Promotion Regulations

§1 GENERAL PROMOTION CONDITIONS. ORGANIZER AND PARTICIPANT

1. The Organizer of the Promotion is GT GROUP Tomaszek Spółka z ograniczoną odpowiedzialnością with its registered office in Łańcut, ul. Cetnarskiego 35/37, 37-100 Łańcut, registered in the register of entrepreneurs of the National Court Register kept by the District Court in Rzeszów, XII Commercial Division of the National Court Register under KRS number: 0000224213, holding NIP number: 8151664972 and REGON: 18000411300000, BDO: 000003403, with a share capital of PLN 13,257,000.00, fully paid up (hereinafter referred to as the "Organizer").
2. This Regulation defines the terms of participation and resignation from participation in the sales promotion of goods, whose distributor and seller in the Republic of Poland is the Organizer (hereinafter referred to as the "Promotion").
3. The Organizer declares that the Promotion is not a game of chance, a lottery, a mutual bet, a promotional lottery, the outcome of which depends on chance, nor any other form of gambling game within the meaning of the Act of November 19, 2009 on gambling games (consolidated text of Journal of Laws of 2022, item 888, as amended).
4. The Promotion will be carried out on the principles set forth in this Regulation (hereinafter referred to as the "Regulation") during the period from July 4, 2025, to July 31, 2025, or until stocks are exhausted (hereinafter referred to as the "Promotion Period").
5. Participation in the Promotion is open to:
   1. Natural persons who meet all the following conditions:
      1. reside or have a permanent place of residence in the territory of the Republic of Poland;
      2. have full legal capacity;
      3. are consumers within the meaning of art. 22[1] of the Civil Code or entrepreneurs with the rights of a consumer, i.e., they make a purchase directly related to their economic activity, when the concluded contract indicates that it does not have a professional character for this person, resulting in particular from the subject of their economic activity, disclosed in the Central Register and Information on Economic Activity,
   2. Legal persons and organizational units without legal personality with their registered office in the Republic of Poland, meeting the participation conditions in the Promotion specified in the Regulation, (hereinafter referred to as the "Participant").
6. The Promotion consists of purchasing a product covered by the promotion by Participants and the possibility of purchasing another product indicated by the Organizer for the price of 1 PLN gross (hereinafter referred to as the "Promotional Product"). The promotion covers products specified in Annex No. 1 to this Regulation available in the Max Elektro online store at: https://maxelektro.pl/ under the terms and conditions specified in this Regulation.
7. The Promotion does not cover products ordered outside the Promotion Period.

§2 DETAILED PROMOTION CONDITIONS

1. To take advantage of the Promotion, you must:
   1. place an order in the online store at: https://maxelektro.pl/ for the product indicated by the Organizer in Annex No. 1 to the Regulation, and
   2. place an order for the product indicated by the Organizer in Annex No. 1 to this Regulation, marked as "product for 1 PLN",
   3. enter the discount code "WORXACS" in the cart when placing the order, and
   4. click the "Apply Discount" button in the cart.
2. The price of the Promotional Product will be automatically calculated after adding the Promotional Product to the cart.
3. The choice of specific products constituting the Subject of the Promotion lies with the Participant of the Promotion meeting the requirements specified in the Regulation for the purchase of the Subject of the Promotion.
4. Purchases of the Promotional Product are valid only for purchases made in a single transaction. A Participant of the Promotion meeting the conditions of the Promotion may gain the right to purchase another Promotional Product after making purchases within a separate sale from the one that was the basis for obtaining the discount previously.
5. A separate sale is understood as a sale confirmed each time by a separate VAT invoice/receipt.
6. The buyer is not entitled to receive a cash equivalent of the discount amount.
7. The Participant has the right to withdraw from the distance purchase agreement, under which they purchased products covered by the Promotion, within 14 days from the date of purchase, without giving a reason, provided that:
   1. in the case where the Participant wishes to return a product that is part of a set, which is not the Promotional Product, the Promotional Product must also be returned,
   2. in the case where the Participant wishes to return the Promotional Product, the Participant is not obliged to return the remaining products that are part of the set.

§3 PERSONAL DATA

1. The Administrator of the Participants' personal data is the Organizer.
2. The Administrator of personal data has appointed a Data Protection Officer (DPO), who is available by phone at: 509 403 053 or by email at: iod@gtpoland.eu. The person responsible for this function is Mr. Jacek Chmiel.
3. Personal data of the Participants are processed for purposes related to the conclusion and performance of sales contracts for products on the basis of art. 6 par. 1 lit. b) GDPR, under the conditions described in the Privacy Policy available on the website at: https://maxelektro.pl/polityka-prywatnosci-maxelektro/, and for purposes related to participation in the Promotion, on the basis of art. 6 par. 1 lit. f) GDPR, i.e., the legitimate interest of the Administrator consisting in fulfilling the Organizer's obligations towards the Promotion Participants, resulting from the fact of conducting the Promotion.
4. Providing personal data by Participants is voluntary, but necessary to participate in the Promotion. Failure to provide data makes participation in the Promotion impossible.
5. Participant's personal data are disclosed to the following categories of entities: companies servicing the Administrator in the IT, legal and debt collection sectors, courier companies, entities providing online payment services, banks, other payment operators.
6. The Administrator stores the Participants' personal data until the expiry of the limitation period for claims arising from applicable legal provisions.
7. The Participant has the right to access their data and to request their rectification, erasure, or restriction of processing. To the extent that the basis for processing personal data is the legitimate interest of the Administrator, the Participant has the right to object to the processing of personal data. The Participant also has the right to lodge a complaint with the supervisory authority responsible for personal data protection, i.e., the President of the Office for Personal Data Protection.

§4 COMPLAINTS

1. This Regulation does not affect or limit the rights of Participants arising from applicable Polish law. This applies in particular to the Participant's rights in case of non-conformity of the goods with the sales contract.
2. All complaints regarding the Promotion should be submitted to the Organizer in writing, with detailed reservations regarding the course of the Promotion.
3. The Participant is obliged to sign and send the written complaint to the Organizer's correspondence address: GT GROUP Tomaszek Spółka z ograniczoną odpowiedzialnością, ul. Cetnarskiego 35, 37-100 Łańcut, or by email: reklamacje@maxelektro.pl.
4. The written complaint should include: Participant's data, correspondence address, email address, and specify what the complaint concerns.
5. All complaints submitted by Participants will be considered within 14 days from the date of delivery of the complaint to the Organizer.
6. The Organizer will send the resolution of the complaint by registered mail or electronically to the address indicated in the complaint.

§5 FINAL PROVISIONS

1. The Participant may not transfer rights or obligations related to and resulting from the Promotion to third parties.
2. All advertising materials concerning the Promotion are for informational purposes only. The legally binding force is held solely by the provisions of the Regulation.
3. The Promotion cannot be combined with other Organizer's promotions.
4. The Organizer reserves the right to change this Regulation during the Promotion Period.
5. The Organizer reserves the right to terminate the Promotion early. The Organizer will inform about the early termination of the Promotion on the website www.maxelektro.pl at least 3 days before its early termination.
6. All Participants of the Promotion are subject to the provisions of this Regulation.
7. In matters not covered by this Regulation, the universally applicable provisions shall apply, including in particular the provisions of the Act of April 23, 1964, Civil Code (consolidated text of Journal of Laws of 2020, item 1740, as amended).
8. Annex No. 1 to the Regulation constitutes its integral part.
9. The Regulation is available on the website at www.maxelektro.pl.

This Regulation is effective from 04.07.2025.
