Limited Warranty Conditions
- The Warranty Period for this Machine is twelve (12) months from the later of the purchase date or delivery date. This warranty applies only if Lavazza receives notice of a defect or non-conformance during this period.
- The purchase receipt, transport document, or delivery note confirms the official delivery date and serves as proof for the start of the Warranty Period. A "defect" is defined as a significant limitation or reduction in the value or suitability for use of the Machine.
- The warranted Machine will be free of defects in materials and workmanship and, under normal use, will operate in all material respects in accordance with applicable instruction manuals, directions, documentation, or other materials (written or electronic) provided by Lavazza to the consumer (the “Documentation”).
- Lavazza's sole and exclusive liability for breach of this warranty is, at Lavazza's option, to:
- a) repair the defective Machine, following the procedure specified in the Practical Notes;
- b) replace the defective Machine with one of the same characteristics or, if not feasible or practical, with a machine of equal or greater value, following the procedure specified in the Practical Notes. Machine replacement is considered impractical when Lavazza would incur unreasonable costs compared to repair, considering the product's value without the defect, the extent of the defect, and the possibility of alternative remedying actions without major inconvenience to the consumer.
- Any intervention during the Warranty Period does not extend or renew the Warranty Period. Machines repaired or replaced by Lavazza remain warranted for the remaining portion of the original Warranty Period. Replaced parts automatically become Lavazza's property.
- The warranty does not cover parts defective due to: negligence during use or storage; improper or inadequate maintenance; neglect, misuse, or abuse; operation for which the Machine was not intended; unauthorized modification or alteration; failure to follow operating instructions; improper installation; repairs by unauthorized persons; use of non-original accessories or spare parts; normal wear and tear (e.g., lime scale build-up, worn gaskets, exhausted water filters); lightning; moisture; fire; use with incorrect voltage; or other events not attributable to the manufacturer or manufacturing defects.
- Lavazza disclaims responsibility for direct or indirect injury to people or animals, or damage to property, resulting from failure to comply with safety rules in the instruction booklet, particularly regarding installation, use, and maintenance.
