Štatút propagačnej a reklamnej súťaže

This statute governs the conditions for participation in the promotional and advertising competition "Google Pixel 9a", the method and procedure for carrying out the activities necessary for its realization, and defines the details of the rights and obligations of the participants of this promotional and advertising competition.

I. Organizer and Operator of the Competition

The organizer and operator of the "Google Pixel 9a" competition is Slovak Telekom, a.s., with its registered office at Bajkalská 28, 817 62 Bratislava, Company ID: 35 763 469, registered in the Commercial Register of the District Court Bratislava I, Section: Sa, Insert No.: 2081/B (hereinafter referred to as the "Organizer").

The Organizer announces the promotional and advertising competition named "Google Pixel 9a" (hereinafter referred to as the "Competition") according to the rules set forth in this Statute. Prizes for the Competition are provided by TCCM, s.r.o., Jindřišská 937/16, 110 00 Prague 1, Company ID 27901084, registered at the Municipal Court in Prague.

II. Subject, Purpose, and Duration of the Competition

1. The subject and purpose of the Competition is to promote the sale of electronic communication services and goods from the Organizer's commercial offer.
2. The Competition is not a game of chance within the meaning of Act No. 30/2019 Coll. on Games of Chance and on Amendments to Certain Acts, as amended. The Competition is a game within the meaning of Section 845 (1) of Act No. 40/1964 Coll. of the Civil Code, as amended (hereinafter referred to as the "Civil Code"), which the Organizer organizes under the conditions and according to the rules expressed in this Statute.
3. The Competition will take place from 30.06.2025 to 07.07.2025 (hereinafter referred to as the "Duration of the Competition") within the territory of the Slovak Republic.

III. Conditions for Participation in the Competition – Participants

1. Any Facebook social network user can participate in the Competition who:
   1. Comments on the competition post on the Organizer's official Facebook fan page https://www.facebook.com/telekom.sk with a comment according to the instructions in the competition post.
   2. Fulfills the further conditions of the Competition specified in this Statute.
2. In the case of a minor participant, all relevant consents and declarations stated in this Statute and related to participation in the Competition shall be made by their legal representative. The use of multiple Instagram social network login accounts (multiple identities of the same natural person) by one participant is prohibited. Violation of this rule may lead to the disqualification of the participant from the Competition.
3. The following persons are not eligible to participate in the Competition:
   1. persons who are employed or in a similar relationship with the Organizer or the Advertising Partner, as well as persons close to such a person in accordance with the definition of this term in Section 116 of the Civil Code, or
   2. towards whom the Organizer has an overdue claim (including a claim for payment of a deposit for provided or requested services or goods, or any other financial deposit), or
   3. whose provision of electronic communication services has been restricted or interrupted by the Organizer in accordance with the provisions of Act No. 351/2011 Coll. on Electronic Communications, as amended.

If it is proven that the winner of the Competition is one of the persons listed in points a), b), or c) of this paragraph, such person is not entitled to the prize, the prize will not be awarded to them, and it will be forfeited to a substitute winner.

4. Each participant is entitled to withdraw from the Competition. Their withdrawal from the Competition must be delivered in writing to the Organizer's registered office.

IV. Course of the Competition

1. The task of the participant during the Duration of the Competition is to answer the question:

   „SÚŤAŽ
   All Google Pixel phones are launched with a unique AI assistant. Do you know its name? Write it in the comment and play for a Google Pixel 9a phone, with which every day is an artistic experience.

   in a comment under the competition post published on the Organizer's official fan page on the Facebook social network, https://www.facebook.com/telekom.sk.

2. Every participant who fulfills all the conditions of the Competition will be included in the draw database.
3. From all participating contestants who fulfill all the conditions of the Competition, the Organizer will draw three (3) winners on 07.07.2025, who will receive the prize specified in Article V of this Statute, and one substitute winner.
4. The results of the draw and the winner will be contacted via private message within 3 working days, provided that the winner is successfully contacted and gives consent for this publication in accordance with Article VI of this Statute.

V. Prizes for Winners

1. The Partner has donated to the Competition: 3x Google Pixel 9a mobile phone valued at €569.00 each including VAT.

The Organizer reserves the right to change the subject of the prize, about which it undertakes to inform the participants no later than 1 working day before the prize draw, by means of a notification of the prize change, which will be published on the Organizer's fan page on the Facebook social network https://www.facebook.com/telekom.sk in the section dedicated to the Competition.

VI. Prize Awarding

1. For the purpose of awarding the prize, the winner of the Competition is obliged to provide the required cooperation to the Organizer.
2. The winner of the Competition will be contacted by the Organizer for the purpose of awarding the prize.
3. For the purpose of publishing the results of the Competition and awarding the prize, the Organizer is authorized to request the winner of the Competition to consent to the processing of their personal data, including name, surname, nickname (if any), email, phone number, and delivery address for the prize. If the winner does not provide their personal data in the scope of: name, surname, nickname (if any), email, phone number, address for the purpose of publishing the results of the Competition and awarding the prize, or if it is not possible to contact the winner within three (3) days of the end of the Competition, this failure to cooperate causes the forfeiture of the right to the prize, and the prize shall be forfeited to the substitute winner. The provision and confirmation of personal data is voluntary, but its non-provision and non-confirmation is considered failure to cooperate on the part of the winner necessary for awarding the prize, which causes the forfeiture of the right to the prize, and the prize shall be forfeited to the substitute winner. The personal data of the winners will be processed by the Organizer for the duration of the Competition. By providing personal data, the winner grants the Organizer consent to process personal data in the scope of name, surname, email, phone number, address for the purpose of awarding the prize and consent to publish personal data in the scope of name, initial of surname, and city for the purpose of publishing the winner's name on the Organizer's official Instagram fan page https://www.instagram.com/telekomsk/ in the section dedicated to the Competition. The rights of the participant regarding the processing of personal data are subject to the regime of Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter referred to as the "Act on the Protection of Personal Data").

4. The prize will be delivered to the winner of the Competition by courier at the Organizer's expense, subject to prior agreement with the winner of the Competition on the date and place of its delivery. In the event that, due to objective impossibility, the prize cannot be awarded to the winner of the Competition (e.g., impossibility to contact the winner of the Competition, refusal to accept the prize by the winner of the Competition), the prize shall be forfeited to the drawn substitute winner. Prize delivery abroad is not possible. The Organizer reserves the right to change the method of prize delivery.

5. In the event that the winner is a person under 18 years of age or a person without legal capacity or a person with limited legal capacity, the prize will be awarded to their legal representative upon presentation of proof of authority to act on behalf of the represented winner.

6. The Organizer is entitled to refuse to award the prize to a winner who is indebted to the Organizer from any contractual relationship, or with whom the Organizer has previously terminated and/or withdrawn from a public service contract.

7. Each winner has the right to refuse the prize. If the winner refuses the prize, the Organizer will proceed in the same way as if adequate cooperation had not been provided by the winner, and the prize will be forfeited to the substitute winner.

VII. Final Provisions

1. The prize in the Competition is not legally enforceable. The prize cannot be exchanged for cash.
2. In case of any doubts regarding the fulfillment of the Competition rules, the Organizer will decide on the further procedure in accordance with this Statute and generally binding legal regulations of the Slovak Republic. The Organizer also reserves the right to change this Statute and/or the conditions of the Competition after its announcement. The Organizer reserves the right to shorten, interrupt, or cancel the Competition, even before the end of its duration. Any change to the Statute and/or the conditions of the Competition or any shortening, interruption, or cancellation of the Competition will be announced by the Organizer on the Organizer's official fan page on the Facebook social network https://www.facebook.com/telekom.sk in the section dedicated to the Competition.
3. The Organizer reserves the right to assess the fulfillment of all conditions of the Competition by the participants and also the right to:
   1. possibly disqualify a participant from the Competition for not fulfilling one of the conditions of the Competition;
   2. not award the prize if the Organizer cannot successfully contact the winner
   3. in accordance with this Statute;
   4. not award the prize if the winner does not collect the prize and/or refuses to collect it;
   5. not award the prize even if the non-fulfillment of any of the Competition conditions is discovered later (after the participant has been determined as the winner in accordance with this Statute), but no later than the moment of prize awarding; awarding a different prize to the winner, which is qualitatively and valuably similar to the prize specified in Article V of this Statute. The substitute prize may also be of a different type or character than the prize according to Article V of this Statute.

4. The prize awarded to the winner is a pre-tax prize, and the Organizer or the Advertising Partner bears no responsibility for any tax obligations arising from the receipt of the prize by the winner within the meaning of Act No. 595/2003 Coll. on Income Tax. Any other related obligations are binding on the winner.

5. By participating in the Competition, the participant agrees to the rules of the Competition and this Statute, and also grants the Organizer consent to process their personal data in the scope of name, surname, nickname (if any), email, contact phone number, and address for the purpose of organizing this Competition, publishing results, and delivering the prize. The participant who becomes the winner of the Competition acknowledges and agrees that any telephone call made to contact the winner in accordance with this Statute may be recorded by the Organizer or the Advertising Partner for the purpose of proving the provision of cooperation by the winner. The provision and granting of consent to process personal data is voluntary, but its non-granting or non-provision is considered a violation of the provisions of this Statute and the conditions of the Competition, which results in the forfeiture of the right to the prize.

6. I acknowledge that my personal data will not be subject to automated decision-making or profiling and will not be transferred to third countries.

7. Participants' personal data will not be provided to other processors for processing.

8. In connection with the processing of my personal data, I have the following rights:

1. to request access to my personal data,
2. to rectify my personal data,
3. to erasure of my personal data,
4. to restrict the processing of my personal data,
5. to object to the processing of my personal data,
6. to data portability,
7. to lodge a complaint with the competent supervisory authority, which is the Office for Personal Data Protection.

10. The participant or winner is entitled to withdraw their consent to the processing of personal data at any time by demonstrably notifying the Organizer of this fact. Withdrawal of consent can be made at any contact point or in writing at the address specified in point 9 of this Article. Withdrawal of consent to the processing of personal data is considered failure to provide the required cooperation by the participant and a violation of the provisions of this Statute and the conditions of the Competition, which results in the forfeiture of the right to the prize.

11. The current version of the Statute will be available upon request at the Organizer's registered office or on the Organizer's official website https://www.telekom.sk/wiki/ostatne/sutaze in the section dedicated to the Competition.
