COMMERCIAL INLAND MARINE WIRELESS COMMUNICATIONS EQUIPMENT COVERAGE CERTIFICATE
This Certificate provides coverage for Your Equipment, subject to its terms, conditions, exclusions, and limits. "You" and "Your" refer to the Insured Customer, and "Company", "We", "Us", and "Our" refer to New Hampshire Insurance Company. "Authorized Representative" refers to Apple, Inc.
I. COVERAGE
We agree to provide insurance for Loss to Your Equipment while coverage is in effect, in return for premium payment. This insurance is primary over any other insurance You may have. Coverage begins at 12:01 a.m. on the Coverage Effective Date, as specified in Your receipt or invoice. We will replace Your Equipment in the event of a Loss, provided You have activated and maintained the standard tracking application on Your Equipment and validated Your identity online when making a claim.
Replacement equipment may not have identical features and functions, may be remanufactured or refurbished with non-original parts, and could be a different model, brand, or color.
II. COVERED CAUSES OF LOSS
Coverage is provided for Theft or Lost Equipment.
III. EXCLUSIONS TO COVERED CAUSES OF LOSS
This Certificate does not cover losses resulting from:
- The Deductible.
- Damage to the Equipment due to: normal wear or tear, gradual deterioration, inherent vice, latent defect, cosmetic damage (marring, scratching, discoloration) that does not affect functionality, alterations, maintenance, repairs, faulty design, cleaning, restoring, or obsolescence (including technological obsolescence).
- Direct, Sudden and Accidental Damage, Theft or Lost Equipment, or Mechanical or Electrical Failure occurring outside the Territory more than sixty (60) days after You left the Territory.
- Loss of value, loss of use, loss of personalized Data, customized software, or information stored in memories, or any consequential loss (including economic loss, loss of turnover, profits, business, goodwill, or expected savings), except as otherwise stated.
- Damage, Theft or Lost Equipment, or Mechanical or Electrical Failure when repairing or replacing only antennas, battery chargers, or batteries.
- Damage caused by any deliberate act by You, Your employees, or any person using the Equipment with Your permission.
- Costs for replacing car kits and other accessories that can no longer be used with the Equipment.
- Confiscation by any government or public authority.
- Costs associated with returning or collecting Equipment for repair, or collecting replacement equipment.
- Damage covered by the manufacturer's guarantee or warranty for parts or labor.
- Loss caused by or resulting from a Computer Virus.
- Loss caused by or resulting from preventative maintenance or preferential adjustments.
- Loss caused by insects, rodents, or other vermin.
- Abuse of the Equipment or use in a manner not intended or designed by the manufacturer, or any act that voids the manufacturer's warranty.
- Routine servicing, inspection, adjustment, or cleaning of the Equipment.
- War risks, riot, terrorism, revolution, or similar events.
- Acts of God (earthquake, hurricane, tornado, or similar events).
- Mechanical and/or Electrical Failure.
- Any property or equipment that is not Equipment.
- Contraband or Equipment in the course of illegal transportation or trade.
- Any antenna or wiring attached to, protruding from, or on the exterior of any vehicle or watercraft.
- Equipment in transit from a manufacturer or seller.
- Data, Nonstandard External Media, and Nonstandard Software.
- Color face plates or other Non-Covered Accessories.
- Equipment with an altered, defaced, or removed unique identification number (IMEI or ESN, etc.).
IV. PREMIUM PAYMENTS
Premiums are charged based on the Equipment Category and Policy Term. For example, Tier 4/Tier 5 coverage for a Monthly Policy Term is $1.00 per Month (if purchased with a Service Contract). Other terms and prices are detailed in the schedule.

V. COVERAGE EFFECTIVE DATE
Coverage is effective at 12:01 A.M. on the stated effective date. For Plan F, coverage begins upon approval and is retroactive to the submission date of the enrollment request. Notification of approval or denial will be provided within fourteen (14) days. For Supplemental 1, a test call to the Equipment may be required after Initial Activation.
VI. LIMITS OF LIABILITY
A. Per Occurrence Limits: The maximum payout for a Loss is the original retail price paid for the Equipment, not exceeding the limit less the applicable deductible.
B. Aggregate Limits: A maximum of 2 replacements of Equipment are allowed per Wireless Number in any 12-month period, calculated from the Date of Replacement.
VII. DEDUCTIBLE
A non-refundable deductible is payable at the time of replacement approval. For Theft or Lost Equipment, the deductible for Tier 4 and Tier 5 is $119.00. Additional charges may apply for causes other than Theft or Lost Equipment if the Equipment is not returned as directed.

VIII. CONDITIONS IN THE EVENT OF LOSS
A. Replacement: We will arrange for replacement through an Authorized Service Facility. Service options, parts availability, and response times may vary by country. You are responsible for shipping and handling charges if service is not available in Your country, and for compliance with import/export laws and duties.
B. No Cash Payout: You will not receive cash; however, We may provide a voucher or gift card equal to the Equipment's market value, not exceeding its original purchase price.
C. Substitute Equipment: We may provide substitute equipment of like kind and quality, which may be new or refurbished, contain non-original parts, or be a different brand, model, or color.
D. Evaluation: Equipment failure evaluation by the Wireless Service Provider, Authorized Representative, or manufacturer may be required prior to replacement approval.
IX. DUTIES IN THE EVENT OF LOSS
A. Reporting a Loss: You must report a Loss promptly to Our Authorized Representative, not later than sixty (60) days from the Date of Loss. Failure to report within this timeframe forfeits the claim. All claims must be submitted through Our Authorized Representative for approval.
B. Minimize Loss: You must take reasonable steps to minimize the Loss and protect the Equipment.
C. Proof of Loss: You may be required to provide a detailed written proof of Loss statement, a police report, a copy of the original bill of sale, and/or a government-issued photo ID.
D. Return of Equipment: If the cause of Loss is other than theft or lost equipment, You must keep the Equipment until the claim is completed. If We replace the Equipment, You may be required to return it at Our expense within ten (10) days using a provided mailer. Failure to do so incurs a non-returned equipment charge. Returning the Equipment as directed avoids this charge.
E. Inspection and Cooperation: You must permit Us to inspect the Equipment and records and cooperate in the investigation of Your claim. You may be questioned under oath if necessary.
F. Information for Claim Approval: You must provide Our Authorized Representative with all necessary information for claim approval within sixty (60) days of reporting the Loss. Failure to accept replacement equipment within sixty (60) days of claim approval results in forfeiture of the equipment and claim.
G. Deductible Payment: You must satisfy the nonrefundable deductible applicable to the Loss.
X. ELIGIBILITY AND CANCELLATION
A. Cancellation: You may cancel coverage by mailing written notice to Our Authorized Representative. The Named Insured may also cancel coverage. We may cancel or change terms with thirty (30) days' notice, or longer if required by law, except for reasons such as fraud, material misrepresentation, or nonpayment of premium, which may allow for immediate cancellation or shorter notice periods. Cancellation due to exhausting the aggregate limit requires thirty (30) days' notice. Notice of cancellation must include the reason and effective date.
B. Eligibility: To be and remain eligible for coverage:
- The Equipment must be designated and eligible for coverage, potentially limited to new Equipment not previously activated.
- You must not have engaged in fraud or abuse with insurance programs.
- You must not have exhausted the Aggregate Limit.
- You must not be in breach of any material term, including failure to return damaged Equipment or satisfy the deductible.
- You must have activated and maintained the standard tracking application and validated Your identity online at the time of claim.
C. Premium Payment: You are responsible for all premium payments.
D. Coverage Term: Insurance is provided for the chosen term unless You or Your Equipment cease to be eligible.
XI. ADDITIONAL CONDITIONS
A. Claim Satisfaction: We will satisfy claims within thirty (30) days after presentation of satisfactory proof of interest and Loss and satisfaction of Your Duties.
B. Recovery and Salvage: Any recovery or salvage accrues to Our benefit. Damaged equipment must be returned upon request. Replaced Equipment becomes Our property and may be disabled, destroyed, or reused. Replacement may be denied if You breach terms, such as failing to return damaged Equipment or satisfy charges/deductibles.
C. Assignment: This Certificate may not be assigned without Our written consent.
D. Subrogation: If an Insured Customer has rights to recover damages from another party, those rights are transferred to Us. The Insured Customer must cooperate in securing these rights and not impair them. Waivers against other parties are permitted under specific conditions.
E. Concealment, Misrepresentation or Fraud: This coverage is void in cases of fraud, intentional concealment, or misrepresentation of material facts concerning the coverage, Equipment, Your interest in the Equipment, or a claim.
XII. DEFINITIONS
A. "Authorized Service Facility": Location for program replacement facilities, selected at Our sole discretion.
B. "Computer Virus": Malicious software that damages, destroys, or interferes with performance of Data, media, software, or systems.
C. "Covered Accessories": Specific Apple-branded bands (Nike Sport, Hermès Sport) supplied with the covered Equipment, if lost or stolen with it.
D. "Data": Information input, stored, or processed by the Equipment.
E. "Date of Loss": The date a Loss to the Equipment occurs.
F. "Date of Replacement": The date replacement Equipment is shipped or picked up.
G. "Direct, Sudden and Accidental Damage": A fortuitous event causing direct physical damage, excluding gradual deterioration, defects, programming errors, Computer Virus, loss of Data, or contamination.
H. "Equipment": Your covered Apple Watch, including its Covered Accessories.
I. "Initial Activation": Time of initial activation of the Wireless Service Provider's service for the Equipment.
J. "Insured Customer(s)": Customer enrolled and accepted for coverage, with Equipment description on file, and who has paid all premiums before a claimed Date of Loss.
K. "Line-Based Coverage": A coverage plan for Equipment on an individual Wireless Number.
L. "Loss" and "Losses": A covered loss as provided in Section II.
M. "Lost": Misplacement of the Equipment where it is unrecoverable.
N. "Mechanical or Electrical Failure": Failure of Equipment due to faulty parts, workmanship, or normal wear and tear when operated per manufacturer's instructions.
O. "Non-Covered Accessories": All accessories not defined as Covered Accessories.
P. "Nonstandard External Media": Physical objects for Data storage not integrated into the Equipment (e.g., data cards, memory cards, external hard drives, flash drives).
Q. "Nonstandard Software": Software other than Standard Software.
R. "Standard External Media": Physical objects for Data storage that came standard in the original packaging with the Equipment.
S. "Standard Software": Operating system pre-loaded or included as standard with the Equipment.
T. "Territory": Worldwide.
U. "Theft": Unlawful taking of the Equipment.
V. "Wireless Number": Mobile telephone or Data line(s) or number(s) assigned by the Wireless Service Provider.
W. "Wireless Service Provider": Entity providing wireless telephone or communications services.
XIII. STATE CHANGES
Terms and conditions may vary for Certificates issued and Insured Customers in select jurisdictions. Please see attached endorsements for applicable revisions.
Duplicate Coverage Warning: This Certificate may provide coverage duplication with Your Personal Auto Insurance Policy, Homeowner's Insurance Policy, or other sources of coverage.
Insurance Fraud Warning: Knowingly providing false, incomplete, or misleading information in a claim or application is insurance fraud, a felony in Florida.
