Starlink Internet Services Limited - Terms of Service for Greece

1. Deposit

1.1 Applicability: This section applies if Starlink Services are currently unavailable in your region and you are placing a deposit payment.

1.2 Deposit Payment: Your deposit payment grants priority for securing Starlink Services when available. It includes all applicable taxes, including VAT. The deposit will be applied to the amount due for the Starlink Kit and Services when they become available.

1.3 Refundable Deposit: Prior to Starlink shipping your Kit, your deposit is fully refundable upon request via your Starlink account. Requesting a refund forfeits your priority position.

1.4 Availability; Limitations: Placing a deposit does not obligate Starlink to provide the Kit and Services, nor does it guarantee availability. Prices are subject to change. Enrollment limits may apply. Kit designs and Services are subject to change based on technological innovation. Starlink does not hold deposit payments separately or pay interest on them. Service availability dates are estimates and subject to change. Delivery depends on regulatory approvals.

2. Agreement to Purchase or Rent the Starlink Kit and Services

2.1 Agreement Term: There is no minimum contract term. You may cancel Services at any time per Section 6.2, and Starlink may terminate the Agreement per Section 6.6.

2.2 No Resale or Unauthorized Agency: You may not resell Services or purchase an excessive number of items from the Starlink shop without authorization. Violations may result in service termination.

2.3 Payments for Purchasing a Starlink Kit and Title Transfer: For Kit purchases, you authorize Starlink to charge your payment method for the one-time purchase price, including shipping, handling, and taxes. Title transfers upon delivery.

2.4 Payments for Renting a Starlink Kit: For Kit rentals, you authorize Starlink to charge your payment method for:

• Activation Fee: A one-time immediate fee upon order placement.
• Monthly Rental Fee: A recurring monthly fee starting on the earlier of Kit activation or 30 days after shipment (the "Payment Due Date").
• Retail Penalty, if applicable: A fee if the Kit is not returned undamaged, untampered, and unmodified within 30 days of service cancellation.

Rented Kits may be new or refurbished and remain Starlink property. Rental is typically for the Standard Service Plan but may be available for other plans at Starlink's discretion. Rental is not available in all locations.

2.5 Payments for Monthly Service Subscription: You authorize Starlink to charge your payment method for:

• Monthly Service Fee: Recurring charges starting on the Payment Due Date.
• Additional Priority or Mobile Priority Data: Automatic charges for data usage beyond your plan's limit, if opted-in. You can track and purchase data via the Starlink App or account. Opt-out is available.

2.6 Payment Method: You authorize Starlink to charge your approved payment method for all charges, including applicable taxes. Credit/debit card use is subject to cardholder agreement terms. You must update payment information to avoid service suspension or termination.

2.7 Shipping & Handling: Charges apply, are displayed in the Order, and are non-refundable. Delivery times are estimates and may require signature. Starlink uses its chosen carrier.

2.8 Taxes, Fees, Surcharges: You are responsible for all applicable taxes, fees, and surcharges, including government fees and license/permit fees.

2.9 Bills, Payment Disputes & Suspended Services: Bills are provided via the Starlink Customer Portal. Disputes must be handled through your account. Undisputed amounts must be paid timely. Failure to pay may result in service suspension.

2.10 Software Updates and License Terms: Software is licensed, not sold, on a non-exclusive, non-transferable basis for use on the Starlink Kit. Starlink retains all intellectual property rights.

3. Starlink Kit Installation

3.1 Kit Install Guidelines: You are responsible for installation in a location with a clear sky view, following the Starlink App and Install Guide. Do not modify the Kit in a way that alters its transmission characteristics. Unauthorized modifications or installations causing material degradation may void the Limited Warranty.

3.2 Kit Install Authorizations: You must ensure compliance with all applicable building codes, zoning, and other regulations. You are responsible for associated fees and obtaining necessary permits.

3.3 IN-MOTION USE PROHIBITED FOR UNDESIGNATED KITS, COUNTRIES AND USES: Use on moving vehicles or vessels is prohibited unless specifically designated and approved by Starlink. Use on aircraft is always prohibited. Such use voids the warranty and may lead to termination.

3.4 Kit Installation on Moving Vehicles: For designated in-motion use, ensure the mount is installed on a structurally sound, horizontal surface. Improper installation can cause accidents. Do not mount if unstable or not properly secured.

4. Fixed Service Plans

4.1 Standard Service Plan: Designed for personal, family, or household use at a fixed land-based location. Service activation and billing cannot be paused. Includes unlimited "Standard" data. Speeds may be slower during peak hours or network congestion.

4.2 Priority Service Plan: Designed for high-demand users, businesses, and institutions at fixed locations. Service use and billing cannot be paused. Includes a set amount of "Priority" data each month, which has network precedence over Standard and Mobile data for faster speeds. Unused Priority data does not rollover. Exhausting Priority data results in unlimited Standard data, potentially with slower speeds.

5. Mobility Service Plans

5.1 Mobile Service Plans:

• Regional or Global Coverage: Allows access to Services at destinations with Starlink coverage. Designed for low-demand, portable, land-based use. "Regional" covers the continent of order; "Global" covers worldwide. Service can be paused and un-paused.
• Mobile Data: Includes unlimited "Mobile" data, which is deprioritized compared to other plans, resulting in slower speeds in congested areas. Stated speeds are not guaranteed and depend on geography. Users can upgrade to Mobile Priority or opt into paying for Mobile Priority data per GB.

5.2 Mobile Priority Service Plans:

• Global Land, Ocean, In-Motion Coverage: For high bandwidth or in-motion users requiring global land and ocean access. Service can be paused and un-paused.
• Mobile Priority Data: Includes a set amount of "Mobile Priority" data with network precedence for faster speeds. Unused data does not rollover. After exhaustion, inland users receive unlimited Mobile data (slower speeds), while ocean users may lose internet access except for account access to purchase more data.

5.3 Limitations on Mobility Services: Supplemental support for enterprise/government requests is available only for Mobile Priority Plans. Starlink does not guarantee service availability, which depends on regulatory approvals. A list of authorized territories is available at www.starlink.com/map.

6. Changes, Cancellation, Returns, Transfers and Termination

6.1 Changes by Starlink: Starlink may change Plans, prices, Terms, or Kit versions with at least 30 days' notice. Continued use constitutes agreement to changes.

6.2 Service Cancellation and Right of Withdrawal: You can cancel Services anytime via your Starlink account. To avoid billing, cancel before your invoice statement is generated. Rented Kits must be returned within 30 days of cancellation to avoid charges.

6.3 Kit Return and Full Refund: Undamaged Kits and accessories can be returned within 30 days of the Payment Due Date for a full refund. This includes refunds for the equipment price and the first month's service/rental fee if returned timely.

6.4 Rented Kit Returns and Fees: Rented Kits must be returned undamaged (normal wear and tear accepted) within 30 days of cancellation or you will be charged the full retail price. You are responsible for loss or damage. Starlink provides a return shipping label.

6.5 Transferring Services and Kits: Purchased Kits may be transferred to another party if the account is paid-in-full and network capacity allows. Transferred services are not available for rented Kits. More information is available at support.starlink.com or www.starlink.com/activate.

6.6 Termination by Starlink: Starlink may terminate or suspend services for violations of Terms, legal orders, technical issues, failure to obtain authorizations, illegal activities, withdrawal of data consent, non-payment, or for convenience.

7. Limited Warranty, Disclaimers, Remedies, and Liabilities

7.1 Limited Warranty: The Starlink Kit and Services are subject to the Limited Warranty.

7.2 Disclaimers: Starlink provides the Kit and Services "AS IS," without express warranties. Starlink disclaims all implied warranties, including merchantability and fitness for a particular purpose.

7.3 Limitations of Liability: Starlink's liability is limited to the total amount paid by you in the six months preceding the claim. This includes limitations on special, incidental, consequential, or punitive damages.

7.4 Assumption of Risk: Your use of the Services and Kit is at your sole risk. Services are not intended for mission-critical or safety-of-life applications.

8. Compliance

8.1 General: You agree to comply with all applicable laws and regulations.

8.2 Privacy: Starlink processes personal information according to its Privacy Policy.

8.3 Acceptable Use Policy: You agree not to violate laws, the Acceptable Use Policy, or infringe on others' rights, or interfere with the network.

8.4 International Trade Laws: You must comply with all applicable International Trade Controls, including export control and sanctions laws. Services are authorized only for the location specified in your Order.

8.5 Modifications to Starlink Products & Export Controls: Starlink Kits are commercial products. Modifications for military end-uses may be subject to ITAR or EAR regulations, requiring U.S. government authorization. Starlink may refuse technical support for modified products.

8.6 Security Measures: You acknowledge Starlink's cybersecurity policies for incident response and data protection.

9. Indemnification

You agree to compensate Starlink for claims arising from your breach of these Terms, your account use, or violation of laws.

10. No Unauthorized Transfers; Assignments, or Acts of Agency

10.1 Transfers and Assignments: You may not assign or transfer the Agreement or Services without Starlink's consent. Unauthorized transfers void the agreement. If your Kit is stolen, you must notify Starlink immediately.

10.2 Acts of Agency: You must create an account in your own name. You cannot use an agent unless they are a household member, personal caregiver, employee, director, or officer, or otherwise approved by Starlink. You warrant you have not purchased through a commercial third-party or bundled service.

11. Governing Law and Disputes

This Agreement is governed by Greek Law. Disputes will be settled in the district courts of Athens, Greece. For services on Mars, disputes will be settled through self-governing principles.

12. General Provisions

12.1 Customer Support: Available via the Starlink Customer Portal and support.starlink.com. Phone support may be recorded.

12.2 Severability: If any term is invalid, the rest remain in effect.

12.3 Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction.

12.4 Records: Keep copies of Terms and receipts. Starlink may change Terms with 30 days' notice; continued use signifies agreement.

12.5 Electronic Delivery Policy, Customer Consent, and Notices: You consent to receive notices electronically via email, pop-up, or portal messages.

12.6 No Waiver: Starlink's failure to enforce a term does not waive future enforcement.
