Introduction

Welcome to the Dell Trade In service, designed to reduce electronic waste through reuse and recycling. By participating, you accept and are bound by this Service Description.

Dell provides the Dell Trade In service in accordance with this Service Description. Your offer, order form, transaction form, receipt, information page, Dell Trade In credit offer, or other mutually-agreed upon form of invoice will include the name of the Service and available options.

THIS SERVICE DESCRIPTION IS A CONTRACT BETWEEN YOU AND DELL. Please read the following terms and conditions carefully. For customers in the United States and Canada, this Service Description requires arbitration on an individual basis to resolve disputes, rather than jury trials or class actions. For all other customers, dispute resolution terms are in your Terms of Sale.

For countries where Dell does not sell or offer services directly, contract terms may vary depending upon the seller's or service provider's terms.

This Service Description is subject to Dell's Terms of Sale (see www.dell.com/terms) when the product or service is purchased directly from Dell. For commercial customers, it is subject to Dell's Commercial Terms of Sale.

This Service Description does not affect statutory rights and remedies under applicable consumer protection laws that cannot be altered or reduced by law. Dell's commercial warranties do not affect applicable statutory warranties or other rights for consumers.

The Scope of This Service

Overview

Dell Marketing L.P. (“Dell”, the “Provider,” “we” or “us”) provides access to various features, content, and trade-in services via the Trade-In Service. By accepting this Service Description, the Privacy Policy, and any other written agreement, you agree to comply with these terms. This Service offers one or more of the following based on criteria described herein:

You may use the Service only for purposes allowed by this Service Description and not in any unlawful way or in any way that harms Dell or others. Dell reserves the right to substitute, change, cancel, or add to any part of this Service Description at any time, including terminating the Trade-In Service.

**'Activated' means your Dell Trade In credit is available for use.

General Customer Responsibilities

Authority to Grant Access

You represent and warrant that you have obtained permission for both yourself and Dell to access and use the devices to be traded in, the data located thereon, and all hardware and software components included therein, for the purpose of providing these Services. If you do not have permission, it is your responsibility to obtain it at your expense before asking Dell to perform these Services. Once the device is shipped, you cannot access or use the device, the data located thereon, or any hardware and software components included therein.

Customer Cooperation

If you seek technical support related to the Service from Dell, you will cooperate with and follow instructions given by Dell remote support, phone analysts, or technicians. Most problems and errors can be corrected remotely through close cooperation.

Trade In and Recycle Device Eligibility and Information

Eligibility

By participating, you represent and warrant that:

FOR DELL TRADE IN AND RECYCLING SERVICES, YOU ACKNOWLEDGE AND AGREE THAT THE RESPONSIBLE RECYCLE AND REUSE SERVICE IS BETWEEN YOU AND THE SERVICE PROVIDER ONLY, AND DELL IS NOT LIABLE FOR AND DOES NOT WARRANT SUCH SERVICE.

Device Eligibility Requirements

You may trade in one or more devices. Device model eligibility and Dell Trade In credit amount are determined by Dell or its representative in its sole discretion and may vary based on the time of purchase, health, and status of the device and its components. Refer to https://TradeIn.Dell.com/ (“Website”) for the most up-to-date information on eligible devices and Trade In credit amounts. Your traded-in device must meet all requirements stated in this Service Description, including but not limited to:

Trade In Credit Validity

Dell will assess your device's status and may offer credit (“Trade In credit” or “Trade In value” or “Value Back”) for eligible devices via a prepaid virtual card for purchases on Dell.com or by phone. To receive the credit, you must send your trade-in device within thirty (30) calendar days of receiving your credit offer, unless Dell specifies a different period.

Data Destruction

You acknowledge that it is your sole responsibility to remove all personal data (e.g., files, photos, videos, music, etc.). You cannot recover data or files stored within the device once it is shipped and data destruction is executed. You also cannot access or use any open, active licenses of software, tools, products, applications, or capabilities on this device. DELL WILL HAVE NO LIABILITY FOR: ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION; LOST OR CORRUPTED DATA, PROGRAMS, OR SOFTWARE; DAMAGED OR LOST REMOVABLE MEDIA; DATA OR VOICE CHARGES INCURRED FROM FAILING TO REMOVE SIM CARDS OR OTHER REMOVABLE MEDIA; LOSS OF USE OF A SYSTEM OR NETWORK; OR ANY ACTS OR OMISSIONS, INCLUDING NEGLIGENCE, BY DELL OR A THIRD-PARTY SERVICE PROVIDER. Dell is not responsible for restoration or reinstallation of any programs or data.

Inspection

Upon receipt and inspection, the original trade-in credit amount may be recalculated. If the device conditions match your attestation and it was sent in a timely manner, the original offer will be honored. If device conditions differ, Dell may cancel the offer or provide an updated offer.

Packaging and Shipping of Trade In Devices

Dell does not provide packaging materials or services. Customers may purchase packaging at FedEx or another provider at their own expense. Devices must be properly packaged to prevent damage, as any damage may reduce the Trade-in value.

Damage Prior to Inspection

The device is the owner's responsibility until received at the device processing facility. If your device becomes damaged or lost in transit before reaching the facility, open a support ticket with the authorized shipping vendor to file a claim. After the vendor's investigation, they will process your claim per their policy. If your device becomes damaged or lost after receipt at the processing facility, open a support ticket with Dell Customer Service to file a claim and open an investigation.

Recycling and Handling

You permit Dell to recycle, shred, destroy, repair, resell, donate, and otherwise handle the device in any manner it deems fit. This includes computer systems, accessories, mobile devices, accessories, storage devices, electronics, peripherals, and other consumer electronics. The device will not be returned to you.

Packaging and Shipping of Recycle Devices

A shipping label will be provided by Dell. Packaging is the customer's responsibility.

Third Party Warranties

These Services may require Dell to access hardware or software not manufactured by Dell. Some manufacturers' warranties may become void if Dell or anyone else other than the manufacturer works on the hardware or software and associated licenses. Dell is not responsible for third-party warranties or any effect the Services may have on them.

Services Terms & Conditions

This Service Description is entered into between you, the customer (“you” or “Customer”), and the Dell entity identified on your Transaction Documentation for the purchase of this Service.

For U.S. Consumers: Dell provides these services in accordance with this Service Description and the applicable “U.S. Consumer Terms of Sale” at http://www.dell.com/terms.

For All Customers: Please see the table below for the URL applicable to your location where your Agreement can be found. The parties acknowledge having read and agreed to be bound by such online terms.
