General Terms and Conditions

Article 1 - Definitions

Action: Promotional contest or promotional activity organized by Samsung.

Action Area: The territory within the Benelux where the Action takes place, as specified in the Special Terms and Conditions. The Action exclusively applies to Action Products purchased within the Action Area.

Action Period: The period during which the Action runs, as determined in the Special Terms and Conditions.

Action Products: The promotional models listed in the Special Terms and Conditions.

Action Terms and Conditions: These General Terms and Conditions, the Special Terms and Conditions, and any additional terms and provisions that Samsung has announced or will announce on its website or in stores during the Action. It is clarified that the Special Terms and Conditions take precedence over the General Terms and Conditions in case of any discrepancy.

Special Terms and Conditions: The accompanying special terms and/or additional terms as described on the Promotion Page, which form a whole with these General Terms and Conditions and are published by Samsung for a specific Action.

Contribution Material: Contributions of any kind (including: images, videos, texts, photos, audio, drawings, paintings, interviews, portraits, social media posts, etc.) from Participants in the context of an Action. This also includes any contributions and recordings made in connection with the Action.

Participant: The person who participates in the Action and is entitled to do so based on Article 2 of these General Terms and Conditions.

Registration Period: The period within which registrations for participation in the Action can be submitted, as stated in the Special Terms and Conditions.

Promotion Page: The page on Samsung.com for current promotions, found at www.samsung.com/be/promo/, www.samsung.com/be_fr/promo/, or www.samsung.com/nl/promo/.

Benefit: Any benefit obtained in an Action, including: a prize, a discount, a cashback, or a product, as described in the Special Terms and Conditions. If it concerns a competition, the winner is the Participant to whom a prize is awarded in the manner specified in the Special Terms and Conditions.

Article 2 - Participation

1. Participation in the Action is open only to natural persons who have a fixed place of residence or stay in the Action Area and are over 18 years of age at the time of participation. Upon request from Samsung, the Participant must identify themselves legally and provide proof of their place of residence or stay and age.
2. Participation in the Action is free of charge, unless otherwise stated in the Special Terms and Conditions.
3. Participation in certain Actions is only possible upon purchase of a specific Action Product, as indicated in the Special Terms and Conditions. Participation in these Actions is open only to those who have purchased the Action Product from a participating store, as mentioned on the website, within the Action Period. If the product was purchased from a non-participating store or from a private individual, participation in the Action is not possible. Subsequent owners of the product (e.g., private individuals who have purchased a so-called 'second chance' product, an 'outlet' product, a B-grade product, or an exchanged product) are also not eligible for participation in the Action and are not entitled to the Benefit. The right to the Benefit also expires upon cancellation of the original purchase, and the Participant must return any received Benefit on their own initiative and at their own expense to Samsung as soon as possible, but in any case within five (5) working days after the right to participate has expired. Participation in the Action or the right to the Benefit is strictly personal and non-transferable. Such promotions are valid while supplies last, and Samsung is not responsible for the availability or stock of Action Products at participating stores.
4. For participation in certain Actions, registration via a website is required, within the Registration Period. Registration is free of charge. The Participant must have an existing email address and a permanent address of residence or stay in the Action Area. Further conditions for registration can be found on this website. Confirmation of registration will be sent to the provided (email) address. If this confirmation is not received, the Participant must contact Samsung within two weeks after registration (see Article 8-1). If additional information and/or documentation is required for successful registration, the registrant will be given fourteen (14) calendar days after receiving the request for correction from Samsung to provide this additional information and/or documentation. If Samsung has not received this additional information and/or documentation within this fourteen (14) calendar day period after receiving the request for correction from Samsung, the registration will not be successful, and the submission will not be included in the Action.
5. Participation in the Action is open only to consumers. A consumer is understood to be a natural person who does not act for purposes related to their trade, business, craft, or profession.
6. Promotions can be combined with other promotions or permanent benefits offered on samsung.com for participating products, unless explicitly stated otherwise in the Special Terms and Conditions.

Article 3 - Exclusions

1. Employees of Samsung, affiliated companies, as well as all persons directly or indirectly involved in (the organization of) the Action or the Benefit or the (indirect) provider of the Benefit, and their respective employees, are excluded from participation.
2. The Participant may only participate in the Action during the Registration Period and exclusively in the manner described in the Action Terms and Conditions. Unless otherwise stated in the Special Terms and Conditions, participation in different actions cannot be combined. If Samsung receives the Participant's submission late, too early, not in the prescribed manner, insufficiently prepaid, incomplete, or otherwise incomplete, the submission will not be accepted, and will not be included in the Action. Samsung accepts no liability for (the consequences of) delayed, incomplete, or lost submissions due to technical reasons or other causes. The Participant shall keep a copy or duplicate of their registration and submissions (including the Contribution Material). Samsung is not responsible for damaged, lost, or delayed submissions.
3. Participation is not allowed, and Samsung is entitled to exclude Participants or groups of Participants without further notice from participation in the Action and any subsequent actions, whereby the right to the Benefit will expire, when:
   • a. A Participant has participated in the Action in violation of the Action Terms and Conditions;
   • b. A Participant provides multiple, incomplete, or false (email) addresses, names, and/or other (personal) data;
   • c. The use of certain scripts, systems, automated functions, or all sorts of techniques that increase the chances of winning is involved;
   • d. There is misuse, fraud, manipulation, or circumvention of and violation of the Action Terms and Conditions; or
   • e. A Participant does not participate in the action for personal use but acts for purposes related to their trade, business, craft, or profession;
   Samsung is entitled to take such action based on a suspicion – without stating reasons and without being obliged to any compensation to the respective Participant – and is not obliged to inform the Participant thereof or to provide proof thereof.

Article 4 - The Benefit

1. The potential right to receive the Benefit is strictly personal, non-exchangeable for goods and/or services, and non-transferable without written consent from Samsung.
2. Samsung is at all times entitled to offer an equivalent alternative for the Benefit without prior notice, without being obliged to any compensation.
3. If a Participant has not contacted Samsung within the period specified in the Special Terms and Conditions, or within one month if this period is missing, and has not accepted the Benefit, Samsung has the right to forfeit that Participant's claim to the Benefit. Samsung may award the relevant Benefit to another Participant. Samsung is not obligated to notify that the Benefit has expired.
4. Samsung strives to transfer, deliver, or personally hand over the Benefit within 16 weeks after submitting a valid registration, or after determining the winners in the case of a competition. If the Benefit is a monetary amount (cashback), it can only be transferred to a bank account within the European Union. If the Benefit is a gift (product), it can only be sent to postal addresses within the Benelux. If the Benefit is sent to a postal address within the Benelux, the Participant is deemed to have received the Benefit upon delivery of the Benefit to the specified postal address.
5. If Dutch gambling tax is due on the Benefit for an Action in the Netherlands, it will be paid by Samsung and not charged to the Participant. The Participant is solely responsible for any other taxes and levies due.

Article 5 - Contribution Material

1. The Participant declares and guarantees that the Contribution Material provided to Samsung in the context of an Action is not unlawful and does not violate the law. In particular, the Participant expressly declares and guarantees that the Contribution Material does not infringe on the (intellectual property) rights of third parties and is not offensive, insulting, racist, defamatory, slanderous, discriminatory, or otherwise contrary to good taste or decency, nor is it or can it be misleading or unlawful in any way. The Participant shall indemnify Samsung against any claim from a third party in connection with the content of the Contribution Material submitted by the Participant. Samsung may, if it deems appropriate or necessary in its sole discretion for any of the aforementioned reasons or any other valid reason, refuse or remove the Contribution Material without consultation or approval from the Participant.
2. The Participant expressly and unconditionally transfers all current and future rights to the Contribution Material (including intellectual property and personality rights) to Samsung. To the extent that this transfer is not permitted by law, the Participant waives these rights. Samsung may exploit and license the Contribution Material worldwide and without limitation through any conceivable medium during and after the Action Period. Furthermore, the Participant waives any right to compensation in connection with (the transfer of) the Contribution Material. The Participant shall ensure that third parties who may assert such rights to the Contribution Material will similarly transfer these rights to Samsung or waive these rights.
3. The Participant authorizes Samsung and/or other companies within the Samsung group to use the Contribution Material (and in particular to display or communicate it to the public) in any way or medium (print, publications, film, digital, etc.) for promotional and other purposes of Samsung and/or another company within the Samsung group, without any right to compensation or remuneration, other than the Benefit to which they may be entitled. The Participant shall ensure that third parties involved in the Participant's participation in the Action also grant a similar authorization to Samsung, without any right to compensation or remuneration.

Article 6 - Exclusion of Liability

1. Samsung, its employees, its commissioned agents, or third parties are, except in cases of intent or gross negligence, not liable for: (i) costs and additional expenses that the Participant may incur in connection with (the payment or use of) the Benefit; (ii) damage caused by (the payment or use of) the Benefit or by the Participant's participation in the Action; (iii) damage caused by malfunctions (of any kind) in the software, computer, network, internet, resulting in the Participant's participation not being received, being defective, delayed, or too late by Samsung; (iv) fraud by Participant(s); and (v) the content of the Contribution Material.
2. Samsung provides no guarantee whatsoever with regard to the Benefit paid out and excludes all liability (except in cases of intent or gross negligence) in this regard. Samsung is not liable for (i) any defects of the Benefit, (ii) if the Benefit is received later than announced, (iii) if the Benefit is received by the wrong person or is lost or damaged during shipment, or (iv) if the (received) Benefit deviates from the offered Benefit in minor aspects.
3. In the event that a social media platform such as Instagram, Facebook, or Twitter is used for an Action, the platform is in no way responsible or liable for the Action. The Action is in no way sponsored, endorsed, administered, or associated with the platform.

Article 7 - Privacy

1. The personal data provided by the Participant to Samsung in the context of this Action are subject to applicable national privacy legislation. Samsung will process this data in its capacity as data controller exclusively for the proper conduct of the Action, its own market research and direct marketing, and for the purposes stated in these Action Terms and Conditions and the Special Terms and Conditions. The personal data may be passed on to one or more entities of the group to which Samsung belongs for the purposes mentioned above, or in case of a legal obligation or at the request of the police or judicial authorities. Personal data will not be sold to third parties.
2. In certain cases, the user may also provide this personal data using their account on a social media platform, such as Facebook or Twitter.
3. Each Participant can exercise their legal right to access, rectify, and object to the use for direct marketing free of charge by sending a written, signed, and dated request, along with a copy of their identity card, to Samsung, by regular mail to Samsung Electronics Benelux B.V., Evert van de Beekstraat 310, 1118 CX Schiphol, The Netherlands (for the Netherlands) or Samsung Electronics Belgium, Diegem (1831) Airport Plaza, Geneva Building, Leonardo Da Vincilaan 19, Belgium (for Belgium and Luxembourg). If it concerns an electronic identity card, a printout of the chip content or an official certificate of residence is also required. The Participant can read the full Samsung privacy policy at http://www.samsung.com/be/info/privacy.html (NL) or http://www.samsung.com/be_fr/info/privacy.html (FR) for Belgium, or www.samsung.com/nl/info/privacy.html for the Netherlands. If a Participant submits a request to delete their personal data, their participation in the Action will expire, and the respective Participant will no longer be eligible for the Benefit.

Article 8 - Complaints

1. For questions, comments, or complaints about the Action, anyone can contact Samsung's customer service via the address and telephone number as stated in the Special Terms and Conditions. Customer service can also be reached by telephone at 088-9090100 (Netherlands), 02 201 2418 (Belgium), or 26 10 37 10 (Luxembourg).
2. Samsung is not obliged to engage in any correspondence regarding exclusions from participation, removal of Contribution Material, or the outcome of an Action, as referred to in the Action Terms and Conditions.
3. The absence of a response from Samsung to a message, email, or letter from the Participant cannot in any case be considered as agreement with the content of that message, email, or letter.

Article 9 - Final Provisions

1. For Actions in the Netherlands that contain an element of chance, the Dutch Code of Conduct for Promotional Lotteries applies to these Action Terms and Conditions and the Action, and Samsung acts in accordance with this Code of Conduct.
2. Samsung reserves the right to cancel, interrupt, or modify the Action, the Action Terms and Conditions, and/or the Benefit at its sole discretion and without prior notice or statement of reasons if circumstances so require, without being liable for any compensation to the Participants.
3. The content of the Action Terms and Conditions and the Special Terms and Conditions is subject to typographical errors and interpretation. No rights can be derived from Samsung's typographical errors and mistakes.
4. The law of the Action Area as determined in the Special Terms and Conditions applies to these Action Terms and Conditions and the Special Terms and Conditions. If the Action Area includes multiple countries, the legislation of the Participant's place of residence shall apply, namely: Belgium, the Netherlands, or the Grand Duchy of Luxembourg.
5. For Participants from the Netherlands, the court of Amsterdam has jurisdiction to hear any disputes between Samsung and the Participant, but not before the parties have consulted each other. For Participants from Belgium, the court of Antwerp has jurisdiction, and for Participants from the Grand Duchy of Luxembourg, the court of Luxembourg (City) has jurisdiction to hear any disputes between Samsung and the Participant. However, the Participant and Samsung undertake to consult each other prior to any proceedings and to attempt to reach an amicable solution.
