General Provisions
This End-User License Agreement (EULA) is between the User and Vasco Electronics Sp. z o.o. S.K.A. concerning VASCO software designed for use with VASCO Devices. Vasco devices include various electronic translators such as the Vasco Translator Premium series, Vasco Traveler series, Vasco Mini, Vasco Translator Solid 4, Vasco Mini 2, Vasco Translator M3, and Vasco Shop & Office Translator. The software may also include third-party components and documentation. The operation of the software relies on services from providers like Google, Microsoft, DeepL, Amazon, IBM, and Baidu. Users must agree to the terms of this agreement and any third-party privacy policies before using the software.
Services
The software provides automatic translation and additional services, integrating tools from Google, Microsoft, DeepL, Amazon, IBM, and Baidu. A feature allows users to share photos with text for translation, stored temporarily on Vasco's servers. Services are generally provided free of charge via Wi-Fi or mobile data, with potential charges from SIM card operators outside Wi-Fi. Top-up services and SIM card operations are managed by Vasco Electronic LLC. Acceptance of Terms and Conditions for Top-ups is required for service provision. Certain locations may have service exclusions.
License
Vasco grants the User a limited, non-transferable, non-exclusive right for non-commercial use of the software solely on the Device. Rights to previous versions expire upon receiving the latest version. Third-party software terms may require Vasco to disclose specific license conditions. All usage rights are granted on a license basis; users do not gain ownership. Users must comply with applicable laws and not violate third-party rights.
License Limitations
Users are prohibited from distributing, copying, leasing, publishing, modifying, correcting, adapting, translating, sublicensing, reverse engineering, decompiling, disassembling, creating derivative works, using unauthorized hardware/software, installing earlier versions, violating laws, or acquiring the application through unauthorized methods. Use is strictly limited to private use related to the device's primary purpose.
Services and Updates
Vasco may provide updates or upgrades that could change settings or disable features. Updates are automatic via Wi-Fi or mobile data. Emergency security updates can be installed automatically without user consent.
Third Party Content
The application may link to third-party content. Vasco does not control or endorse these links and is not liable for third-party content. Users access such content at their own risk.
Guidelines of Information
Vasco and third parties may process data for agreement performance, complaint handling, and safeguarding interests. Device and application information may be collected for system monitoring, marketing, and user behavior tracking. A unique identifier may be assigned to the device.
Detailed information on data usage and privacy policies can be found at Vasco Electronics Privacy Policy and relevant third-party policies. Users must read and accept these documents before using the device.
Limitation of Liability
Users utilize the software at their own risk. Vasco and third-party providers disclaim warranties regarding compatibility, accuracy, timeliness, completeness, reliability, and security. Vasco does not guarantee the device or software will be error-free or uninterrupted. Liability for damages related to the operation of the software and third-party services is disclaimed to the extent permitted by law.
Breach of Contract, Termination and Remedies
Vasco may take measures against users who breach the agreement, including temporarily or permanently preventing access to the software or services. Vasco reserves the right to pursue legal action for violations.
Amendments to the Agreement
Users are bound by the current agreement version. Vasco may update terms, with changes available at Vasco Electronics Privacy Policy. Continued use implies acceptance of the latest terms. Users should regularly review terms of service and privacy policies of third-party providers.
Contact and Complaints
Users have the right to complain about the software and device. Complaints should include user identification and justified reservations. For questions or complaints, contact support@vasco-electronics.com. Complaints are processed within 14 days.
Miscellaneous Provisions
The agreement is governed by Polish law, but mandatory provisions of the user's country may also apply. The user recognizes the exclusive jurisdiction of Vasco's general court. In case of disputes, users may contact an arbitration court for mediation. If any provision is found invalid, it will be interpreted to be effective, and other terms remain in force. The agreement is effective upon acceptance and is for an indefinite period, terminable by the user. The original Polish version of the Terms and Conditions prevails in case of translation discrepancies.
