TCL CARE General Terms and Conditions
(2-Year Manufacturer Warranty + 3-Year Extended Warranty) for Select TCL Televisions
I. INTRODUCTION
These terms apply to devices distributed by TCL Netherlands B.V. and sold during the promotion period from July 1, 2025, to December 31, 2025.
II. SPECIAL PROVISIONS
Subject of TCL CARE Promotion
The promotion covers select TCL televisions (hereinafter referred to as the 'device' or 'electronic device'), as detailed on the invoice. The organizer of the promotion is Partum Usluge D.O.O. The scope of the promotion includes repair or replacement and proper functioning of the purchased electronic device, valid only for unforeseen and sudden failures or malfunctions of the item covered by the TCL CARE promotion. Unforeseeable failures are those that the user did not foresee in a timely manner, nor was obliged to foresee with due diligence, excluding gross negligence. The promotion covers the reimbursement of costs covered by the manufacturer's warranty for an additional period of the same length as the manufacturer's regular warranty or for the period indicated on the warranty itself.
Territorial and Temporal Validity of the Promotion
The promotion is valid in the territory of the Republic of Serbia. The promotion begins at the moment of device purchase and lasts until the end of the agreed period. The first two years of warranty refer to the manufacturer's warranty, and the additional 3 years of warranty are provided through PARTUM USLUGE d.o.o. The extended warranty begins on the day the regular warranty expires, provided that the user has registered their product for the extended warranty within 30 days of purchasing the device at: https://tcl-promotion.com/rs/.
User's Rights
- Reimbursement of device repair costs, provided that the cost does not exceed the value of a similar device at the time of failure.
- Reimbursement of the cost of a new device at the time of failure, if it cannot be repaired or if repair costs exceed the purchase value. In case of device replacement, the new device comes with a standard 2-year manufacturer warranty.
- Reimbursement of the cost of a device that is technically most similar to the device for which repair is uneconomical, if such a device can no longer be purchased or is not produced. In case of device replacement, the new device comes with a standard 2-year manufacturer warranty.
- In case of destruction, or if repair cannot be performed due to technical or objective reasons, or if it exceeds the purchase value.
- In case of failure or damage to the subject of the extended warranty, including damage caused by defects in this contract, which are discovered after the expiration of the manufacturer's statutory warranty.
The assessment of repair costs is determined by a written statement from the authorized manufacturer's service center. In case of device replacement, the device covered by the TCL CARE promotion, if requested, remains at the disposal of PARTUM USLUGE d.o.o. In any case, the maximum liability cannot exceed the price of the covered device at the time of failure. During the extended warranty period, the customer is entitled to a product replacement exclusively if the device cannot be repaired. During the extended warranty period, the repair time is not defined by law and may exceed 30 days.
Exclusions from the Promotion Scope
The extended warranty promotion does not apply to the following products and services:
- Devices/products purchased for resale or income generation (working tools).
- Rented or pledged devices.
- Used devices or products that have undergone repair or adjustment.
- Intentional or fraudulent actions by the user or any third party.
- Sabotage, terrorism, war, hostilities, war operations, or war events, revolution, insurrection, or civil unrest resulting from such events.
- Costs of repairing defects and replacing faulty parts covered by the manufacturer's warranty during the manufacturer's warranty period.
- Failure of devices or device parts not covered by the manufacturer's warranty or considered consumables (batteries, remote controls, filters, belts, etc.).
- Cleaning of the device, replacement of filters, or clearing blockages.
- Failure of all types of software (including operating systems, driver software).
- Failure caused by the removal of minor defects, especially scratches and other cosmetic defects that do not affect the technical usability of the device, as well as any aesthetic damage.
- Failure due to moisture or limescale.
- Failure caused by liquid ingress, or damage that is a direct or indirect consequence of atmospheric precipitation.
- Corrosion or liquid spillage on the device.
- Consequences of natural disasters, such as earthquakes, floods, storms, lightning, and similar.
- Loss of earnings, fines, delays, etc.
- Modifications, upgrades, or improvements to the device.
- Misuse of the device.
- Repair of the device abroad.
- Use of the device contrary to the manufacturer's instructions.
- Physical damage in any case is not covered.
User Obligations
If the device fails, the user is obliged to:
- Immediately take all possible measures to prevent further damage to the covered device.
- Report the failure within 3 calendar days by phone at 11/425-0050 or by email at claims@tvpromotion.eu.
- Provide all data and other evidence necessary to determine the cause, scope, and extent of the failure.
In addition to reporting the failure, which should include a description of the circumstances under which the failure occurred and a description of the device malfunction, the user must provide the following documentation:
- Proof of purchase (invoice), including details of payment and purchase date; 2) a copy of the Warranty Card.
- Certificate of extended warranty.
When registering for the promotion, general and personal information must be provided. By registering for the promotion, the customer agrees to the processing of their personal data.
