Software Licensing Agreement

Caution: Be sure to read the Software License Agreement before opening the bag containing the key code.

Thank you for purchasing this Panasonic product. Before opening the bag containing the key code packaged with this product, please read the Software Licensing Agreement below. After agreeing to the terms of the Software Licensing Agreement, go to the activation code generation site and generate the “activation key”. The activation key you have generated will allow you to use this software. Note that by opening the bag containing the key code, you are considered to have agreed with the terms of the Software License Agreement. The Software License Agreement is a legally binding agreement between you and Panasonic (hereinafter referred to as the Agreement). It is also proof that you have been granted a license to use the Software by Panasonic under the law. Any user of the software shall be bound by this Agreement as “you” or “user” of this Agreement.

Article 1 License
The users obtain the license of the software (i.e. the software loaded in the main device which can be activated using the activation key and the activation key packaged with this product), but the copyright or intellectual property right of the software does not transfer to the users.
Article 2 Usage Device
The software may be used on a single device loaded with the software and not on any other devices.
Article 3 Reverse Engineering, Decompiling or Disassembly
The Software is provided to you as is, and Panasonic makes no express or implied warranties whatsoever with respect to the Software. You shall not reverse engineer, decompile, or disassemble the Software. Panasonic or any of its distributors or dealers shall not be bound by warranty for any defects in the Software or damage to you caused by your reverse engineering, decompiling, or disassembly of the Software. If you are imposed any damage form such your reverse engineering, decompiling, or disassembly of the Software, Panasonic and Affiliates shall not provide any warranty, indemnification and/or compensation thereto. “Affiliate” means company or other legal entity which: (a) is Controlled by Panasonic; (b) Controls Panasonic; or (c) is under common Control with Panasonic. “Control” means that more than fifty percent (50%) of the shares or ownership interest representing the voting right for the election of directors or persons performing similar functions for such a corporation, company or entity that are owned or controlled, directly or indirectly, by the controlling entity. Such corporation, company or entity shall be deemed to be an Affiliate so long as such ownership or control exists.
Article 4 No Warranty
The Software will be provided “as is” basis. Panasonic and Affiliates does not provide any expressed, implied and/or legal warranty and/or indemnification regarding any defect of the Software (including but not limited to any accuracy, completeness, safety, merchantability,

effectiveness, quality, fitness for a particular purpose and for registrations, defect related to security, defect, error, bug, problem, damage of data and infringement) for user. Panasonic does not have any liability for users to provide the Software not including such defects. If user’s use of the software and/or user’s behavior related to this agreement bring any damage for Panasonic and/or Affiliates, user shall warrant and indemnify Panasonic, and/or Affiliates and hold Panasonic and Affiliates harmless, from such damage. User shall settle any dispute between user and any third parties: (i) which are caused by use of the Software; and/or (ii) which are caused by breach of this agreement by user, on user’s liability and user’s cost. Panasonic and Affiliates does not have any liability for user’s damage, cost and payment caused by user’s use of the Software and user’s behavior related to this agreement. This Article shall not be applied if user will be damaged by Panasonic’s intentional breach and/or Panasonic’s breach caused by gross negligence. Panasonic’s cumulative liability regarding breach of this agreement and tort for user shall be: (i) limited only to direct damages and does not include any indirect and consequential damage and lost profit regardless of whether Panasonic can predict it or not; and (ii) actual payment by user to Panasonic in accordance with this agreement or 10,000 (ten thousand) yen whichever is higher.
Article 5 Changes to Specifications
Panasonic may change the information in the specifications and related documents for the Software without prior notice in the future. Panasonic will update the Software for the purpose of bug fixes, improvement, modification, addition and/or enhancement of security functions. Such updates may add, remove and/or change the function of the Software. Such updates shall be performed by Panasonic on its sole discretion and such updates may be necessary condition for use of the Software. In this case: (i) if user request to continue to use the Software, user shall perform the updates immediately; or (ii) if user does not request to continue to use the Software, user shall suspend and destroy the Software immediately. Panasonic’s liability regarding quality decline of the Software caused by any update (including but not limited to function removal or new bug occurrence) shall be limited only to the extent set forth in the Article “No Warranty”.
Article 6 Export Control
You shall comply with all laws and regulations related to export control at home and abroad with respect to the Software.
Article 7 Change Of Party
Panasonic may assign and transfer the rights, obligation and status of licensor under this agreement to assignee, if Panasonic assign and/or transfer the business related to this agreement by business assignment, merger and/or company split, or any other situation on its sole discretion.
Article 8 Governing Law
This document shall be governed by and construed and enforced in accordance with the laws of Japan, without regard to its conflict of law provisions.
Article 9 Agreed Jurisdiction
Any dispute arising out of or in relation to this document shall be subject to the exclusive jurisdiction of the Osaka District Court.
Article 10 Priority Of Japanese Language Version
If Japanese language version of this agreement is attached herewith, such version shall prevail over this version.

2. Export the device information
Export the device information from the camera.

“PRIVATEPANA_GRPPAVCLUMIXACTV” folder on the card.

3. Acquire the activation code
Acquire an activation code from the site that generates it. · The supplied key code is required to acquire an activation code.
Agree to the Software Licensing Agreement, and remove the key code from its bag.
1 Insert the card containing the device information into a PC
connected to the Internet.
2 Using a browser on the PC, access the activation code
generation site, and follow the on-screen instructions to acquire an activation code.

· The activation code (file name: ACTIVE.LST) will be saved to the “PRIVATEPANA_GRPPAVCLUMIXACTV” folder on the card.
· If another “ACTIVE.LST” file is already stored in the “PRIVATEPANA_GRPPAVCLUMIXACTV” folder on the card, the new file may overwrite it and be saved. Before saving the new file, confirm that there is no “ACTIVE.LST” file in the above folder.

4. Import the activation code

Import the activation code to the camera to enable the extended functions.

· Le code de la clé ne peut pas être réémis. Conservez-le en lieu sûr.
· Avant d’ouvrir le sac qui contient le code de la clé, vérifiez attentivement le modèle compatible.
· Avant d’ouvrir le sac qui contient le code de la clé, lisez attentivement le “Contrat de licence de logiciel”.
· Si vous retirez le ruban adhésif du sac qui contient le code de la clé pour l’ouvrir, vous serez réputé avoir accepté les conditions stipulées dans le Contrat de licence de logiciel.
· Vous ne pourrez pas retourner le produit, une fois que vous aurez retiré le ruban adhésif du sac qui contient le code de la clé pour l’ouvrir.
· Pour utiliser ce produit, vous devez disposer d’un ordinateur ayant un accès à Internet.
Après avoir consenti aux déclarations susmentionnées, retirez le ruban adhésif du sac qui contient le code de la clé, prenez le code qui se trouve à l’intérieur et activez le logiciel.

Contrat de licence de logiciel
Attention : Assurez-vous de lire le Contrat de licence de logiciel avant d’ouvrir le sac qui contient le code de la clé.
Merci d’avoir acheté ce produit de Panasonic. Avant d’ouvrir le sac qui contient le code de la clé fourni avec ce produit, veuillez lire le Contrat de licence de logiciel qui se trouve ci-dessous. Après avoir accepté les conditions stipulées dans le Contrat de licence de logiciel, allez sur le site de génération des codes d’activation et générez la “clé d’activation”. La clé d’activation que vous aurez générée vous permettra d’utiliser le logiciel. Notez qu’en ouvrant le sac qui contient le code de la clé, vous serez réputé avoir accepté les conditions stipulées dans le Contrat de licence de logiciel. Le Contrat de licence de logiciel est un accord ayant force obligatoire entre vous et Panasonic (ci-après appelé le Contrat). Il constitue, en outre, une preuve qu’une licence vous autorisant à utiliser le logiciel vous a été octroyée par Panasonic conformément à la législation. Article 2 Dispositif d’utilisation
Le logiciel ne peut être utilisé que dans un seul dispositif contenant le logiciel et dans aucun autre.
Article 3 Ingénierie inverse, décompilation ou désassemblage
Le Logiciel vous est fourni en l’état et Panasonic n’offre aucune garantie expresse ou implicite quelle qu’elle soit, concernant le Logiciel. Vous ne devez pas effectuer d’ingénierie inverse, ni décompiler ou désassembler le Logiciel. l’efficacité, la qualité, l’adéquation à un usage particulier et pour les enregistrements, défaut lié à la sécurité, défaut, erreur, bogue, problème, endommagement des données et contrefaçon) à l’utilisateur. Panasonic n’a pas la responsabilité de fournir aux utilisateurs le Logiciel exempt de ces défauts. Si l’utilisation du logiciel par l’utilisateur et/ou le comportement de l’utilisateur lié à cet accord causent des dommages à Panasonic et/ou aux affiliés, l’utilisateur devra garantir et indemniser Panasonic et/ou les affiliés et tenir Panasonic et les affiliés indemnes de tels dommages. L’utilisateur devra régler tout litige entre l’utilisateur et tout tiers : (i) causés par l’utilisation du Logiciel ; et/ou (ii) causés par la violation de cet accord par l’utilisateur, sur la responsabilité de l’utilisateur et les frais de l’utilisateur. Panasonic et ses affiliés n’assument aucune responsabilité pour les dommages subi par l’utilisateur, les coûts et les paiements de l’utilisateur découlant de son utilisation du Logiciel et le comportement de l’utilisateur lié à cet accord. Cet article ne s’applique pas si l’utilisateur est lésé par une violation intentionnelle de Panasonic et/ou une violation de Panasonic causée par une négligence grave. Article 5 Modification des spécifications
Panasonic peut modifier ultérieurement, sans préavis, les renseignements contenus dans les spécifications et les documents connexes relatifs au Logiciel. Panasonic mettra à jour le Logiciel dans le but de corriger des bogues, de perfectionner, de modifier, d’ajouter et/ou d’améliorer des fonctions de sécurité. De telles mises à jour peuvent ajouter, retirer et/ou modifier la fonction du Logiciel. De telles mises à jour devront être effectuées par Panasonic à sa seule discrétion et ces mises à jour pourront être une condition nécessaire à l’utilisation du Logiciel. Dans ce cas : (i) si l’utilisateur demande à continuer d’utiliser le Logiciel, l’utilisateur devra immédiatement effectuer les mises à jour ; ou (ii) si l’utilisateur ne demande pas à continuer d’utiliser le Logiciel, l’utilisateur devra suspendre et détruire immédiatement le Logiciel. La responsabilité de Panasonic concernant la baisse de qualité du logiciel suite à une mise à jour (y compris, mais sans s’y limiter, la suppression de fonctions ou l’apparition de nouveaux bogues) sera limitée uniquement dans la mesure indiquée dans l’article « Aucune garantie ».
Article 6 Contrôle des exportations
Vous devrez respecter toutes les lois et réglementations qui régissent le contrôle des exportations dans votre pays et à l’étranger relativement au Logiciel.
Article 7 Changement de Partie
Panasonic peut céder et transférer ses droits, obligations et statuts de concédant en vertu du présent accord au cessionnaire, si Panasonic cède et/ou transfère l’activité liée à cet accord par cession d’entreprise, fusion et/ou scission de société, ou toute autre situation à sa seule discrétion.
Article 8 Loi en vigueur
Le présent document sera régi, interprété et appliqué conformément aux lois du Japon, sans égard aux principes de conflit de lois.
Article 9 Juridiction convenue
Toute contestation résultant du présent document, ou relative à celui-ci, relèvera de la seule compétence du tribunal de district d’Osaka.
Article 10 Priorité à la version en langue japonaise
Si une version en langue japonaise de cet accord est jointe à la présente, elle prévaudra sur celle-ci.

2. Exportation des données de l’appareil photo
Exportez les données de l’appareil photo depuis celui-ci.
1 Insérez la carte dans l’appareil photo.
· Insérez une carte formatée avec l’appareil photo.

· Si un écran de sélection de fente de carte s’affiche, sélectionnez la carte sur laquelle écrire.
· L’écran de confirmation s’affiche. Il s’exécute lorsque [Oui] est sélectionné.
· Les données de l’appareil photo (nom de fichier : SERIAL.LST) seront enregistrées dans le dossier “PRIVATEPANA_GRPPAVCLUMIXACTV” de la carte.

3. Obtention du code d’activation
Obtenez votre code d’activation sur le site qui génère ce type de code. · Pour obtenir votre code d’activation, vous aurez besoin du code de la clé fourni.
Acceptez le Contrat de licence de logiciel, puis retirez le code de la clé qui est contenu dans le sac.
1 Insérez la carte qui contient les données de l’appareil photo
dans un ordinateur de bureau connecté à Internet.

Softwarelizenzvereinbarung

Vielen Dank für Ihren Kauf dieses Panasonic-Produkts. Bevor Sie den Umschlag mit dem Schlüssel-Code aus dem Lieferumfang dieses Produkts öffnen, lesen Sie die nachfolgenden Softwarelizenzvereinbarung. Nachdem Sie den Bedingungen der Softwarelizenzvereinbarung zugestimmt haben, gegen Sie zur Website zum Generieren des Aktivierungscodes und generieren Sie den “Aktivierungsschlüssel”. Mit dem generierten Aktivierungsschlüssel können Sie die Software verwenden. Beachten Sie, wenn Sie den Umschlag mit dem Schlüssel-Code öffnen, bestätigen Sie, dass Sie den Bedingungen der Softwarelizenzvereinbarung zustimmen. Bestimmung 1 Lizenz
Der Benutzer erhält eine Lizenz zur Nutzung der Software (d. h., der Software, die auf dem Hauptgerät geladen wurde und die mit dem Aktivierungsschlüssel aus dem Lieferumfang dieses Produkts aktiviert werden kann), jedoch werden weder Urheberrecht noch sämtliche geistigen Eigentumsrechte an der Software auf den Benutzer übertragen.
Bestimmung 2 Gerätenutzung
Die Software darf auf einem einzelnen Gerät, auf dem die Software geladen wurde verwendet werden. die Verwendung auf anderen Geräten ist nicht zulässig.
Bestimmung 3 Reverse-Engineering, Dekompilierung oder Disassemblierung
Die Software wird Ihnen in ihrem “As Is”-Zustand bereitgestellt, und Panasonic gibt keinerlei ausdrückliche oder stillschweigende Garantien bezüglich der Software ab. Sie dürfen die Software nicht einem ReverseEngineering, Dekompilieren oder Disassemblieren unterziehen. Wenn der Gebrauch der Software durch den Benutzer und/oder das Verhalten des Benutzers bezüglich dieser Vereinbarung irgendwelche Schäden für Panasonic und/oder Geschäftspartner auslösen, garantiert und sichert der Benutzer Panasonic und/oder Geschäftspartner gegen solche Schäden und hält Panasonic und Geschäftspartner unbeschadet. Panasonics gesamte Haftung bezüglich Verletzung dieser Vereinbarung und Rechtsverletzung für den Benutzer ist: (i) nur beschränkt auf direkte Schäden und schließt keine indirekten oder Folgeschäden und verlorenen Einnahmen ein unabhängig davon, ob Panasonic diese vorhersehen kann oder nicht; und (ii) tatsächliche Zahlung durch den Benutzer an Panasonic gemäß dieser Vereinbarung oder von 10000 (zehntausend) Yen, welche Summe davon die höhere ist.
Bestimmung 5 Änderungen an den Spezifikationen
Panasonic kann künftig die Information in den Spezifikationen und verbundenen Dokumenten für die Software jederzeit und ohne vorherige Ankündigung ändern. Panasonic aktualisiert die Software zum Zweck von Fehlerkorrekturen, Verbesserung, Modifikation, Erweiterung und/oder Fortentwicklung von Sicherheitsfunktionen. Solche Aktualisierungen können Funktionalität der Software ergänzen, vermindern oder ändern. Solche Aktualisierungen werden von Panasonic nach ihrem eigenen Ermessen durchgeführt und solche Aktualisierungen können notwendige Voraussetzungen für den Gebrauch der Software darstellen. Wenn in diesem Fall (i) der Benutzer verlangt, die Software weiterhin zu benutzen, muss der Benutzer die Aktualisierungen umgehen vornehmen; oder (ii) der Benutzer nicht verlangt, die Software weiterhin zu benutzen, muss der Benutzer den Gebrauch beenden und die Software umgehend löschen. Panasonics Haftung bezüglich Qualitätseinbußen der Software, die durch jegliche Aktualisierungen verursacht werden (einschließlich aber nicht beschränkt auf Entfernung von Funktionalität oder Neuauftreten von Fehlern) ist nur auf den Umfang wie in der Bestimmung “Keine Garantie” dargelegt beschränkt.
Bestimmung 6 Ausfuhrkontrolle
Im Hinblick auf die Software sind Sie verpflichtet, alle Gesetze und Bestimmungen in Bezug auf die Ausfuhrkontrolle einzuhalten, wenn Sie die Software zu Hause oder in einem anderen Land einsetzen.
Bestimmung 7 Änderungen der Vertragspartei
Panasonic kann die Rechte, Verpflichtungen und den Status als Lizenzgeber unter dieser Vereinbarung an einen Empfänger abtreten und übertragen, wenn Panasonic den mit dieser Vereinbarung zusammenhängenden Geschäftsbereich durch Geschäftsabtretung, Fusion und/oder Firmenaufteilung oder in jeglicher anderer Situation nach ihrem eigenen Ermessen abtritt und/oder überträgt.
Bestimmung 8 Geltendes Recht
Dieser Vertrag wird bestimmt und ausgelegt in Übereinstimmung mit der japanischen Gesetzgebung, und zwar ohne Berücksichtigung der kollisionsrechtlichen Bestimmungen.
Bestimmung 9 Vereinbarte Rechtsordnung
Alle Streitigkeiten bezüglich dieses Vertrags können ausschließlich vor den Gerichten des Bezirksgerichts von Osaka verhandelt werden.
Bestimmung 10 Vorrang der Version in japanischer Sprache
Wenn die Version in japanischer Sprache hier als Anlage beigefügt ist, soll jene Version über die vorliegende Version den Vorrang haben.

Artículo 1 Licencia
Los usuarios obtienen la licencia del software (esto es, el software cargado en el dispositivo principal que puede ser activado usando la clave de activación y la clave de activación incluida con este producto), pero los derechos de autor o de propiedad intelectual del software no se transfieren a los usuarios.
Artículo 2 Dispositivo de uso
El software puede ser usado en un único dispositivo cargado con el software y no en cualquier otro dispositivo.
Artículo 3 Ingeniería inversa, decompilación o desensamblaje
Usted adquiere el Software en su condición actual y Panasonic no ofrece ninguna garantía explícita o implícita para el Software. Usted se compromete a no usar técnicas de ingeniería inversa en el Software, descompilarlo o desensamblarlo. Ni Panasonic ni sus distribuidores o intermediarios se verán obligados a cumplir las condiciones de la garantía por cualquier defecto en el Software o cualquier daño causado por usted mediante ingeniería inversa, descompilación o desensamblaje del Software. Si usted sufre cualquier tipo de perjuicio debido a técnicas de ingeniería inversa, descompilación o desensamblaje, Panasonic y sus Subsidiarias no proveerán ninguna garantía, indemnización o compensación al respecto. “Subsidiaria” se refiere a una compañía u otra persona jurídica que: (a) esté bajo Control de Panasonic; (b) Controle a Panasonic; o (c) esté bajo Control compartido con Panasonic. “Control” significa más de un cincuenta por cierto (50%) de las acciones o intereses de propiedad que representen el derecho de voto para la elección de consejeros o personas que realicen una tarea similar para una corporación, compañía o persona jurídica que pertenezcan o estén controladas, directa o indirectamente, por la persona jurídica en control. Dicha corporación, compañía o persona jurídica será considerada Subsidiaria siempre que exista dicha propiedad o control.
Artículo 4 Ausencia de garantía
El Software se proveerá sin garantía. Panasonic y sus Subsidiarias no proporcionan ninguna garantía legal o indemnización explícita o implícita respecto a cualquier defecto del Software

(incluyendo, entre otros, defectos relacionados con la precisión, completitud, seguridad, posibilidades de comercialización, efectividad, calidad, idoneidad para un propósito concreto y para registros, seguridad, defecto, error, defecto de software, problemas, perjuicios o infracciones relacionados con datos) al Usuario. Panasonic no es legalmente responsable de proveer el Software al Usuario libre de dichos defectos. Si el uso del Software por parte del Usuario o el comportamiento del usuario en relación con el software llegase a causar algún perjuicio a Panasonic o sus Subsidiarias, el Usuario deberá garantizar e indemnizar a Panasonic o sus Subsidiarias y eximir de responsabilidad a Panasonic y sus Subsidiarias sobre dicho perjuicio. El Usuario deberá resolver cualquier disputa entre el Usuario y terceras partes: (i) causada por el uso del Software; o (ii) causada por incumplimiento de este Contrato por parte del Usuario, a su propia costa. Panasonic y sus Subsidiarias no tendrán responsabilidad legal por cualquier perjuicio, costo o pago causado por el uso del Software por parte del Usuario y de su conducta en relación con este Contrato. Este Artículo no será de aplicación si el usuario recibe algún perjuicio causado por un incumplimiento intencional o negligencia grave por parte de Panasonic. La responsabilidad civil total de Panasonic por este Contrato y por perjuicios al usuario será: (i) limitada exclusivamente a perjuicios directos sin incluir perjuicios indirectos o devenidos y pérdida de ingresos independientemente de si Panasonic puede preverlo o no; y (ii) limitada al pago del Usuario a Panasonic según este contrato o 10.000 (diez mil) yenes si esta cantidad es superior al pago.
Artículo 5 Modificaciones de las especificaciones
Panasonic puede modificar en el futuro la información de las especificaciones y documentos relacionados con el software sin aviso previo. Panasonic actualizará el Software para solucionar errores, mejorar, modificar, añadir o potenciar las funciones de seguridad. Dichas actualizaciones podrían añadir, eliminar o cambiar el funcionamiento del Software. Estas actualizaciones serán realizadas por Panasonic a su discreción y podrían ser una condición necesaria para usar el Software. En este caso: (i) si el Usuario solicita seguir usando el Software, el Usuario deberá aplicar las actualizaciones de inmediato; o (ii) si el Usuario no solicita seguir usando el Software, el Usuario deberá detener y destruir el Software de inmediato. La responsabilidad legal de Panasonic respecto a una pérdida de calidad del Software causada por una actualización (incluyendo, entre otros, eliminación de funciones o aparición de nuevos errores) estará limitada a las disposiciones establecidas en el Artículo “Ausencia de garantía”.
Artículo 6 Control de exportación
Usted debe cumplir todas las leyes y normativas relacionadas con el control de exportación en su país y en el extranjero en lo que respecta al software.
Artículo 7 Modificación de parte
Panasonic podrá asignar y transferir los derechos, obligaciones y condición de licenciante establecidos en este contrato a una tercera parte, si Panasonic asigna o transfiere el negocio relacionado con este Contrato mediante cesión de negocio, fusión o escisión de negocio, o cualquier otra situación a su discreción.
Artículo 8 Legislación aplicable
Este documento deberá regirse, interpretarse y aplicarse de acuerdo con las leyes de Japón, independientemente de sus disposiciones sobre conflicto de leyes.
Artículo 9 Jurisdicción
Cualquier disputa que pueda surgir de o en relación con este documento estará sujeta a la jurisdicción exclusiva del tribunal del distrito de Osaka.
Artículo 10 Prioridad de versión en japonés
Si la versión en japonés de este contrato esta adjunta a este documento, dicha versión prevalecerá sobre la presente.

· Si ya hay guardado otro archivo “ACTIVE.LST” en la carpeta “PRIVATEPANA_GRPPAVCLUMIXACTV” de la tarjeta, puede que el nuevo archivo lo sobreescriba y se guarde. Antes de guardar un archivo nuevo, confirme que no hay ningún archivo “ACTIVE.LST” en la carpeta anterior.

4. Importe el código de activación

Contratto di licenza software
Attenzione: accertarsi di leggere il Contratto di licenza software prima di aprire la busta contenente il codice.
Grazie per aver acquistato questo prodotto Panasonic. Prima di aprire la busta contenente il codice che fa parte di questo prodotto, leggere il seguente Contratto di licenza software. Dopo aver accettato i termini del Contratto di licenza software, andare al sito di generazione del codice di attivazione e generare il “codice di attivazione”. Il codice di attivazione generato consentirà di usare questo software. Notare che aprendo la busta contenente il codice, si considerano accettati i termini del Contratto di licenza software. Il Contratto di licenza software è un contratto legalmente vincolante tra l’utente e Panasonic (nel seguito del documento chiamato Contratto). Costituisce inoltre prova che è stata concessa una licenza per l’uso del Software da parte di Panasonic in base alla legge. Articolo 1 Licenza
Gli utenti ottengono la licenza del software (cioè il software caricato nel dispositivo principale che può essere attivato usando il codice di attivazione e il codice di attivazione contenuto in questo prodotto), ma il copyright o il diritto di proprietà intellettuale del software non viene trasferito agli utenti.
Articolo 2 Utilizzo del dispositivo
Il software può essere usato su un unico dispositivo in cui il software è caricato e non su altri dispositivi.
Articolo 3 Decodifica, decompilazione o disassemblaggio
Il Software viene fornito così com’è, e Panasonic non fornisce alcuna garanzia esplicita o implicita riguardo al Software. È proibito decodificare, decompilare o disassemblare il Software. Panasonic o i suoi distributori o rivenditori non sono vincolati dalla garanzia per qualsiasi difetto del Software o danni causati da decodifica, decompilazione o disassemblaggio del Software. In caso di danni provocati da tale decodifica, decompilazione o disassemblaggio del Software, Panasonic e le sue Affiliate non forniranno alcuna garanzia, indennizzo e/o risarcimento per tali danni. “Affiliata” indica una società o un’altra persona giuridica che: (a) è Controllata da Panasonic; (b) Controlla Panasonic; o (c) è Controllata congiuntamente a Panasonic. “Controllo” indica che oltre il cinquanta percento (50%) delle azioni o delle partecipazioni che danno diritto al voto per l’elezione degli amministratori o delle persone che esercitano funzioni analoghe per tale società, azienda o soggetto è posseduto o controllato, direttamente o indirettamente, dal soggetto che esercita il controllo. Il Software verrà fornito “così com’è”. Panasonic e le sue Affiliate non forniscono all’utente alcuna garanzia espressa, implicita e/o legale, né alcun indennizzo per qualsiasi difetto del Software (compresi, a titolo esemplificativo ma non esaustivo, le garanzie di accuratezza, completezza,

sicurezza, commerciabilità, efficacia, qualità e idoneità per scopi particolari, e gli indennizzi per registrazioni, difetti collegati alla sicurezza, difetti, errori, errori di programmazione, problemi, danneggiamento di dati e violazioni). Panasonic non avrà alcuna responsabilità di fornire agli utenti il Software privo di tali difetti. Qualora l’utilizzo del software da parte dell’utente e/o il suo comportamento in relazione al presente Accordo arrechino qualsiasi danno a Panasonic e/o alle sue Affiliate, l’utente dovrà manlevare e tenere indenne da tale danno Panasonic e le sue Affiliate. L’utente dovrà risolvere qualsiasi controversia tra l’utente stesso e soggetti terzi: (i) causata dall’utilizzo del Software; e/o (ii) causata dalla violazione del presente accordo da parte dell’utente del presente, sotto la sua responsabilità e a sue spese. Panasonic e le sue Affiliate non saranno responsabili nei confronti dell’utente per eventuali danni, costi e pagamenti causati dall’impiego del Software da parte dell’utente e da suoi comportamenti in relazione al presente accordo. Il presente Articolo non troverà applicazione in caso di danni subiti dall’utente per dolo o colpa grave di Panasonic. La responsabilità complessiva di Panasonic per eventuali violazioni del presente accordo e illeciti civili nei confronti dell’utente sarà: (i) limitata esclusivamente ai danni diretti, e non includerà alcun danno indiretto e consequenziale, né alcun mancato guadagno, indipendentemente dal fatto che Panasonic potesse prevederli o meno; e (ii) sarà limitata all’importo più elevato tra la somma effettivamente pagata dall’utente a Panasonic ai sensi del presente accordo e 10.000 (diecimila) yen.
Articolo 5 Modifiche alle specifiche
Panasonic può modificare le informazioni nelle specifiche e nei documenti relativi al Software, senza alcun preavviso, in futuro. Panasonic aggiornerà il Software per correggere errori di programmazione, per apportare miglioramenti, modifiche o aggiunte e/o per potenziare le funzioni di sicurezza. Tali aggiornamenti possono aggiungere, rimuovere o modificare alcune funzionalità. Tali aggiornamenti verranno effettuati da Panasonic a suo insindacabile giudizio, e possono essere una condizione necessaria per l’utilizzo del Software. In tal caso: (i) qualora l’utente intenda continuare a utilizzare il Software, dovrà eseguire immediatamente gli aggiornamenti; o (ii) qualora l’utente non intenda continuare a utilizzare il Software, dovrà cessare immediatamente di farne uso e distruggerlo. Nel caso in cui la qualità del Software peggiori a seguito di un aggiornamento (ad esempio per la rimozione di funzioni o l’introduzione di nuovi errori di programmazione), la responsabilità di Panasonic sarà limitata esclusivamente a quanto previsto dall’Articolo “Assenza di garanzie”.
Articolo 6 Controllo delle esportazioni
È necessario rispettare tutte le leggi ed i regolamenti in materia di controllo delle esportazioni in patria e all’estero per quanto riguarda il Software.
Articolo 7 Cambiamento delle Parti
Panasonic può cedere e trasferire i diritti, gli obblighi e lo stato di licenziante ai sensi del presente accordo a un cessionario, qualora Panasonic decida, a suo insindacabile giudizio, di cedere e/o trasferire l’attività collegata al presente accordo per cessione di attività, fusione e/o scissione aziendale.
Articolo 8 Legge applicabile
Questo documento è regolato, interpretato e applicato in conformità con le leggi del Giappone, senza tenere conto di eventuali conflitti con disposizioni di legge.
Articolo 9 Accordo sul foro competente
Qualsiasi controversia derivante da o in relazione a questo documento è soggetto alla giurisdizione esclusiva del Tribunale distrettuale di Osaka.
Articolo 10 Priorità della versione in lingua giapponese
Qualora la versione in lingua giapponese del presente accordo sia allegata a questo documento, tale versione prevarrà su qualsiasi altra versione.

2 Usando un browser sul PC, accedere al sito per la generazione
del codice di attivazione, e seguire le istruzioni a video per ottenere un codice di attivazione.
