Annex to the Promotion Regulations: "Cashback Promotion for Galaxy S25, S25+, S25 Ultra and A36 – Refund up to 1400 PLN"

This annex corrects an obvious error in the original Regulations concerning the promotion end date.

§ 1. Correction of Promotion Dates

Pursuant to § 9 sec. 1 pt. 6) of the Regulations, the Organizer amends § 1 sec. 13 of the Regulations to read as follows:

"13. Purchase Term – term from 14.07.2025 to 28.07.2025, 23:59 (being the date and time of sending the order to the online store server of the Retail Partner or making a purchase at the Retail Partner, indicated on the proof of purchase);

§ 2. General Provisions

1. The remaining provisions of the Regulations remain unchanged.

2. The amendment to the Regulations is available on the Website.

3. The amendment to the Regulations is effective from the date of its publication.

4. The consolidated text of the Regulations constitutes an annex to this Annex.

Annex to the Annex: Consolidated Text of the Regulations "Cashback Promotion for Galaxy S25, S25+, S25 Ultra and A36 – Refund up to 1400 PLN"

§ 1. Definitions

Terms used in the Regulations and written in capital letters have the following meanings:

  1. Product Activation: Activation of the Product with an active Polish telecommunications service SIM card for at least 5 minutes and acceptance of the End-User License Agreement (EULA);
  2. Business Days: days from Monday to Friday, excluding public holidays in the Republic of Poland;
  3. Organizer: Samsung Electronics Polska spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw (ul. Postępu 14, 02-676 Warszawa), entered into the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number 0000128080, NIP 526-10-44-039, REGON 011612810, share capital PLN 52,759,500;
  4. SSCE: Samsung Electronics Romania S.R.L. registration number: J40/7668/2012, VAT: RO 22694272, address Sos. Bucuresti-Ploiesti, 172-176, building A, Bucharest, district 1, postal code 015016, acting on behalf of the Organizer to support the Organizer in handling the Promotion;
  5. Smolar: Smolar Agencja Promocyjno-Reklamowa spółka z ograniczoną odpowiedzialnością with its registered office at: ul. Inżynierska, no. 15, Łódź, code 93-569, entered into the register of entrepreneurs of the National Court Register kept by the District Court for Łódź-Śródmieście in Łódź, XX Commercial Division of the National Court Register under number 0000444211, share capital PLN 10,000, NIP: 7272788075, REGON: 101524274, acting on behalf of the Organizer to support the Organizer in handling the Promotion (and also acting as the Organizer's processing entity), including in the scope of handling the complaint process;
  6. Retail Partner: also referred to as a Partner; a retail outlet (physical or online) run by / belonging to:

Promotion Details

  1. Product: Samsung Galaxy S25, S25+, S25 Ultra and A36 smartphones. Product availability and retail price depend on the individual offer of Retail Partners;
  2. Promotion: promotion under the name "Cashback Promotion for Galaxy S25, S25+, S25 Ultra and A36 – Refund up to 1400 PLN", conducted according to the principles and conditions described in the Regulations;
  3. Regulations: this regulation;
  4. Website: Promotion website available at: galaxyzwrot.samsung.pl
  5. Product Activation Term: from 14.07.2025 to 03.08.2025, 23:59;
  6. Registration Term: from 14.07.2025 to 10.08.2025, 23:59;
  7. Purchase Term: from 14.07.2025 to 28.07.2025, 23:59 (being the date and time of sending the order to the online store server of the Retail Partner or making a purchase at the Retail Partner, indicated on the proof of purchase);
  8. Participant/Client: (i) a natural person of full legal capacity; (ii) a natural person running a sole proprietorship, of full legal capacity, who purchased the Product from a Retail Partner (under the conditions specified in these Regulations) and is not participating in the Promotion as part of their business activity, and has familiarized themselves with the content of these Regulations and accepted its provisions and fulfilled all conditions specified therein;
  9. Refund: a one-time bonus in the form of a monetary amount specified in § 5 sec. 1 of the Regulations, paid to the Participant under the conditions described in the Regulations;
  10. Members Application: the Samsung Members mobile application, through which the Client registers for the Promotion.

§ 2. General Provisions

  1. The Regulations define: the purpose of the Promotion; the duration of the Promotion; the conditions for participation in the Promotion; the method of submitting complaints related to participation in the Promotion.
  2. The purpose of the Promotion is to promote the Products indicated in the Regulations.
  3. The Promotion consists of granting Participants, who have met the conditions specified in the Regulations, a monetary bonus in the form of a Refund.
  4. The Promotion is conducted in the territory of the Republic of Poland.
  5. The Promotion is conducted from 14.07.2025 to 10.08.2025, 23:59 (Purchase Term).
  6. The Promotion schedule is as follows:
    • time for Product Purchase: as defined in § 1 sec. 13 above;
    • time for Product Activation: as defined in § 1 sec. 11 above;
    • registration for the Promotion: as defined in § 1 sec. 12 above;
    • Refund disbursement – Refund payment, within 14 calendar days from the date of confirmation of the application for the Promotion;
    • submission of complaints: by 24.10.2025.
  7. Participants who meet the following conditions may participate in the Promotion:
    • purchase the Product at a Retail Partner during the Purchase Term;
    • register for the Promotion during the Registration Term;
    • have a Samsung Account in the Members Application;
    • accept the Regulations;
    • meet other conditions specified in the Regulations.

§ 3. Purchase of Product Covered by the Promotion

  1. The Product submitted for the Promotion must be purchased by the Participant during the Purchase Term at a Retail Partner. The terms of sale of the Product, including its retail price, are determined entirely by the Retail Partner.
  2. The Participant forfeits the right to participate in the Promotion and receive the Refund if they exercise their statutory or contractual right (granted by the seller) to withdraw from the Product sales agreement. A Participant who has registered for the Promotion and subsequently withdraws from the Product purchase is obliged to notify the Organizer via email at: promocja-zwrot@promo.smolar.pl.

§ 4. Application for the Promotion

  1. Participation in the Promotion is done via the application form.
  2. To apply for the Promotion, the Participant must activate the Product during the Activation Term, create an account/log in to the Samsung Members application on the Product during the Registration Term, and complete the application form available in the Samsung Members application under the 'Benefits' tab, and attach supporting documents (proof of purchase of the Product). Registration via the application form mentioned in point 6 below is only possible within Poland.
  3. For Participants who do not have a Samsung Account, participation in the Promotion requires creating a Samsung Account by completing the registration form available at https://account.samsung.com/ or via the Samsung Members application. The Client is obliged to provide true and up-to-date personal data during the Samsung Account registration process. Providing false, incorrect, or incomplete personal data may result in the inability to participate in the Promotion.
  4. To activate the Product, it is necessary to turn on the Device within the territory of Poland with an active SIM card from a Polish operator and have access to the Internet or mobile network. Device activation is free of charge, provided that it does not cover the costs of connection to the Internet network used by the User. Internet connection costs correspond to the rates of the network operator used by the User.
  5. The application for the Promotion is considered submitted upon registration of the Participant's application on the Organizer's server.
  6. A correctly completed application form includes:
    • Participant's personal data, i.e., first name, last name, email address; for individuals running sole proprietorships, the company name must also be provided;
    • Participant's bank account number held with a bank based in Poland;
    • date of Product purchase;
    • Product details: Product IMEI number;
    • name of the Retail Partner from whom the Product was purchased;
    • confirmation of familiarization with the Regulations by checking the box "I have read the Promotion Regulations";
    • proof of Product purchase: invoice/receipt;
    • proof of Product order (with the order date visible within the Purchase Term).
    • A photo of the side of the product packaging (cardboard box) showing the label with the barcode and readable IMEI number.
    • A cut-out fragment from the Product packaging with the barcode and IMEI number.
  7. One Participant can receive only one Refund in the Promotion, regardless of the number of Products purchased.

§ 5. Refund

  1. Subject to the other provisions of the Regulations, including § 4 sec. 2, a Participant who meets all the conditions specified in the Regulations will receive a Refund in the amount indicated in the table below:

  1. The Refund will be paid within 14 calendar days from the date of confirmation of the application's correctness, to the Participant's bank account number provided in the application form.
  2. Providing incorrect data by the Participant may result in the inability to receive or a delay in the Refund payment.
  3. Participation of Clients in the Promotion is voluntary. Anyone who has participated in the Promotion has the full right to withdraw from participation at their own discretion and without incurring any costs.
  4. If the rewards granted to Promotion Participants are subject to a lump-sum income tax for natural persons, as referred to in Article 30 sec. 1 pt. 2 of the Act of July 26, 1991, on Personal Income Tax, the benefits granted to Participants will be increased by an additional cash bonus of 11.11% of the reward value. This additional cash bonus will not be paid out and will be deducted for the payment of the lump-sum tax, which will be remitted to the competent tax authority. Participants agree to such deduction.
  5. The Refund cannot be exchanged for any other benefit.

§ 6. Verification

  1. Based on the data provided by the Participant in the application, the Organizer will verify the applications submitted by Participants within 21 calendar days from the date the completed Form is received by the server supporting the applications submitted via the Website. The Participant will be informed of the verification result via email, to the address provided in the Form.
  2. In case of formal deficiencies in the promotion application, as listed in § 4 sec. 6 above, the Participant will be notified by email to supplement the deficiencies within 5 business days. Failure to supplement the formal deficiencies by the Participant or supplementing them after the deadline entitles the Organizer to reject the application.
  3. The Organizer will request the Participant to supplement formal deficiencies only once. If the deficiencies are supplemented within the deadline, the verification will be re-performed by the Organizer within 21 days.
  4. Applications that have been: sent after the Registration Term, are incorrect, non-compliant with the Regulations, contain false data, as well as applications containing formal errors, including incomplete, illegible, or unclear scans/photos of the Product proof of purchase, or not supplemented despite the request to supplement formal deficiencies according to sec. 2 above, will disqualify the Participant from receiving the Refund.
  5. SSCE has the right to additional verification of applications, which may, in certain cases, require re-application for the promotion. For example, SSCE also has the right to request the original document confirming the Product purchase. In case of the need for additional verification of an application, SSCE will notify the Participant via email. The Participant will be obliged to provide the requested documents or data within 5 (five) Business Days from the date of receiving the request. If the Participant fails to provide explanations within the deadline, the Organizer will exclude the Participant from the Promotion. If deficiencies are supplemented within the deadline, re-verification will be performed by the Organizer within 21 days from the date of their supplementation. The Participant will be informed of the verification result via email, to the address provided in the Form.
  6. Each proof of Product purchase can be submitted under the Promotion only once.
  7. The Organizer recommends that Participants regularly check their email inbox and read emails sent to them in connection with the Promotion, regularly update their personal data, including verifying the anti-spam tools and settings used by the Participant. If anti-spam tools and settings are used, the Participant is obliged to regularly check whether emails from the Organizer have not ended up in the inbox containing messages classified as spam.

§ 7. Complaints

  1. The right to submit a complaint is granted to the Promotion Participant.
  2. Complaints related to the Promotion may be submitted by 24.10.2025.
  3. A complaint must include:
    • Participant's first and last name;
    • correspondence address or contact email address;
    • a description of the circumstances forming the basis of the complaint.
  4. Complaints and questions regarding the Promotion should be sent/submitted to:
    • in writing to the address: Smolar Agencja Promocyjno-Reklamowa sp. z o.o., ul. Inżynierska, no. 15, 93-569 Łódź, with the annotation "Cashback Promotion for Galaxy S25, S25+, S25 Ultra and A36 – Refund up to 1400 PLN";
    • by email to: promocja-zwrot@promo.smolar.pl
    • in person at the registered office of Smolar Agencja Promocyjno-Reklamowa sp. z o.o., ul. Inżynierska, no. 15, 93-569 Łódź.
  5. Submitted complaints will be processed within a maximum of 14 Calendar Days from the date of receipt of the complaint. Participants will be notified of the method of complaint resolution in the form in which the complaint was submitted, immediately after its resolution.
  6. The deadline for submitting a complaint, as provided in the Regulations, does not exclude or limit the rights of the Participant under the law, in particular the provisions on the statute of limitations for claims.
  7. The complaint procedure does not exclude or limit the Participant's right to pursue their rights before common courts.

§ 8. Personal Data Protection

  1. The administrator of Clients' personal data is Samsung Electronics Polska Sp. z o.o. with its registered office in Warsaw (address: ul. Postępu 14, 02-676 Warszawa).
  2. Samsung processes Clients' personal data in connection with participation in the Promotion (Art. 6 sec. 1 lit. f of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC; hereinafter referred to as "RODO").
  3. Samsung processes Clients' personal data in connection with participation in the Promotion, for the purpose of:
    • organizing and conducting the Promotion;
    • communication with Users;
    • providing benefits and services specified in the Regulations;
    • handling complaints.
  4. Samsung processes Participants' personal data also for purposes related to fulfilling Samsung's legal obligations, including tax and accounting obligations (the basis for processing is the necessity of data for fulfilling a legal obligation incumbent on the administrator, i.e., Art. 6 sec. 1 lit. c RODO).
  5. Samsung may use Clients' personal data for marketing purposes, including promoting goods and services and products and services of Samsung's business partners. The legal basis for processing personal data for marketing purposes is the legitimate interest of the administrator (Art. 6 sec. 1 lit. f RODO) consisting in conducting marketing activities.
  6. As part of marketing activities, Samsung may send Clients messages containing information about new products or services. Sending such information may only occur if Users have given separate consent for marketing communication, which may be withdrawn at any time. Withdrawal of consent is possible by contacting Samsung or by clicking the link provided in each electronic message containing marketing communications.
  7. Samsung may use the collected personal data to create so-called Client profiles, based on, among other things, their interests, purchase history, and activity within the Platform. Based on the created profiles, Samsung may send more tailored marketing communications informing about goods and services.
  8. Furthermore, in certain situations, it is or may be necessary to process Clients' personal data for purposes other than those indicated above, which are necessary due to the pursuit of the Organizer's legitimate interests (Art. 6 sec. 1 lit. f RODO), in particular:
    • for purposes related to monitoring and improving the quality of services provided;
    • if applicable, for internal reporting purposes within Samsung and the Samsung Group;
    • to prevent and counteract abuses and the use of Samsung's activities for purposes related to the violation of law;
    • if applicable, for purposes related to dispute proceedings, as well as proceedings before public authorities and other proceedings, including for the purpose of pursuing and defending claims.
  9. In cases other than those indicated above, Clients' personal data will be processed solely on the basis of prior consent, to the extent and for the purpose specified in the consent.
  10. Failure to provide all required personal data by the Client may be an obstacle to participating in the Promotion and Samsung providing services to them.
  11. To the extent that personal data is collected based on consent, the provision of personal data is voluntary.
  12. The processing of personal data will cover the scope of data indicated in the promotion application form, as well as other data provided by the User in connection with participation in the Promotion.
  13. In connection with the processing of Clients' personal data for the purposes indicated in point 1 above, their personal data may be disclosed to the following recipients or categories of recipients:
    • entities participating in processes necessary for the implementation of the Promotion and the provision of services under the Promotion; Smolar Agency;
    • entities from the Samsung capital group;
    • entities supporting Samsung in its business processes, including entities processing personal data on behalf of Samsung (so-called data processors), and
    • public administration bodies and entities performing public tasks or acting on behalf of public administration bodies, to the extent and for the purposes resulting from legal provisions.
  14. Clients' personal data will be processed for the period necessary to provide services under the Promotion.
  15. After the expiry of the above period, Clients' personal data may continue to be processed to the extent required by law or for the purpose of fulfilling Samsung's legitimate interest as an administrator of data within the scope specified in point 3 above (subject to the deadlines specified by tax law), and in the case of the Client's consent to data processing after the termination or expiry of the agreement, until the withdrawal of that consent.
  16. Profiling means any form of automated processing of personal data, which consists of using it to prepare and send personalized services/offers tailored to the User's needs. Offers are prepared based on the Client's activity within the services provided by Samsung. Offers will be sent to Clients only if they have given their consent.
  17. Samsung assures that all persons whose personal data are processed have the appropriate rights resulting from RODO, namely:
    • the right of access to personal data, including the right to obtain a copy of that data;
    • the right to request rectification (correction) of personal data if the data is incorrect or incomplete;
    • the right to request the erasure of personal data (the so-called "right to be forgotten") – if (i) the data is no longer necessary for the purposes for which it was collected, (ii) the data subject has objected to the processing of data, requesting its restriction instead, (iii) the data subject has withdrawn the consent on which the processing is based and there is no other legal basis for processing, (iv) the data is processed unlawfully, (v) the data must be erased to comply with a legal obligation;
    • the right to request restriction of personal data processing – (i) the data subject disputes the accuracy of personal data, (ii) the processing of data is unlawful, and the data subject objects to the erasure of data, requesting its restriction instead, (iii) the administrator no longer needs the data for its purposes, but the data subject needs it to establish, exercise or defend claims, (iv) the data subject has objected to the processing of data pending the determination of whether the administrator's legally justified grounds override the grounds for objection;
    • the right to data portability, if: (i) processing is based on a contract concluded with the data subject or on consent given by such person, and (ii) processing is carried out in an automated manner;
    • the right to object to the processing of personal data, including profiling, if: (i) there are reasons related to the data subject's particular situation, and (ii) data processing is based on the necessity for purposes arising from Samsung's legitimate interest.
  18. The Client is entitled to submit a request to exercise the rights mentioned above and below (withdrawal of consent) by completing the form available at www.samsung.com/pl (https://www.europe-samsung.com/gdpr/webform/pl), in accordance with the instructions available on the website.
  19. To the extent that the Client has consented to the processing of personal data, they have the right to withdraw their consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  20. In the event that Samsung's processing of a Client's personal data is deemed to violate RODO provisions, the Client has the right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office.
  21. For reasons of corporate requirements, the Organizer may transfer Participants' personal data outside the European Economic Area (EEA). In such cases, the Organizer guarantees that a similar level of data protection in the third country is ensured by implementing one of the following safeguards:
    • personal data is transferred to countries that the European Commission has recognized as ensuring an adequate level of personal data protection;
    • we use appropriate contracts approved by the European Commission or rely on binding corporate rules that guarantee data security.
  22. As part of exercising rights, the Organizer also provides the possibility to obtain copies of appropriate safeguards for personal data in case of transfer to third countries.

§ 9. Amendment of Regulations

  1. The Organizer reserves the right to amend the Regulations in connection with and in the event of at least one of the following important reasons:
    • introduction of new or amendment of existing generally applicable legal provisions, if it directly affects the content of the Regulations and necessitates its amendment;
    • amendment or emergence of new interpretations of generally applicable legal provisions as a result of court rulings or decisions of public authorities or administration bodies directly affecting the provisions of these Regulations and necessitating their amendment;
    • a ruling, decision, recommendation or recommendation of an authorized public authority concerning the Regulations and resulting in the necessity to adapt them to such a ruling, decision, recommendation or recommendation;
    • adaptation of the Regulations to market conditions related to technological, technical and IT progress, affecting the provisions of these Regulations;
    • change of company data, tele-address or URL addresses posted in the Regulations,
    • the necessity to introduce changes other than those mentioned above, provided that they collectively meet the following conditions: i) they are legal (including, in particular, they do not infringe individual or collective consumer interests); ii) they are favorable to current and potential Participants; iii) their introduction is necessary for the proper implementation of the Promotion in a manner that is beneficial to current and potential Participants.
  2. Notice of amendment of the Regulations will be made available on the Website.
  3. An amendment to the Regulations cannot negatively affect rights previously acquired by Participants.

§ 10. Final Provisions

  1. The Organizer recommends that Participants regularly check their email inbox and familiarize themselves with emails sent to them in connection with the Promotion, regularly update the Participant's personal data, including verifying the anti-spam tools and settings used by the Participant. If anti-spam tools and settings are used, the Participant is obliged to regularly check whether emails from the Organizer have not ended up in the inbox containing messages classified as spam.
  2. The Regulations will be available for inspection on the Website throughout the duration of the Promotion. The Participant may retain the content of the Regulations by downloading it from the Website.
