Remedies included in the legal conformity warranty according to OUG no. 140/2021:

ARCTIC guarantees all legal rights provided by OUG no. 140/2021 for the benefit of consumers regarding the legal conformity warranty. The provisions of this legal conformity warranty certificate are supplemented accordingly by the provisions of OUG no. 140/2021.

In case of non-conformity, the consumer has the right to have the goods brought into conformity, to receive a proportional price reduction, or to terminate the contract, under the conditions of the law - art. 11 (1). Consumers may opt for a specific corrective measure if the non-conformity of the goods is found shortly after delivery, within 30 calendar days - art. 11 (7). For the goods to be brought into conformity, the consumer may opt for repair or replacement, unless the chosen corrective measure is impossible or, compared to the other available corrective measure, would impose disproportionate costs on the seller, taking into account all circumstances (e.g., the value of the goods if there were no non-conformity, the severity of the non-conformity, or if the alternative corrective measure could be performed without significant inconvenience to the consumer) - art. 11 (2).

Incorrect Installation of Goods (art. 7):

Any non-conformity caused by incorrect installation of the goods is considered a non-conformity of the goods in any of the following situations:

Proof of Non-conformity:

Any non-conformity found within one year from the date the goods (including those with digital elements) were delivered is presumed to have existed at the time of delivery of the goods, unless proven otherwise, or unless this presumption is incompatible with the nature of the goods or the non-conformity - art. 10 (1).

For goods with digital elements for which the sales contract provides for continuous supply of digital content or digital services for a certain period, the burden of proof regarding the conformity of the digital content or digital service during the legal warranty periods lies with the seller in case of a non-conformity found during this period - art. 10 (3).

Remedy by Repair:

If the non-conformity is remedied by repair, the legal warranty periods are extended by the downtime of the good, from the moment the non-conformity was brought to the seller's attention until the effective delivery of the good in normal use condition to the consumer - art. 12 (6).

Remedy by Replacement:

If the non-conformity is remedied by replacement, for goods that replace non-conforming goods, the legal warranty periods for the replaced product begin to run from the date of replacement with the new product - art. 12 (7).

Price Reduction and Contract Termination:

The consumer has the right to obtain a proportional price reduction in accordance with the law, or to terminate the sales contract under the conditions of the law, in any of the following cases - art. 11(4):

The consumer has the right to suspend payment of any outstanding part of the price of the goods or of a part thereof until the seller has fulfilled its legal obligations - art. 11(6). The price reduction is proportional to the decrease in the value of the goods received by the consumer compared to the value the goods would have had if they were in conformity - art.13.

Contract Termination:

The legal warranty for hidden defects is applicable under the law, according to OG no. 21/1992 (revised 2) on consumer protection, OUG no. 140/2021, and the Civil Code. A hidden defect is a qualitative deficiency of a delivered product or a provided service that was not known and could not have been known by the consumer through ordinary means of verification.
