Returns

If you wish to return your product, both the purchased item and the promotional gift must be returned. If both items are not received, the purchase cannot be canceled, and the purchase amount cannot be refunded.

General Terms and Conditions

Please read these General Terms and Conditions and the accompanying specific promotion terms and/or additional conditions found on the Samsung Promotion Page (the "Specific Promotion Terms") carefully. These General Terms and Conditions and the Specific Promotion Terms apply to the Promotion and your participation. By participating, you agree to the Promotion Terms.

Article 1 - Definitions

• Promotion: A promotional contest or activity organized by Samsung as described in the Specific Promotion Terms.
• Promotional Area: The territory within the Benelux where the Promotion takes place, as stated in the Specific Promotion Terms. The Promotion exclusively applies to Promotion Products purchased within the Promotional Area.
• Promotion Period: The period during which the Promotion runs, as determined in the Specific Promotion Terms.
• Promotion Products: The promotional models listed in the Specific Promotion Terms.
• Promotion Terms: These General Terms and Conditions, the Specific Promotion Terms, and any additional conditions and provisions that Samsung has announced or will announce on its website or in stores during the Promotion. The Specific Promotion Terms take precedence over the General Terms and Conditions in case of any discrepancy. The Promotion Terms are valid for promotional activities organized by Samsung.
• Specific Promotion Terms: The accompanying specific promotion terms and/or additional conditions described on the Promotion Page, which form an integral part of these General Terms and Conditions and are published by Samsung for a specific Promotion.
• Participant Material: Contributions of any nature (including images, videos, texts, photos, audio, drawings, paintings, interviews, portraits, social media posts, etc.) from Participants in the context of a Promotion. This also includes any contributions and recordings made in connection with the Promotion.
• Participant: The person who participates in the Promotion and is entitled to do so based on Article 2 of these General Terms and Conditions.
• Registration Period: The period within which registrations for participation in the Promotion can be submitted, as stated in the Specific Promotion Terms.
• Promotion Page: The page on Samsung.com for current promotions, found at www.samsung.com/nl/promo/, www.samsung.com/be/promo, or www.samsung.com/be_fr/promo.
• Samsung: Samsung Electronics Benelux B.V., located at Evert van de Beekstraat 310, 1118 CX Schiphol, Netherlands, with a branch office in Diegem (1831) Airport Plaza, Geneva Building, Leonardo Da Vincilaan 19 in Belgium, with enterprise number 0472.450.079.
• Benefit: Any benefit obtained from a Promotion, including a prize, discount, cashback, or product, as described in the Specific Promotion Terms. In the case of a contest, the winner is the Participant who is awarded a prize in the manner specified in the Specific Promotion Terms.

Article 2 - Participation

1. Participation is open only to natural persons residing in the Promotional Area who are 18 years or older at the time of participation. Participants must provide valid identification and proof of residence and age upon request by Samsung.
2. Participation is free of charge, unless otherwise specified in the Specific Promotion Terms.
3. Participation in certain Promotions requires the purchase of a specific Promotion Product, as indicated in the Specific Promotion Terms. Participants must have purchased the Promotion Product from a participating retailer listed on the website within the Promotion Period. Purchases from non-participating retailers or private individuals are not eligible. Second-hand, outlet, or exchanged products are also not eligible. If the original purchase is rescinded, any received Benefit must be returned to Samsung within five (5) working days. Participation and the right to a Benefit are personal and non-transferable. Promotions are valid while supplies last, and Samsung is not responsible for the availability or stock of Promotion Products at participating retailers.
4. Some Promotions require registration via a website within the Registration Period. Registration is free. Participants must have a valid email address and a residential address within the Promotional Area. Further registration conditions are available on the website. Registration confirmation will be sent to the provided email address. If confirmation is not received, contact Samsung within two weeks of registration. If additional information or documentation is required for successful registration, participants will have fourteen (14) calendar days from the request to provide it. Failure to provide this information within the specified timeframe will result in unsuccessful registration and disqualification from the Promotion.
5. Participation is open only to consumers, defined as natural persons not acting for purposes related to their trade, business, craft, or profession.

Article 3 - Exclusions

1. Employees of Samsung, affiliated companies, and individuals directly or indirectly involved in the organization or provision of the Promotion or Benefit, along with their respective employees, are excluded from participation.
2. Participants can only participate during the Registration Period and in the manner described in the Promotion Terms. Unless otherwise stated in the Specific Promotion Terms, participation in different promotions cannot be combined. Incomplete, late, or improperly submitted entries will not be accepted. Samsung is not liable for delays, losses, or errors in entries due to technical reasons or other causes. Participants should retain copies of their registrations and submissions. Samsung is not responsible for damaged, lost, or delayed submissions.
3. Participation is not permitted, and Samsung reserves the right to exclude participants or groups of participants without notice, forfeiting any right to a Benefit, if:
   • A participant violates the Promotion Terms.
   • A participant provides multiple, incomplete, or false (email) addresses, names, and/or other personal data.
   • Scripts, systems, automated functions, or techniques are used to increase winning chances.
   • There is misuse, fraud, manipulation, circumvention, or breach of the Promotion Terms.
   • A participant is not acting for personal use but for commercial, business, craft, or professional purposes.
   Samsung may take such action based on suspicion, without providing reasons or owing compensation, and is not obligated to inform the participant or provide proof.

Article 4 - The Benefit

1. The right to receive the Benefit is personal, non-exchangeable for goods/services, and non-transferable without Samsung's written consent.
2. Samsung may offer an equivalent alternative to the Benefit at any time without prior notification and without obligation for compensation.
3. If a Participant fails to claim the Benefit within the timeframe specified in the Specific Promotion Terms (or within one month if no timeframe is provided), Samsung has the right to forfeit the Participant's claim to the Benefit. Samsung may award the Benefit to another Participant and is not obligated to notify the Participant that the Benefit has been forfeited.
4. Samsung aims to deliver or transfer the Benefit within 16 weeks after a valid registration or winner determination. Cashback benefits can only be transferred to bank accounts within the European Union. Product benefits can only be shipped to addresses within the Benelux. Benefits are considered received upon delivery to the specified postal address.
5. If Dutch gaming tax is applicable to a Promotion in the Netherlands, Samsung will pay it. Participants are responsible for any other applicable taxes and levies.

Article 5 - Participant Material

1. Participants declare and guarantee that their submitted Participant Material is lawful and does not infringe on third-party rights, nor is it offensive, discriminatory, or otherwise inappropriate. Participants will indemnify Samsung against any third-party claims related to the content of the Participant Material. Samsung may refuse or remove Participant Material at its discretion without prior consultation or approval from the Participant.
2. Participants unconditionally transfer all current and future rights (including intellectual property and personality rights) to the Participant Material to Samsung. Where such transfer is not legally permitted, Participants waive these rights. Samsung may exploit and license the Participant Material worldwide and without limitation across all media during and after the Promotion Period. Participants waive any right to compensation for the transfer of Participant Material. Participants must ensure that third parties with rights to the Participant Material also transfer or waive these rights accordingly.
3. Participants authorize Samsung and its group companies to use the Participant Material (display, communicate to the public) in any manner or medium for Samsung's promotional and other purposes, without any compensation other than the potential Benefit. Participants must ensure that third parties involved in their participation grant similar authorization to Samsung without compensation.

Article 6 - Limitation of Liability

1. Samsung, its employees, agents, or third parties are not liable, except in cases of intent or gross negligence, for: (i) costs and expenses incurred by the Participant related to the Benefit; (ii) damage caused by the Benefit or participation in the Promotion; (iii) damage caused by technical failures (software, computer, network, internet) affecting the submission; (iv) fraud by Participants; and (v) the content of the Participant Material.
2. Samsung provides no warranties regarding the Benefit and excludes all liability (except for intent or gross negligence). Samsung is not liable for: (i) defects in the Benefit; (ii) delayed receipt of the Benefit; (iii) incorrect receipt, loss, or damage during shipping; or (iv) minor deviations of the received Benefit from the offered Benefit.
3. If a social media platform (e.g., Instagram, Facebook, Twitter) is used for a Promotion, the platform is not responsible or liable for the Promotion and is not associated with it in any way.

Article 7 - Privacy

1. Participant data is processed in accordance with applicable national privacy laws. Samsung will use this data solely for the Promotion's execution, market research, and direct marketing as outlined in the Promotion Terms. Data may be shared with Samsung group entities or authorities if legally required. Personal data will not be sold to third parties.
2. In some cases, users may provide data via social media platform accounts (e.g., Facebook, Twitter).
3. Participants can exercise their rights to access, correct, or object to direct marketing by sending a written, signed, and dated request with a copy of their ID to Samsung (addresses provided for the Netherlands, Belgium, and Luxembourg). If a participant requests the deletion of their personal data, their participation in the Promotion and eligibility for the Benefit will be forfeited. Participants can review Samsung's full privacy policy at the provided URLs.

Article 8 - Complaints

1. For questions, comments, or complaints regarding the Promotion, contact Samsung customer service using the contact details provided in the Specific Promotion Terms. Customer service can be reached at 088-9090100 (Netherlands), 02 201 2418 (Belgium), or 26 10 37 10 (Luxembourg).
2. Samsung is not obligated to engage in correspondence regarding exclusions, removal of Participant Material, or Promotion results.
3. Samsung's lack of response to a participant's communication does not constitute agreement with its content.

Article 9 - Final Provisions

1. For Promotions in the Netherlands with a chance element, the Dutch Code of Conduct for Promotional Lotteries applies, and Samsung acts in accordance with this Code.
2. Samsung reserves the right to cancel, interrupt, or modify the Promotion, Promotion Terms, or Benefit at its discretion and without prior notice or reason if circumstances require, without incurring liability for damages to Participants.
3. The content of the Promotion Terms and Specific Promotion Terms is subject to typographical errors and interpretation. No rights can be derived from Samsung's errors.
4. The law of the Promotional Area (Belgium, Netherlands, or Grand Duchy of Luxembourg, based on the Participant's place of residence) applies to these Promotion Terms and Specific Promotion Terms.
5. For Participants from the Netherlands, the Amsterdam court has jurisdiction for disputes after mutual consultation. For Participants from Belgium, the Antwerp court has jurisdiction. For Participants from the Grand Duchy of Luxembourg, the Luxembourg City court has jurisdiction. Both Samsung and the Participant agree to consult and attempt to reach an amicable solution before initiating legal proceedings.
