Samsung Trade-In Program
The Samsung Trade-In Program is a special offer from the Official Samsung Online Store aimed at stimulating sales of Samsung products and services, as well as promoting resource conservation and responsible environmental stewardship.
General Provisions
Organizer: Samsung Electronics Ukraine Company LLC, EDRPOU code 36048094, registered address: 01032, Kyiv, Lva Tolstogo St., 57.
Program Partner: BRIZ LLC, EDRPOU code 43884277, registered address: 03061, Kyiv, Gazova St., 30.
Participant: An adult, legally capable individual purchasing a Samsung smartphone from the Official Samsung Online Store.
The program is conducted in Ukraine, excluding temporarily occupied territories, in accordance with current legislation and these official rules and the Public Accession Agreement between the Partner and the Client.
Program Conditions
When purchasing a new Samsung smartphone (New Product), the Client has the right to sell their used smartphone, tablet, laptop, or wearable device (Used Product) to the Partner under the terms of the Public Accession Agreement, available at the provided link, for an agreed-upon price.
Purchases of New Products are made under general conditions, with specific features defined by these Rules.
If a discount is provided by the Organizer for a New Product sold under the Trade-In conditions, such a sale is called "Trade-In with Benefit".
Procedure for Evaluating and Selling Used Products
The evaluation of the Used Product is carried out by the Client after adding the New Product to the cart, during the checkout process.
For a preliminary valuation of the Used Product, the Client completes and signs a Statement of Accession to the Public Accession Agreement between the Partner and the Client.
The Statement includes information about the technical condition of the Used Product and a questionnaire covering the make, model, memory capacity, etc., of the Used Product.
The Client is solely responsible for the accuracy of the data provided in the Statement.
Based on the preliminary evaluation, the estimated value of the Used Product is displayed on the website, at which price the Partner agrees to purchase the Used Product. However, the purchase of the Used Product will always be at the contract price.
The Partner may refuse a preliminary evaluation of the Used Product if, in their opinion, the evaluation is economically unjustified.
If the Client agrees with the estimated value, the Client completes the purchase of the New Product, signifying their agreement with the purchase terms within the Trade-In program.
Participant Obligations After Receiving the New Product
For the final evaluation of the Used Product, determination of the contract price, and completion of the Used Product sale transaction after receiving the New Product, the Client must personally send the Used Product to the Partner.
Shipment must be made via the postal operator "Nova Poshta" at the recipient's expense (non-cash payment to BRIZ LLC) to the following recipient details: BRIZ LLC, Kyiv, branch №139, contact person: Mykyta Fedchenko, tel. +380 992282488.
If the Used Product is sent by a trusted person of the Client, the Client must inform the Partner in advance about this person, providing their full name and phone number.
If the New Product was purchased under "Trade-In with Benefit" conditions, the Client must send the Used Product to the Partner within 7 calendar days from the date of purchase of the New Product.
Information support from the Partner is available by phone (0800 3303 27) daily from 9 AM to 7 PM.
Sale of Used Products
Upon receiving the Used Product, the Partner conducts a final evaluation to establish the contract price and then agrees it with the Client.
Once the contract price is agreed upon by the Client and Partner, the Used Product is sold, and its contract price is transferred by the Partner to the Client's bank account.
The sale is made after deducting all taxes and fees. Since the Client is not a registered business entity, the Partner is responsible for acting as a tax agent, withholding and paying to the budget (state/local) all taxes and fees stipulated by law. The Partner withholds personal income tax at a rate of 5% and military levy at a rate of 5% from the contract price of the Used Product payable to the Client.
Consequences of Participant's Failure to Send the Used Product
If the New Product was purchased under "Trade-In with Benefit" conditions and the Client does not send the Used Product to the Partner within 7 calendar days from the date of purchase of the New Product, the Organizer may use technical means to inform the Client about the non-fulfillment of the obligation (notification) and to significantly restrict the functionality of the New Product (blocking).
Notifications are sent by the Organizer to the New Product within 14 calendar days from the day following the expiry of the 7-day period established for sending the Used Product.
Blocking of the New Product occurs on the 15th calendar day after the first notification. The result of blocking is the restriction of the New Product's functionality. From this moment, the Client will only be able to make calls to the Organizer. Other functions will be unavailable.
Blocking of the New Product also occurs on the day the Partner receives a parcel from the Client if the parcel does not contain the Used Product specified by the Client in the Statement.
Unblocking Conditions
Unblocking is a paid service available for purchase in the Organizer's Official Online Store.
The cost of unblocking is set by the Organizer and depends on the model of the New Product.
After purchasing the unblocking service, the Organizer will inform the Client by phone about the possibility of unblocking in real-time. If agreed, the Organizer and Client will proceed with unblocking by exchanging access keys and PIN codes. If not agreed, another time for real-time unblocking will be arranged.
After unblocking, full functionality of the New Product is restored.
Once unblocked, the New Product cannot be blocked again.
Program Information
The Organizer is not responsible for communication between the Client and the Partner, nor for the fulfillment of obligations by the Partner or the Client.
The Organizer is not responsible for determining the estimated or contract price of the Used Product.
Neither the Organizer nor the Partner guarantees that the contract price will be higher than or equal to the estimated value.

In case of early termination of the Program, or any other changes or additions to the terms and conditions of the Promotion, notification will be published on the website.
The Organizer reserves the right to involve third parties in conducting the Promotion and to make changes and post additional information about the Promotion.
The Partner is not responsible for data preservation on the Used Product; therefore, data backup and deletion from the Used Product are solely the Client's responsibility.
Other Conditions
The Organizer may provide additional discounts on New Products when purchased under the Program.
In case of situations allowing for ambiguous interpretation of the Rules and/or issues not covered by these Rules, the final decision is made by the Organizer and/or the Partner in accordance with the requirements of current Ukrainian legislation.
In the event of circumstances preventing the Program's operation, such as internet network malfunctions or failures, making further program operation impossible, the Organizer has the right to temporarily suspend or completely terminate the Program.
The Organizer is not responsible for non-fulfillment of its obligations due to force majeure circumstances, such as natural disasters, fires, floods, military actions of any kind, blockades, significant changes in Ukrainian legislation, or other circumstances beyond the Organizer's control, if these circumstances prevent the fulfillment of such obligations.
By participating in the Program, the Client confirms that they have read and agree to the Rules, and also gives consent for: the processing/use of their personal data for the purpose of contacting them regarding the Program; free use of their provided information by the Organizer for marketing purposes through methods that do not contradict current Ukrainian legislation (including transfer to third parties).
Processing of the Client's personal data is carried out by the Organizer under confidentiality terms, and by the Partner under the terms of the Public Accession Agreement.
