General Promotion Terms

These General Promotion Terms and the accompanying Special Promotion Terms (the "Special Promotion Terms") apply to the Promotion and your participation. By participating in the Promotion, you agree to the Promotion Terms.

Article 1 - Definitions

Key terms include: "Promotion" (promotional contest or action), "Promotion Area" (Benelux territory), "Promotion Period" (duration of the action), "Participating Products" (models listed in Special Terms), "Promotion Terms" (General and Special Terms), "Submission Material" (contributions from participants), "Participant" (person participating), "Registration Period" (period for entries), "Promotion Page" (Samsung.com promo pages), "Samsung" (Samsung Electronics Benelux B.V.), and "Benefit" (discount, prize, cashback, or product).

Article 2 - Participation

1. Participation is open to natural persons aged 18+ residing in the Promotion Area. Proof of residence and age may be required.
2. Participation is free of charge, unless otherwise specified in the Special Promotion Terms.
3. Participation in certain promotions requires the purchase of a specific "Promotion Product" from a participating retailer within the Promotion Period. Subsequent owners or participants who bought products from non-participating retailers or individuals are not eligible. Benefits must be returned if the original purchase is cancelled. Participation and benefits are personal and non-transferable. Promotions are valid while stocks last.
4. Registration via a website may be required within the Registration Period. Participants must have a valid email address and residential address in the Promotion Area. Confirmation will be sent to the provided email. If confirmation is not received, contact Samsung within two weeks. Additional information or documentation may be requested, with a 14-day deadline for submission. Failure to comply will result in unsuccessful registration.
5. Participation is open only to consumers (natural persons not acting for business purposes).
6. Promotions may be combined with other offers unless explicitly stated otherwise in the Special Promotion Terms.

Article 3 - Exclusions

1. Samsung employees, affiliated persons, and their respective employees are excluded from participation.
2. Participants can only participate during the Registration Period and as described in the Promotion Terms. Submissions that are late, incomplete, or not in the prescribed manner will not be accepted. Samsung is not liable for delayed, incomplete, or lost submissions due to technical reasons or other causes. Participants should keep copies of their registrations and submissions.
3. Participation is not allowed, and Samsung may exclude participants, if: a. The participant violates the Promotion Terms. b. The participant provides multiple, incomplete, or false information. c. Automated systems or techniques are used to increase chances of winning. d. There is misuse, fraud, manipulation, or breach of the Promotion Terms. e. The participant is not acting for personal use but for business purposes. Samsung may exclude participants based on suspicion without prior notice or obligation to provide compensation or proof.

Article 4 - The Benefit

1. The right to receive the Benefit is personal, non-exchangeable for goods/services, and non-transferable without Samsung's written consent.
2. Samsung may offer an equivalent alternative benefit without prior notice or compensation.
3. If a Participant does not claim the Benefit within the specified term (or within one month if no term is specified), Samsung may forfeit the claim. Samsung may award the Benefit to another Participant.
4. Samsung aims to process Benefits within 16 weeks of valid registration or winner determination. Cashbacks are paid to EU bank accounts; products are shipped to Benelux addresses. Receipt of a product is confirmed upon delivery.
5. Any Dutch gambling tax applicable to a Benefit in the Netherlands will be paid by Samsung. Participants are responsible for any other applicable taxes.

Article 5 - Submission Material

1. Participants guarantee that their submission material is lawful and does not infringe third-party rights. Samsung may refuse or remove submissions deemed inappropriate or unlawful.
2. Participants grant Samsung irrevocable rights to use, exploit, and license the submission material worldwide for any medium and purpose. Participants waive any right to compensation for the submission material.
3. Participants authorize Samsung and its group companies to use the submission material for promotional and other purposes without compensation, other than the Benefit itself.

Article 6 - Exclusion of Liability

1. Samsung, its employees, and third parties are not liable for costs, damages, technical issues, fraud, or the content of submission material, except in cases of intent or gross negligence.
2. Samsung provides no warranty regarding the Benefit and excludes liability for defects, delayed delivery, loss, damage, or minor discrepancies in the Benefit.
3. Social media platforms used for promotions are not affiliated with, sponsored by, or responsible for the promotion.

Article 7 - Privacy

1. Participant data is processed according to applicable privacy laws for the promotion, market research, and direct marketing. Data may be shared within the Samsung group or with authorities if legally required. Data will not be sold to third parties.
2. Data may be provided via social media accounts (e.g., Facebook, Twitter).
3. Participants can exercise their legal rights regarding data access, correction, and objection to direct marketing by contacting Samsung. Requesting data deletion will result in forfeiture of participation and benefits. Participants can review Samsung's privacy policy online.

Article 8 - Complaints

1. Questions, comments, or complaints about the Promotion should be directed to Samsung customer service using the contact details provided in the Special Promotion Terms. Contact numbers are provided for Netherlands, Belgium, and Luxembourg.
2. Samsung is not obligated to correspond regarding exclusions, removal of submission material, or promotion results.
3. Samsung's lack of response to a participant's communication does not constitute agreement.

Article 9 - Final Provisions

1. For promotions in the Netherlands with a chance element, the Dutch Code of Conduct for Promotional Lotteries applies.
2. Samsung reserves the right to cancel, suspend, or modify the promotion, terms, or benefits at its discretion without prior notice, if circumstances require, without liability for damages.
3. The content of the Promotion Terms is subject to errors and interpretation. No rights can be derived from Samsung's errors.
4. The law of the Promotion Area (as specified in the Special Promotion Terms) applies. If the Promotion Area includes multiple countries, the law of the participant's residence (Belgium, Netherlands, or Luxembourg) applies.
5. Disputes involving participants from the Netherlands will be handled by the Amsterdam court. For participants from Belgium, the Antwerp court has jurisdiction. For participants from Luxembourg, the Luxembourg City court has jurisdiction. Parties are encouraged to seek amicable solutions before pursuing legal action.
