How to Participate

Returns

If you are not satisfied and wish to return your order, you must also cancel your Samsung Care+ insurance. The Samsung Care+ insurance cannot be canceled if your ordered product is not returned.

If the order is not received by Samsung, the purchase cannot be canceled, and the purchase amount cannot be refunded.

Exchanges

Products can be exchanged for a different color by initiating a return process. If you wish to exchange for a different model, you must return the order, cancel the Samsung Care+ insurance, and place a new order. The Samsung Care+ insurance cannot be canceled if your purchase is not returned. General Terms and Conditions

Article 1 - Definitions

The following definitions apply in these General Terms and Conditions:

• “Actie” (Promotion): A promotional competition or promotional activity as described in the Special Terms and Conditions, organized by Samsung.
• “Actiegebied” (Promotional Area): The territory within the Benelux where the Promotion takes place, as stated in the Special Terms and Conditions. The Promotion exclusively applies to Promotional Products purchased within the Promotional Area.
• “Actieperiode” (Promotion Period): The period during which the Promotion is valid, as determined in the Special Terms and Conditions.
• “Actieproducten” (Promotional Products): The promotional models as listed in the Special Terms and Conditions.
• “Actievoorwaarden” (Promotion Terms): These General Terms and Conditions, the Special Terms and Conditions, and any additional terms and conditions that Samsung has made known or will make known on its website or in stores during the Promotion. It is clarified that in case of a discrepancy between the two, the Special Terms and Conditions shall prevail over the General Terms and Conditions. The Promotion Terms are valid for promotional activities organized by Samsung.
• “Bijzondere Actievoorwaarden” (Special Terms and Conditions): The accompanying special terms and conditions and/or additional terms and conditions as described on the Promotion Page, which form a whole with these General Terms and Conditions and are published by Samsung together with the Promotion for a specific Promotion.
• “Deelnamemateriaal” (Participation Material): Contributions of any kind (including: images, videos, texts, photos, audio, drawings, paintings, interviews, portraits, social media posts, etc.) from Participants in the context of a Promotion. This also includes any contributions and recordings made in connection with the Promotion.
• “Deelnemer” (Participant): The person who participates in the Promotion and is entitled to do so based on Article 2 of these General Terms and Conditions.
• “Registratieperiode” (Registration Period): The period within which registrations for participation in the Promotion can be submitted, as stated in the Special Terms and Conditions.
• “Promotiepagina” (Promotion Page): The page on Samsung.com for current promotions, found at www.samsung.com/nl/promo/, www.samsung.com/be/promo, or www.samsung.com/lu/promo.
• “Samsung”: Samsung Electronics Benelux B.V., located at Evert van de Beekstraat 310, 1118 CX Schiphol, Netherlands, with a branch office in Diegem (1831) Airport Plaza, Geneva Building, Leonardo Da Vincilaan 19, Belgium, with company number 0472.450.079.
• “Voordeel” (Benefit): Any benefit obtained in a Promotion, including: a prize, a discount, a cashback, or a product, as described in the Special Terms and Conditions. If it concerns a competition, the winner is the Participant who is awarded a prize in the manner specified in the Special Terms and Conditions.

Article 2 - Participation

1. Participation in the Promotion is open only to natural persons who have a permanent residence or domicile in the Promotional Area and are 18 years of age or older at the time of participation. Upon Samsung's request, the Participant must legally identify themselves and provide proof of their residence and age.
2. Participation in the Promotion is free of charge, unless otherwise specified in the Special Terms and Conditions.
3. Participation in certain Promotions is only possible upon purchase of a specific Promotional Product, as indicated in the Special Terms and Conditions. Participation in these Promotions is only open to those who have purchased the Promotional Product from a participating retailer, as mentioned on this website, within the Promotion Period. If the product was purchased from a non-participating retailer or a private individual, participation in the Promotion is not possible. Subsequent owners of the product (e.g., private individuals who have purchased a so-called 'second chance' product, an 'outlet' product, a B- or C-grade product, or an exchanged product) are also not eligible for participation in the Promotion and are not entitled to the Benefit. The right to the Benefit also expires upon cancellation of the original purchase, and in that case, the Participant must return any received Benefit on their own initiative and at their own expense to Samsung, as soon as possible but in any case within five (5) working days after the right to participate has expired. Participation in the Promotion or the right to the Benefit is strictly personal and non-transferable. Such Promotions are valid while supplies last, and Samsung is not responsible for the availability or stock of Promotional Products at participating retailers.
4. For participation in certain Promotions, registration via a website is required, within the Registration Period. Registration is free of charge. The Participant must have an existing email address and a residential address in the Promotional Area. Further registration conditions can be found on this website. Confirmation of registration will be sent to the provided (email) address. If this confirmation is not received, the Participant must contact Samsung within two weeks of registration (see Article 8-1). If additional information and/or documentation is required for successful registration, the registrant will be given the opportunity to provide this additional information and/or documentation within fourteen (14) calendar days after receiving the request for correction from Samsung. If Samsung does not receive this additional information and/or documentation within this fourteen (14) calendar day period after receiving the request for correction from Samsung, the registration will not be successful, and the submission will not be included in the Promotion.
5. Participation in the Promotion is open only to consumers. A consumer is understood to be a natural person who does not act for purposes related to their trade, business, craft, or profession.

Article 3 - Exclusions

1. Employees of Samsung, affiliated companies of Samsung, as well as all persons directly or indirectly involved in (the organization of) the Promotion or the Benefit or the (indirect) provider of the Benefit, and their respective employees, are excluded from participation.
2. The Participant can only participate in the Promotion during the Registration Period and exclusively in the manner described in the Promotion Terms. Unless otherwise stated in the Special Terms and Conditions, participation in different promotions cannot be combined. If the Participant's submission is not received by Samsung in a timely manner, too early, not in the prescribed manner, insufficiently franked, incomplete, or otherwise incomplete, the submission will not be accepted, and it will not be included in the Promotion. Samsung accepts no liability for (the consequences of) delayed, incomplete, or lost submissions due to technical reasons or other causes. The Participant shall keep a copy or duplicate of their registration and submissions (including the Participation Material). Samsung is not responsible for damaged, lost, or delayed submissions.
3. Participation is not permitted, and Samsung is entitled to exclude Participants or groups of Participants from participation in the Promotion and any subsequent promotions without further notice, forfeiting the right to the Benefit, when:
   • a. A Participant has participated in the Promotion in violation of the Promotion Terms;
   • b. A Participant provides multiple, incomplete, or false (email) addresses, names, and/or other (personal) data;
   • c. Use is made of certain scripts, systems, automated functions, or any techniques that increase the chances of winning;
   • d. There is misuse, fraud, manipulation, or circumvention of and infringement of the Promotion Terms; or
   • e. A Participant does not participate in the promotion for personal use but acts for purposes related to their trade, business, craft, or profession;
   Samsung is entitled to take this action based on suspicion – without stating reasons and without being liable for any compensation to the respective Participant – and is not obliged to inform the Participant thereof or to provide proof.

Article 4 - The Benefit

1. Any right to receive the Benefit is strictly personal, non-exchangeable for goods and/or services, and non-transferable without Samsung's written consent.
2. Samsung is at all times entitled to offer an equivalent alternative for the Benefit without prior notice, without being liable for any compensation.
3. If a Participant does not report to Samsung within the period specified in the Special Terms and Conditions, or within one month if this period is missing, and has accepted the Benefit, Samsung has the right to forfeit the Participant's claim to the Benefit. Samsung may award the relevant Benefit to another Participant. Samsung is not obliged to notify that the Benefit has been forfeited.
4. Samsung aims to transfer, deliver, or personally hand over the Benefit within 16 weeks after submitting a valid registration, or after determining the winners in the case of a competition. If the Benefit is a monetary amount (cashback), it can only be transferred to a bank account number within the European Union. If the Benefit is a gift (product), it can only be shipped to postal addresses within the Benelux. In case the Benefit is shipped to a postal address within the Benelux, the Participant is deemed to have received the Benefit at the time of delivery of the Benefit to the specified postal address.
5. If Dutch gambling tax is due on the Benefit for a Promotion in the Netherlands, it will be paid by Samsung and will not be charged to the Participant. The Participant is solely responsible for any other applicable taxes and levies.

Article 5 - Participation Material

1. The Participant declares and guarantees that the Participation Material provided to Samsung in the context of a Promotion is not unlawful and does not violate the law. In particular, the Participant expressly declares and guarantees that the Participation Material does not infringe on the rights of third parties (intellectual property rights) and is not offensive, insulting, racist, defamatory, discriminatory, or otherwise contrary to good taste or decency, nor is it misleading or unlawful in any way. The Participant shall indemnify Samsung against any claim from a third party related to the content of the Participation Material submitted by the Participant. Samsung may, if it deems it appropriate or necessary in its sole discretion for any of the aforementioned reasons or any other valid reason, refuse or remove the Participation Material without the Participant's consultation or approval.
2. The Participant expressly and unconditionally transfers all current and future rights to the Participation Material (including intellectual property and personality rights) to Samsung. To the extent that this transfer is not permitted by law, the Participant waives these rights. Samsung may exploit and license the Participation Material worldwide and without limitation through any conceivable medium during and after the Promotion Period. Furthermore, the Participant waives any right to compensation in connection with (the transfer of) the Participation Material. The Participant shall ensure that third parties who may assert such rights on the Participation Material also transfer these rights to Samsung in a corresponding manner, or waive these rights.
3. The Participant authorizes Samsung and/or other companies of the Samsung group to use the Participation Material (and in particular to display or share it with the public) in any manner or medium (print, publications, film, digital, etc.) for promotional and other purposes of Samsung and/or another company of the Samsung group, without any right to compensation or remuneration, other than the Benefit to which they may be entitled. The Participant shall ensure that third parties involved in the Participant's participation in the Promotion also grant a similar authorization to Samsung, without any right to compensation or remuneration.

Article 6 - Exclusion of Liability

1. Samsung, its employees, its commissioned auxiliaries, or third parties are not liable, except in cases of intent or gross negligence, for: (i) costs and additional expenses that the Participant may incur in connection with (the payment or use of) the Benefit; (ii) damage caused by (the payment or use of) the Benefit or by the Participant's participation in the Promotion; (iii) damage caused by malfunctions (of any kind) in the software, computer, network, or internet, resulting in the Participant's submission not being received, being received incompletely, delayed, or too late by Samsung; (iv) fraud by Participant(s); and (v) the content of the Participation Material.
2. Samsung provides no warranty whatsoever with regard to the Benefit provided and excludes all liability (except in cases of intent or gross negligence) in this regard. Samsung is not liable for: (i) any defects in the Benefit, (ii) if the Benefit is received later than announced, (iii) if the Benefit is received by the wrong person or is lost or damaged during shipment, or (iv) if the (received) Benefit deviates from the offered Benefit in minor aspects.
3. In the event that a social media platform such as Instagram, Facebook, or Twitter is used for a Promotion, the platform is in no way responsible or liable for the Promotion. The Promotion is in no way sponsored, endorsed, managed, or associated with the platform.

Article 7 - Privacy

1. The personal data provided by the Participant to Samsung in the context of this Promotion are subject to applicable national privacy laws. Samsung will process this data in its capacity as data controller exclusively for the proper conduct of the Promotion, its own market research, and direct marketing, and for the purposes stated in these Promotion Terms and the Special Terms and Conditions. Personal data may be transferred within the framework of the aforementioned purposes to one or more entities of the group to which Samsung belongs or in case of a legal obligation or at the request of the police or judicial authorities. Personal data will not be sold to third parties.
2. In certain cases, the user may also provide this personal data using their account on a social media platform, such as Facebook or Twitter.
3. Each Participant can exercise their legal right to access, rectify, and object to the use of their data for direct marketing free of charge by sending a written, signed, and dated request, along with a copy of their identity card, to Samsung, by regular mail to Samsung Electronics Benelux B.V., Evert van de Beekstraat 310, 1118 CX Schiphol, Netherlands (for the Netherlands) or Samsung Electronics Belgium, Diegem (1831) Airport Plaza, Geneva Building, Leonardo Da Vincilaan 19, Belgium (for Belgium and Luxembourg). If it concerns an electronic identity card, a printout of the chip content or an official certificate of residence is also required. The Participant can read the full Samsung privacy policy at http://www.samsung.com/be/info/privacy.html (NL) or http://www.samsung.com/be_fr/info/privacy.html (FR) for Belgium or www.samsung.com/nl/info/privacy.html for the Netherlands. If a Participant submits a request for the deletion of their personal data, their participation in the Promotion will expire, and the respective Participant will no longer be eligible for the Benefit.

Article 8 - Complaints

1. For questions, comments, or complaints about the Promotion, anyone can contact Samsung customer service at the address and phone number as stated in the Special Terms and Conditions. Customer service can also be reached by phone at 088-9090100 (Netherlands), 02 201 2418 (Belgium), or 26 10 37 10 (Luxembourg).
2. Samsung is not obliged to engage in any correspondence regarding exclusions from participation, removal of Participation Material, or the outcome of a Promotion, as referred to in the Promotion Terms.

Article 9 - Final Provisions

1. For Promotions in the Netherlands that contain an element of chance, the Dutch Code of Conduct for Promotional Lotteries applies to these Promotion Terms and the Promotion, and Samsung acts in accordance with this Code of Conduct.
2. Samsung reserves the right to cancel, interrupt, or modify the Promotion, the Promotion Terms, and/or the Benefit at its own discretion and without prior notice or reason, if circumstances so require, without being liable for any compensation to the Participants.
3. The content of the Promotion Terms and the Special Terms and Conditions is subject to typographical errors and interpretation. No rights can be derived from Samsung's typographical errors and mistakes.
4. The law of the Promotional Area as determined in the Special Terms and Conditions applies to these Promotion Terms and the Special Terms and Conditions. If the Promotional Area includes multiple countries, the legislation of the Participant's place of residence, namely: Belgium, the Netherlands, or the Grand Duchy of Luxembourg, shall apply.
5. For Participants from the Netherlands, the court of Amsterdam has jurisdiction to hear any disputes between Samsung and the Participant, but not before the parties have consulted each other. For Participants from Belgium, the court of Antwerp has jurisdiction, and for participants from the Grand Duchy of Luxembourg, the court of Luxembourg (City) has jurisdiction to hear any disputes between Samsung and the Participant. However, the Participant and Samsung undertake to consult each other prior to any potential proceedings and to attempt to reach an amicable solution.
