Samsung Live Back to School mit AI Giveaway Terms and Conditions

1 Eligibility

1.1 Participants must be 18 years or older and reside in Germany. Employees of Samsung, their relatives, and individuals involved in the conception and execution of this giveaway are excluded from participation.

1.2 Each person may enter the giveaway only once. Winners of a Samsung livestream giveaway within the last 12 months are excluded from participation.

1.3 To participate, an account on Instagram, YouTube, or TikTok is required. Participation is via the Instagram channel @samsunggermany, the YouTube channel @SamsungGermany, or the TikTok channel @mirell_masciullo.

2 Execution

2.1 The giveaway will take place during the "Samsung Live Back to School mit AI" livestream on August 7, 2025, from 6:00 PM to 8:00 PM on the following channels: Instagram @samsunggermany, YouTube @SamsungGermany, and TikTok @mirell_masciullo. Prizes mentioned in section 3.1 will be drawn from comments submitted according to section 2.2 by the respective draw times.

2.2 To enter, participants must post a comment in the livestream chat on the respective channel (@samsunggermany, @SamsungGermany, or @mirell_masciullo) with their favorite product featured in the livestream (Galaxy Z Fold7 / Galaxy Z Flip7 / Galaxy Watch8 / Galaxy Watch8 Classic) or a corresponding hashtag (#GalaxyZFold7 / #GalaxyZFlip7 / #GalaxyWatch8 / #GalaxyWatch8Classic), adhering to section 6.3 of these terms. Prizes listed under section 3.1.1 will be drawn from eligible comments.

2.3 By submitting a comment or hashtag, the participant accepts these terms and conditions and agrees to be notified of winning by Samsung via chat message (Instagram, YouTube, TikTok) as per section 2.4.

2.4 Winners will be randomly selected via lottery from all participants who have submitted a comment according to section 2.2 by the respective draw time.

If a winner has commented on Instagram, YouTube, or TikTok, they will be contacted via live chat message and asked to send their personal contact details (name, address in Germany) to gewinnspiel@samsunglive.de, including a screenshot of their Instagram, YouTube, or TikTok account with their username for verification.

2.5 The winner must respond within 48 hours of the win notification via email. The prize will be sent after successful verification. If no response is received within the timeframe, Samsung is entitled to disqualify the original winner.

3 Prizes

3.1 The following prizes will be raffled:

• 1x Galaxy Z Flip7
• 1x Galaxy S25 Edge

3.2 Prizes are non-negotiable, non-exchangeable, and non-transferable. No credit or cash payout will be given.

3.3 Samsung reserves the right to replace a prize with another prize of similar value if the specified prize is unavailable for reasons beyond Samsung's control.

4 Exclusion from the Giveaway

4.1 Samsung is entitled to exclude participants who violate these terms and conditions, provide false, misleading, or fraudulent information, use unfair means, attempt to enter multiple times, or manipulate the draw results.

4.2 If an exclusion reason exists, Samsung is entitled to withdraw prizes, even retrospectively, and to reclaim awarded prizes or demand compensation.

5 Usage Rights, Consent, and Waiver

The winner agrees to the publication of their comment, including their username, on Samsung Germany's Instagram page and other channels specified in 2.2. The winner grants Samsung a non-exclusive, geographically and materially unlimited, and royalty-free right to use, reproduce, display, publish, make publicly accessible, and distribute the comment for promotional purposes. The winner confirms they will provide written confirmation of these usage rights upon request.

6 Liability

6.1 Samsung is not liable for the availability or technical accuracy and completeness of the promotion page filter, comments, likes, shares, and any links for participants. Specifically, Samsung is not liable for damages, losses, or data deletions resulting from technical malfunctions, delays, viruses, or similar causes.

6.2 Samsung is not liable for damages incurred during the execution of the giveaway or the claiming of a prize. However, statutory liability for (a) personal injury or death, (b) damages caused intentionally or by gross negligence, (c) damages due to the breach of a material contractual obligation (i.e., an obligation on which the participant could and did rely), and (d) cases where liability cannot be excluded by law (e.g., Product Liability Act) is not excluded. If Samsung negligently breaches a material contractual obligation, liability is limited to the typically foreseeable damage.

6.3 Participants undertake to comply with applicable criminal laws and youth protection regulations and not to disseminate or display any racist, pornographic, obscene, offensive, or content unsuitable for minors.

7 Miscellaneous

7.1 Samsung is entitled to terminate the giveaway prematurely, especially in cases of force majeure or if proper execution of the giveaway cannot be guaranteed due to technical and/or legal reasons.

7.2 If any provision of these terms and conditions is or becomes wholly or partially invalid, the validity of the remaining provisions shall not be affected. An invalid provision shall be replaced by one that is legally permissible and most closely approximates the content of the invalid provision. The same applies to any gaps in regulation.

7.3 The law of the Federal Republic of Germany applies.
