Mercury Offer Terms & Conditions

Introduction

This document outlines the terms and conditions for new Mercury customers joining an eligible electricity and broadband bundle for a 2-year term. It details the offer, eligibility criteria, joining bonuses, plan changes, pricing, and early termination consequences.

1. The Offer

New customers can choose a joining bonus (or upgrade with a top-up payment) when they sign up for an eligible electricity and broadband bundle for a 2-year term.

2. Eligibility

This offer is available to new residential customers who:

• Sign up for electricity and an eligible broadband service together at the same address for a 2-year term.
• Are not existing Mercury customers.
• Have not had electricity or broadband services with Mercury NZ Limited within the last 12 months.

Mercury NZ Limited reserves the right to accept or decline any application and may require credit checks. This offer cannot be combined with other offers. For more information, call 0800 10 18 10. The offer is non-transferable and not redeemable for cash.

3. Changes

This offer may be subject to change or expiry without prior notice.

4. Application

These Offer Terms are in addition to Mercury's General Residential Terms, Electricity and Piped Gas Terms, Phone and Internet Terms, and Privacy Policy. In case of any inconsistency, these Offer Terms take precedence. Full details are available at mercury.co.nz.

5. Term

The agreement is for a 2-year term for electricity and broadband services. There is no specific term for gas, landline phone, or mobile phone services.

6. Term Commencement

The Term begins when both broadband and electricity services are connected with Mercury, including any interim wireless broadband service, or at the end of any applicable cooling-off period, whichever is later. Exceptions apply if you opt for FibreMax with an interim wireless broadband service and select a Tier Two or Tier Three joining bonus, in which case the Term starts upon connection of FibreMax and electricity services.

7. Interim Services

If FibreClassic or FibreMax is chosen with an interim wireless broadband service, wireless broadband prices apply until fibre connection. After connection, the applicable price for the chosen fibre plan will be charged.

8. Joining Bonus

Customers can choose a joining bonus based on their selected broadband plan. Upgrades to higher tiers are possible with an upfront top-up payment.

Tier One Joining Bonus

Products available on Wireless, FibreClassic, and FibreMax.

Tier Two Joining Bonus

Products available only with a top-up payment on FibreMax, or available with top-up payment on Wireless and FibreClassic.

Tier Three Joining Bonus

Available with top-up payment on Wireless, FibreClassic, and FibreMax.

Upgrades:

• Wireless and FibreClassic customers can upgrade to Tier Two with a $400 top-up payment.
• Wireless and FibreClassic customers can upgrade to Tier Three with a $700 top-up payment.
• FibreMax customers can upgrade to Tier Three with a $300 top-up payment.

9. Changes to Your Joining Bonus

Once the Term begins, the joining bonus cannot be changed unless Mercury delivers an incorrect bonus or an exchange is required due to a fault under the Consumer Guarantees Act 1993. Incorrect bonuses must remain unopened in original packaging.

If a mobile handset is chosen as a joining bonus, the SIM card will be sent when the mobile service commences, and the handset will be dispatched afterwards.

10. Changes to Upgrades

Mercury may, at its discretion, allow changes to a chosen joining bonus upgrade prior to the Term commencement. If a new upgrade requires a different top-up payment, the difference must be paid, or the previous payment will be refunded. If the new upgrade does not require a top-up payment, the original payment will be refunded. All refunds are processed within 10 days.

11. Changes to Your Broadband Plan Before Term Commencement

Changing your broadband plan before the Term starts may affect your joining bonus. If the new plan requires a different top-up payment, adjustments will be necessary. Refunds for previous payments will be processed within 10 days.

12. Changes to Pricing

All pricing is subject to change with notice provided according to Mercury's General Terms and Conditions. A Dual Fuel Discount of 17.25 cents per day (inc GST) is available for customers with both electricity and gas services from Mercury. This discount will be applied as a credit on the gas portion of the bill. If you move to a different property, your energy pricing and Dual Fuel Discount may change.

13. Router Requirements

Customers choosing a fibre service can use a Mercury router or their own compatible device. Specifications for compatible devices are available at mercury.co.nz/fibre-BYOD-specs. Using a non-compatible router may affect service speeds. Wireless broadband customers require a Mercury router. A postage and handling fee of $14.95 applies for Mercury-issued routers.

14. Your Broadband Plan and Prices

*Prices are subject to change as set out in clause 12.1.

15. Changing Your Broadband Plan During the Term

Permitted changes include:

• FibreMax customers with a Tier One bonus switching to FibreClassic.
• FibreClassic customers upgrading to FibreMax.
• Wireless broadband customers upgrading to FibreClassic or FibreMax (subject to availability).
• Wireless broadband customers may change between wireless plans, subject to availability. Downgrading data allowances is permitted, but upgrading may not be guaranteed.

Prohibited changes include:

• Changing from FibreMax to FibreClassic if a Tier Two or Tier Three bonus was selected.
• Moving from FibreClassic or FibreMax to a wireless broadband service or to FibreLite.

16. Wireless Broadband

This section applies to customers selecting wireless broadband. Availability varies by area. The 1000GB plan is restricted to areas near cellphone towers. Contact Mercury or visit their website to check availability. Unused data on capped plans does not roll over. Additional data packs can be purchased for $10 per 10GB. A one-off 10GB data pack is automatically applied when the monthly allowance is consumed, if no manual packs have been added. Manual data packs are available for 30 days use.

For non-capped wireless plans, unused data does not roll over. After consuming the monthly data allowance, speeds are reduced to 5Mbps until the next plan renewal. Usage information may have a delay of up to 4 hours. Customers are responsible for monitoring their data usage.

17. Early Termination Fees

Early termination fees apply if the agreement is terminated before the end of the Term. These fees vary based on the broadband service and joining bonus selected and reduce monthly. Fees are payable once during the Term. Termination due to Mercury's breach (e.g., non-payment) may incur applicable fees. Upgrading a joining bonus with a top-up payment means the early termination fee is based on the equivalent product of the bonus tier for your broadband service.

18. Other Termination Consequences

No early termination fee applies if you switch gas providers, cancel your gas service, switch landline providers, cancel your landline service, switch mobile providers, or cancel your mobile service. All prices and fees quoted are inclusive of GST.
