Chapter 2: Hardware Preparation

Tools and Components for Component Installation

Before starting the setup of your Synology NAS, prepare the following tools and components:

Warning: If you install a drive that contains data, the system will format the drive and erase all existing data. Back up all important data before installation.

Drive Installation

  1. Slide the top cover as shown in the illustration below. Lift the top cover and set it aside.
  2. Install Drives:
    • 3.5" Drives with 3 screw holes on each side (see image below):
      a. Slide the drive into the drive tray and push it in completely until it is firmly connected to the SATA connector.
      b. Secure the hard drive with the provided screws.
    • 3.5" Drives with 2 screw holes on each side (see image below):
      a. Place the HDD bracket onto the Synology NAS and secure it to the Synology NAS with the provided screws.
    • 2.5" Drives:
      a. Mount the drive into the 2.5" drive bracket (Type C, sold separately) and secure it by tightening the screws for 2.5" drives.
      b. Slide the 2.5" drive bracket into the drive tray and push it in completely until it is firmly connected to the SATA connector. Secure the drive bracket with the provided screws.
  3. If you have another drive ready, install it by repeating the steps above.

Note: If you plan to set up a RAID volume, it is recommended that all installed drives be of the same size for optimal capacity utilization.

Powering On the Synology NAS Device

  1. Connect one end of the power adapter to the power port of the Synology NAS. Connect the other end to the electrical outlet.
  2. Connect the Synology NAS to a switch, router, or hub using the LAN cable.

Chapter 4: Installing DSM on Your Synology NAS

Installing DSM Using the Web Assistant

After completing the hardware setup, install DiskStation Manager (DSM), Synology's browser-based operating system, on your DS220j.

The DS220j comes with a built-in Web Assistant that allows you to download the latest DSM version from the internet and install it on your DS220j. To launch the Web Assistant, follow these steps:

  1. Turn on the DS220j.
  2. On a computer connected to the same network as your DS220j, open a web browser.
  3. Enter one of the following in the web browser's address bar:
    • find.synology.com
    • synologynas:5000
  4. The Web Assistant will launch in your web browser. It will search for Synology NAS devices on your local network. The status of your DS220j should show as “Not installed”. [Image of Web Assistant interface showing Synology NAS status as Not Installed]
  5. Click “Connect” to start the setup process. Follow the on-screen instructions.

Note:

  1. Internet connection is required to install DSM on your Synology NAS using the Web Assistant.
  2. Recommended browsers: Chrome, Firefox.
  3. Your Synology NAS and computer must be connected to the same local network.
  4. If you accidentally leave the installation process before completion, log in to DSM as admin (default administrator account name) with the password field left blank.

Section 1. Limited Software License

Synology grants you a limited, non-exclusive, non-transferable, personal license to install, run, and use one copy of the Software loaded onto the Product or on your devices connected to the Product, solely in connection with the authorized use of the Product, under the terms of this EULA.

Section 2. Documentation

You may make and use a reasonable number of copies of the documentation provided with the Software. However, these copies must be used solely for your internal purposes and may not be further published or distributed (whether in printed or electronic form) to any third party.

Section 3. Backup

You may make a reasonable number of copies of the Software solely for backup and archival purposes.

Section 4. Updates

Any software provided to you by Synology or made available on Synology’s website at www.synology.com (“Website”) or any other source provided by Synology that updates or supplements the original Software and for which no additional license terms are provided, is subject to this EULA.

Section 5. License Limitations

The license described in Sections 1, 2, and 3 applies only to the extent that you have ordered and paid for the Product, and it constitutes all the rights you have with respect to the Software. Synology reserves all rights that are not expressly granted to you in this EULA. Without limiting the foregoing, you shall not, and shall not permit any third party to: (a) use the Software for any purpose other than in connection with the Product; (b) license, distribute, rent, lease, transfer, assign, or otherwise convey the Software; (c) reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or any trade secrets relating to the Software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation; (d) modify, adapt, alter, translate, or create derivative works from the Software; (e) remove, alter, or obscure any proprietary notices on the Product or Software; or (f) circumvent or attempt to circumvent any of Synology’s methods for controlling access to the components, features, or functions of the Product or Software. Within the limitations set forth in Section 5, you are not prohibited from providing any services hosted on the Synology NAS server to any third party for commercial purposes.

Section 6. Open Source

The Software may contain components licensed to you by Synology under the GNU General Public License (“GPL Components”), which is available for review at http://www.gnu.org/licenses/gpl.html. The terms of the GPL apply only to the GPL Components and only to the extent that this EULA conflicts with the terms of the GPL with respect to your use of the GPL Components, and you agree to be bound by the GPL in your use of those Components.

Section 7. Audit

Synology shall have the right to audit your compliance with the terms of this EULA. You agree to provide Synology with access to your facilities, equipment, books, records, and documents, and to otherwise cooperate reasonably with Synology to facilitate such audit by Synology or its designated agent.

Section 8. Ownership

The Software is valuable proprietary property of Synology and its licensors and is protected by copyright law and other intellectual property laws and treaties. Synology or its licensors own all right, title, and interest in and to the Software, including, without limitation, all copyright and other intellectual property rights.

Section 9. Limited Warranty

Synology warrants that the Software will, in all material respects, conform to the Software specifications published or otherwise made available by Synology on the Website for the period required by applicable local laws. Synology will use commercially reasonable efforts to, at Synology’s option, correct any non-conformance of the Software or replace the Software that does not conform to the foregoing warranty, provided that you provide Synology with written notice of such non-conformance within the warranty period. The foregoing warranty shall not apply to any non-conformance caused by: (w) use or reproduction or distribution or sharing in violation of this EULA; (x) any modification or alteration of the Software by any party other than Synology; (y) the combination of the Software with any product, service, and other item provided by a party other than Synology; or (z) your failure to comply with this EULA.

Section 10. Support

Synology will make support services available to you during the period specified in Section 9. Support for the Software may be made available by Synology upon written request after the expiration of the applicable period.

Section 11. Disclaimer of Warranties

EXCEPT FOR THE FOREGOING, THE SOFTWARE IS PROVIDED “AS IS” AND WITH ALL FAULTS. SYNOLOGY AND ITS SUPPLIERS HEREBY DISCLAIM ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, ARISING BY LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, TITLE, AND NON-INFRINGEMENT WITH RESPECT TO THE SOFTWARE. WITHOUT LIMITING THE FOREGOING, SYNOLOGY DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, VIRUS-FREE, OR OTHERWISE DEFECT-FREE.

Section 12. Limitation of Certain Damages

IN NO EVENT SHALL SYNOLOGY OR ITS LICENSORS BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES OR LIABILITIES (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INFORMATION, REVENUE, PROFITS, OR BUSINESS) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE OR OTHERWISE IN CONNECTION WITH THIS EULA OR THE SOFTWARE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF SYNOLOGY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 13. Limitation of Liability

THE LIABILITY OF SYNOLOGY AND ITS SUPPLIERS ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE OR OTHERWISE IN CONNECTION WITH THIS EULA OR THE SOFTWARE SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT, REGARDLESS OF THE AMOUNT OF DAMAGES YOU MAY INCUR, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE. THE FOREGOING DISCLAIMERS OF WARRANTY, LIMITATION OF CERTAIN DAMAGES, AND LIMITATION OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. TO THE EXTENT THAT SUCH LAWS APPLY TO THIS EULA, THESE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

Section 14. Export Restrictions

You acknowledge that the Software is subject to export controls imposed by the United States. You agree to comply with all applicable laws and regulations that apply to the Software, including, without limitation, U.S. Export Administration Regulations.

Section 15. Termination

If you fail to comply with the terms set forth herein, Synology may terminate this EULA without prejudice to any other rights. In such event, you must cease using the Software and destroy all copies of the Software and all of its component parts.

Section 16. Assignment

You may not assign or transfer any of your rights under this EULA, except for components pre-installed on the Products, without Synology’s prior written consent. Any assignment or transfer in violation of the foregoing shall be void.

Section 17. Governing Law

Unless expressly prohibited by local law, this EULA shall be governed by the laws of the country of incorporation of Synology Inc., without regard to its conflict of laws principles.

Section 18. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this EULA shall be finally settled by arbitration administered by three neutral arbitrators in accordance with the rules of the arbitration act and the applicable rules of the country of incorporation of Synology Inc. In such cases, the arbitration shall be limited to a dispute between you and Synology. The arbitration, or any part thereof, shall not be consolidated with any other arbitration and shall not be conducted as a class arbitration or class action. The arbitration shall take place in Taipei and shall be conducted in English or, if agreed by both parties, in Mandarin Chinese. The arbitration award shall be final and binding on all parties and may be enforced in any court of competent jurisdiction. You understand that, but for this provision, you would have had the right to the benefits of a court proceeding, including trial by jury and the right to bring or participate in class actions, and you expressly and knowingly waive these rights and agree to resolve disputes through binding arbitration, as provided herein. Nothing in this section shall prohibit or limit Synology from seeking injunctive relief or other equitable rights or remedies that it may have at law or in equity for actual or threatened breach of any provision of this EULA relating to Synology’s intellectual property rights.

Section 19. Attorney’s Fees

In any arbitration, mediation, or other legal action or proceeding to enforce any right or remedy arising under this EULA, the prevailing party shall, in addition to any award of damages, be entitled to recover its costs and reasonable attorneys’ fees.

Section 20. Severability

If any provision of this EULA is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remainder of this EULA shall remain in full force and effect.

Section 21. Entire Agreement

This EULA constitutes the entire agreement between Synology and you with respect to the Software and the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, and representations, whether oral or written. No amendment, modification, or waiver of any provision of this EULA shall be effective unless in writing and signed by the party to be bound thereby.

Synology Inc. Limited Product Warranty

SYNOLOGY, INC. LIMITED PRODUCT WARRANTY

THIS LIMITED WARRANTY (THE “WARRANTY”) APPLIES TO THE SYNOLOGY PRODUCTS DEFINED BELOW BY SYNOLOGY, INC. AND ITS AFFILIATES, INCLUDING SYNOLOGY AMERICA CORP (COLLECTIVELY, “SYNOLOGY”). BY OPENING THE PRODUCT PACKAGE OR USING THE PRODUCT, YOU AGREE TO BE BOUND BY, AND YOU AGREE TO BE BOUND BY, THE TERMS OF THIS WARRANTY. PLEASE NOTE THAT THIS LIMITED WARRANTY DOES NOT APPLY TO THE SOFTWARE CONTAINED IN THE PRODUCTS, WHICH IS GOVERNED BY ITS OWN END USER LICENSE AGREEMENT, AND SYNOLOGY RESERVES THE RIGHT TO MAKE MODIFICATIONS OR CHANGES TO THIS WARRANTY ON THE PRODUCT PERIODICALLY WITHOUT PRIOR NOTICE. IF YOU DO NOT AGREE WITH THE TERMS OF THIS WARRANTY, DO NOT USE THE PRODUCT. INSTEAD, YOU MAY RETURN THE PRODUCT TO THE SELLER FROM WHICH YOU PURCHASED IT, FOR A REFUND ACCORDING TO THE SELLER’S APPLICABLE RETURN POLICY. PLEASE NOTE THAT SYNOLOGY’S WARRANTY IS NOT AVAILABLE IN EVERY COUNTRY, AND SYNOLOGY MAY REFUSE TO PROVIDE SERVICE UNDER THIS LIMITED WARRANTY IF IT IS REQUESTED IN A COUNTRY OTHER THAN THE COUNTRY WHERE THE PRODUCT WAS ORIGINALLY PURCHASED. THE COUNTRY WHERE THE PRODUCT WAS ORIGINALLY PURCHASED WILL BE DETERMINED BY SYNOLOGY’S INTERNAL RECORDS.

Article 1. Products

(a) The term “Products” means new or refurbished products. (b) The term “New Product” means a Synology branded hardware product and Synology branded accessories in their original packaging purchased by a customer from an authorized Synology distributor or reseller. You can view our “New Products” at https://www.synology.com/products/status. (c) The term “Refurbished Product” means any Synology products that have been refurbished by a Synology affiliate or an authorized Synology distributor or reseller, excluding those products sold “as is” or “without warranty.” (d) Further Definitions: “Customer” means the original individual or legal entity purchasing the Product from Synology or an authorized Synology distributor or reseller; “Online Store” means an online store operated by Synology or a Synology affiliate; “Software” means Synology’s proprietary software that is provided with the Product, downloaded by the Customer from the Website, or pre-installed in the Synology Product, and includes all firmware, associated media, images, animations, video, audio, text, and applets embedded in or on the Software or Product, and any updates and upgrades to such Software.

Article 2. Warranty Period

(a) “Warranty Period”: The Warranty Period commences on the date of purchase as indicated on the proof of purchase or invoice issued to the Customer and expires one day after the expiration of the warranty period for all New Products. The warranty period for all New Products is listed at https://www.synology.com/products/status. For Refurbished Products or repaired parts, it is the remaining warranty period of the Product they replace or ninety (90) days from the date of replacement or repair of the Product, whichever is longer; it does not apply to products sold “as is” or “without warranty.” In the absence of a receipt or invoice, the warranty period will commence on the date of manufacture according to our internal records. (b) “Extended Warranty Period”: For Customers who purchase the optional EW201/EW202 service for the Products specified in Article 1(b), the warranty period stated in Article 2(a) for the respective Product registered with the optional EW201/EW202 service will be extended by two years. Article 3. Limited Warranty and Remedies

3.1 Limited Warranty

Subject to Article 3.2, Synology warrants to the Customer that no Product will (a) be defective in materials or workmanship and (b) each Product will, under normal use during the Warranty Period, perform substantially in accordance with the specifications published by Synology for the Product. This limited warranty does not cover software contained in the Product or purchased by the Customer, which is subject to any accompanying end user license agreement provided with the Product. Synology does not warrant any Refurbished Product sold “as is” or “without warranty.” This limited warranty is NON-TRANSFERABLE and applies only to Customers who purchase Products directly from Synology affiliates, resellers, and distributors authorized by Synology. The warranty provided in Article 3 will terminate if the Customer sells or transfers the Product to another party.

3.2 Exclusions

The foregoing warranties and warranty obligations do not apply to a Product that has been (a) installed or used in a manner not specified or described in the Product or accompanying documentation; (b) serviced (including upgrades and extensions) by anyone other than a Synology representative or an authorized Synology service provider; (c) misused, misapplied, or damaged in any way; (d) used with items not provided by Synology, unless they are hardware or software for which the Product is intended; (e) otherwise fails to conform to Product specifications, and such non-conformance is attributable to causes beyond Synology’s control. (f) sold as a tie-in product with any third-party hardware product or any software, even if bundled with or sold alongside a Synology hardware product. (g) disassembled by the Customer, unless authorized by Synology; (h) the Customer fails to implement a repair, modification, extension, enhancement, or other update that Synology makes available to the Customer; (i) the Customer implements, installs, or uses a repair, modification, extension, enhancement, or update made available by any third party. (j) any compatibility issues in installing hardware products, software, or components not supported by Synology. (k) damage to the Product resulting from accident, fire, liquid contact, earthquake, or other external cause. (l) cosmetic damage due to normal wear and tear or otherwise due to the normal aging of the Product, including, without limitation, scratches, dents, and cracked plastic on ports, unless the defect is attributable to a defect in materials or workmanship; (m) the serial number has been removed or defaced from the Product, making it unidentifiable.

3.3 Warranty Support and Exclusive Remedy

If the Customer notifies Synology of any breach of the warranties set forth in Article 3.1 during the applicable Warranty Period in the manner described below, Synology will, upon Synology’s verification of such breach, at Synology’s option: (a) use commercially reasonable efforts to repair the Product, (b) provide technical support, or (c) replace the Product that does not conform to the warranty, or a component thereof, upon return of the non-conforming Product in accordance with Article 3.4. The foregoing constitutes Synology’s entire liability and the Customer’s sole and exclusive remedies for any breach of warranty under Article 3.1 or for any other defect or deficiency in the Product. The Customer shall provide reasonable assistance to Synology in diagnosing and verifying the non-conformance of the Product. Return procedures can be found at https://www.synology.com/knowledgebase/DSM/tutorial/Service_Application/How_to_make_warranty_claim_for_Synology_NAS. For warranty claims, the Customer must return the complete Product to Synology in accordance with this Article.

3.4 Return of Product

Any returned Product that has been disassembled (unless authorized by Synology) will be rejected and returned to the Customer at the Customer’s expense. Each Product must be returned in the same condition as it was received from Synology to the address designated by Synology, with freight prepaid, in the original packaging or packaging that adequately protects the Product. The Customer is responsible for insuring and bearing the risk of loss for the returned items until they are properly received by Synology.

3.5 Synology Replacement

If Synology decides to replace any Product under this warranty in accordance with Article 3.1, Synology will ship a replacement Product at Synology’s expense by the shipping method chosen by Synology, upon receipt of the non-conforming Product in accordance with Article 3.4 and Synology’s verification that the Product does not conform to the warranty. In certain countries, Synology may, at its sole discretion, for selected Products, choose to ship a replacement Product to the Customer before receiving the non-conforming Product returned by the Customer (the “Synology Replacement Service”) as part of the Synology Replacement Service. This is subject to the terms and conditions of the Synology Replacement Service.

3.6 Disclaimer of Warranties

THE WARRANTIES, OBLIGATIONS, AND LIABILITIES OF SYNOLOGY AND THE REMEDIES OF CUSTOMER SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF, AND CUSTOMER HEREBY WAIVES, ANY AND ALL OTHER WARRANTIES, OBLIGATIONS, OR LIABILITIES OF SYNOLOGY AND ANY AND ALL OTHER RIGHTS, CLAIMS, AND REMEDIES OF CUSTOMER AGAINST SYNOLOGY, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE; IMPLIED WARRANTIES ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE; NON-INFRINGEMENT OR MISUSE; OR ANY OTHER STATUTORY OR EQUITABLE RIGHTS, CLAIMS, OR REMEDIES. SYNOLOGY DOES NOT WARRANT, AND EXPRESSLY DISCLAIMS, ANY WARRANTY THAT DATA OR INFORMATION STORED ON ANY SYNOLOGY PRODUCT WILL BE SECURE AND FREE FROM LOSS. SYNOLOGY RECOMMENDS THAT CUSTOMERS TAKE APPROPRIATE MEASURES TO BACK UP ANY DATA STORED ON THE PRODUCT. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO THE CUSTOMER.

Article 4. Limitation of Liability

4.1 Force Majeure

Synology shall not be liable for any delay or failure to perform under this warranty due to causes beyond its reasonable control (including, without limitation, acts or omissions of the Customer), and such delay or failure shall not be considered a breach or default of this warranty.

4.2 Limitation of Certain Damages

IN NO EVENT SHALL SYNOLOGY OR ITS SUPPLIERS BE LIABLE FOR ANY COVER CHARGES OR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES OR OTHER LIABILITY (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INFORMATION, REVENUE, PROFITS, OR BUSINESS) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT, ACCOMPANYING DOCUMENTATION, OR SOFTWARE, AND ANY OTHER GOODS OR SERVICES PROVIDED UNDER THIS WARRANTY, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF SYNOLOGY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

4.3 Limitation of Liability

THE LIABILITY OF SYNOLOGY AND ITS SUPPLIERS ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT, ACCOMPANYING DOCUMENTATION, OR SOFTWARE, AND ANY OTHER GOODS OR SERVICES PROVIDED UNDER THIS WARRANTY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE PRODUCT, REGARDLESS OF THE AMOUNT OF DAMAGES THE CUSTOMER MAY INCUR, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. THE FOREGOING LIMITATION OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. THE LAW OF CERTAIN STATES OR JURISDICTIONS DOES NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. TO THE EXTENT THAT SUCH LAWS APPLY TO THIS PRODUCT, THESE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO THE CUSTOMER.

Article 5. Miscellaneous

5.1 Proprietary Rights

The Product and all accompanying software and documentation supplied with the Product are protected by patent laws and intellectual property laws and treaties of Synology and its suppliers and licensors. Synology retains and reserves all right, title, and interest in and to the intellectual property of the Product, and, under this Warranty, does not transfer any title or intellectual property rights in the Product, accompanying software, or documentation or any other goods supplied hereunder to the Customer. The Customer shall (a) comply with the terms of the End User License Agreement of Synology that accompanies any Software supplied by Synology or an authorized Synology distributor or reseller; and (b) not reverse engineer, decompile, or otherwise attempt to derive the source code of any Product or component thereof or accompanying Software, or otherwise misuse, bypass, or infringe any of Synology’s intellectual property rights.

5.2 Assignment

The Customer shall not assign or transfer, directly or by operation of law, any of the rights granted herein without Synology’s prior written consent, except for components pre-installed on the Products. Any assignment or transfer in violation of the foregoing shall be void.

5.3 No Additional Terms

Except as expressly permitted by this Warranty, neither party shall be bound by any term or other provision which conflicts with the terms of this Warranty and which may be made by the other party in any order, document, receipt, acceptance, communication or otherwise, unless each party has expressly agreed to be bound by such term in writing.

5.4 Governing Law

Unless expressly prohibited by local law, this Warranty shall, for Customers residing in the USA, be governed by the laws of the State of Washington, U.S.A.; and for Customers not residing in the USA, by the laws of the Republic of China (Taiwan), without regard to any conflict of laws principles that would cause the application of the laws of any other jurisdiction to apply. The United Nations Convention on Contracts for the International Sale of Goods of 1980, and the amendments thereto, shall not apply.

5.5 Dispute Resolution

Any dispute or claim arising out of or relating to this warranty, the Product, or the services provided by Synology in connection with the Product or the relationship between Customers residing in the USA and Synology shall be finally settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (except as otherwise provided below), by one arbitrator. The arbitration shall be limited to a dispute between the Customer and Synology. The arbitration, or any part thereof, shall not be consolidated with any other arbitration and shall not be conducted as a class arbitration or class action. The arbitration shall be conducted in King County, Washington State, U.S.A., by submission of documents, by telephone, online, or in person, as determined by the arbitrator based on the request of the parties. The party prevailing in the arbitration or lawsuit in the U.S.A. or outside the U.S.A. shall be entitled to recover all costs and reasonable attorneys’ fees, including any fees paid by the prevailing party in the arbitration. Any award rendered by the arbitrator shall be final and binding on all parties and may be entered in any court of competent jurisdiction. You understand that, but for this provision, you would have had the right to the benefits of a court proceeding, including trial by jury and the right to bring or participate in class actions, and you expressly and knowingly waive these rights and agree to resolve disputes through binding arbitration, as provided herein. For Customers not residing in the USA: Any dispute, controversy, or claim described in this section shall be finally settled by arbitration administered by three neutral arbitrators in accordance with the procedures of the Chinese Arbitration Act and the applicable rules. The arbitration shall take place in: Taipei, Taiwan, Republic of China, and shall be conducted in English or, if agreed by both parties, in Mandarin Chinese. The arbitration award shall be final and binding on all parties and may be enforced in any court of competent jurisdiction. Nothing in this section shall prohibit or limit Synology from seeking injunctive relief or other equitable rights or remedies that it may have at law or in equity for actual or threatened breach of any provision of this Warranty in connection with Synology’s intellectual property rights.

5.6 Attorneys’ Fees

In any arbitration, mediation, or other legal action or proceeding to enforce any right or remedy arising under this Warranty, the prevailing party shall, in addition to any award of damages, be entitled to recover its costs and reasonable attorneys’ fees.

5.7 Export Restrictions

You acknowledge that the Product may be subject to export controls imposed by the United States of America. You shall comply with all applicable laws and regulations that apply to the Product, including, without limitation, the export regulations of the United States Department of Commerce.

5.8 Severability

If any provision of this Warranty is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remainder of this Warranty shall remain in full force and effect.

5.9 Entire Agreement

This Warranty constitutes the entire agreement between Synology and the Customer with respect to the subject matter hereof and supersedes all prior agreements. No amendment, modification, or waiver of any provision of this Warranty shall be effective unless in writing and signed by the party to be bound thereby.

FCC Declaration of Conformity

This device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) this device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.

VCCI Declaration

This device is a Class B device. This device is intended for use in a residential environment, but may cause interference with radio or television reception when placed close to such devices. Please follow the instructions in the manual for proper handling.
