Decathlon START30 Promotional Campaign Regulations
These regulations are hereinafter referred to as the "Regulations".
§ 1. ORGANIZER
- The Organizer of the Promotional Campaign (hereinafter referred to as the "Promotional Campaign") is Decathlon sp. z o.o. with its registered office in Warsaw at ul. Geodezyjna 76, 03-290 Warsaw, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under KRS number 0000007163, NIP: 9511855233, REGON: 013102058, BDO: 000005259, with a share capital of PLN 8,859,465.00 (hereinafter referred to as the "Organizer").
- Any contact related to the organization and course of the Promotional Campaign should be made through the Decathlon Customer Service Office (e-mail address: kontakt@decathlon.pl).
§ 2. PLACE OF THE PROMOTIONAL CAMPAIGN
The Promotional Campaign is conducted on the territory of the Republic of Poland.
§ 3. PROMOTIONAL CAMPAIGN PERIOD
- The Promotional Campaign is conducted from 06.12.2024 to 31.12.2025, until 23:59 inclusive. The Organizer reserves the right to change the date of the Promotional Campaign and does not bear any responsibility in this regard.
- The discount code with the content "START30", granting the rights indicated in § 5 para. 1 below (hereinafter referred to as the "Discount Code"), will be active until 31.12.2025, until 23:59.
- The Organizer is not responsible for the inability to use the Discount Code within the period specified in para. 2 above, if this inability is related to circumstances not attributable to the Organizer. In particular, Participants within the meaning of § 4 para. 2 below (hereinafter referred to as "Participant") do not have any claims against the Organizer related to the Participant's internet connection problems that prevented the finalization of purchases within the period specified in the Regulations.
§ 4. CONDITIONS FOR PARTICIPATION IN THE PROMOTIONAL CAMPAIGN
- Only persons who fulfill all the conditions specified in the Regulations will participate in the Promotional Campaign.
- Participants of the Promotional Campaign are natural persons who, cumulatively:
- possess full legal capacity and are at least 18 years old;
- comply with these Regulations;
- have an active user account (hereinafter referred to as the "Account") registered on the website www.decathlon.pl (hereinafter referred to as the "Website"), or register an Account during the Promotional Campaign;
- have not used the option to make purchases in the Organizer's mobile application (hereinafter referred to as the "Application");
- have consented to receive marketing messages from the Organizer.
- Only individual customers may participate in the Promotional Campaign, i.e., persons making purchases of products for their own private needs, not related to their business activities.
- The Organizer reserves the right to exclude Participants who violate any provisions of these Regulations from participating in the Promotional Campaign. In such a situation, they will not be entitled to use the Discount Code or to make claims against the Organizer.
- Participation in the Promotional Campaign is free of charge and voluntary.
§ 5. RULES OF THE PROMOTIONAL CAMPAIGN
- The Promotional Campaign consists of providing Participants with the opportunity to use the "START30" discount code, which, when making the first purchase in the Application for a minimum total amount of PLN 300 (three hundred zlotys) before applying the Discount Code, entitles to a discount of PLN 30 (thirty zlotys) on the most expensive product at its regular price, located in the Participant's shopping cart (hereinafter referred to as the "Discount").
- The Promotional Campaign applies only to products available in the Application that are sold exclusively by the Organizer. Products sold by external Partners are not covered by the Promotional Campaign. Information on who is the seller of a given product is available on the product card.
- Discounted products are not covered by the Promotional Campaign, i.e., the Discount cannot apply to a discounted product; however, the value of discounted products is included in the total value of the Participant's cart, referred to in para. 1 above.
- The discount code can only be used for purchases made by the Participant using their Account via the Application.
- The discount code can be used only once, i.e., the Discount will be applied to the purchase of one most expensive product in the cart within a single transaction.
- The discount code is not exchangeable for another or for its cash equivalent or any other form.
- The Promotional Campaign cannot be combined with other promotional campaigns offered by the Organizer.
§ 6. EXCLUSIONS
- The possibility of using the rights granted by the Discount Code is excluded if the purchased products include only products offered by entities other than Decathlon Sp. z o.o. Information on who is the seller of each product is available on the product card.
- If the purchases include products offered by Decathlon Sp. z o.o. and by external entities, the discount granted based on the Discount Code will apply only to Decathlon Sp. z o.o. products purchased in accordance with the provisions of these Regulations.
- The discount code does not cover products sold under the "2nd life" service, included in the listing on the following website: https://www.decathlon.pl/produkty-2nd-life. In the case of purchasing the above-mentioned products, the Participant does not acquire the right to use the Discount Code.
§ 7. COMPLAINT PROCEDURE
- Complaints or information about irregularities concerning the Promotional Campaign can be submitted during the Promotional Campaign and for 21 days after its termination in the following ways:
- in writing to the Organizer's correspondence address, or
- electronically to the e-mail address: kontakt@decathlon.pl.
- A complaint or information about irregularities should include the Participant's name and surname, as well as a detailed description and indication of the reasons for submitting the complaint.
- The Organizer will notify about the method of handling the complaint or information about irregularities by registered letter sent to the address provided in the complaint or by sending a message to the e-mail address (depending on the form of submission), within 30 days of receiving the submission.
- The Organizer will consider complaints or information about irregularities based on these Regulations.
- Any disputes arising from participation in the Promotional Campaign will be settled amicably, and in the event of an inability to reach an agreement, the disputes will be subject to resolution by the common court competent for the Participant's place of residence or registered office.
- The provisions of this paragraph do not exclude the rights granted to Participants under separate legal provisions.
§ 8. PERSONAL DATA PROCESSING
- The administrator of the Participants' personal data (hereinafter referred to as the "Administrator") within the meaning of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as "RODO"), is the Organizer.
- The Administrator has appointed a contact point through which Participants can exercise their rights related to personal data protection. The contact point is the Data Protection Inspector, available via e-mail: iod@decathlon.com.
- Participants' personal data are processed for the purpose and scope of conducting the Promotional Campaign on the basis of the necessity of processing for the fulfillment of a legal obligation incumbent on the Administrator in connection with the public promise made within the meaning of art. 919 et seq. of the Civil Code, in accordance with art. 6 para. 1 lit. c RODO.
- Regardless of para. 3, Participants' personal data are processed on the basis of art. 6 para. 1 lit. f RODO (legitimate interest of the Administrator) for the purpose of pursuing, establishing or defending potential claims – the Administrator's interest is legal protection.
- Providing personal data is voluntary, although necessary for the purposes indicated above, including for the purpose and scope of conducting the Promotional Campaign. This information is strictly confidential and is used exclusively by the Administrator.
- Personal data may be disclosed to entities authorized to do so under the law.
- The Administrator may entrust the processing of personal data to third parties by way of a written agreement, exclusively for the purpose and scope necessary for the conduct of the Promotional Campaign, in accordance with art. 28 RODO.
- Personal data will not be transferred to third countries or international organizations.
- Personal data will be stored for the period necessary to achieve the objectives, including for the period required for the conduct of the Promotional Campaign.
- Personal data will be stored until the statute of limitations expires in accordance with the applicable provisions of generally binding law regarding potential claims that may be brought against the Administrator.
- The Participant has the right to access their data and to rectify, erase, restrict processing, data portability, object to the processing of personal data, and withdraw consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
- The Participant has the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing of personal data concerning the Participant violates RODO regulations.

§ 9. FINAL PROVISIONS
- These Regulations are exclusively binding on the territory of the Republic of Poland. Matters not regulated by these Regulations shall be governed by Polish law.
- If any provision of the Regulations is found to be illegal, void, or otherwise unenforceable to the extent provided by law, then to the extent that such provision is illegal, void, or unenforceable, it shall be excluded and removed, and the remaining provisions of the Regulations shall remain in full force and effect and shall continue to be binding and enforceable.
- In matters not covered by these Regulations, all decisions will be made by the Organizer. All Organizer's decisions are binding on the Participants.
- The Promotional Campaign will be conducted in accordance with the Regulations and is subject to Polish law.
- By participating in the Promotional Campaign, the Participant confirms that they have read these Regulations.
- This Promotional Campaign constitutes a public promise by the Organizer within the meaning of art. 919 et seq. of the Civil Code.
- The Organizer reserves the right to unilaterally amend the provisions of these Regulations for important reasons, including in the event of changes in the Organizer's business activities, such as changes to its profile, scope of product assortment, introduction of new services or facilities related to the provision of services, or expansion of the Organizer's service scope to include new related or unrelated services, changes in the Organizer's commercial policy, of which the Organizer will inform the Participants.
- These Regulations are effective from 06.12.2024.
