New Customers

Welcome to Mercury! This document outlines the terms and conditions for new customers joining Mercury for electricity and broadband services for a 2-year term.

1. The Offer

Choose a joining bonus (or upgrade with a top-up payment) when you sign up for an eligible electricity and broadband bundle for a 2-year term.

2. Eligibility

This offer is available to new residential customers who:

• Sign up for electricity and an eligible broadband service at the same address for a 2-year term.
• Are not existing Mercury customers.
• Have not had electricity or broadband services with Mercury NZ Limited within the last 12 months.

Mercury reserves the right to accept or decline any application. Credit criteria may apply. This offer cannot be combined with other offers. For more information, call 0800 10 18 10. The offer is non-transferable and not redeemable for cash.

3. Changes

This offer may be subject to change or expiry without prior notice.

4. Application

These Offer Terms are in addition to Mercury's General Residential Terms, Electricity and Piped Gas Terms, Phone and Internet Terms, and Privacy Policy. In case of any inconsistency, these Offer Terms take precedence. Full details are available at mercury.co.nz.

5. Term

The agreement is for a 2-year term for electricity and broadband. There is no specific term for gas, landline phone, or mobile phone services.

6. Term Commencement

The Term begins when both broadband and electricity services are connected with Mercury, or at the end of any cooling-off period, whichever is later. Special conditions apply for FibreMax connections with interim wireless broadband and specific joining bonuses (Tier Two or Tier Three).

7. Interim Services

If you opt for an interim wireless broadband service for FibreClassic or FibreMax, you will pay wireless broadband prices until your fibre service is connected. You can cancel the interim service at any time.

8. Joining Bonus

Your joining bonus is determined by your chosen broadband plan. You can upgrade to a higher tier product with an upfront top-up payment.

Upgrades are available with specific top-up payments:

• Upgrade to Tier Two: $400 top-up payment.
• Upgrade to Tier Three: $700 top-up payment.
• FibreMax customers can upgrade to Tier Three for $300.

9. Changes to Your Joining Bonus

Once the Term begins, your joining bonus cannot be changed unless Mercury delivers an incorrect bonus or the bonus is faulty under the Consumer Guarantees Act 1993. If incorrect, the bonus must remain unopened.

10. Changes to Upgrades

If you wish to change your joining bonus upgrade (made via top-up payment), Mercury may allow this before the Term commences. Additional payments or refunds will be processed accordingly. Refunds are typically issued within 10 days.

11. Changes to Your Broadband Plan Before Term Commencement

Changing your broadband plan before the Term starts may affect your joining bonus. Contact Mercury for details. Refunds for top-up payments will be processed if the new plan does not require one, or if a different top-up amount is needed.

12. Changes to Pricing

All pricing is subject to change with notice. A Dual Fuel Discount of 17.25 cents per day (inc GST) is available for customers with both electricity and piped gas/LPG with Mercury. Pricing may vary if you move to a different property.

13. Router Requirements

For fibre services, you can use a Mercury router or your own compatible device. Specifications for BYOD are at mercury.co.nz/fibre-BYOD-specs. For wireless broadband, a Mercury router is required. A $14.95 postage and handling fee applies for Mercury-issued routers.

14. Your Broadband Plan and Prices

15. Changing Your Broadband Plan During the Term

Permitted changes include:

• FibreMax customers with a Tier One bonus can switch to FibreClassic.
• FibreClassic customers can upgrade to FibreMax.
• Wireless broadband customers can upgrade to FibreClassic or FibreMax, subject to availability.
• Wireless broadband customers may switch between wireless plans, but Mercury cannot guarantee the availability of higher data allowances if switching back.

Prohibited changes include:

• Changing from FibreMax to FibreClassic if a Tier Two or Tier Three bonus was selected.
• Moving from FibreClassic or FibreMax to a wireless broadband service or FibreLite.

16. Wireless Broadband

This section applies to customers selecting wireless broadband. Availability varies by area. The 1000GB plan is limited to areas near cellphone towers. Contact Mercury or visit the website to check availability. Unused data on capped plans does not roll over. Data packs are available for purchase ($10 for 10GB). A one-off automatic data pack is applied if you use your full monthly allowance.

For non-capped wireless plans, speeds reduce to 5Mbps after the data allowance is used. Speeds may be lower due to various factors. Data usage is updated with a delay of up to 4 hours. Monitor your usage responsibly.

17. Early Termination Fees

Early termination fees apply if you end your agreement before the Term ends, excluding specific circumstances like switching providers for gas, landline, or mobile services. The fee amount depends on your chosen plan and joining bonus, and it reduces monthly. If you upgrade your bonus with a top-up payment, the early termination fee is based on the equivalent bonus tier for your broadband service.

18. Other Termination Consequences

There are no early termination fees if you switch gas providers, cancel your gas service, switch landline providers, cancel your landline service, switch mobile providers, or cancel your mobile phone service.
