Disclaimers and Limitations
THIS NEW VEHICLE LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY MADE IN CONNECTION WITH YOUR TESLA VEHICLE. ANY IMPLIED WARRANTIES OR CONDITIONS ARISING UNDER THE LAWS OF ANY JURISDICTION, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, OR THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, ARE HEREBY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW AND ARE LIMITED IN DURATION TO THE TERMS OF THIS NEW VEHICLE LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR CONDITIONS OR THEIR DURATION, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
TO THE EXTENT PERMITTED BY THE LAWS OF YOUR JURISDICTION, THE REPAIR OR REPLACEMENT OF NEW OR RECONDITIONED PARTS FOR WARRANTY-Covered DEFECTS BY TESLA IS YOUR EXCLUSIVE REMEDY UNDER THIS NEW VEHICLE LIMITED WARRANTY OR ANY IMPLIED WARRANTY.
Tesla does not authorize any third party to assume any obligation or liability on behalf of Tesla in connection with this New Vehicle Limited Warranty. The decision whether to repair or replace a part, or to use a new or reconditioned part, under this New Vehicle Limited Warranty is solely at Tesla's discretion.
Your Rights Under the Laws of Your Country
This New Vehicle Limited Warranty grants you specific legal rights. These rights do not replace or affect your rights under the laws of your country. In addition to the rights under this New Vehicle Limited Warranty, you may have other rights under the laws of your country, including but not limited to statutory warranty rights.
Transfer of Ownership
This New Vehicle Limited Warranty is transferable, subject to its limitations, to any person who subsequently and lawfully acquires title to the vehicle from the original purchaser. To the extent permitted by the laws of your country regarding subsequent owners, any statutory warranty rights or similar rights that accrue to the original purchaser of the vehicle do not transfer to subsequent owners.
Who Can Make Claims Under This New Vehicle Limited Warranty?
The original purchaser or a subsequent owner of a new Model S vehicle purchased in the European Warranty Region, whose vehicle registration or title is issued in the name of the original purchaser or a subsequent owner in accordance with the laws of your country, may make claims under the terms of this New Vehicle Limited Warranty.
When Does the Warranty Period Begin and End?
This New Vehicle Limited Warranty begins on the first day the new vehicle is put into service by delivery to the original purchaser, or by lease, or registration as a company car or demonstrator model, whichever occurs first. It provides coverage for the period described in the "WARRANTY" section. Parts repaired or replaced under this New Vehicle Limited Warranty are covered only until the end of the applicable New Vehicle Limited Warranty period, unless otherwise required by the laws of your country.
WARRANTY
This New Vehicle Limited Warranty includes the Basic Vehicle Limited Warranty, the Supplemental Restraint System ("SRS") Limited Warranty, and the Battery Limited Warranty, each as described below. Subject to the exclusions and limitations in this New Vehicle Limited Warranty, Tesla will perform such repair or replacement at no charge to you, provided Tesla is informed of the warranty-covered defect within the applicable warranty period.
Repairs will be performed using new or reconditioned parts at Tesla's sole discretion. All replaced parts or other components are the exclusive property of Tesla, unless otherwise determined by local legislation.
Basic Vehicle Limited Warranty
Subject to separate coverage for specific parts and the exclusions and limitations described in this New Vehicle Limited Warranty, and any minimum warranty period required by the laws of your country, this New Vehicle Limited Warranty covers repair or replacement necessary to correct material or workmanship defects in any Tesla-manufactured or supplied parts that occur under normal use for a period of 4 years or 80,000 km (50,000 miles), whichever occurs first.
Supplemental Restraint System ("SRS") Limited Warranty
Subject to the exclusions and limitations described in this New Vehicle Limited Warranty, and any minimum warranty period required by the laws of your country, this SRS Limited Warranty covers repair or replacement necessary to correct material or workmanship defects in Tesla-manufactured or supplied parts of the vehicle's seat belt or airbag system that occur under normal use for a period of 5 years or 100,000 km (60,000 miles), whichever occurs first.
Battery Limited Warranty
The Model S Lithium-ion battery (the "Battery") is a highly sophisticated powertrain component designed to withstand extreme driving conditions. You can trust that Tesla's state-of-the-art battery is covered by this Battery Limited Warranty, which covers repair or replacement of a defective or malfunctioning battery, subject to the limitations described above. If warranty claims are made for your Battery, Tesla will repair the unit or replace it with a factory-reconditioned unit that has an energy capacity no less than the original battery capacity prior to the malfunction. Your vehicle's Battery is covered under this Battery Limited Warranty for a period of 8 years from the date of delivery or for the mileage specified below, whichever occurs first, based on your Battery configuration:
- 60 kWh - 200,000 km (125,000 miles)
- 85 kWh - Unlimited kilometers/miles
Notwithstanding the scope of this warranty, damage resulting from intentional misuse (including intentional disregard of active vehicle warnings), collision or accident, or service or opening of the Battery by non-Tesla personnel is not covered by this Battery Limited Warranty.
Additionally, damage resulting from the following activities is not covered by this Battery Limited Warranty:
- Exposing the vehicle to ambient temperatures above 60°C (140°F) or below -30°C (-22°F) for more than 24 consecutive hours;
- Physical damage to the Battery or any intentional attempt, by physical means, programming, or other methods, to extend (other than as specified in your documentation) or shorten the Battery's life;
- Contact of the Battery with direct flame; or
- Flooding of the Battery.
The Battery, like all Lithium-ion batteries, is subject to gradual energy and power loss with continued duration and use. Any energy or power loss of the Battery over time or due to or as a result of Battery use is NOT covered by this Battery Limited Warranty. For important notes on maximizing Battery life and capacity, please refer to your documentation.

Voiding the Warranty
You are responsible for the proper operation of the vehicle and for maintaining and keeping a complete and accurate service record of your vehicle, including the 17-digit Vehicle Identification Number (VIN), name and address of the service center, mileage, dates of service or maintenance, and description of service or maintenance items, and for passing these records to any subsequent purchaser. The New Vehicle Limited Warranty will be void if you fail to follow the specific instructions and recommendations regarding the use and operation of the vehicle contained in your Model S documentation, including but not limited to:
- Observing all vehicle recalls;
- Carrying passengers and cargo within the specified load limits; and
- Performing all repairs.
Although Tesla does not require all service or repair to be performed at a Tesla Service Center or Tesla-authorized repair facility, this New Vehicle Limited Warranty may be voided and coverage excluded due to improper maintenance, service, or repair. Tesla Service Centers and Tesla-authorized repair facilities possess the necessary expertise, specialized training, tools, and parts for your vehicle. Although this New Vehicle Limited Warranty, subject to its terms, also provides coverage when maintenance, service, or repairs are performed at independent repair facilities, Tesla strongly recommends that all maintenance, service, and repair be performed at a Tesla Service Center or Tesla-authorized repair facility.
This New Vehicle Limited Warranty will also be void if:
- Vehicles for which the Vehicle Identification Number has been altered, defaced, or removed, or the odometer or other related systems have been disconnected, altered, or rendered inoperable so that the Vehicle Identification Number or the actual mileage cannot be readily determined;
- Vehicles that have been designated, identified, or branded as dismantled, fire damaged, flood damaged, salvage, rebuilt, junk, restored, irreparable, or total loss; and
- Vehicles that have been determined by an insurance company to be a total loss.

TO THE EXTENT PERMITTED BY THE LAWS OF YOUR COUNTRY, TESLA SHALL NOT BE LIABLE FOR ANY DIRECT DAMAGES IN EXCESS OF THE FAIR MARKET VALUE OF THE VEHICLE AT THE TIME THE CLAIM IS MADE.
THE FOREGOING LIMITATIONS AND EXCLUSIONS SHALL APPLY REGARDLESS OF WHETHER THE CLAIM IS BASED UPON CONTRACT, NEGLIGENCE (INCLUDING NEGLIGENCE AND GROSS NEGLIGENCE), BREACH OF TERM OR WARRANTY, MISREPRESENTATION (WHETHER NEGLIGENT OR OTHERWISE) OR OTHERWISE AT LAW OR IN EQUITY, EVEN IF TESLA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE REASONABLY FORESEEABLE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INDIRECT, DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
Nothing in this agreement shall limit or exclude Tesla's liability for death or personal injury caused solely and directly by the negligence of Tesla or its employees, agents, or subcontractors (as applicable), fraud or fraudulent misrepresentation, intentional misconduct, or any other liability that is proven in a court of competent jurisdiction by a final judgment and cannot be excluded or limited by the laws of your country.
OBTAINING WARRANTY SERVICE
To obtain warranty service, you must notify Tesla within the applicable warranty period and bring the vehicle, at your expense (subject to the laws of your country), to a Tesla Service Center or other repair facility designated by Tesla in the applicable region or country during normal business hours. You can find the location of the nearest Tesla Service Center at www.teslamotors.com. The location of Tesla Service Centers may change at any time without notice. Subject to the laws of your country, the cost of transporting your vehicle is not included in this New Vehicle Limited Warranty, and you are solely responsible for the cost of transporting your vehicle to a Tesla Service Center or other repair facility designated by Tesla. The Tesla Ranger Mobile Service is not part of this New Vehicle Limited Warranty.
Please have your Vehicle Identification Number (VIN) ready, which is located on the upper dashboard on the driver's side of the vehicle and visible through the windshield; it is also located on your vehicle's registration and title. Please also have ready the date of vehicle delivery, current mileage, and a description of the defect when you contact Tesla.
If your address changes, please contact Tesla at the address or phone number provided in the "Who is the Warranty Provider?" section of this New Vehicle Limited Warranty.
Payment of Taxes for Repairs
Some laws and/or local governments require the withholding of taxes on repairs performed under warranty. If the laws of your country require this, you are responsible for paying these taxes. Tesla is entitled to offset and/or withhold such amounts and other payments mentioned in this New Vehicle Limited Warranty, as Tesla determines in its sole discretion which amounts must be offset and/or withheld for the performance of such payments under local, national, international, or foreign tax law. If amounts are offset and/or withheld in this manner, such amounts will be treated for all purposes of this New Vehicle Limited Warranty as if they had been paid to the customer.
Reasonable Time for Repairs
You must allow Tesla a reasonable period of time to perform repair and/or service. Subject to the laws of your country, you are responsible for promptly picking up the vehicle at your own expense upon notification by Tesla that the vehicle repair and/or service has been completed.
Modifications and Waivers
No person or entity, including but not limited to Tesla employees or authorized representatives, may modify or waive any part of this New Vehicle Limited Warranty. Tesla may, on a case-by-case basis, offer to pay some or all of the costs for certain repairs that are no longer covered by this New Vehicle Limited Warranty for specific vehicle models, which in some countries (if relevant according to the laws of your country) are referred to as "adjustment programs" or similar programs. In such cases, Tesla will inform all known and registered owners of the affected vehicles. You may also contact Tesla directly regarding the applicability of such programs to your vehicle (if applicable). Tesla may also, on an ad hoc and case-by-case basis, offer to pay some or all of the costs for certain vehicle repairs that are no longer covered by this New Vehicle Limited Warranty. Tesla reserves the right, if permitted by the laws of your country, to proceed as described above and make changes to vehicles manufactured or sold by Tesla and applicable warranties at any time, without incurring any obligation or claim to make the same or similar payment or make changes to vehicles previously manufactured or sold by Tesla or applicable warranties, including this New Vehicle Limited Warranty.
WARRANTY ENFORCEMENT AND DISPUTE RESOLUTION
Subject to the laws of your country (which may vary by country), this New Vehicle Limited Warranty and any disputes or claims arising out of or in connection with it or its subject matter (including non-contractual disputes or claims) shall be governed by English law, and you and Tesla hereby submit to the non-exclusive jurisdiction of the courts of England and Wales, although the laws of your country or the legal provisions for all damage claims and all consumer protection claims may apply according to the laws of your country. If any provision of this New Vehicle Limited Warranty is held to be unenforceable by a court of competent jurisdiction because it is invalid or in conflict with any law of the relevant jurisdiction, the remaining provisions shall remain in full force and effect, and the rights and obligations of the parties shall be construed and enforced accordingly as if this New Vehicle Limited Warranty had not contained the particular unenforceable provisions, and the unenforceable terms shall be replaced by such terms as are valid, legal, and enforceable and most closely approximate the intent of Tesla in the invalid or unenforceable provision.
Your new vehicle and its safety equipment comply with the motor vehicle laws of your country. All owners of the vehicle are required, to the extent permitted by the laws of your country, to notify Tesla in writing and within a reasonable time of any defects they discover during the applicable warranty period specified in this New Vehicle Limited Warranty, to give Tesla the opportunity to perform the necessary repairs before pursuing any remedies under the laws of your country.
