This document outlines the terms and conditions for the promotion titled "Choose higher memory Samsung Galaxy Z Fold7, Z Flip7 or Z Flip7 FE and get up to 1300 PLN cashback".

Promotion Details

Promotion Schedule

Eligibility Requirements

To participate in the promotion, participants must:

  1. Purchase the Product during the Purchase Period at a Retail Point.
  2. Register for the Promotion during the Registration Period.
  3. Have a Samsung Account on the Members application.
  4. Accept the Regulations.
  5. Meet all other conditions specified in the Regulations.

Product Purchase

The Product submitted for the Promotion must be purchased by the Participant during the Purchase Period at a Retail Point. The terms of product sale, including its retail price, are determined solely by the Retail Point. A Participant forfeits the right to participate in the Promotion and receive the Cashback if they exercise their statutory or contractual right to withdraw from the Product purchase agreement. A Participant who has registered for the Promotion and subsequently withdraws from the Product purchase is obliged to notify the Organizer via email at: zwrotnakonto@promo.smolar.pl.

Promotion Registration

  1. Promotion entry is made via the registration form.
  2. To enter the Promotion, the Participant must activate the Product during the Activation Period, create/log in to the Samsung Members application on the Product during the Registration Period, and complete the registration form available in the Samsung Members application under the "Benefits" tab. Participants must also attach supporting documents (proof of purchase). Registration via the form is only possible within Poland.
  3. To participate in the Promotion, Participants who do not have a Samsung Account must create one by completing the registration form available at https://account.samsung.com/ or via the Samsung Members application. Participants are required to provide true and up-to-date personal data during the Samsung Account registration process. Providing incorrect, incomplete, or inaccurate personal data may result in disqualification from the Promotion.
  4. To activate the Product, the device must be turned on within Poland with an active SIM card from a Polish telecommunications provider and have access to the Internet or mobile network. Device activation is free of charge, excluding any costs associated with Internet access. Internet access costs correspond to the rates of the user's network provider.
  5. Submission to the Promotion is confirmed upon registration of the Participant's entry on the Organizer's server.
  6. A correctly completed registration form must include: personal data (name, surname, email address; for sole proprietorships, the company name must also be provided); bank account number held with a Polish bank; date of product purchase; product details (Product IMEI number); name of the Retail Partner where the product was purchased; confirmation of reading and accepting the Promotion Regulations; proof of purchase (invoice/receipt); proof of order (with the order date visible within the Purchase Period); a photo of the side of the product's packaging (cardboard box) showing the barcode sticker and legible IMEI number.
  7. Each Participant can receive only one Cashback for the purchase of a specified Product, regardless of the number of devices purchased. For example, if a Participant buys two Galaxy Z Fold7 1TB devices, they will receive only one Cashback.

Cashback

Subject to the other provisions of these Regulations, including § 4 para. 2, a Participant who meets all the conditions specified in the Regulations will receive a Cashback in the amount indicated in the table below:

The Cashback will be paid within 21 calendar days from the date of confirmation of the correct promotion entry to the bank account number provided in the registration form. Providing incorrect data by the Participant may result in the inability to receive or delay in the Cashback payment. Participation in the Promotion is voluntary. Any participant who has taken part in the Promotion has the full right to withdraw from participation at their own discretion and without any costs. If prizes awarded to Promotion participants are subject to a flat-rate income tax for natural persons, as referred to in art. 30 sec. 1 item 2 of the Act of July 26, 1991, on Personal Income Tax, the benefits awarded to participants will be increased by an additional cash prize of 11.11% of the prize value. This additional cash prize will not be paid out and will be withheld for the payment of the flat-rate tax, which will be remitted to the competent tax authority. Participants agree to such withholding. The Cashback cannot be exchanged for any other gratification.

Verification

Based on the data provided by the Participant in the registration form, the Organizer will verify the promotion entries submitted by Participants within 21 calendar days from the date of receipt of the completed form on the server handling entries submitted via the internet. As a result of the verification, the Participant will be informed via email at the address provided in the Form. In case of formal deficiencies in the promotion entry, as listed in § 4 para. 6, the Participant will be asked via email to supplement the deficiencies within 5 business days. Failure to supplement the formal deficiencies by the Participant or supplementing them after the deadline entitles the Organizer to reject the entry. The Organizer will request the Participant to supplement the formal deficiencies only once. If the deficiencies are supplemented within the deadline, the verification will be carried out again by the Organizer within 21 days. Entries that have been sent after the Registration Period, are incorrect, do not comply with the Regulations, contain false data, as well as entries with formal errors, including incomplete, illegible, or unclear scans/photos of the proof of purchase, or those not supplemented despite the request to supplement formal deficiencies according to para. 2 above, will disqualify the Participant from receiving the Cashback. SSCE has the possibility of additional verification of entries, which in special cases may require re-submission to the promotion. SSCE, for example, also has the right to request the original document confirming the product purchase. In the event of additional verification of the entry, SSCE will notify the Participant via email. The Participant will be obliged to provide the requested documents or data within 5 (five) Business Days of receiving the request. Failure by the Participant to provide explanations within the deadline will result in the Participant's exclusion from the Promotion. If the deficiencies are supplemented within the deadline, the verification will be carried out again by the Organizer within 21 days. The Participant will be informed of the verification result via email at the address provided in the Form. Each proof of purchase of the Product can only be submitted once within the Promotion. The Organizer recommends that Participants regularly check their email inbox and familiarize themselves with emails sent to them in connection with the Promotion, regularly update the Participant's personal data, including verifying the anti-spam tools and settings used by the Participant. If anti-spam tools and settings are used, the Participant is obliged to regularly check if messages from the Organizer have not been sent to the spam folder containing messages classified as spam.

Complaints

Personal Data Protection

The administrator of Customers' personal data is Samsung Electronics Polska Sp. z o.o., with its registered office in Warsaw. Samsung processes Customers' personal data in connection with participation in the Promotion (Art. 6 sec. 1 lit. f of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC; hereinafter referred to as "GDPR"). Samsung processes Customers' personal data in connection with participation in the Promotion for the purposes of: organization and conduct of the Promotion; communication with Users; provision of benefits and services specified in the Regulations; handling complaints. Samsung also processes Participants' personal data to fulfill its legal obligations, including tax and accounting obligations (the legal basis for processing is the necessity of data for fulfilling a legal obligation incumbent on the administrator, i.e., Art. 6 sec. 1 lit. c GDPR). Samsung may use Customers' personal data for marketing purposes, including promoting goods and services and products of Samsung's business partners. The legal basis for processing personal data for marketing purposes is the legitimate interest of the administrator (Art. 6 sec. 1 lit. f GDPR) consisting in conducting marketing activities. As part of its marketing activities, Samsung may send Customers messages containing information about new products or services. The sending of such information may only take place if Users have given separate consent for marketing communication, which can be withdrawn at any time. Withdrawal of consent is possible by contacting Samsung or via the link provided in each electronic message containing marketing communications. Samsung may use the collected personal data to create so-called Customer profiles, based on, among other things, their interests, purchase history, and activity within the Platform. Based on the created profiles, Samsung may send more tailored marketing communications informing about goods and services. Furthermore, in certain situations, it is or may be necessary to process Customers' personal data for purposes other than those indicated above, which are necessary for the pursuit of the Organizer's legitimate interests (Art. 6 sec. 1 lit. f GDPR), in particular: for purposes related to monitoring and improving the quality of services provided; if applicable, for internal reporting within Samsung and the Samsung Group; to prevent and counteract abuses and violations of Samsung's activities for purposes related to violations of the law; if applicable, for purposes related to conducting disputes, as well as proceedings before public authorities and other proceedings, including for the purpose of asserting and defending against claims. In cases other than those indicated above, Customers' personal data will be processed solely on the basis of prior consent, within the scope and for the purposes specified in the consent. Failure by the Customer to provide all required personal data may hinder participation in the Promotion and the provision of services by Samsung to them. To the extent that personal data is collected on the basis of consent, the provision of personal data is voluntary. The processing of personal data will cover the scope of data indicated in the promotion registration form, as well as other data provided by the User in connection with participation in the Promotion. In connection with the processing of Customers' personal data for the purposes indicated in point 1 above, their personal data may be made available to the following recipients or categories of recipients: entities participating in processes necessary for the implementation of the Promotion and provision of services within the Promotion; Smolar Agency; entities from the Samsung capital group; entities supporting Samsung in its business processes, including entities processing personal data on behalf of Samsung (so-called data processors); and public administration bodies and entities performing public tasks or acting on behalf of public administration bodies, within the scope and for the purposes resulting from legal provisions. Customers' personal data will be processed for the period necessary to provide services within the Promotion. After the expiry of the above period, Customers' personal data may continue to be processed to the extent required by law or for the pursuit of Samsung's legitimate interest as an administrator of data within the scope defined in point 3 above (subject to the deadlines provided by tax law), and in the case of the Customer's consent to data processing after the termination or expiry of the agreement, until the withdrawal of such consent. Profiling should be understood as any form of automated processing of personal data, which consists of using them to prepare and send personalized services/offers, tailored to the User's needs. Offers are prepared based on the Customer's activity within the services provided by Samsung. Offers will be sent to Customers only if they have given their consent. Samsung ensures that all persons whose personal data are processed have the appropriate rights arising from GDPR, namely: the right to access personal data, including the right to obtain a copy of such data; the right to request rectification (correction) of personal data if the data are incorrect or incomplete; the right to request erasure of personal data (the so-called "right to be forgotten") if (i) the data are no longer necessary for the purposes for which they were collected, (ii) the data subject has objected to the processing of personal data, (iii) the data subject has withdrawn their consent on which the processing is based and there is no other legal basis for processing, (iv) the data are processed unlawfully, (v) the data must be erased in order to comply with a legal obligation; the right to request restriction of processing of personal data - (i) the data subject disputes the accuracy of personal data, (ii) the processing of data is unlawful, and the data subject objects to the erasure of data, requesting in return their restriction, (iii) the administrator no longer needs the data for its purposes, but the data subject needs them to establish, defend or pursue claims, (iv) the data subject has objected to the processing of data pending verification of whether the legitimate grounds for processing on the administrator's side override the grounds for objection; the right to data portability in cases where: (i) processing is based on a contract concluded with the data subject or on the consent of such person, and (ii) processing is carried out by automated means; the right to object to the processing of personal data, including profiling, if: (i) there are reasons related to the data subject's specific situation, and (ii) the processing of data is based on the necessity for the purposes arising from Samsung's legitimate interest. The Customer is entitled to submit a request to exercise the rights referred to above and below (withdrawal of consent) by completing the form available at https://www.europe-samsung.com/gdpr/webform/pl, in accordance with the instructions available on the website. To the extent that the Customer has given consent to the processing of personal data, they have the right to withdraw their consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. If it is considered that Samsung's processing of Customer's personal data violates the provisions of GDPR, the Customer has the right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office. In cases justified by corporate requirements, the Organizer may transfer Participants' personal data outside the European Economic Area (EEA). In such cases, the Organizer guarantees that a similar level of data protection in the third country is ensured by introducing one of the following safeguards: the transfer of personal data takes place to countries that the European Commission considers to provide an adequate level of personal data protection; we use appropriate contracts approved by the European Commission or rely on binding corporate rules that guarantee data security. Within the scope of exercising rights, the Organizer also provides the possibility of obtaining copies of appropriate safeguards for personal data in the case of transfer to third countries.

Changes to the Regulations

The Organizer reserves the right to amend the Regulations in connection with and in the event of at least one of the following valid reasons: introduction of new or amendment of existing generally applicable legal provisions, if it directly affects the content of the Regulations and necessitates their amendment; amendment or appearance of new interpretations of generally applicable legal provisions as a result of court rulings or decisions of public or administrative authorities directly affecting the provisions of these Regulations and necessitating their amendment; ruling, decision, recommendations or recommendations of an authorized public authority concerning the Regulations and resulting in the need to adapt them to such ruling, decision, recommendation or recommendation; adaptation of the Regulations to market conditions related to technological and IT progress, affecting the provisions of these Regulations; change of company details, tele-addresses or URL addresses included in the Regulations; the need to introduce other changes than those mentioned above, provided that they collectively meet the following conditions: i) they are in compliance with the law (including, in particular, not infringing individual or collective consumer interests); ii) they are beneficial for current and potential Participants; iii) their introduction is necessary for the proper implementation of the Promotion in a manner that is beneficial for current and potential Participants. Announcement of changes to the Regulations will be made available on the Website. Changes to the Regulations cannot negatively affect rights previously acquired by Participants.

Final Provisions

The Organizer recommends that Participants regularly check their email inbox and familiarize themselves with emails sent to them in connection with the Promotion, regularly update the Participant's personal data, including verifying the anti-spam tools and settings used by the Participant. If anti-spam tools and settings are used, the Participant is obliged to regularly check if messages from the Organizer have not been sent to the spam folder containing messages classified as spam. The Regulations will be available for inspection on the Website throughout the duration of the Promotion. The Participant may save the content of the Regulations by downloading it from the Website.
