General Terms and Conditions of the Action

Please read these General Terms and Conditions of the Action carefully, as well as the Specific Terms and Conditions of the Action and/or any additional General Conditions described on the Samsung Action page (the "Specific Terms and Conditions of the Action"). These General Terms and Conditions of the Action, together with the Specific Terms and Conditions of the Action, apply to the Action and your participation in it. By participating in the Action, you declare that you accept the General Terms and Conditions of the Action.

Article 1 - Definitions

• Action: Promotional contest or promotional action as described in the Specific Terms and Conditions of the Action organized by Samsung.
• Zone of the Action: The Benelux territory where the Action takes place, as indicated in the Specific Terms and Conditions of the Action. The Action only concerns promotional products purchased within the Zone of the Action.
• Period of the Action: The period during which the promotion runs, as indicated in the Specific Terms and Conditions of the Action.
• Products of the Action: The promotional models as indicated in the Specific Terms and Conditions of the Action.
• Conditions of the Action: These General Terms and Conditions of the Action, the Specific Terms and Conditions of the Action, and any additional conditions that Samsung has announced or disclosed during the Action on its website or at the point of sale. It is specified that in case of a difference between the two, the Specific Terms and Conditions of the Action shall prevail over the General Terms and Conditions of the Action. The General Terms and Conditions of the Action apply to promotional campaigns organized by Samsung.
• Specific Terms and Conditions of the Action: The associated Specific Terms and Conditions of the Action and/or additional General Conditions as described on the Action page, form a whole with these General Terms and Conditions of the Action and are published by Samsung with the Action for a specific Action.
• Participation Material: Contributions of any nature (including: images, videos, texts, photographs, audio, drawings, paintings, interviews, portraits, social media messages, etc.) from Participants as part of an Action. This also includes any payments and recordings made as part of the campaign.
• Participant: The person who takes part in the Action and is also eligible to do so based on Article 2 of these General Terms and Conditions of the Action.
• Registration Period: Period during which registrations to participate in the Action can be submitted, as indicated in the Specific Terms and Conditions of the Action.
• Action Page: Refers to the Samsung.com page dedicated to current Actions, located at www.samsung.com/nl/promo, www.samsung.com/be/promo, or www.samsung.com/be_fr/promo.
• Samsung: Samsung Electronics Benelux B.V., located at Rue Evert van de Beek 310, 1118 CX Schiphol, Netherlands, with a branch in Diegem (1831) Airport Plaza, Geneva Building, Leonardo Da Vincilaan 19 in Belgium, under company number 0472.450.079.
• Benefit: Any benefit obtained during an Action, including: a prize, a reduction, a cash rebate, or a product, as described in the Specific Terms and Conditions of the Action. In the case of a contest, the winner is the Participant who receives a prize in the manner indicated in the Specific Terms and Conditions of the Action.

Article 2 - Participation

1. Participation in the Action is open only to natural persons residing in the Zone of the Action and aged over 18 years at the time of participation. Upon Samsung's request, the Participant shall validly identify themselves and provide proof of their place of residence and age.
2. There are no costs associated with participation, unless otherwise indicated in the Specific Terms and Conditions of the Action.
3. Specific Terms and Conditions of the Action. Participation in these Actions is only open to those who have purchased the Product of the Action from a Participating store in the Action, as indicated on this website, during the Period of the Action. If the product is purchased from a non-participating store or from a private individual, you cannot participate in the Action. Successive owners of the product (e.g., individuals who have purchased a so-called "second chance" product, an "outlet" product, a B-grade product, etc., or an exchanged product) also cannot participate in the promotion and will not be able to benefit from the Benefit in any case. Furthermore, the right to the Benefit will become void upon cancellation of the original purchase, and the Participant must then return any Benefit already received to Samsung on their own initiative and at their own expense, as soon as possible, and in any case within five (5) working days of the expiry of the right to participate. Participation in the Action or the right to the Benefit is strictly personal and non-transferable. These promotions are valid while stocks last. Samsung is not responsible for the availability or stock of the Products of the Action in the Participating stores.
4. Registration via a website is required to participate in certain Actions, during the Registration Period. Registration is free of charge. The Participant must possess a valid email address and a valid permanent residence address located within the Zone of the Action. Other registration conditions can be consulted via this website. Confirmation of registration will be sent to the provided (email) address. If this confirmation is not received, the Participant must contact Samsung within two weeks of registration (see Article 8-1). If additional information and/or documents are required to complete the registration, the Participant will have the opportunity to provide this additional information and/or documents up to fourteen (14) calendar days after receiving Samsung's request for correction. If Samsung has not received this additional information and/or documents within these fourteen (14) calendar days after receiving Samsung's request for correction, the registration will fail and the corresponding participation will not be taken into account in the Action.
5. Participation in the Action is open only to consumers. By consumer, we mean a natural person who does not act for purposes related to their commercial, industrial, craft, or professional activity.
6. Promotions are cumulative with other promotions or permanent benefits offered on Samsung.com for the included products, unless otherwise stated in the specific promotion conditions.

Article 3 - Exclusions

1. Samsung employees, employees of Samsung subsidiaries, and all persons directly or indirectly involved in the (organization of) the Action or the Benefit, or the (indirect) supplier of the Benefit, and their respective employees, are excluded from participation.
2. The Participant may only participate in the Action during the Registration Period and only in the manner described in the General Terms and Conditions of the Action. Unless otherwise stated in the Specific Terms and Conditions of the Action, combined participation in different Actions is not permitted. If the Participant does not provide what is requested by Samsung in time, provides it too early, not in the prescribed manner, with insufficient postage, incompletely, or if their submission is incomplete in any way, the submission will not be accepted and therefore not taken into account in the Action. Samsung disclaims all liability for delays, incomplete or lost submissions for technical or other reasons. The Participant shall keep a copy or transcript of their participation and submissions (including the Participation Material). Samsung is not responsible for damaged, lost, or delayed submissions.
3. Participation is not allowed and Samsung is entitled to exclude Participants or groups of Participants from participation in the Action and any subsequent Action without further notice, the right to the benefit becoming void, if:
   • a. A Participant has participated in the Action in violation of the General Terms and Conditions of the Action;
   • b. A Participant provides incomplete or false addresses (email), names, and/or other (personal) data;
   • c. Various scripts, systems, automated functions, or techniques that increase the chances of winning are used;
   • d. There is abuse, fraud, manipulation, or circumvention and violation of the General Conditions; or
   • e. A Participant does not participate in the Action for personal use, but acts for purposes related to their trade, business, craft, or profession;
   Samsung is entitled to do so based on suspicion without stating a reason and without being obliged to pay any compensation to the Participant concerned and is not obliged to inform the Participant or provide proof to justify itself.

Article 4 - Benefit

1. Any right to the Benefit is strictly personal, cannot be exchanged for goods and/or services, and is not transferable without Samsung's written consent.
2. Samsung is at all times entitled to offer an equivalent alternative to the Benefit without prior notice, without any obligation to pay compensation.
3. If a Participant does not notify Samsung within the period specified in the Specific Terms and Conditions of the Action, or within one month if this period is exceeded, Samsung has the right to cancel the Participant's right to the Benefit. Samsung may then possibly award the relevant Benefit to another Participant. Samsung is not obliged to notify that the right to the Benefit has expired.
4. Samsung endeavors to transfer, deliver, or personally hand over the Benefit to the Participant within 16 weeks of the submission of a valid registration or the determination of winners in the case of a contest. When the Benefit is a sum of money (cashback), it can only be transferred to an account number within the European Union. When the Benefit is a gift (product), it can only be sent to postal addresses within the Benelux. In the case where the Benefit is sent to a postal address within the Benelux, the Participant is considered to have received the Benefit at the time of delivery of the Benefit to the indicated postal address.
5. If Dutch gambling tax is payable on the Benefit for a promotion in the Netherlands, it will be paid by Samsung and will not be charged to the Participant. The Participant is responsible for all other applicable taxes and duties.

Article 5 - Participation Material

1. The Participant declares and warrants that the Participation Material provided to Samsung as part of an Action is not illegal and does not violate the law. In particular, the Participant expressly declares and warrants that the Participation Material does not infringe on the rights (of intellectual property) of third parties and is not or cannot be insulting, offensive, hurtful, racist, libelous, defamatory, discriminatory, or otherwise contrary to good taste or decency. This Participation Material may also not be misleading or illegal in any way. The Participant shall indemnify Samsung against any third-party claims relating to the content of the Participation Material submitted by the Participant. Samsung may, at its sole discretion, deem this Participation Material unsuitable for any of the aforementioned reasons or for any other reason it deems valid. Samsung may then refuse or remove the Participation Material in question, without needing to consult or obtain the Participant's approval.
2. The Participant assigns all current and future rights to the Participation Material (including intellectual property and moral rights) expressly and unconditionally to Samsung. To the extent that this transfer is not permitted by law, the Participant waives these rights. Samsung may exploit and license the Participation Material worldwide and without limitation by any imaginable medium during and after the Period of the Action. Furthermore, the Participant waives any right to compensation in relation to the (transfer of) the Participation Material. The Participant shall ensure that third parties who are involved in the Action as part of the Participant's participation also provide Samsung with an identical authorization, without being entitled to any compensation or indemnity.
3. The Participant authorizes Samsung and/or other companies in the Samsung group to use the Participation Material (and in particular to display or communicate it to the public) in any way whatsoever (print, publications, film, digital, etc.), for Samsung's promotional and other purposes and/or those of another company in the Samsung group, without being entitled to any compensation or indemnity, other than the Benefit to which they may be entitled. The Participant shall ensure that third parties who are involved in the Action as part of the Participant's participation also provide Samsung with an identical authorization, without being entitled to any compensation or indemnity.

Article 6 - Exclusion of Liability

1. Samsung, its employees, auxiliary persons, or third parties engaged by it, are not liable, except in cases of intent or gross negligence, for: (i) additional costs and expenses that the Participant would incur in connection with the (distribution or use) of the Benefit; (ii) damages caused by (the supply or use of) the Benefit or by the Participant's participation in the Action; (iii) damages caused by malfunctions (of any kind whatsoever) of software, computer, network, or the internet, as a result of which the Participant's participation was not registered, or was registered incorrectly, delayed, or late by Samsung; (iv) fraud by the Participant(s); and (v) the content of the Participation Material.
2. Samsung offers no guarantee regarding the provided Benefit and excludes all liability (except in cases of intent or gross negligence) in this regard. Samsung shall not be liable (i) for any defect in the Benefit, (ii) if the Benefit is received later than announced, (iii) if the Benefit is received by the wrong person or is lost or damaged during transport, or (iv) if certain minor points of the (received) Benefit differ from the proposed Benefit.
3. In the event that a social media platform such as Facebook or Twitter is used for an Action, the platform is in no way responsible for the Action. The Action is not sponsored, approved, administered, or associated with the platform in any way.

Article 7 - Confidentiality

1. Personal data communicated to Samsung by the Participant in the context of this Action are subject to applicable national privacy laws. Samsung will only process this data in its capacity as data controller for the proper conduct of the Action, for its own market research and direct marketing, and for the purposes stated in these General Terms and Conditions of the Action and the Specific Terms and Conditions of the Action. Personal data may be transferred within the framework of the aforementioned purposes to one or more entities of the group to which Samsung belongs or in case of a legal obligation or at the request of police or judicial authorities. Personal data will not be sold to third parties.
2. In some cases, the user may also provide this personal data using their account on a social media platform, such as Facebook or Twitter.
3. Each Participant can freely exercise their legal right of access, rectification, and objection to the use of their data for direct marketing by sending Samsung a written request, signed and dated for this purpose, accompanied by a copy of their identity card, by postal mail to Samsung. Electronics Benelux BV, Evert van de Beekstraat 310, 1118 CX Schiphol, Netherlands (for the Netherlands) or Samsung Electronics Belgium, Diegem (1831) Airport Plaza, Geneva Building, Leonardo Da Vincilaan 19, Belgium (for Belgium and Luxembourg). In the case of an electronic identity card, a printout of the chip content or an official certificate of residence is also required. The Participant can read Samsung's full privacy policy at http://www.samsung.com/be/info/privacy.html (NL) or http://www.samsung.com/be_fr/info/privacy.html (FR) for Belgium or www.samsung.com/nl/info/privacy.html for the Netherlands. If a Participant submits a request to delete their personal data, their participation in the Action will become void, and the Participant concerned will no longer be able to benefit from the Benefit.

Article 8 - Complaints

1. Any person with questions, comments, or complaints regarding the Action can contact Samsung's customer service at the address and telephone number indicated in the Specific Terms and Conditions of the Action. Customer service can also be reached at the number 088-9090100 (Netherlands), 02 201 2418 (Belgium) or 26 10 37 10 (Luxembourg).
2. Samsung is not bound by any correspondence concerning exclusions from participation, the deletion of Participation Material, or the outcome of an Action, as indicated in the General Terms and Conditions of the Action.
3. Samsung's failure to respond to a message, email, or letter from the Participant cannot under any circumstances be considered as consent to the content of that message, email, or letter.

Article 9 - Final Provisions

1. For Actions in the Netherlands containing an element of chance, the Dutch Code of Conduct for Promotional Lotteries (Nederlandse Gedragscode Promotionele Kansspelen) applies to these General Terms and Conditions and the promotion, and Samsung acts in accordance with this code of conduct.
2. Samsung reserves the right to cancel, interrupt, or modify the Action, the General Terms and Conditions of the Action, and/or the Benefit at its sole discretion and without prior notice or justification if circumstances so require, without being liable in any way for compensation to Participants.
3. The content of the General Terms and Conditions and the Specific Terms and Conditions of the Action is subject to typographical errors and interpretation. No rights can be derived from writing errors or mistakes made by Samsung.
4. These General Terms and Conditions of the Action and the Specific Terms and Conditions of the Action are governed by the law of the Zone of the Action as defined in the Specific Terms and Conditions of the Action. If the Zone of the Action covers multiple countries, the legislation of the Participant's place of residence shall apply: namely, Belgium, the Netherlands, or the Grand Duchy of Luxembourg.
5. For Participants from the Netherlands, the court of Amsterdam has jurisdiction for any dispute between Samsung and the Participant, but only if the parties have first entered into mutual consultation. For Participants from Belgium, the court of Brussels has jurisdiction, and for Participants from the Grand Duchy of Luxembourg, the court of Luxembourg (City) has jurisdiction for any dispute between Samsung and the Participant. However, the Participant and Samsung undertake to consult and attempt to find an amicable solution prior to any proceedings.
