General Terms and Conditions

Article 1: Definitions

Action

Promotional contest or campaign as described in the Specific Conditions of Action organized by Samsung.

Zone of Action

The Benelux territory where the Action takes place, as indicated in the Specific Conditions of Action. The Action only concerns promotional products purchased within the Zone of Action.

Period of Action

The period during which the promotion runs, as indicated in the Specific Conditions of Action.

Products of Action

The promotional models as specified in the Specific Conditions of Action.

Conditions of Action

These General Conditions of Action, the Specific Conditions of Action, and any supplementary conditions announced or disclosed by Samsung via its website or point of sale. In case of discrepancy, the Specific Conditions of Action prevail over the General Conditions of Action. The General Conditions of Action apply to promotional campaigns organized by Samsung.

Specific Conditions of Action

The associated Specific Conditions of Action and/or supplementary General Conditions described on the Action page, forming a whole with these General Conditions of Action, and published by Samsung with the Action for a specific Action.

Participation Material

Any form of contribution (including images, videos, text, photos, audio, drawings, paintings, interviews, portraits, social media messages, etc.) from Participants within an Action. This also includes any payments and recordings made as part of the campaign.

Participant

The person who takes part in the Action and is eligible to do so based on Article 2 of these General Conditions of Action.

Period of Registration

The period during which registrations to participate in the Action can be submitted, as indicated in the Specific Conditions of Action.

Advantage

Any advantage obtained during an Action, including a prize, discount, cash rebate, or product, as described in the Specific Conditions of Action. In case of a contest, the winner is the Participant who receives a prize as indicated in the Specific Conditions of Action.

Article 2: Participation

1. Participation in the Action is open only to individuals residing in the Zone of Action and aged 18 or older at the time of participation. Upon Samsung's request, the Participant must provide valid identification and proof of residence and age.
2. There are no costs associated with participation, unless otherwise stated in the Specific Conditions of Action.
3. Participation in these Actions is exclusively open to those who have purchased the Product of Action from a Participating Retailer of the Action, as indicated on the website, during the Period of Action. Participation is not possible if the product is purchased from a non-participating retailer or from a private individual. Successors of the product (e.g., buyers of 'second-hand', 'outlet', 'B-C' products, or exchanged products) cannot participate. The right to the Advantage becomes void after cancellation of the initial purchase, and the Participant must return any Advantage received at their own expense and promptly (within five (5) business days). Participation or the right to the Advantage is strictly personal and non-transferable. These promotions are valid while stocks last. Samsung is not responsible for the availability or stock of Products of Action at Participating Retailers.
4. Online registration via a website is required for certain Actions during the Period of Registration. Registration is free. The Participant must have a valid email address and a valid permanent residence address within the Zone of Action. Other registration conditions can be found on the website. Registration confirmation will be sent to the provided email address. If confirmation is not received, contact Samsung within two weeks (see Article 8-1). If additional information/documents are needed, the Participant has 14 calendar days after receiving Samsung's request to provide them. Failure to do so will result in the registration failing and the participation not being counted.
5. Participation is open only to consumers. A consumer is a natural person not acting for purposes related to their commercial, industrial, artisanal, or professional activity.
6. Promotions may be combined with other ongoing promotions or permanent advantages offered on Samsung.com for included products, unless otherwise specified in the special conditions of the promotion.

Article 3: Exclusions

1. Employees of Samsung, its subsidiaries, and all persons directly or indirectly involved in the organization of the Action or the Advantage, or the supplier of the Advantage and their respective employees, are excluded from participation.
2. Participants may only participate during the Period of Registration and as described in the General Conditions of Action. Combined participation in different Actions is not permitted unless otherwise stated in the Specific Conditions of Action. Incomplete, late, or improperly submitted entries may be rejected. Samsung disclaims liability for delays, incompleteness, or loss due to technical or other reasons. Participants must retain copies of their submissions. Samsung is not responsible for damaged, lost, or delayed submissions.
3. Participation is not allowed, and Samsung has the right to exclude Participants or groups of Participants from the Action and any subsequent Actions without prior notice (rendering the right to the Advantage void), if:
   • a. A Participant has participated in violation of the General Conditions of Action.
   • b. A Participant provides incomplete or false addresses (email), names, or other data.
   • c. Various scripts, systems, automated functions, or techniques are used to increase winning chances.
   • d. Abuse, fraud, manipulation, or circumvention of the General Conditions occurs.
   • e. A Participant does not participate for personal use but acts for commercial, business, artisanal, or professional purposes.
   Samsung may do this based on suspicion without stating a reason and without obligation to compensate the Participant or provide justification.

Article 4: Advantage

1. The right to the Advantage is strictly personal, cannot be exchanged for goods/services, and is non-transferable without Samsung's written consent.
2. Samsung reserves the right to offer an equivalent alternative to the Advantage at any time without prior notice and without obligation to provide compensation.
3. If a Participant does not contact Samsung within the timeframe specified in the Specific Conditions of Action, or within one month if this term is exceeded, Samsung may cancel the Participant's right to the Advantage and potentially award it to another Participant. Samsung is not obligated to notify that the right to the Advantage has expired.
4. Samsung endeavors to transfer, deliver, or personally hand over the Advantage to the Participant within 16 weeks of a valid registration submission or winner determination. Cashback can only be transferred to a bank account number within the European Union. Gifts (products) can only be sent to postal addresses within the Benelux. For deliveries within the Benelux, the Participant is considered to have received the Advantage upon delivery to the indicated postal address.
5. If Dutch gambling tax is payable on the Advantage for a promotion in the Netherlands, Samsung will pay it and it will not be charged to the Participant. The Participant is responsible for all other taxes and duties.

Article 5: Participation Material

1. The Participant declares and guarantees that the Participation Material submitted to Samsung is not illegal and does not infringe any law. Specifically, the Participant guarantees that the material does not infringe third-party rights (intellectual property) and is not insulting, offensive, harmful, racist, slanderous, defamatory, discriminatory, or otherwise contrary to good taste or decency. The material must not be misleading or illegal. The Participant will indemnify Samsung against any third-party claims related to the submitted Participation Material. Samsung may, at its sole discretion, deem the material unsuitable for any of the aforementioned reasons or any other valid reason and may refuse or remove it without consulting or obtaining the Participant's approval.
2. The Participant expressly and unconditionally assigns all current and future rights to the Participation Material (including intellectual property and moral rights) to Samsung. To the extent this transfer is not legally permissible, the Participant waives these rights. Samsung may exploit and license the Participation Material worldwide and without limitation through any imaginable medium, during and after the Period of Action. The Participant waives any right to compensation related to the transfer of the Participation Material. The Participant will ensure that third parties who may exercise rights over the Participation Material also transfer these rights to Samsung identically or waive them.
3. The Participant authorizes Samsung and/or other Samsung group companies to use the Participation Material (including displaying or communicating it to the public) in any manner (print, publications, film, digital, etc.) for Samsung's promotional and other purposes, without any right to compensation or indemnification, other than the Advantage. The Participant will ensure that third parties involved in their participation also grant Samsung an identical authorization without compensation or indemnification.

Article 6: Exclusion of Liability

1. Samsung, its employees, auxiliaries, or third parties engaged by it, are not liable, except in cases of intent or gross negligence, for: (i) additional costs and expenses incurred by the Participant related to the Advantage; (ii) damages caused by the provision or use of the Advantage or the Participant's participation in the Action; (iii) damages caused by malfunctions (of any nature) of software, computers, networks, or the internet, resulting in the Participant's entry not being registered, or being registered incorrectly, delayed, or late; (iv) fraud by the Participant(s); and (v) the content of the Participation Material.
2. Samsung offers no warranty regarding the provided Advantage and excludes all liability (except for intent or gross negligence) in this regard. Samsung will not be liable for: (i) any defect of the Advantage, (ii) if the Advantage is received later than announced, (iii) if the Advantage is received by the wrong person or is lost or damaged during transport, or (iv) if minor aspects of the received Advantage differ from the proposed Advantage.
3. In cases where a social media platform like Facebook or Twitter is used for an Action, the platform is in no way responsible for the Action. The Action is not sponsored, endorsed, administered, or associated with the platform.

Article 7: Confidentiality

1. Personal data communicated to Samsung by the Participant is subject to applicable national privacy laws. Samsung will process this data solely as the data controller for the proper conduct of the Action, for its own market research and direct marketing, and for the purposes stated in these General Conditions of Action and the Specific Conditions of Action. Personal data may be transferred to one or more entities within the Samsung group for the aforementioned purposes, or in case of legal obligation or request from police or judicial authorities. Personal data will not be sold to third parties.
2. In some cases, users may also provide personal data using their social media account (e.g., Facebook or Twitter).
3. Each Participant can freely exercise their legal right to access, rectify, and oppose the use of their data for direct marketing by sending a written, signed, and dated request to Samsung, accompanied by a copy of their ID, via postal mail to Samsung Electronics Benelux BV (Netherlands) or Samsung Electronics Belgium (Belgium/Luxembourg). For electronic IDs, a printout of the chip content or an official certificate of residence is also required. Participants can read Samsung's full privacy policy at the provided URLs. If a Participant requests the deletion of their personal data, their participation in the Action will become void, and they will no longer be eligible for the Advantage.

Article 8: Claims

1. Any person with questions, comments, or claims regarding the Action can contact Samsung's customer service at the address and phone number indicated in the Specific Conditions of Action. Customer service is also reachable at 088-9090100 (Netherlands), 02 201 2418 (Belgium), or 26 10 37 10 (Luxembourg).
2. Samsung is not bound by any correspondence concerning participation exclusions, removal of Participation Material, or the outcome of an Action, as stated in the General Conditions of Action.
3. Samsung's lack of response to a Participant's message, email, or letter cannot be considered consent to the content of that communication.

Article 9: Final Provisions

1. For Actions in the Netherlands involving an element of chance, the Dutch Code of Conduct for Promotional Games applies to these General Conditions and the promotion, and Samsung acts in accordance with this code.
2. Samsung reserves the right to cancel, interrupt, or modify the Action, the General Conditions of Action, and/or the Advantage at its sole discretion and without prior notice or justification if circumstances require, without being liable for any compensation to Participants.
3. The content of the General Conditions and Specific Conditions of Action is subject to typographical errors and interpretation. No rights can be derived from errors or mistakes made by Samsung.
4. These General Conditions of Action and the Specific Conditions of Action are governed by the law of the Zone of Action as defined in the Specific Conditions of Action. If the Zone of Action covers multiple countries, the legislation of the Participant's place of residence applies: namely, Belgium, the Netherlands, or the Grand Duchy of Luxembourg.
5. For Participants in the Netherlands, the court of Amsterdam has jurisdiction for any dispute between Samsung and the Participant, but only if the parties have first attempted mutual consultation. For Participants in Belgium, the court of Brussels has jurisdiction, and for Participants in the Grand Duchy of Luxembourg, the court of Luxembourg (City) has jurisdiction for any dispute between Samsung and the Participant. However, the Participant and Samsung undertake to consult and attempt to reach an amicable solution before initiating any proceedings.
