Breville Father's Day Espresso Promotion 2023

Promotion Overview

These Terms and Conditions govern the Breville Father's Day Espresso Promotion ("Promotion"). Participation signifies acceptance of these terms. The promotion is not valid with other offers.

Promoter: BREVILLE PTY LIMITED ABN 98 000 092 928, 2/170-180 Bourke Road, Alexandria, NSW 2015.

Promotional Period: Commences 9:00 am (AEST) on Thursday, 27th July 2023 and closes at 11:59 pm (AEST) on Sunday, 10th September 2023. The Promoter may extend this period.

Claim Submission Deadline: Online Claim Form must be submitted by 11:59 pm (AEST) on Sunday, 24th September 2023.

Promotional Gift: Consists of one of three possible gift packs: 'Gift Pack 1', 'Gift Pack 2', or 'Gift Pack 3'.

Redemption Requirements:

1. Purchase a Participating Product from a Participating Retail Store.
2. Satisfy all other eligibility and claim requirements outlined herein.

Gift Limit: One (1) Gift Pack per item purchased. Gifts are not redeemable for cash and cannot be redeemed with other offers.

Definitions

Immediate Family Member

Means any of the following: spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister or first cousin.

Participating Product

Any Breville product listed by model name and number, supplied by Breville in Australia and sold directly by Breville or a Participating Retail Store.

Participating Products and Bonus Gifts

Note: Any costs for installation, insurance, warranty, or delivery not explicitly covered are the responsibility of the claimant.

A "Participating Retail Store" is any Australian retail store authorised by Breville to sell Participating Products and invited to participate in the Promotion. This includes:

Claimants should verify with the retailer that it is a Participating Retail Store before purchasing.

Proof of Purchase: An original tax invoice clearly confirming the purchase, specifying the Participating Product, price paid, Participating Retail Store, and purchase date within the Promotional Period.

Proof of Model Number: Proof of the model number of a Participating Product by Breville.

Purchase: Full and final payment for a Participating Product during the Promotional Period, or a binding finance agreement. Laybys are included only if the final payment is made during the period. Afterpay and Zippay transactions count only if payment is made in full during the Promotional Period.

Privacy

Personal information collected for the Promotion may be disclosed to third parties for the purpose of conducting the Promotion, including agents, contractors, service providers, and regulatory authorities. Breville and its agents may use information for promotional, marketing, publicity, research, and profiling purposes. Claimants acknowledge this collection and potential disclosure. For privacy inquiries, contact Breville's Privacy Officer at privacy@breville.com. These Terms and Conditions incorporate Breville's privacy policy.

Eligibility and Claims

To be eligible for a Gift Pack, claimants must:

1. Be an Australian resident currently living in Australia, with an Australian residential and postal address. Gift Packs are delivered only within Australia.
2. Be aged 18 years or over, or if under 18, have obtained consent from a parent or legal guardian.
3. Not be an employee of the Promoter, a Participating Retail Store, or an associated agency, nor an Immediate Family Member of such a person.
4. Be the end-user of the Participating Product, purchasing for personal use or as a personal gift, not for commercial purposes, re-sale, re-supply, rental, hire purchase, or any other indirect use.
5. Make a Purchase and retain the original Proof of Purchase.
6. Visit promotions.breville.com.au ("Website") by 24th September 2023 and follow all instructions.
7. Instructions may include retaining original packaging and Proof of Purchase, and providing details via the "Online Claim Form", including full name, contact number, email, address, and a scanned copy or photograph of the Proof of Purchase.

The Promoter and its agencies are not responsible for lost, stolen, late, damaged, or misdirected claims. Claimants must ensure all personal details are correct.

Validation of Claims

The Promoter will validate the Proof of Model Number and Proof of Purchase for each claimant.

Upon successful validation, the Promoter will notify the claimant via email.

Gift Packs

Validated claimants will receive a Gift Pack based on their purchased Promotional Product.

Gift Packs are provided "as is" and delivered by a third party, subject to delivery or processing delays.

Beanz Subscription Component:

To redeem the Beanz Subscription component, claimants must create an account on the Beanz website (https://www.beanz.com/au), enter a credit card at checkout, add a qualifying purchase, and apply the voucher code. Claimants must cancel their subscription if they do not wish to be charged for continued subscription. An email notification will be sent prior to credit card charging.

Beanz are provided separately and are subject to delivery delays. Refer to Beanz Terms & Conditions for details.

Gift Pack Contents:

• Gift Pack 1: For purchases of the Oracle® Touch (BES990) or Oracle® (BES980) models. Includes: 1 Breville Puck Sucker, 1 Breville Dual Wall Latte Duo (200ml), Exclusive Live Roaster Online Masterclass, and a BEANZ Member Discount (6 months @ 50% off, limit 24 x 250g bags).
• Gift Pack 2: For purchases of Dynamic Duo™ (BEP920), Barista Touch Impress™ (BES881), Barista Touch™ (BES880), or Barista Pro™ (BES878) models. Includes: 1 Breville Knock Box Mini, 1 Breville Dual Wall Latte Duo (200ml), Live Roaster Online Demonstration, and a BEANZ Member Discount (4 months @ 50% off, limit 16 x 250g bags).
• Gift Pack 3: For purchases of Dual Boiler™ (BES920), Barista Express Impress™ (BES876), Barista Express® (BES870), Barista Express Impress™ with Milk Jug Thermal (BES875), Bambino Plus (BES500), or Bambino (BES450) models. Includes: Live Roaster Online Demonstration, and a BEANZ Member Discount (3 months @ 50% off, limit 12 x 250g bags).

Delivery within Australia is free. Changes to delivery address require 7 calendar days notice via askus@breville.com.au. Breville is not liable if a delivery cannot be made due to late address change notification.

The Promoter is not responsible for delivery or processing delays. Gift Packs will generally be delivered within 28 business days of the notification email.

If a Gift Pack or element becomes unavailable, the Promoter may substitute it with an item of equal or greater value at its discretion. No additional compensation will be provided for substitutions.

Invalid Claims

Claimants providing invalid Proof of Model Number or Proof of Purchase will be notified via email and given 14 calendar days to provide valid documentation. Failure to do so may result in claim invalidation.

The Promoter may verify claim validity, including claimant identity, age, and residence. Disqualification may occur for non-compliance or tampering. All Promoter decisions are final.

Incomplete, indecipherable, or illegible claims are invalid. Claimants are responsible for providing correct contact details and notifying Breville of any changes.

General

Claims are disqualified if the Participating Product is returned for refund or exchange.

All costs associated with the promotion and claim are the claimant's responsibility, including taxes and ancillary expenses.

The Promoter is not liable for interruptions to web services that may affect participation.

The Promoter excludes liability for personal injury, loss, or damage arising from the promotion, including technical difficulties, acts or omissions, theft, or issues with purchase documentation, except where such liability cannot be excluded by law.

These Terms and Conditions are subject to consumer rights under the Competition and Consumer Act 2010 (Cth) ("CCA"). Breville's liability for breach of statutory conditions or guarantees is limited as specified in the document.

These Terms and Conditions are governed by the laws of New South Wales. Claimants submit to the non-exclusive jurisdiction of the courts of New South Wales.
