Samsung Galaxy Pre-sale Promotion Terms and Conditions

This document outlines the terms and conditions for the promotional campaign titled "Promotion for the first pre-sale customers of Samsung Galaxy".

§ 1 Definitions

  1. Smolar: Smolar Agencja Promocyjno-Reklamowa, a limited liability company with its registered office at ul. Inżynierska 15, Łódź, 93-569. Registered in the National Court Register (KRS) under number 0000444211. Smolar acts as an agent for the Organizer in supporting the Promotion, including handling claims.
  2. Samsung Account: An individual customer account that allows the customer to register the Device and access services provided by the Organizer.
  3. Promotion: A premium sale of Samsung Galaxy smartphones and smartwatches: Z Fold7, Z Flip7, Z Flip7 FE, Watch8, Watch8 Classic, Watch Ultra (2025). The promotion runs from July 9, 2025, 16:00 to July 13, 2025, 23:59, or until the prize pool is exhausted. Delivery/pickup terms depend on the Partner's offers.
  4. Promotion Period: From July 9, 2025, 16:00 to July 13, 2025, 23:59, or until the prize pool is exhausted.
  5. Organizer: Samsung Electronics Polska sp. z o.o., with its registered office in Warsaw at ul. Postępu 14, 02-676 Warsaw. Registered in the National Court Register (KRS) under number 0000128080. The Organizer awards the prizes in the Promotion and carries out activities defined in these Regulations with the cooperation of Smolar.
  6. Product or Device: Samsung Galaxy Z Fold7, Z Flip7, Z Flip7 FE smartphones, and Galaxy Watch8, Watch8 Classic, Watch Ultra (2025) smartwatches. Availability, retail price, and delivery terms are subject to the Partner's individual offer.
  7. Customer or Participant: An individual who is of legal age and has full legal capacity; an individual conducting a sole proprietorship not participating in the Promotion as part of their non-agricultural business activity; making a purchase of a Product from a Partner Handlowy (under the conditions specified in these Regulations), who has read and met all the conditions herein. Legal entities cannot be Participants.
  8. Partner Handlowy (Retail Partner): A distributor offering the Product or a point of sale (physical store or online store) where Customers can order and purchase Products. The following are Partner Handlowy/Points of Sale: Orange Polska S.A., P4 Sp. z o.o., Polkomtel Sp. z o.o., T-Mobile Polska S.A., Media Expert (TERG S.A.), electro.pl (TERG S.A.), avans.pl (TERG S.A.), Media Markt (Media Saturn Holding Polska Sp. z o.o.), RTV EURO AGD (EURO-net Sp. z o.o.) (Note: RTV EURO AGD Annopol Outlet Warszawa and euro.com.pl/cms/outlet.bhtml are excluded), oleole.pl (EURO-net Sp. z o.o.), Komputronik S.A., Vobis (I-Terra Sp. z o.o.), Samsung Brandstores (Matrix Media Sp. z o.o.), Samsung Brandstores (I-Terra sp. z o.o.), matrixmedia.pl (Matrix Media Sp. z o.o.), 4CV Mobile Sp. z o.o. SP. K, Maxelektro.pl (GT GROUP TOMASZEK Sp. z o.o.), x-kom sp. z o.o., Vity.pl (operated by Polski Koncern Naftowy ORLEN SA), AB Foto sp. z o.o., al.to sp. z o.o., Netia S.A., Empik S.A. (Note: Stores operating on the Marketplace https://www.empik.com/empikplace are excluded. Only purchases documented by an invoice issued by Empik S.A. qualify for participation). Samsung Shop (operated by Samsung Electronics Polska sp. z o.o.) via www.samsung.com/pl and the Samsung Shop mobile app. Employee Shop (https://www.samsung.com/pl/multistore/epp/employees) is excluded. Samsung Partner Programs: Samsung Employee Shop (https://www.samsung.com/pl/multistore/eppc/eppc) participates. Samsung Education Shop (https://www.samsung.com/pl/multistore/epp/eppedu) participates. Samsung Club (https://www.samsung.com/pl/multistore/epp/eppac and https://www.samsung.com/pl/multistore/epp/pl_epp_pko_bp) participates. Samsung Shop-Poland on Allegro (https://allegro.pl/uzytkownik/Samsung--Polska) participates.
  9. Regulations: These Promotion Regulations, defining the terms of participation, duration, information procedures, and complaint submission.
  10. Prize: Upon purchasing a Device covered by the Promotion, the Customer will receive the following prize, subject to availability and limits:
    • For Samsung Galaxy Z Fold7, Z Flip7, Z Flip7 FE: Galaxy Buds3 Pro (SM-R630NZAAEUE) (cumulative limit of 3000 units).
    • For Samsung Galaxy Watch8, Watch8 Classic, Watch Ultra (2025): Galaxy Buds3 (SM-R530NZAAEUE) (cumulative limit of 2500 units).
    The total number of prizes is limited to 5500 units, distributed as shown in the table. Prizes are awarded on a first-come, first-served basis upon receipt of a correctly completed Form. The Organizer will announce the exhaustion of the prize pool on the website and in the Samsung Members Application.
  11. Form: An online form available at przedsprzedaz.samsung.pl, which the Customer fills out to register for the Promotion.
  12. Website: The website at przedsprzedaz.samsung.pl and przedsprzedaz-smartwatch.samsung.pl, where information about the Promotion, including the Regulations, is published.
  13. Business Day: Any day from Monday to Friday, excluding public holidays.

§ 2 General Provisions

  1. Customers eligible to participate in the Promotion must:
    • a) Order and purchase a Device from a Partner Handlowy within the period from July 9, 2025, 16:00 to July 13, 2025, 23:59 (or until the prize pool is exhausted). The purchase date is the date and time the order is sent to the online store server or placed at the Point of Sale, as indicated on the proof of purchase.
    • b) Activate the Device between July 9, 2025, 16:00 and August 11, 2025, 23:59. Activation means starting the Device in Poland with a Polish telecommunications provider's SIM card for at least 5 minutes and accepting the End-User License Agreement (EULA).
    • c) Log in to the Samsung Members Application using a Samsung Account.
    • d) Complete the Promotion application form (hereinafter referred to as the "Form") available at przedsprzedaz.samsung.pl between July 28, 2025, and August 18, 2025, 23:59. The Form must be filled out in Poland.
  2. Device activation requires the Device to be started in Poland with a Polish telecommunications provider's SIM card and access to the internet or mobile network. Activation is free of charge, excluding internet connection costs.
  3. Participation is limited to Customers who purchased the Device during the Promotion Period from a Partner Handlowy, confirmed by a fiscal document (e.g., receipt, invoice).
  4. Customers without a Samsung Account must create one by completing the registration form at https://account.samsung.com or via the Samsung Members application. Customers must provide truthful and up-to-date personal data. Inaccurate, incorrect, or incomplete data may prevent participation.
  5. If prizes are subject to lump-sum income tax for individuals, the prize value will be increased by an additional cash prize of 11.11% of the prize value. This additional cash prize will not be paid out but will be withheld for the payment of the lump-sum tax. Participants agree to this deduction.
  6. Participation in the Promotion is voluntary. Participants may withdraw at any time without incurring costs.
  7. The Promotion applies only to Products purchased within the Partner Handlowy network.
  8. The Organizer reserves the right to request the original proof of purchase or additional verification of the purchase.
  9. Prizes will be sent to eligible Participants within 21 business days of the confirmation of successful application. Verification of applications takes up to 14 calendar days.
  10. By participating in the Promotion, the Participant accepts the Regulations and cannot claim ignorance of them.

§ 3 Prize Awarding Rules

  1. To register for the Promotion, complete the registration form. The form can only be completed in Poland.
  2. Between July 28, 2025, and August 18, 2025, 23:59, the Customer submits the correctly completed application Form along with the proof of purchase. The submission deadline is determined by the date the application is received by the server.
  3. A correctly completed Form requires the submission of truthful data, including:
    • a) Device model and IMEI/serial number.
    • b) Participant's full name.
    • c) Prize shipping address in Poland.
    • d) Participant's phone number.
    • e) Participant's email address.
    • f) Date of Device purchase.
    • g) Company name (for individuals running a business).
    • h) Proof of order for the Device during the promotion period.
    • i) Proof of purchase.
    • j) Photo of the device's nameplate showing IMEI/serial numbers.
    • k) Name of the Partner Handlowy where the Product was purchased.
    • l) Confirmation of reading and accepting the Regulations.
  4. The Participant must provide truthful and complete data.
  5. Upon meeting all participation conditions, the Participant is entitled to the Prize:
    • Samsung Galaxy Z Fold7, Z Flip7, Z Flip7 FE: Galaxy Buds3 Pro (SM-R630NZAAEUE) (limit 3000 units).
    • Samsung Galaxy Watch8, Watch Classic, Watch Ultra (2025): Galaxy Buds3 (SM-R530NZAAEUE) (limit 2500 units).
  6. Smolar will verify the correctness of applications based on the provided data. Applications submitted after the deadline, incorrect, incomplete, non-compliant with the Regulations, containing false data, or illegible/unclear scans/photos of the proof of purchase will be disqualified.
  7. In case of formal deficiencies in the completed Form, the Participant will be notified by email within 14 calendar days of the Form's submission to the Organizer's server. Missing documents must be sent to przedsprzedaz@promo.smolar.pl within 5 business days. Failure to submit or late submission of missing documents will result in the disqualification of the application. Timely submission of missing documents means the Form is considered submitted within the original deadline.
  8. The Organizer will request the Participant to complete formal deficiencies only once. The Participant will be informed of the result of the re-verification by email within 7 business days.
  9. Providing incorrect data may result in the inability to receive or a delay in prize delivery.
  10. Prizes will be sent after successful verification of the application and fulfillment of all promotion conditions, via courier to the Participant's address provided in the application form, no later than 21 business days from the date of confirmation of correct verification.
  11. The Organizer does not provide for the possibility of exchanging Prizes for their cash equivalent or other prizes.
  12. If multiple units of the same model are purchased (e.g., two Galaxy Z Fold7), one Participant can receive only one Prize. Similarly, purchasing two smartwatches, e.g., Samsung Watch 8 Classic, entitles to only 1 Prize. A Participant can receive a maximum of six Prizes in total (one for each eligible product type). Purchasing a pre-sale smartphone and smartwatch in a single order entitles to one benefit in the form of Galaxy Buds3 Pro.
  13. If the Customer withdraws from the purchase agreement, they must promptly return the Prize received under the Promotion to Smolar Agencja Promocyjno-Reklamowa, ul. Inżynierska 15, 93-569 Łódź, with the note "Samsung Galaxy Buds3 or Buds3 PRO for the first pre-sale customers of Samsung Galaxy Z Fold7, Z Flip7, Z Flip7 FE and Watch8, Watch8 Classic, Watch Ultra (2025)".
  14. Participants are advised to regularly check their email and Samsung Members application for updates and to verify their personal data and anti-spam settings.
  15. The Regulations will be available on the Website throughout the Promotion period. Participants can download and save the Regulations.

§ 4 Complaints related to the Promotion

  1. Complaints should be submitted no later than November 10, 2025. It is recommended to report issues with form submission as soon as possible.
  2. The complaint submission deadline does not exclude or limit the Participant's rights under applicable law, particularly regarding statute of limitations.
  3. The complaint procedure does not exclude or limit the Participant's right to pursue their claims in common courts.
  4. All complaints should be submitted in the following forms:
    • a) Email to: przedsprzedaz@promo.smolar.pl
    • b) Mail to: Smolar Agencja Promocyjno-Reklamowa spółka z ograniczoną odpowiedzialnością, ul. Inżynierska 15, 93-569 Łódź, with the note "Promotion for the first pre-sale customers of Samsung Galaxy". The complaint should include data for customer identification, proof of purchase (paper or scan), and a detailed description of the event justifying the complaint and any supporting circumstances.
    • c) In person at: Smolar Agencja Promocyjno-Reklamowa sp. z o.o., ul. Inżynierska 15, 93-569 Łódź.
  5. The Organizer will process complaints based on these Regulations within 14 calendar days of receipt. The Customer will be notified of the complaint resolution method in the same format as the complaint was submitted.

§ 5 Personal Data

  1. The data controller for Customer personal data is Samsung Electronics Polska Sp. z o.o., located in Warsaw (ul. Postępu 14, 02-676 Warsaw).
  2. Samsung processes Customer personal data in connection with participation in the Promotion (Article 6(1)(f) of the GDPR) for the purposes of organizing and conducting the Promotion, communication with Users, prize delivery, service provision, and complaint handling.
  3. Samsung also processes Participants' personal data to fulfill legal obligations, including tax and accounting requirements (Article 6(1)(c) of the GDPR).
  4. Samsung may use Customer personal data for marketing purposes, including promoting its own and its business partners' goods and services, based on its legitimate interest (Article 6(1)(f) of the GDPR). This may include sending messages about new products or services, provided Users have consented.
  5. Samsung may create customer profiles based on interests, purchase history, and platform activity to send more tailored marketing communications.
  6. Personal data may also be processed for other purposes necessary for the Organizer's legitimate interests (Article 6(1)(f) of the GDPR), including service monitoring and improvement, internal reporting, preventing abuse, and handling legal disputes.
  7. Personal data will be processed based on prior consent for purposes not covered above.
  8. Failure to provide required personal data may prevent participation in the Promotion or the provision of services.
  9. Providing personal data based on consent is voluntary.
  10. Personal data processing includes data provided in the application form and any other data provided by the User in connection with participation.
  11. Customer personal data may be shared with entities involved in the Promotion's execution and service provision (Smolar for complaint handling and prize delivery), Samsung group entities, business partners processing data on Samsung's behalf, and public authorities as required by law.
  12. Customer personal data will be processed for the period necessary to provide services under the Promotion.
  13. After this period, personal data may continue to be processed as required by law or for Samsung's legitimate interests, or until consent is withdrawn.
  14. Profiling is automated data processing to provide personalized services/offers tailored to the User's needs, based on consent.
  15. Samsung ensures that all individuals whose data is processed have the rights granted by the GDPR, including the right to access, rectify, erase, restrict processing, data portability, and object to processing.
  16. Customers can exercise their rights by filling out the form at www.samsung.com/pl (https://www.europe-samsung.com/gdpr/webform/pl).
  17. Customers have the right to withdraw their consent for data processing at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  18. If a Customer believes Samsung's processing of their personal data violates the GDPR, they have the right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office.
  19. For corporate reasons, the Organizer may transfer personal data outside the European Economic Area (EEA). In such cases, the Organizer guarantees an equivalent level of data protection through approved mechanisms like European Commission-approved contracts or binding corporate rules.
  20. The Organizer also provides the possibility to obtain copies of relevant data security measures for transfers to third countries.

§ 6 Final Provisions

  1. The content of these Regulations is available to Customers on the Website. Customers can download and save the Regulations.
  2. In matters not covered by the Regulations, generally applicable Polish law applies. All communication regarding the Regulations will be in Polish.
  3. The Organizer reserves the right to amend the Regulations due to reasons such as:
    • a) Changes in applicable laws.
    • b) New interpretations of laws resulting from court rulings or public authority decisions.
    • c) Decisions, recommendations, or orders from public authorities requiring adaptation of the Regulations.
    • d) Adaptation to market conditions due to technological advancements.
    • e) Changes in company details, contact information, or URLs.
    • f) Other necessary changes, provided they are lawful, beneficial to participants, and essential for the proper execution of the Promotion.
  4. Any amendment to the Regulations will not negatively affect rights acquired by Participants prior to the amendment.
  5. Announcements of amendments to the Regulations will be made in advance on the Website.
