This USA Domestic Minimum Advertised Price (MAP) Policy is established to support Summer Infant's resellers, protect their investments, safeguard the brand's reputation, and discourage pricing-based advertising practices. The policy aims to ensure a high level of satisfaction, customer service, and support that consumers expect from Summer Infant products and its network of retailers, dealers, and distributors.
Summer Infant reserves the right to not do business with any retailer, dealer, or distributor that advertises any product covered by this MAP Policy below its Minimum Advertised Price. Summer Infant believes this program will enhance its competitiveness and benefit its resellers.
Official Policy and Guidelines
Summer Infant will assign a Minimum Advertised Price (MAP) for all covered products. Advertising MAP Products at a price lower than the MAP constitutes a violation of this policy. Summer Infant may, at times, permit advertising of specific products at a lower price with advance notice. The company reserves the right to modify or suspend MAPs for specified periods.
The term “advertising” encompasses all media, including flyers, posters, coupons, mailers, newspapers, magazines, catalogs, internet, websites, forums, email newsletters, television, radio, and public signage. Activities intended to circumvent the policy, such as solicitations for 'group purchases', are also considered violations.
Summer Infant maintains a list of MAP Products, which is subject to updates and modifications. The most current version can be found at www.summerinfant.com/MAPpricelist. Website features like “click for price,” automated pricing emails, or pre-formatted responses that display prices before items are added to a cart are considered violations.
Bundling or selling MAP Products with unapproved products, or packages where the advertised price is lower than the total MAP of included items, is a violation. The policy also addresses advertising that includes additional discounts, coupons, gift cards, or incentives that result in an immediate price reduction below the MAP. Advertisements stating “lowest prices” or price matching are permissible as long as no advertised price falls below the MAP.
Summer Infant may offer direct manufacturer rebates. Resellers advertising these rebates must ensure the advertised price is compliant with the MAP policy, and rebate details are presented clearly and consistently with the advertised product price. Violations at one store location may apply to all locations of a reseller.
This policy does not intend to restrict resellers' decisions on advertising or selling Summer Infant products at prices they choose, but it does outline Summer Infant's right to make independent decisions regarding product allocations and reseller participation.
Summer Infant sales personnel cannot modify or grant exceptions to this policy. Resellers are solely responsible for compliance. Summer Infant reserves the right to cancel the MAP Policy at any time.
Policy Violations
Resellers are given twenty-four (24) hours to correct a first violation of the MAP Policy. Failure to correct a violation results in supply restrictions: fourteen (14) days for a first violation, thirty (30) days for a second, and one (1) year for subsequent violations. Summer Infant may also cancel pending orders and refuse new ones for policy violations.
