Samsung Promotion Terms and Conditions

"Pay in 30x0% with 3-month deferral on Samsung products 30.07 - 31.08.2025"

§ 1 Definitions

  1. Bank: Santander Consumer Bank S.A., located in Wrocław, Poland. Registered under KRS number 0000040562. NIP: 5272046102. Share capital: 520,000,000.00 PLN.
  2. Credit: Interest-free credit for product purchase granted by the Bank, available at Samsung Stores for amounts between 100 PLN and 40,000 PLN. Repayment period from 2 to 30 installments, with the last installment being a balancing payment. The first installment is due no earlier than 120 days from the Credit Agreement date. The Participant is not responsible for any costs associated with granting the Credit, except for costs incurred in case of an Agreement violation.
  3. Promotion: The promotional campaign "Pay in 30x0% with 3-month deferral on Samsung products 30.07 - 31.08.2025", organized and conducted by the Organizer from 30.07.2025 to 31.08.2025, under the terms described in these Regulations.
  4. Regulations: These Regulations for the "Pay in 30x0% with 3-month deferral on Samsung products 30.07 - 31.08.2025" promotion. The Regulations define the terms of participation, duration of the Promotion, information dissemination about the Promotion and its conditions, and the procedure for submitting complaints related to the Promotion.
  5. Organizer: Samsung Electronics Polska sp. z o.o., with its registered office in Warsaw, Poland (ul. Postępu 14, 02-676 Warszawa). Registered under KRS number 0000128080. NIP: 526-10-44-039. REGON: 011612810. Share capital: 52,759,500 PLN.
  6. Participant: An adult individual with full legal capacity, purchasing promotional products for personal use not related to business activity, residing in the Republic of Poland, possessing a PESEL number, who has read and accepted these Regulations and met the specified conditions.
  7. Promotional Products: All Samsung products with a value not exceeding 40,000 PLN, available in the Samsung Store at www.samsung.com/pl, subject to the Organizer's current offer.
  8. Agreement: The Credit Agreement concluded between the Bank and the Participant through the Organizer, as referred to in art. 5, points 13 and 14 of the Act of May 12, 2011, on consumer credit (consolidated text: Journal of Laws of 2024, item 1497, as amended), hereinafter referred to as "UKK".
  9. Samsung Store: An IT platform available via the website www.samsung.com/pl/, administered by Samsung, enabling users to view promotional products, their prices, availability, place orders, and conclude sales agreements for promotional products, in accordance with the regulations of the online Samsung Store: Samsung Store Regulations.
  10. Website: The website with information about the Promotion available at: Promotion Regulations.

§ 2 Promotion Rules

  1. The Promotion means that the Participant does not incur any costs for the Credit, i.e., interest or commission.
  2. The Promotion may be combined with other Organizer promotions, unless the regulations of a specific Organizer promotion state otherwise.
  3. The Promotion is valid from 30.07.2025 to 31.08.2025 (the date of submitting the Credit application is decisive).
  4. A Participant in the Promotion is a person referred to in § 1, item 6 of these Regulations, provided they meet all the following conditions:
    • Purchases a selected Promotional Product participating in the Promotion at the Samsung Store and selects the "Installments" payment method during checkout. Subsequently, after being redirected to the Bank's website to complete the installment credit application, selects the option "Pay in 30x0% with 3-month deferral on Samsung products".
    • Concludes an Agreement with the Bank through the Samsung Store.
    • Does not withdraw from the Agreement within 14 days of its conclusion.
  5. In case of withdrawal from the sales agreement for one of the Devices, the funds for that Device will be refunded by the Organizer directly to the Bank, and consequently, any overpayment will be credited by the Bank towards the repayment of subsequent Credit installments.

§ 3 Complaints

  1. Complaints regarding the Credit are handled according to the terms of the Agreement concluded between the Participant and the Bank. The Agreement contains detailed information on the method and form of submitting complaints regarding the Credit.
  2. For purchased Promotional Products and the course of the Promotion, the Participant has the right to submit a complaint to the Organizer.
  3. A complaint must include:
    • Participant's first and last name.
    • Correspondence address or email address for contact.
    • Description of the circumstances forming the basis of the complaint.
  4. Complaints should be submitted within 14 days from the end of the Promotion:
    • In writing to the address: Samsung Electronics Polska sp. z o.o. ul. Postępu 14, 02-676 Warszawa; or
    • By email to: support_sepol@email.support.samsung.com with the subject line: Promotion: "Pay in 30x0% with 3-month deferral on Samsung products 30.07 - 31.08.2025"; or
    • Via the complaint form available at: Samsung Complaints Form.
  5. Submitted complaints will be processed within a maximum of 14 calendar days from the date of receipt. Interested parties will be notified of the complaint resolution method in the same form as the complaint was submitted.
  6. The time limit for submitting a complaint provided for in these Regulations does not exclude or limit the Participant's rights under applicable law, particularly regarding statutes of limitations for claims.
  7. The complaint procedure does not exclude or limit the Participant's right to pursue their claims before common courts.

§ 4 Personal Data Protection

  1. The Administrator of the Participant's personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), concerning the conclusion and execution of the Credit Agreement, is the Bank, in accordance with the information clause regarding the processing of personal data provided to the Participant at the stage of concluding the Credit Agreement.   2. The Administrator of the Participants' personal data within the meaning of "GDPR" concerning the Promotion, including its organization and execution, and any complaint proceedings, as well as the conclusion and execution of sales agreements for promotional products, is the Organizer. For other aspects of processing Participants' personal data for the purpose of conducting the Promotion, the Personal Data Processing Principles apply, available at: Samsung Privacy Policy.

§ 5 Change of Regulations

  1. The Organizer reserves the right to amend these Regulations in connection with and in the event of the occurrence of at least one of the following important reasons:
    • Introduction of new or amendment of existing generally binding legal provisions, if it directly affects the content of these Regulations and necessitates their amendment.
    • Change or emergence of new interpretations of generally binding legal provisions as a result of court judgments or decisions of public authorities or administration, directly affecting the provisions of these Regulations and necessitating their amendment.
    • A ruling, decision, recommendation, or endorsement by a competent public authority concerning these Regulations, resulting in the need to adapt them to such a ruling, decision, recommendation, or endorsement.
    • Change of company details, tele-address, or URL addresses included in the text of these Regulations.
    • The necessity to introduce changes other than those mentioned above, provided that they collectively meet the following conditions: (i) they are lawful (including, in particular, not infringing individual or collective consumer interests); (ii) they are beneficial for current and potential Participants; (iii) their introduction is necessary for the proper execution of the Promotion in a manner that is beneficial to current and potential Participants.
  2. An announcement of the change to the Regulations will be published on the Website at least 3 days before it comes into effect.
  3. Changes to the Regulations cannot negatively affect rights previously acquired by Participants.

§ 6 Final Provisions

  1. The Regulations will be available for review at: Samsung Promotion Regulations throughout the entire duration of the Promotion. The Participant may save the content of the Regulations by downloading it from the Website.
  2. The Bank makes the decision regarding the terms and granting of the Credit. The Organizer of the Promotion acts as a credit intermediary within the meaning of art. 5, item 3 of the Act of May 12, 2011, on consumer credit (consolidated text: Journal of Laws of 2024, item 1497, as amended). For its role, the Organizer receives remuneration from the Bank.
  3. In all matters not regulated by these Regulations, the Organizer shall make the decision.
