case of purchasing, for example, 3 Galaxy A36 models, they may receive a maximum of one Rebate).

In the case described in § 6 para. 3 of the Regulations (failure to pass the KYC process by the Customer), the Organizer will disburse funds corresponding to the amount of the Card Rebate on the terms specified in § 6 para. 3-4 of the Regulations.

16. Card: A virtual payment card, credited with an amount equivalent to the Card Rebate, a VISA payment card, issued and serviced by Planet Pay based on the Card Agreement. The validity period of the Card is 11 months from the date of concluding the Card Agreement, effective at the end of the calendar month. The Card is credited once by the Organizer with the equivalent of the Card Rebate. It is not possible to re-credit the Card or withdraw cash. Except for the situation described in the next paragraph, it is also not possible to transfer funds available on the Card to a bank account. Unused funds on the Card will be paid by Planet Pay to the Customer (if a Card Agreement has been concluded) to the bank account indicated by the Customer - on the terms specified in the Card Agreement and in § 6 para. 1-2 of the Regulations.

17. Card Agreement: An agreement for the issuance of a Card concluded between the Customer and Planet Pay, the template of which the Customer can find on the Website. The conclusion of the aforementioned agreement is necessary to receive the Card Rebate, subject to the case described in § 6 para. 3-4 of the Regulations. To conclude the aforementioned agreement, the Customer must perform the following steps: a) install the Samsung Card Rebate Application; b) provide the correct Activation Code; c) familiarize themselves with the content of these Regulations and the Card Agreement and the attached documents and accept their content; d) provide personal data (including PESEL number; identity card series and number; identity card expiry and issue date); e) successfully pass the KYC process.

18. Members Application: The Samsung Members mobile application, through which the Customer registers for the Promotion.

19. Samsung Card Rebate Application: A free mobile application available for download from the Google Play Store and Galaxy Store, provided by Planet Pay. Through it, the Customer can, in particular: a) undergo the KYC Process, b) be provided with the Card, c) tokenize the Card in the Google Wallet. The rules for installing and using the Samsung Card Rebate Application are described in the Regulations of the "SAMSUNG CARD REBATE" Mobile Application available on the Promotion Website.

20. KYC Process: ("Know Your Customer") a set of procedures carried out by Planet Pay to conclude the Card Agreement, in fulfillment of Planet Pay's obligations arising from the Act of March 1, 2018, on counteracting money laundering and terrorist financing. The description of these activities is available in the Card Agreement. If the KYC process is not successfully completed, the Card will not be issued to the Customer.

21. Google Wallet: A mobile application in the form of a digital wallet, through which the Customer has access to the Card and can make mobile payments using the Google Pay service.

22. Promotional Form: An online form to which the Customer is redirected from the Samsung Members Application, which they fill out to obtain an individual promotional code entitling them to receive the Card Rebate. After filling out the Promotional Form and successful verification of the purchase of the Device, the Customer receives an individual promotional code via email, which allows them to later fill out the Card Rebate Form in the Samsung Card Rebate Application and receive the Benefit in the form of a Card Rebate. Verification of the application takes up to 21 calendar days.

23. Card Rebate Form: A form available in the Samsung Card Rebate Application, where the Customer provides the individual promotional code and undergoes the KYC Process required to receive the Card Rebate.

24. Promotional Code: An email code received after successful verification of the application in the Promotional Form, which the Customer enters into the Samsung Card Rebate Application, entitling them to conclude the Card Agreement.

§ 2. General Provisions

  1. The Regulations define:
    • the purpose of the Promotion;
    • the duration of the Promotion;
    • the conditions for participation in the Promotion;
    • the method of submitting complaints related to participation in the Promotion.
  2. The purpose of the Promotion is to promote the Products indicated in the Regulations and to make card payments using the Products.
  3. The Promotion consists of granting Participants, who have met all the conditions specified in the Regulations, a Card Rebate.
  4. The Promotion is conducted in the territory of the Republic of Poland.
  5. The Promotion is conducted in the period from 14.07.2025 to 27.07.2025, 23:59 (Purchase Period).
  6. The Promotion schedule is as follows:
    • Period for Product Purchase: as defined in § 1 para. 13 above;
    • Period for Product Activation: as defined in § 1 para. 11 above;
    • Promotion registration: as defined in § 1 para. 12 above;
    • Promotional codes are received up to 21 days after positive verification of the application in the promotional form;
    • The Card Agreement may be concluded after receiving the promotional code;
    • Submission of complaints related to the Promotion is recommended: by 24.10.2025. Failure to meet this deadline does not deprive the consumer of rights granted by law;
    • Submission of complaints related to Cards, payment transactions, withdrawal of funds to the Customer's bank account in cases specified in § 6 para. 1-2 of the Regulations and the Samsung Card Rebate Application, takes place on the terms specified in the Card Agreement and the regulations of the Samsung Card Rebate Application.
  7. Participants who meet the following conditions may participate in the Promotion:
    • Purchase the Product at a Point of Sale during the Purchase Period;
    • Have a Samsung Account in the Members Application;
    • Activate the Product during the Product Activation Period;
    • Fill out the Promotional Form after logging into the Samsung Members Application and accept the Regulations;
    • Successfully pass the KYC Process in the Samsung Card Rebate Application;
    • Conclude the Card Agreement with Planet Pay in the Samsung Card Rebate Application;
    • Meet other conditions specified in the Regulations.

§ 3. Product Purchase Covered by the Promotion

  1. The Product submitted for the Promotion must be purchased by the Participant during the Purchase Period at a Point of Sale. The rules for selling the Product, including its retail price, are determined entirely by the Point of Sale.
  2. The Participant forfeits the right to participate in the Promotion and the Card Rebate in case of exercising the statutory or contractual (granted by the Product seller) right of withdrawal from the Product sales agreement. A Participant who has registered for the Promotion and subsequently withdraws from the Product sales agreement is requested to report this to the Organizer at the email address zwrot@promo.smolar.pl.

§ 4. Promotion Registration

  1. Participant registration for the Promotion takes place via the Samsung Members Application and the Samsung Card Rebate Application.
  2. To register for the Promotion, the Participant must:
    • activate the Product during the Activation Period;
    • create an account/log in to the Samsung Members Application on the Product during the Registration Period;
    • by 10.08.2025, fill out the Promotional Form available after logging into the Samsung Members application and attach the Device proof of purchase and the Product order confirmation for the Promotion, and then after positive verification of the application:
    • by 10.09.2025, enter the Activation Code in the Samsung Card Rebate Application and accept the Promotion Regulations in the Samsung Card Rebate Application. To conclude the Card Agreement with Planet Pay, you must complete the form in the Samsung Card Rebate Application with your personal data and submit all declarations required by Planet Pay (including within the KYC Process). Providing incorrect, inaccurate, or incomplete personal data may result in disqualification from the Promotion.
    • After 14 days from the moment of successful verification, you will have the possibility of mobile payments via the Card in the Google Wallet.
  3. The condition for participation in the Promotion for Participants who do not have a Samsung Account is to create a Samsung Account by filling out the registration form, available at https://account.samsung.com/ or via the Members Application. The Customer is obliged to provide true and up-to-date personal data during the Samsung Account registration process. Providing incorrect, inaccurate, or incomplete personal data may result in the inability to receive the Card and participate in the Promotion.
  4. To activate the Product, it is necessary to run the Product in Poland with an active SIM card of a Polish operator and have access to the Internet or mobile network. Product activation is free of charge, except that it does not include the costs of connection to the Internet network used by the Customer. Internet connection costs correspond to the rates of the network operator used by the Customer.
  5. The Participant is obliged to provide true and complete data.
  6. In case of withdrawal from the agreement for the purchased Product (exercising the statutory or contractual right of withdrawal granted by the seller), the Participant is obliged to immediately inform the Organizer via email at: zwrot@promo.smolar.pl and return the Benefits received within the Promotion.
  7. Based on the data provided by the Participant in the application, Smolar will verify the correctness of the applications submitted using the Promotional Form. Applications sent after the deadline for Promotion registration, incorrect, incomplete, not in accordance with the Regulations, containing incorrect data or illegible, or unclear scans/photos of the Proof of Purchase, not containing the proof of Product order in the Promotion, will disqualify the possibility of receiving Benefits.
  8. Smolar has the right to additional verification of applications, which in specific cases may require re-submission to the promotion (filling out the form) or sending additional documents and data. Smolar also has the right, for example, to request the presentation of the original document confirming the Product purchase. In case of the need for additional verification of the application, Smolar will notify the Participant via email. The Participant will be obliged to provide the requested documents or data within 5 (five) business days from the date of receiving the request at the email address: zwrot@promo.smolar.pl (applies to the Promotional Form). In case of failure to provide explanations by the Participant within the deadline, the Organizer will exclude the Participant from the Promotion.
  9. Smolar will verify the submitted applications no later than within 21 calendar days from the date of receipt of the application on the server handling the traffic of applications.
  10. The Organizer will request the Participant to supplement formal deficiencies in the Form only once. In the case of supplementing the deficiencies within the deadline, the result of the re-verification will be communicated to the Participant within 7 business days via email, to the address indicated in the Form.

§ 5. Card Rebate

  1. Subject to the remaining provisions of the Regulations, including § 4 para. 2, the Participant who meets all the conditions specified in the Regulations will receive a Card Rebate in the amount indicated in the table below:

2. Providing incorrect data by the Participant may result in the inability or delay in issuing the Card.

3. Customer participation in the Promotion is voluntary. Anyone who has participated in the Promotion has the full right to withdraw from participation in it at their own discretion and without incurring any costs.

4. Pursuant to art. 21 para. 1 item 68 of the Act of July 26, 1991 on personal income tax (Journal of Laws 2022.2647 item, as amended), the value of prizes related to sales promotion of goods or services is exempt from income tax - if the single value of these winnings or prizes does not exceed PLN 2,000, provided that the exemption from tax on prizes related to sales promotion of goods or services does not apply to prizes received by the taxpayer in connection with their non-agricultural business activity, which constitute income from this activity.

§ 6. Payout to Customer's Bank Account

  1. In the case of:
    • expiration of the Card's validity period; or
    • premature termination of the Card Agreement (due to its termination)
    - subject to point 2 below, Planet Pay will pay the Customer to the bank account indicated by the Customer any unused funds on the Card.
  2. To receive the payout referred to in point 1 above, after 10 months from the conclusion of the Card Agreement, an option to provide the Customer's bank account number will appear in the Samsung Card Rebate Application menu - the Customer should then provide their current bank account number in the Samsung Card Rebate Application and give consent for the payout (if required by law at the time of payout). The payout is made by Planet Pay within 14 days from the expiry of one year from the date of concluding the Card Agreement.
  3. In the event of the Customer failing the KYC Process:
    • despite the Customer's due diligence in this regard, which means providing all data and documents required by Planet Pay within the deadlines set by Planet Pay and despite this obtaining a negative decision regarding the conclusion of the Card Agreement, or
    • due to the Customer not having the documents required to pass the KYC Process (regarding the lack of a valid identity card) - subject to point 4 below, the Customer who: i) has met the conditions for participation in the Promotion specified in these Regulations, except for successfully passing the KYC Process and concluding the Card Agreement, and ii) has submitted a complaint regarding not passing the KYC Process in accordance with § 7 of the Regulations and the complaint has been positively considered, the Organizer will pay to the bank account indicated by the Customer funds corresponding to the amount of the Card Rebate specified in § 5 para. 1 of the Regulations. The Organizer draws attention to the fact that for the proper consideration of the complaint, it may be necessary to ask the Organizer to obtain information from Planet Pay regarding the circumstances of the Customer not passing the KYC Process, which, however, may only take place with the explicit and prior consent of the Customer.
  4. To receive the payout referred to in point 3 above, the Customer should fill out the application form provided by Smolar and give consent for the payout (if required by law at the time of payout). The payout is made by the Organizer within the following period:
    • in the case of Customers whose complaint was submitted and positively considered before the end of Registration in the Samsung Card Rebate Application, i.e., before 10.09.2025 (according to § 1 para. 13 of the Regulations), the payout will take place within 21 days from the end of Registration, and in the case of Customers whose complaint was submitted and positively considered after the end of Registration in the Samsung Card Rebate Application, i.e., after 10.09.2025 (according to § 1 para. 13 of the Regulations), the payout of funds will take place within 21 days from the date of positive consideration of the complaint.

§ 7. Complaints and Inquiries Regarding the Promotion

  1. The Participant is guaranteed the right to obtain information about the Promotion and the right to submit a complaint.
  2. Complaints and inquiries related to the Promotion may be submitted to the Organizer.
  3. The complaint should contain data enabling the identification of the Customer. To ensure the complaint process runs smoothly, please also indicate the circumstances justifying the complaint and the proof of purchase (in paper or scanned form).
  4. Complaints and inquiries related to the Promotion should be submitted to the Organizer within the recommended period by 24.10.2025 (however, the Organizer recommends submitting complaints as soon as possible) in the following forms: in writing to the address: Smolar Agencja Promocyjno-Reklamowa sp. z o.o., ul. Inżynierska, nr 15, 93–569 Łódź, with the note "Promocja Galaxy S25, S25+, S25 Ultra oraz A36 – lipcowy zwrot na kartę"; via electronic mail to the address: zwrot@promo.smolar.pl; in person at the address: Smolar Agencja Promocyjno-Reklamowa sp. z o.o., ul. Inżynierska, nr 15, 93-569 Łódź.
  5. In case of any questions regarding the Promotion or any problems related to the Promotion registration, please contact us by email at: zwrot@promo.smolar.pl. The Organizer will make every effort to enable the Customer to take advantage of the Promotion.
  6. The Organizer will consider and respond to the complaint on paper or another durable medium within 14 days of its receipt.
  7. The deadline for submitting a complaint, which is provided for in the Regulations, does not exclude or limit the rights granted to the Participant by law, in particular by the provisions on the statute of limitations for claims.
  8. The complaint procedure does not exclude or limit the Participant's right to pursue their rights before common courts.

§ 8. Complaints Related to Payment Transactions, Cards, Fund Payouts, and the Samsung Card Rebate Application

  1. Complaints related to payment transactions initiated by the Card, payouts of funds to the Customer's bank account in cases specified in § 6 para. 1-2 of the Regulations, and the operation of the Samsung Card Rebate Application should be submitted to Planet Pay, on the terms resulting from the Card Agreement (and the documents attached to it) and the Regulations of the Samsung Card Rebate Application.
  2. The Customer can submit a complaint to Planet Pay in one of the following ways:
    • in writing – in person using a form at Planet Pay's registered office or by post to the registered office address of Planet Pay or to the address of the Complaint Service Team, ul. Szosa Zambrowska 100, 18-400 Łomża, or
    • verbally by phone to the BOK Consultant at +86 216 13 68 (fee according to the operator's price list), or
    • in person to the protocol at Planet Pay's registered office, or
    • electronically to Planet Pay's email address: reklamacje.kartowe@planetpay.pl

§ 9. Personal Data Protection

  1. The administrator of Customers' personal data is Samsung Electronics Polska Sp. z o.o. with its registered office in Warsaw (address: ul. Postępu 14, 02-676 Warszawa) (in the scope of participation in the Promotion and consideration of complaints).
  2. The Organizer processes Customers' personal data in connection with participation in the Promotion (in the scope of participation in the Promotion and consideration of complaints) for the following purposes:
    • organization and conduct of the Promotion; including: organization and conduct of the Promotion, communication with Participants, awarding prizes (the legal basis for processing is the legitimate interest of the administrator – art. 6 para. 1 lit. f RODO);
    • consideration of complaints (the legal basis for processing is the legitimate interest of the administrator – art. 6 para. 1 lit. f RODO);
    • purposes related to the Organizer fulfilling legal obligations, including tax and accounting obligations (the legal basis for processing is the necessity of data for fulfilling a legal obligation incumbent on the administrator – art. 6 para. 1 lit. c RODO);
    • for the purpose of defense against potential claims or for pursuing potential claims (the legal basis for processing is the legitimate interest of the administrator – art. 6 para. 1 lit. f RODO);
    • for marketing purposes, including the promotion of goods and services and products and services of the Organizer's business partners. The legal basis for processing personal data for marketing purposes is the legitimate interest of the administrator (art. 6 para. 1 lit. f RODO) consisting in conducting marketing activities.
  3. As part of marketing activities, the Organizer may send Customers messages containing information about new products or services. Sending the above information may take place only if Users have given separate consent for marketing communication, which may be withdrawn at any time. Withdrawal of consent is possible by contacting Samsung or via the link included in each electronic message containing marketing communications.
  4. In connection with the processing of Participants' personal data for the purposes indicated in point 2, personal data may be made available to the following recipients or categories of recipients:
    • entities from the Samsung capital group,
    • entities supporting the Organizer in its business processes, including entities processing personal data on behalf of the Organizer (so-called data processors) and Samsung business partners, e.g., entities providing accounting and bookkeeping services, IT services, and transport companies for the Organizer;
    • public administration bodies and entities performing public tasks or acting on behalf of public administration bodies, to the extent and for the purposes resulting from legal provisions.
  5. For the purpose of handling the Promotion and considering any complaints, the Organizer has entrusted the processing of Participants' personal data to Smolar, SSCE, and
  6. for the purpose of handling the Promotion in the scope of sending mailings of prizes or access codes to the service to Smolar (as a data processor for the Organizer).
  7. Samsung will store Participants' personal data for the duration of the Promotion and for the period necessary to fulfill the Organizer's legal obligations. The period of storing Participants' personal data may be extended each time by the period of limitation of claims (subject to the deadlines provided for by tax law).
  8. Participants have the right to: access data, rectify it, erase it, or restrict its processing, and to object to the processing of data due to their particular situation. Samsung ensures the exercise of these rights to the extent resulting from art. 15-22 of the RODO. The Participant has the option to submit a request to exercise the rights referred to above by filling out the form available at samsung.pl, in accordance with the instructions available on the aforementioned website.
  9. To the extent that the Participant has consented to the processing of personal data, they have the right to withdraw their consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. The Participant has the option to submit a request to exercise the right to withdraw consent by filling out the form available on samsung.pl, in accordance with the instructions available on the aforementioned website.
  10. In cases justified by corporate requirements, Samsung may transfer personal data outside the European Economic Area (EEA). In such cases, we guarantee that a similar level of data protection in the third country is ensured by introducing one of the following safeguards:
    • personal data transfer takes place to countries that the European Commission has recognized as ensuring an adequate level of personal data protection;
    • we use appropriate contracts approved by the European Commission or rely on binding corporate rules that guarantee the security of personal data of the Participant.
  11. As part of exercising the Participant's rights, the Organizer also provides the possibility of obtaining copies of appropriate safeguards for personal data or information about their location; in the case of transfer of data to third countries.
  12. The Participant has the right to lodge a complaint with the competent supervisory authority, which is the President of the Personal Data Protection Office.
  13. Personal data is provided by Participants voluntarily, but providing the data is necessary to participate in the Promotion.

  15. Profiling is understood as any form of automated processing of personal data, which consists of using it to prepare and send personalized services/offers, tailored to the Participant's needs. Participant data will be profiled only.

Annex No. 2 to the Promotion Regulations

"Galaxy S25, S25+, S25 Ultra and A36 Promotion - July Card Rebate" - Rules for Granting the "Card Rebate up to PLN 1400" Benefit ("Annex to the Promotion Regulations")

§ 1. Definitions

The terms used in this Annex to the Promotion Regulations and written in capital letters have the following meanings:

  1. Product Activation: Activation of the Product, acceptance of the End-User License Agreement (EULA).
  2. Organizer: Samsung Electronics Polska spółka z ograniczoną odpowiedzialnością, located in Warsaw (ul. Postępu 14, 02-676 Warszawa), registered in the National Court Register...
  3. Planet Pay: Planet Pay spółka z ograniczoną odpowiedzialnością, located in Warsaw (ul. Jutrzenki 139, 02-231 Warszawa), registered in the National Court Register... with a share capital of PLN 9,676,750.00, NIP: 6793083313, REGON: 122603652, holding a license to operate as a national payment institution, acting as an entity authorized to issue and service Cards.

All activities performed by Planet Pay in relation to the Customer, which are related to the Promotion, are performed by Planet Pay to conclude or based on the Card Agreement concluded with the Customer. These activities are performed as Planet Pay's own contractual or statutory obligations. In no case, in performing the aforementioned activities, is Planet Pay a subcontractor of the Organizer, which in particular means that Planet Pay is responsible for the faulty performance of its own obligations.

4. Point of Sale: The meaning given in the Promotion Regulations.

5. Promotion Regulations: The promotion regulations under the name "Galaxy S25, S25+, S25 Ultra and A36 Promotion - July Card Rebate" conducted in the period from 14.07.2025 - 27.07.2025 (sales dates).

6. Product: Smartphone: Samsung Galaxy S25 Ultra, S25+, S25, A36 - Product availability and their retail prices depend on the individual offers of Partner Handlowy.

7. Promotion: The promotion under the name "Galaxy S25, S25+, S25 Ultra and A36 Promotion - July Card Rebate", conducted according to the principles and conditions described in the Promotion Regulations and this Annex to the Promotion.

8. Annex to the Regulations: These Regulations, which the Customer can familiarize themselves with on the Promotion Website.

9. Registration Period (in the Samsung Card Rebate application): From 14.07.2025 – 10.09.2025.

10. Purchase Period: The meaning given in the Promotion Regulations (being the date and time of order submission to the online store server of the Point of Sale or purchase at the Point of Sale, indicated on the proof of purchase).

11. Participant/Customer: (i) an adult individual with full legal capacity; (ii) who has purchased the Primary Product and Additional Product from a Partner Handlowy (under the conditions specified in the Promotion Regulations and this Annex to the Promotion Regulations); (iii) and who has also familiarized themselves with the content of the Promotion Regulations and this Annex to the Promotion Regulations and accepted their provisions and fulfilled all conditions specified therein. A legal entity cannot be a Participant.

12. Card Rebate (Card Rebate for mobile payments): A one-time bonus financed by the Organizer in the form of a monetary amount, as specified in § 4 para. 1 of the Annex to the Promotion Regulations, which credits the Card. The Customer can use the funds on the Card and make transactions with it on the terms specified in this Annex to the Promotion Regulations, the Card Agreement, and the documents attached to it. The Customer is advised of the rules and restrictions related to the use of the Card, as specified in particular in § 1 point 16 of the Annex to the Promotion Regulations, § 4 of the Card Agreement, and chapter 4 § 2 of the Regulations for Issuing and Servicing Cards, which is an attachment to the Card Agreement. One Participant may receive a maximum of one Card Rebate in the Promotion for the purchase of a given Product model (in the case of purchasing, for example, 3 Galaxy A36 models, they may receive a maximum of one Rebate). In the case described in § 5 para. 3 of the Annex to the Promotion Regulations (failure to pass the KYC process by the Customer), the Organizer will disburse funds corresponding to the amount of the Card Rebate on the terms specified in § 5 para. 3-4 of the Annex to the Promotion Regulations.

13. Card (Card for mobile payments): A virtual payment card, credited with an amount equivalent to the Card Rebate, a VISA payment card, issued and serviced by Planet Pay based on the Card Agreement. The validity period of the Card is 11 months from the date of concluding the Card Agreement, effective at the end of the calendar month. The Card is credited once by the Organizer with the equivalent of the Card Rebate. It is not possible to re-credit the Card or withdraw cash. Except for the situation described in the next paragraph, it is also not possible to transfer funds available on the Card to a bank account. Unused funds on the Card will be paid by Planet Pay to the Customer (if a Card Agreement has been concluded) to the bank account indicated by the Customer - on the terms specified in the Card Agreement and in § 5 para. 1-2 of the Annex to the Promotion Regulations.

14. Card Agreement: An agreement for the issuance of a Card concluded between the Customer and Planet Pay, the template of which the Customer can find on the Website. The conclusion of the aforementioned agreement is necessary to receive the Card Rebate, subject to the case described in §5 para. 3-4 of the Annex to the Promotion Regulations. To conclude the aforementioned agreement, the Customer must perform the following steps: a) install the Samsung Card Rebate Application; b) provide the correct Activation Code; c) familiarize themselves with the content of this Annex to the Promotion Regulations and the Card Agreement and the attached documents and accept their content; d) provide personal data (including PESEL number; identity card series and number; identity card expiry and issue date); e) successfully pass the KYC process.

15. Samsung Card Rebate Application: A free mobile application available for download from the Google Play Store and Galaxy Store, provided by Planet Pay. Through it, the Customer can, in particular: a) undergo the KYC Process, b) be provided with the Card, c) tokenize the Card in the Google Wallet. The rules for installing and using the Samsung Card Rebate Application are described in the Regulations of the "SAMSUNG CARD REBATE" Mobile Application available on the Promotion Website.

16. KYC Process: ("Know Your Customer") a set of procedures carried out by Planet Pay to conclude the Card Agreement, in fulfillment of Planet Pay's obligations arising from the Act of March 1, 2018, on counteracting money laundering and terrorist financing. The description of these activities is available in the Card Agreement. If the KYC process is not successfully completed, the Card will not be issued to the Customer.

17. Google Wallet: A mobile application in the form of a digital wallet, through which the Customer has access to the Card and can make mobile payments using the Google Pay service.

18. Promotional Code: An individual activation code that the Customer receives after filling out the Promotional Form and successful verification, necessary for entering into the Samsung Card Rebate Application, entitling them to conclude the Card Agreement.

19. Smolar: Smolar Agencja Promocyjno-Reklamowa spółka z ograniczoną odpowiedzialnością, located at ul. Inżynierska, nr 15, Łódź, postal code 93-569, registered in the National Court Register... acting on behalf of the Organizer to support the Promotion (and also acting as a data processor for the Organizer), including in the scope of handling the complaint process.

§ 2. General Provisions

  1. The Annex to the Promotion Regulations defines:
    • conditions for receiving the Card Rebate;
    • the method of submitting complaints related to the Card Rebate benefit.
  2. Participants who meet the following conditions may receive the Card Rebate benefit:
    • Purchase the Primary Product at a Point of Sale during the Purchase Period;
    • Have a Samsung Account in the Members Application;
    • Activate the Product during the Product Activation Period;
    • Fill out the Promotional Form and after positive verification, receive the Promotional Code;
    • Register participation in the Promotion in the Samsung Card Rebate Application according to the principles described in the Annex to the Promotion Regulations and accept the Promotion Regulations (together with the Annex to the Promotion Regulations);
    • Successfully pass the KYC Process in the Samsung Card Rebate Application;
    • Conclude the Card Agreement with Planet Pay in the Samsung Card Rebate Application;
    • Meet other conditions specified in the Promotion Regulations and the Annex to the Promotion Regulations.

§ 3. Promotion Registration

  1. Participant registration for the Promotion, in the case of choosing the Card Rebate benefit, takes place via the Samsung Members Application and the Samsung Card Rebate Application.
  2. To register for the Promotion and receive the Card Rebate benefit, the Participant must activate the Product during the Activation Period, create an account/log in to the Samsung Members Application on that Product during the Registration Period, fill out the Promotional Form, and then after positive verification of the application, enter the Promotional Code during the Registration Period in the Samsung Card Rebate Application and accept the Promotion Regulations (together with the Annex to the Promotion Regulations) in the Samsung Card Rebate Application. To conclude the Card Agreement with Planet Pay, you must complete the form in the Samsung Card Rebate Application (Card Rebate Form) with your personal data and submit all declarations required by Planet Pay (including within the KYC Process). Providing incorrect, inaccurate, or incomplete personal data/declarations may result in disqualification from the Promotion.
  3. The condition for participation in the Promotion and receiving the Card Rebate benefit for Participants who do not have a Samsung Account is to create a Samsung Account by filling out the registration form, available at https://account.samsung.com/ or via the Members Application. The Customer is obliged to provide true and up-to-date personal data during the Samsung Account registration process. Providing incorrect, inaccurate, or incomplete personal data may result in the inability to receive the Card and participate in the Promotion.
  4. To activate the Primary Product, it is necessary to run this Product in Poland with an active SIM card of a Polish operator and have access to the Internet or mobile network. Product activation is free of charge, except that it does not include the costs of connection to the Internet network used by the Customer. Internet connection costs correspond to the rates of the network operator used by the Customer.

§ 4. Card Rebate

  1. Subject to the remaining provisions of the Annex to the Promotion Regulations, including § 4 para. 2, the Participant who meets all the conditions specified in the Promotion Regulations and the Annex to the Promotion Regulations will receive a Card Rebate in the amount indicated in the table below:

2. Providing incorrect data by the Participant may result in the inability or delay in issuing the Card.

3. Customer participation in the Promotion is voluntary. Anyone who has participated in the Promotion has the full right to withdraw from participation in it at their own discretion and without incurring any costs.

4. Pursuant to art. 21 para. 1 item 68 of the Act of July 26, 1991 on personal income tax (Journal of Laws 2022.2647 item, as amended), the value of prizes related to sales promotion of goods or services is exempt from income tax - if the single value of these winnings or prizes does not exceed PLN 2,000, provided that the exemption from tax on prizes related to sales promotion of goods or services does not apply to prizes received by the taxpayer in connection with their non-agricultural business activity, which constitute income from this activity.

§ 5. Payout to Customer's Bank Account

  1. In the case of:
    • expiration of the Card's validity period; or
    • premature termination of the Card Agreement (due to its termination)
    - subject to point 2 below, Planet Pay will pay the Customer to the bank account indicated by the Customer any unused funds on the Card.
  2. To receive the payout referred to in point 1 above, after 10 months from the conclusion of the Card Agreement, an option to provide the Customer's bank account number will appear in the Samsung Card Rebate Application menu - the Customer should then provide their current bank account number in the Samsung Card Rebate Application and give consent for the payout (if required by law at the time of payout). The payout is made by Planet Pay within 14 days from the expiry of one year from the date of concluding the Card Agreement.
  3. In the event of the Customer failing the KYC Process:
    • despite the Customer's due diligence in this regard, which means providing all data and documents required by Planet Pay within the deadlines set by Planet Pay and despite this obtaining a negative decision regarding the conclusion of the Card Agreement, or
    • due to the Customer not having the documents required to pass the KYC Process (regarding the lack of a valid identity card) - subject to point 4 below, the Customer who: i) has met the conditions for participation in the Promotion specified in the Promotion Regulations and this Annex to the Promotion Regulations, except for successfully passing the KYC Process and concluding the Card Agreement, and ii) has submitted a complaint regarding not passing the KYC Process in accordance with § 6 of the Annex to the Promotion Regulations and the complaint has been positively considered, the Organizer will pay to the bank account indicated by the Customer funds corresponding to the amount of the Card Rebate specified in § 4 para. 1 of the Annex to the Promotion Regulations. The Organizer draws attention to the fact that for the proper consideration of the complaint, it may be necessary to ask the Organizer to obtain information from Planet Pay regarding the circumstances of the Customer not passing the KYC Process, which, however, may only take place with the explicit and prior consent of the Customer.
  4. To receive the payout referred to in point 3 above, the Customer should fill out the application form provided by Smolar and give consent for the payout (if required by law at the time of payout). The payout is made by the Organizer within the following period:
    • in the case of Customers whose complaint was submitted and positively considered before the end of Registration in the Samsung Card Rebate Application, i.e., before 10.09.2025 (according to § 1 para. 12 of the Annex to the Promotion Regulations), the payout will take place within 21 days from the end of Registration, and in the case of Customers whose complaint was submitted and positively considered after the end of Registration in the Samsung Card Rebate Application, i.e., after 10.09.2025 (according to § 1 para. 12 of the Annex to the Promotion Regulations), the payout of funds will take place within 21 days from the date of positive consideration of the complaint.

§ 6. Complaints Related to Payment Transactions, Cards, Fund Payouts, and the Samsung Card Rebate Application

  1. Complaints related to payment transactions initiated by the Card, payouts of funds to the Customer's bank account in cases specified in § 5 para. 1-2 of the Annex to the Promotion Regulations, and the operation of the Samsung Card Rebate Application should be submitted to Planet Pay, on the terms resulting from the Card Agreement (and the documents attached to it) and the Regulations of the Samsung Card Rebate Application.
  2. The Customer can submit a complaint to Planet Pay in one of the following ways:
    • in writing – in person using a form at Planet Pay's registered office or by post to the registered office address of Planet Pay or to the address of the Complaint Service Team, ul. Szosa Zambrowska 100, 18-400 Łomża, or
    • verbally by phone to the BOK Consultant at +86 216 13 68 (fee according to the operator's price list), or
    • in person to the protocol at Planet Pay's registered office, or
    • electronically to Planet Pay's email address: reklamacje.kartowe@planetpay.pl
