FNAC Smartphone Trade-In Program - Apple Campaign Regulations

1. Definitions

1.1 Trade-in Service: An initiative by FNAC PORTUGAL where participants can trade in their old equipment that meets the specifications in Article 2 and is listed in point 1.3, to receive a trade-in value towards the purchase of a new equipment listed in point 1.4.

1.2 Participant: Any individual, resident in Portugal, over 18 years old, with a valid NIF, who can be identified and presents their eligible old equipment that meets the criteria in point 1.3. The participant must accept and comply with the terms of this Regulation.

1.3 Eligible Old Equipment: The following phones are eligible for the Trade-in Service:

The trade-in value varies based on the model, internal capacity, and signs of use, as defined in this Regulation.

Note: For Samsung S24 Ultra, S23 Ultra, S22 Ultra, or S21 Ultra trade-ins, the original S-Pen must be present and in good working condition.

1.4 Eligible New Equipment: The following phones are eligible for the campaign until September 27, 2025:

*The participant will receive an additional trade-in value in accordance with the table above.

To benefit from the conditions in this point, the following cumulative conditions must be met:

a. The old equipment must correspond to one of the equipment listed in point 1.3.

b. The participant must purchase one of the models identified as “New Equipment”.

c. The participant must complete the purchase of the “New Equipment” exclusively:

i. At any of the FNAC physical stores in Portugal and Madeira, as described in point 1.5.

d. The participation period for the campaign described in point 1.4 is until September 27, 2025.

e. Campaign is limited to existing stock.

NOTE: If the newly purchased equipment is returned, the additional trade-in value will not be refunded, as the right to the additional value is lost once the purchase is canceled.

1.6 Promoter: FNAC PORTUGAL - Actividades Culturais e Distribuição de Livros, Discos, Multimédia e Produtos Técnicos, Sociedade Unipessoal, Lda., headquartered at Edifício Amoreiras Plaza, Rua Professor Carlos Alberto Mota Pinto, nr. 9 - 6B, taxpayer number 503 952 230, registered at the Commercial Registry Office of the 2nd Section of Lisbon, under the same number.

1.7 Equipment Limit: Each participant in this Trade-in Service can trade in a maximum of 3 (three) pieces of equipment per NIF within a maximum period of 90 days. Each piece of equipment submitted is subject to all conditions and requirements of this Regulation, with the equipment undergoing a unit-by-unit evaluation, not aggregated. If the maximum limit of equipment in the indicated period is exceeded, the internal commercial evaluation conditions resulting from the evaluation of each piece of equipment will apply, and the Client will be contacted by the FNAC Trade-in team for this purpose.

2. Acceptance Conditions

2.1. To benefit from the trade-in value, the equipment submitted by the Participant must cumulatively meet the following requirements:

a) Participants must remove the SIM card (if the equipment has one, due to its characteristics) and delete all personal information stored on the device. The Promoter is not responsible for the destruction or loss of information, or its use by third parties.

b) The equipment must be able to turn on without a charger.

c) The equipment must be in perfect condition or show minor signs of use.

d) The equipment must have all its components intact.

e) The trade-in equipment must be included in the list of equipment indicated in Point 1.3 of the Regulation; otherwise, the Participant will not benefit from the Trade-in Service.

f) When submitting the equipment for functional evaluation, the Participant guarantees that there is no active security lock and agrees that the equipment's information may be accessed solely for testing purposes.

g) The Participant must declare to be the legitimate owner of the equipment by presenting valid identification (citizen card, identity card, or passport) and signing the respective Purchase and Sale agreement, demonstrating and declaring that there is no indication to the contrary, and also declare ownership in writing on the equipment ownership transfer declaration, to be formalized on the date of submission of the old equipment.

h) The equipment must be GSM and have menus in Portuguese.

i) The equipment must not have any user or network (operator) lock.

j) Full approval in the functional evaluation technical tests carried out by the in-store technician.

k) For trade-ins of Samsung S24 Ultra, S23 Ultra, S22 Ultra, or S21 Ultra models, as described in point 1.3, the trade-in equipment must possess its original S-Pen, which must be in good condition (physically suitable for its correct functionality) to be evaluated.

2.2. Once the old equipment is submitted and ownership transferred to the Participant after the contracted sale, it cannot be returned.

3. Offer

3.1. The Trade-in Service offers a value to be determined after the trade-in evaluation process, upon submission of an old equipment at the eligible physical stores listed in point 1.5 of this Regulation, provided it meets all the Conditions.

3.2. The Participant must carry out the trade-in of their old Smartphone at one of the indicated physical stores, and may proceed with the submission under the following circumstances:

3.2.1. If the participant wishes to make a purchase at a FNAC physical store or at one of the SES Stores operated by FNAC, for any product or service, they will receive the trade-in value of the eligible old equipment on a FNAC gift card.

3.2.2. If the participant only wishes to trade in the eligible old equipment at any eligible physical store, they will receive the value, as they prefer, either on a FNAC gift card or in cash (subject to applicable legal limits and sufficient cash availability) or bank transfer.

3.3. The maximum discount values for trade-ins in the Trade-in Service are presented in the simulators, updated weekly, available at:

4. Valuation Criteria and Other Conditions

4.1. By participating in this Trade-in Service, the Participant accepts the conditions of this Regulation.

4.2. The Promoter reserves the right to reject the purchase of equipment if it does not meet the established conditions. The evaluation will be carried out at a FNAC store by a technician and communicated to the Participant.

4.3. The value applied to the purchase of old equipment falling under Grade A, B, or in certain cases C will preferably adhere to the following criteria:

a. The trade-in value assumes that the equipment is functional for all its intended purposes and varies based on the model, internal capacity, presence of non-original parts, and signs of use on the equipment, according to functional and analytical evaluation criteria by the technician.

b. In addition to the parameters defined in the previous point, the equipment will be evaluated to ensure its inclusion in the respective categorization (Grade A, B, or C - criteria associated with visible wear from use), according to the following scale, available at https://www.fnac.pt/recondicionados-restart:

• Grade A Equipment – Items in very good condition, with minimal signs of use.
• Grade B Equipment – Items in good condition, with slight signs of use.
• Grade C Equipment – Items with visible signs of use.

4.4. If there is a valid reason, the Promoter may introduce changes to this Regulation at any time, making the updated version available at https://www.fnac.pt/retomas-apple.

4.5. Participation in this Trade-in Service is subject to a maximum of 3 (three) equipment trade-ins per NIF within a 90-day period. Each submitted equipment is subject to all conditions and requirements of this Regulation, undergoing a unit-by-unit evaluation. If the maximum limit is exceeded, internal commercial evaluation conditions will apply, and the Client will be contacted by the FNAC Trade-in team.

5. Personal Data

1. Within the scope of this Regulation, and whenever the participant provides their personal data, it will be processed by FNAC PORTUGAL in accordance with Law No. 58/2019, of August 8, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (General Data Protection Regulation). This data will be used exclusively for all procedures related to the valuation of the traded-in equipment and verification of its functional status, as well as for the management of the Trade-in Service according to this Regulation.

2. The Participant must ensure full compliance with the Acceptance Conditions in point 2, above, of this Regulation, particularly those concerning the safeguarding and deletion of personal information.

3. Personal data provided by interested parties will be processed by FNAC for the purposes of valuing the traded-in equipment, verifying its functional status, and managing the Trade-in Service according to this Regulation.

4. FNAC PORTUGAL guarantees Participants the right to access their data, as well as rectification, erasure, objection, restriction, and portability, as defined in FNAC's privacy policy, available at https://www.fnac.pt/segurancaconfidencialidade.
