These terms and conditions govern the Breville Father's Day 2023 Promotions, encompassing Espresso, Cooking, and Pizza offers. Participation in any of these promotions signifies acceptance of these terms.

General Terms and Conditions

Definitions

"Immediate Family Member" means any of the following: spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister or first cousin.

"Participating Product" means any of the Breville products listed in the tables above that are supplied by Breville in Australia and sold directly by Breville or by a Participating Retail Store.

"Participating Retail Store" means any Australian retail store authorised by Breville to sell Participating Products, including but not limited to:

"Proof of Purchase" means an original tax invoice clearly confirming a Purchase, specifying the Participating Product, price paid, Participating Retail Store, and date of purchase within the Promotional Period.

"Proof of Model Number" means proof of the model number of a Participating Product.

"Purchase" means making full and final payment or entering a binding finance agreement for a Participating Product during the Promotional Period. Laybys are included only if the final payment is made during the period. Afterpay and Zippay transactions count only if paid in full during the period.

Privacy

Breville and its agents collect personal information to conduct the Promotion and may disclose it to third parties (agents, contractors, service providers, offer suppliers, regulatory authorities). Information may be used for promotional, marketing, publicity, research, and profiling purposes. Claimants acknowledge that their information is collected by or on behalf of Breville and may be disclosed to group companies and third parties. For requests regarding access, update, or correction of information, contact Breville's Privacy Officer at privacy@breville.com. These terms incorporate Breville's privacy policy, available at https://breville.com.au/pages/privacy-policy.

Eligibility and Claims

To be eligible to claim a Gift Pack, claimants must:

• Be an Australian resident currently living in Australia with an Australian residential and postal address. Gift Packs are delivered only within Australia.
• Be aged 18 years or over, or if under 18, have obtained consent from a parent or legal guardian.
• Not be an employee of the Promoter, a Participating Retail Store, or an associated agency, nor be an Immediate Family Member of such a person.
• Be the end-user of the Participating Product, purchasing it for personal use or as a personal gift, not for commercial purposes, re-sale, re-supply, rental, hire purchase, or any other indirect use.
• Make a Purchase and retain the original Proof of Purchase.
• Visit promotions.breville.com.au by 24th September 2023 and follow all prompts. This includes retaining original packaging and Proof of Purchase, and completing the "Online Claim Form" with full name, contact details, residential address, and a scanned copy/photograph of the Proof of Purchase.

The Promoter and its agencies are not responsible for lost, stolen, late, damaged, or misdirected claims. Claimants must ensure all personal details are correct.

Validation of Claims

The Promoter will validate the Proof of Model Number and Proof of Purchase. Successful claimants will be notified via email.

Gift Packs

Gift Packs are provided as is and delivered by a third party, subject to delivery or processing delays. The Beanz subscription component requires creating an account on the Beanz website (https://www.beanz.com/au) and entering a credit card at checkout. Claimants must cancel the subscription if they do not wish to be charged after receiving the gift. Beanz are delivered separately from other items.

Invalid Claims

Claims may be invalidated if an invalid Proof of Model Number or Proof of Purchase is provided. Claimants will be notified and given 14 calendar days to provide valid documentation. The Promoter may verify claims and disqualify any claimant not in accordance with these terms. Incomplete, indecipherable, or illegible claims are invalid. Claimants are responsible for providing correct contact details.

General

If a Participating Product is returned for refund or exchange, the claim is disqualified. All costs associated with the promotion and claim are the claimant's responsibility, including taxes (excluding GST) and ancillary costs. The Promoter makes no guarantee of web service availability and is not responsible for interruptions.

The Promoter excludes all liability for personal injury, loss, or damage arising from the promotion, including technical difficulties, acts or omissions, theft, unauthorized access, or issues with purchase documentation. Nothing in these terms excludes, restricts, or modifies consumer rights under the Competition and Consumer Act 2010 (Cth) or other applicable legislation.

These Terms and Conditions are governed by the laws of New South Wales. Claimants submit to the non-exclusive jurisdiction of the courts of New South Wales.
