Samsung Galaxy S25 Series Promotion

§ 1. Definitions

Terms used in the Regulations and written with a capital letter have the following meaning:

1. Samsung Care+: Insurance protection provided by Amtrust International Underwriters DAC, based in Dublin, Ireland, under an insurance agreement. It covers the possibility of reporting an unlimited number of insured events during the insurance period. However, in case of replacement of the insured device with a new one, according to the applicable general insurance conditions, a maximum of 2 such replacements are possible for an insurance agreement concluded for a period of 12 months, and a maximum of 4 replacements for an insurance agreement concluded for a period of 24 months. It is stipulated that in the case of replacement with a new device, the insured person is obliged to pay a deductible of PLN 329 (amount applies to Galaxy S series smartphones). In the case of smartphone repair, you will not incur any additional costs. Detailed terms and conditions of insurance, exclusions, and limitations of insurance coverage are specified in the general terms and conditions of insurance available at: www.samsung.com/pl/offer/samsung-care-plus/
2. Business Days: Days from Monday to Friday, excluding public holidays in the Republic of Poland.
3. Organizer: Samsung Electronics Polska sp. z o.o. with its registered office in Warsaw (ul. Postępu 14, 02-676 Warsaw), entered into the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number 0000128080, NIP 526-10-44-039, REGON 011612810, share capital PLN 52,759,500.
4. Product: Samsung Galaxy S25 Ultra, S25 Edge, S25+, S25, S24, S24 FE models indicated in Annex No. 2 offered by the Organizer for sale in the Samsung Store operated by the Organizer, introduced into circulation in the territory of the Republic of Poland by Samsung. Product availability and delivery times depend on the Organizer's current offer in the Samsung store at www.samsung.com/pl. The lowest price from 30 days before the price reduction of individual products is indicated in Annex No. 2.
5. Promotion: Sale under the name "Samsung Galaxy S25 Ultra, S25 Edge, S25+, S25, S24, S24 FE with a discount on Samsung Care+ purchase in the Samsung store" conducted on the terms and conditions described in the Regulations, from June 23, 2025, to July 6, 2025, 11:59:59 PM.
6. Regulations: This regulation together with its attachments, which constitute an integral part thereof.
7. Promotional Website: The promotion website is available at: www.samsung.com/pl
8. Samsung Store: An IT platform available through the website www.samsung.com/pl/, administered by Samsung, enabling users to view Products, including their prices and availability, and to place orders and conclude product sales agreements, in accordance with the regulations of the online Samsung Store: https://www.samsung.com/pl/shop-faq/service-and-warranty/regulamin-internetowego-sklepu-samsung/.
9. Participant: (i) an adult individual with full legal capacity; (ii) an individual conducting a sole proprietorship, with full legal capacity, residing in Poland and not participating in the Promotion as part of their non-agricultural business activity, purchasing the Product (under the terms specified in these Regulations); who has read the content of these Regulations and accepted its provisions and met the conditions specified therein.
10. Amtrust: Amtrust International Underwriters DAC, a company established and existing under the laws of Ireland, with its registered office in Dublin, Ireland, at 6-8 College Green, Dublin 2, D07 VP48, registered under number 169384, operating under license number CBI C33525 issued by the Central Bank of Ireland (CBI) and subject to the regulations of this bank.

§ 2. General Provisions

1. The Regulations specify:
1. the purpose of the Promotion;
2. the duration of the Promotion;
3. the conditions for participation in the Promotion;
4. the procedure for submitting complaints related to participation in the Promotion.
2. The purpose of the Promotion is to provide the Participant with a discount of PLN 300 on the current price of a selected Product in the Samsung Store, for an order placed in the Samsung Store that simultaneously includes the purchase of the Product and a Samsung Care+ insurance in any variant. To take advantage of the Promotion when purchasing the Product, the Participant should add the Samsung Care+ insurance along with the Product to the cart themselves. After adding the Product and Samsung Care+ insurance to the cart, the Participant will receive a benefit in the form of a product price reduction of PLN 300. The product price after the discount cannot be lower than PLN 1.
3. The Promotion is conducted exclusively in the Samsung store at www.samsung.com/pl.
4. The Promotion is conducted from June 23, 2025 (the first day on which it is possible to purchase the Product) until July 6, 2025 (the last day on which it is possible to purchase the Product).
5. Products at the promotional price will be offered on a first-come, first-served basis, and the availability of individual Products in the Promotion may be exhausted earlier.
6. The Organizer reserves that the availability of individual Products in the Samsung Store may change during the Promotion (including being exhausted), and in the event of unavailability of Products covered by the Promotion in the Samsung Store, the Participant will not be able to purchase the given Product at the promotional price.
7. Participation of Customers in the Promotion is voluntary. Anyone who has participated in the Promotion has the full right to withdraw from participation in it at their own discretion and without incurring any costs.
8. A Participant in the Promotion may purchase only one Product with one Samsung Care+ insurance at the promotional price.
9. If the Organizer detects that a Participant is attempting to participate in the Promotion again, the Organizer will be entitled to refuse the order or to enable the Participant to purchase Products exceeding the limits indicated in point 8 above at the regular price.
10. Products purchased under the Promotion are intended exclusively for the private use of Participants acting as consumers within the meaning of the Civil Code or for the own use of entrepreneurs conducting business activity not related to trade (in particular, goods sales) and may not be resold for commercial or profit purposes.
11. The Organizer does not provide for the possibility of exchanging the discount in the Promotion for its cash equivalent or for other prizes.
12. In the event of withdrawal from the agreement for the sale of purchased Samsung Care+ Insurance, the Participant is obliged to return the discount received under the Promotion immediately. Samsung will inform the customer where and how to return the obtained benefit in the Promotion.
13. The Promotion can be combined with other Organizer promotions, unless otherwise stated in the regulations of those promotions.
14. If the price reductions made available to the Promotion Participants are subject to a lump-sum income tax for individuals, as referred to in art. 30 sec. 1 point 2 of the Act of July 26, 1991, on personal income tax, the benefits granted to the Participants will be increased by an additional cash prize in the amount of 11.11% of the Prize value. The additional cash prize will not be paid out and will be withheld to pay the lump-sum tax, which will be remitted to the competent tax authority. Participants agree to such withholding.

§ 3. Complaints

1. The Participant of the Promotion has the right to submit a complaint.
2. Complaints related to the Promotion should be submitted to the Organizer.
3. The complaint must include:
1. Participant's first and last name;
2. correspondence address or e-mail address for contact;
3. description of the circumstances constituting the basis for the complaint.
4. Complaints should be sent within 14 days from the end of the promotion within the meaning of the regulations of the online Samsung store:
1. in writing to the address: Samsung Electronics Polska sp. z o.o. ul. Postępu 14, 02-676 Warsaw; or
2. by e-mail to the address support_sepol@email.support.samsung.com with the subject: "Samsung Galaxy S25 Ultra, S25 Edge, S25+, S25, S24, S24 FE with a discount on Samsung Care+ purchase in the Samsung store"
3. via the complaint form available on the website: https://www.samsung.com/pl/complaints/
5. Submitted complaints will be processed within a maximum of 14 days from the date of receipt of the complaint. Interested parties will be notified of the complaint resolution method in the form corresponding to the form in which the complaint was submitted, immediately after its resolution.
6. The deadline for submitting a complaint, which is provided for in the Regulations, does not exclude or limit the rights available to the Participant under the law, in particular the provisions on the statute of limitations for claims.
7. The complaint procedure does not exclude or limit the Participant's right to pursue their rights before common courts.

§ 4. Personal Data Protection

1. Information on the processing of personal data by the Organizer in connection with participation in the Promotion is Annex No. 3 to the Regulations.
2. Detailed information on the processing of personal data by the Organizer can be found in the Privacy Policy available at: https://www.samsung.com/pl/info/privacy.

§ 5. Changes to the Regulations

1. The Organizer reserves the right to change the Regulations in connection with and in the event of the occurrence of at least one of the following important reasons:
1. introduction of new or amendment of existing generally applicable legal provisions, if it directly affects the content of the Regulations and necessitates its amendment;
2. amendment or emergence of new interpretations of generally applicable legal provisions as a result of court judgments or decisions of authorities or public administration bodies that directly affect the provisions of these Regulations and necessitate their amendment;
3. ruling, decision, recommendation or endorsement of a competent public authority, relating to the Regulations and resulting in the necessity to adapt them to such ruling, decision, recommendation or endorsement;
4. changes in the Samsung brand's Product portfolio;
5. adaptation of the Regulations to market conditions related to technical, technological and IT progress, affecting the provisions of these Regulations;
6. change of company, tele-address data or URL addresses included in the text of the Regulations;
7. the need to introduce other changes than those mentioned above, provided that they meet the following conditions: i) they are in accordance with the law (including, in particular, they do not infringe individual or collective consumer interests); ii) they are beneficial for current and potential Participants; iii) their introduction is necessary for the proper implementation of the Promotion in a manner that is beneficial for current and potential Participants.
2. The participant will be informed about changes to the Regulations by the Organizer posting on the website: https://www.samsung.com/pl/shop-faq/service-and-warranty/regulaminy-promocji/ an appropriate announcement referring to the summary of changes to the Regulations with one day's notice.
3. Information about changes to the Regulations will be kept for the duration of the Promotion and for at least 14 days after its end. A Participant who does not agree to the proposed changes will not continue to participate in the Promotion.
4. Changes to the Regulations cannot negatively affect the rights previously acquired by Participants.

§ 6. Final Provisions

1. The Regulations will be available for inspection throughout the entire period of the Promotion. The Participant may save the content of the Regulations by downloading it from the Website.
2. The following attachments to the Regulations constitute their integral part:
1. Annex No. 1 – Samsung Care+ insurance;
2. Annex No. 2 - Product models;
3. Annex No. 3 - Information on the processing of Participant's personal data by the Organizer in connection with participation in the Promotion.

Clause on personal data processing by the Organizer

1. The Administrator of the Participant's personal data is the Organizer of the Promotion, which is Samsung Electronics Polska sp. z o.o. with its registered office in Warsaw (ul. Postępu 14, 02-676 Warsaw).
2. Participant's personal data is processed for the purpose of:
1. conducting the Promotion (the basis for processing is the legitimate interest of the administrator – art. 6 sec. 1 lit. f GDPR);
2. handling complaints (the basis for processing is the legitimate interest of the administrator – art. 6 sec. 1 lit. f GDPR);
3. for purposes related to the fulfillment of the Organizer's legal obligations, including tax and accounting obligations (the basis for processing is the necessity of data for the fulfillment of a legal obligation incumbent on the administrator – art. 6 sec. 1 lit. c GDPR);
4. for the purpose of defense against potential claims or for the purpose of pursuing potential claims (the basis for processing is the legitimate interest of the administrator – art. 6 sec. 1 lit. f GDPR).
3. In connection with the processing of the Participant's personal data for the purposes indicated in point 2, personal data may be made available to the following recipients or categories of recipients:
1. entities from the Samsung capital group,
2. entities supporting the Organizer in its business processes, including entities processing personal data on behalf of the Organizer (so-called data processors) and Samsung business partners, e.g. entities providing accounting and bookkeeping services, entities providing IT services for the Organizer and transport companies, public administration bodies and entities performing public tasks or acting on behalf of public administration bodies, to the extent and for the purposes resulting from legal provisions.
3. for the purpose of servicing the Promotion and handling potential complaints, the Organizer has entrusted Smolar with the processing of Participants' personal data.
4. Samsung will store Participants' personal data for the duration of the Promotion and for the period necessary to fulfill the Organizer's legal obligations. The period of storage of Participants' personal data may be extended each time by the statute of limitations for claims.
5. Participants have the right to access, rectify, erase or restrict the processing of their data and to object to the processing of data due to their particular situation. Samsung ensures the exercise of the above rights within the scope resulting from art. 15-22 GDPR. The Participant has the possibility to submit a request for the exercise of rights referred to above by filling out the form available at https://www.samsung.com/pl/info/privacy (https://www.europe-samsung.com/gdpr/webform/pl), in accordance with the instructions available on the website.
6. In cases justified by Samsung group's corporate requirements, personal data may be transferred outside the European Economic Area (EEA). In such cases, we guarantee that a similar level of protection for your data in a third country is ensured by introducing one of the following safeguards:
1. transfer of personal data takes place to countries that the European Commission has recognized as ensuring an adequate level of personal data protection;
2. we use appropriate contracts approved by the European Commission or rely on binding corporate rules that guarantee the security of personal data.
7. As part of exercising the Participant's rights, the Organizer also provides the possibility to obtain copies of appropriate safeguards for personal data in the event of transfer to third countries.
8. The Participant has the right to lodge a complaint with the competent supervisory authority, which is the President of the Personal Data Protection Office.
9. Personal data is provided by Participants voluntarily, but providing data is necessary to participate in the Promotion.
