Samsung Monitor Trade-Up Program - Annex No. 1 to Regulations

This document details amendments to the "OdZysk Program for Monitors in the Samsung Store with the Service of Samsung Collecting Old Equipment" regulations.

Amendments to Regulations

Based on § 6, item 1, point 4 of the Regulations, due to technological development including a new monitor size, the Organizer introduces the following changes:

  1. The content of Annex No. 1 is changed as follows:

Regulations of the "OdZysk Program for Monitors in the Samsung Store with the Service of Samsung Collecting Old Equipment"

§ 1. Definitions

Terms used in the Regulations and written with a capital letter are given the following meaning:

  1. Organizer: Samsung Electronics Polska Sp. z o.o. with its registered office in Warsaw (ul. Postępu 14, 02-676 Warsaw), entered into the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number 0000128080, NIP 526-10-44-039, REGON 011612810, share capital PLN 52,759,500.
  2. Device: All Samsung monitors with a diagonal of 34 inches and larger available on the website www.samsung.com.pl. Device availability depends on the Organizer's current offer available in the Samsung Store at www.samsung.com/pl.
  3. Program: Promotional campaign organized and conducted by the Organizer on the terms described in these Regulations during the period from January 31, 2025, until the Program's conclusion with a two-week notice from the Organizer or until the limit of 1000 purchases within the Program is used. A Participant may use the Program only once.
  4. Regulations: These regulations, along with their annexes, which constitute an integral part thereof.
  5. Website: The website with information about the Program available at: samsung.com/pl/offer/odkup-monitora/.
  6. Participant: (i) an adult individual with full legal capacity residing in Poland; (ii) an individual conducting sole proprietorship, residing in Poland, with full legal capacity, who has read and accepted the provisions of these Regulations and met all conditions specified therein, who owns old equipment, has expressed a desire to participate in the Program by filling out a form, and is not participating in the Program as part of their non-agricultural business activity.
  7. Samsung Store: An IT platform available via the website www.samsung.com/pl/ administered by Samsung, enabling users to view Devices, including their price and availability, and to place orders and conclude sales agreements for Devices, in accordance with the rules specified in the regulations of the online Samsung Store: www.samsung.com/pl/shop-faq/service-and-warranty/regulamin-internetowego-sklepusamsung/.
  8. Old Equipment: A monitor in relation to which the Customer has expressed a desire to order the collection service described in point III. 4 of the Regulations for Additional Services in the Samsung Store, available at: www.samsung.com/pl/shop-faq/delivery-and-installations/regulamin-dostaw-i-uslug-dodatkowych/.

§ 2. General Provisions

  1. These Regulations define: the conditions for participation in the Program, the duration of the Program, the method of informing about the Program and its conditions, and the method of submitting complaints related to the Program.
  2. The purpose of the Program is to obtain a discount on the purchase of a new Device. The discount value depends on the size of the purchased Device; the detailed discount value is in Annex No. 1 to the Regulations.
  3. The Program is conducted in the territory of the Republic of Poland from January 31, 2025, until the Organizer informs about the Program's termination with a two-week notice. The Organizer will inform about the Program's termination on the Website.
  4. The Program is conducted in the territory of the Republic of Poland.

§ 3. Program Participation Rules

  1. Participants who meet the following criteria can take part in the Program:
    • Purchase a Device in the Samsung Store;
    • Are owners of Old Equipment;
    • On the Device card or in the cart during the purchase of the Device, clicked the "Add" button next to the "Trade Up" option;
    • Filled out a form indicating the type and brand of the Old Equipment;
    • Prepared and handed over the Old Equipment in accordance with the rules specified in the Regulations for Additional Services in the Samsung Store, available at: www.samsung.com/pl/shop-faq/delivery-and-installations/regulamin-dostaw-i-uslug-dodatkowych/.
  2. To use the discount, place the Device in the cart in the Samsung Store, then after providing delivery details, select the "Trade UP" option and fill out the form as indicated above. The discount will then be applied automatically.
  3. If more than one Device is added to the cart, the discount will be applied only to the single most expensive Device.
  4. By submitting and paying for an order with a completed form, the Participant undertakes to hand over the Old Equipment to the courier representative. Failure to prepare the Old Equipment for collection authorizes the Organizer not to release the order to the Participant.
  5. If the Participant wishes to exercise their statutory right to withdraw from the Device sales agreement without giving a reason, the amount Samsung will be obliged to refund for such Device will be the amount actually paid by the Participant for the Device after the discount. Simultaneously, if the Participant exercises their statutory right to withdraw from the Agreement, Samsung will not be obliged to return the Old Equipment, as the Participant, by expressing their will to participate in the Program, has declared their intention to dispose of the Old Equipment.
  6. If the discount is subject to a flat-rate income tax for individuals, as referred to in Article 30, item 1, point 2 of the Act of July 26, 1991, on Personal Income Tax, the benefits granted to Participants will be increased by an additional cash prize of 11.11% of the prize value. The additional cash prize will not be paid out and will be withheld for the payment of the flat-rate tax, which will be remitted to the competent tax authority. Participants agree to such withholding.
  7. The Program can be combined with other Organizer promotions activated by a promotional code, unless otherwise indicated in the regulations of those other promotions.
  8. In case of the Program's termination, the Organizer will inform about it on the Website.
  9. The Organizer does not provide for the possibility of exchanging the discount for its cash equivalent or for other benefits.

§ 4. Complaints

  1. Complaints related to the Program should be submitted within 14 days from the date of Device delivery via the complaint form available at www.samsung.com/pl/complaints/, with the subject line "Program OdZysk for Monitors in the Samsung Store with the Service of Samsung Collecting Old Equipment".
  2. The complaint should include the following data: first name, last name, email address, and a detailed description of the event justifying the complaint and all circumstances supporting the validity of the claim.
  3. Complaints will be processed based on the provisions of these Regulations within 14 days from the date of receiving the complaint. Interested parties will be notified of the complaint resolution method in a form corresponding to the form in which the complaint was submitted, immediately after its processing.
  4. The deadline for submitting a complaint, as provided in the Regulations, does not exclude or limit the rights available to the participant based on legal provisions, particularly provisions on the statute of limitations for claims.
  5. The complaint procedure does not exclude or limit the participant's right to pursue their rights before common courts.
  6. Any technical problems related to the correct operation of the Samsung Store or the incorrect operation of the Program can be reported via the form www.samsung.com/pl/contact-us/ or by calling the Call Center at +48 22 4600-500.

§ 5. Personal Data Protection

  1. Information on the processing of personal data by the Organizer in connection with participation in the Program is Annex No. 2 to the Regulations.
  2. Detailed information on the processing of personal data by the Organizer can be found in the Privacy Policy available at: www.samsung.com/pl/info/privacy.

§ 6. Amendments to the Regulations

  1. The Organizer reserves the right to amend the Regulations for a justified reason. A justified reason for amending the Regulations is considered, in particular, any of the following reasons (disjunctively):
    • Introduction of new or changes to existing generally applicable legal provisions, if it has a direct impact on the content of the Regulations and necessitates its amendment;
    • Change or emergence of new interpretations of generally applicable legal provisions as a result of court judgments or decisions of public authorities or administration bodies directly affecting the provisions of these Regulations and necessitating their amendment;
    • Judgment, decision, recommendations, or advice from an authorized public authority concerning the Regulations and resulting in the need to adapt them to such judgment, decision, recommendation, or advice;
    • Adaptation of the Regulations to market conditions related to technical, technological, and IT progress, affecting the provisions of these Regulations;
    • Elimination of any interpretive ambiguities of the Regulations;
    • The need to counteract violations or abuses of the Regulations;
    • Change of company data, contact details, or URLs included in the text of the Regulations.
  2. An announcement of the amendment to the Regulations will be made public on the Website 7 days in advance.
  3. Amendments to the Regulations cannot negatively affect the rights previously acquired by Participants.

§ 7. Final Provisions

  1. Contact with the Organizer is made via the contact form on the website: www.samsung.com/pl/contact-us/.
  2. The Regulations will be available for inspection on the Website throughout the duration of the Program. The Participant may retain the content of the Regulations by downloading it from the Website.
  3. The following annexes to the Regulations constitute an integral part thereof:
    • Annex No. 1 - list of Devices participating in the Program.
    • Annex No. 2 - information on the processing of participant's personal data by the Organizer in connection with participation in the Program.

Annex No. 2: Clause on Personal Data Processing by the Organizer

  1. The administrator of the Participants' personal data is the Program Organizer, which is Samsung Electronics Polska Sp. z o.o. with its registered office in Warsaw (ul. Postępu 14, 02-676 Warsaw) or Samsung.
  2. Participants' personal data are processed for the purpose of:
    • 2.1. Conducting the Program; including for: organizing and running the Program, communicating with Participants, awarding prizes (the legal basis for processing is the legitimate interest of the administrator - Art. 6(1)(f) GDPR);
    • 2.2. Handling complaints (the legal basis for processing is the legitimate interest of the administrator - Art. 6(1)(f) GDPR);
    • 2.3. For purposes related to the Organizer fulfilling legal obligations, including tax and accounting obligations (the legal basis for processing is the necessity of data for fulfilling a legal obligation incumbent upon the administrator - Art. 6(1)(c) GDPR);
    • 2.4. For the purpose of defending against potential claims or pursuing potential claims (the legal basis for processing is the legitimate interest of the administrator - Art. 6(1)(f) GDPR);
    • 2.5. For marketing purposes, consisting of promoting goods and services and products and services of the Organizer's business partners. The legal basis for processing personal data for marketing purposes is the legitimate interest of the administrator (Art. 6(1)(f) GDPR) consisting of conducting marketing activities;
    • 2.6. As part of marketing activities, the Organizer may send Participants messages containing information about new products or services. Sending the above information may only occur if Participants have given separate consent for marketing communication, which can be withdrawn at any time. Withdrawal of consent is possible by contacting Samsung or via the link included in each electronic message containing marketing communications.
  3. In connection with the processing of Participants' personal data for the purposes indicated in point 2, personal data may be made available to the following recipients or categories of recipients:
    • 3.1. Entities within the Samsung capital group;
    • 3.2. Entities supporting the Organizer in its business processes, including entities processing personal data on behalf of the Organizer (so-called data processors) and Samsung business partners, e.g., entities providing accounting and bookkeeping services, entities providing IT services to the Organizer, and transport companies;
    • 3.3. Public administration bodies and entities performing public tasks or acting on behalf of public administration bodies, to the extent and for the purposes resulting from legal provisions.
  4. Samsung will store Participants' personal data for the duration of the Program and for the period necessary to fulfill the legal obligations incumbent upon the Organizer. The period of storing Participants' personal data may be extended each time by the statute of limitations for claims (subject to deadlines provided by tax law).
  5. Participants have the right to: access their data, rectify it, erase it, or restrict its processing, and to object to the processing of data due to their particular situation. Samsung ensures the implementation of the above rights to the extent resulting from Articles 15-22 of the GDPR. The Participant has the option to submit a request to exercise the rights mentioned above by filling out the form available on samsung.pl, in accordance with the instructions available on the aforementioned website.
  6. To the extent that the Participant has consented to the processing of personal data, they have the right to withdraw their consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out based on consent before its withdrawal.
  7. In cases justified by Samsung group corporate requirements, personal data may be transferred outside the European Economic Area (EEA). In such cases, we guarantee that a similar level of protection for your data in the third country is ensured by implementing one of the following safeguards:
    • 7.1. Personal data transfer takes place to countries that the European Commission has recognized as ensuring an adequate level of personal data protection;
    • 7.2. We use appropriate contracts approved by the European Commission or rely on binding corporate rules that guarantee the security of the Participant's personal data.
  8. As part of exercising the Participant's rights, the Organizer also provides the possibility to obtain copies of appropriate safeguards for personal data in case of transfer to third countries.
  9. The Participant has the right to lodge a complaint with the competent supervisory authority, which is the President of the Personal Data Protection Office.
  10. Personal data are provided by Participants voluntarily, but providing data is necessary to participate in the Program.
  11. Detailed information on the processing of personal data by the Organizer has been included in Samsung's privacy policy, which can be found at: www.samsung.com/pl/info/privacy/RODO/ - Konkursy i promocje.
  12. Profiling should be understood as any form of automated processing of personal data, which consists of using them for the purpose of preparing and sending personalized services/offers tailored to the Participant's needs. Participant data will be profiled only if they consent.
