Warranty Information
Manufacturer of the product: FAST ČR, a.s., U Sanitasu 1621, 25101 Říčany, Czech Republic. FAST Hungary Kft. H-2310 Szigetszentmiklós, Kántor út 10. Tel.: 06-23-330-905; 06-23-330-830, Fax: 06-23-330-827, E-mail: szerviz@fasthungary.hu
FAST Hungary Kft. (2310 Szigetszentmiklós, Kántor út 10.), as the importer of the product in Hungary, provides a warranty for the device of the type and serial number indicated on this warranty card under the following conditions:
FAST Hungary Kft. warrants the product for a period of 24 months from the date of handover to the consumer (purchase), or if the installation is carried out by the seller or its authorized representative, from the date of installation. For products with a retail price of 250,001,- Ft or more, the warranty period is 36 months. If the consumer puts the product into operation within six months of handover, the warranty period starts from the date of handover. The warranty period for product components and accessories (e.g., batteries) is 12 months, with the exception of batteries, for which the warranty period undertaken by us does not apply. Any of our products (or their components or accessories) that are listed in Annex 1 of the mandatory warranty regulation for durable consumer goods no. 151/2003 (IX.22.) and whose purchase price reaches gross HUF 10,000,- is considered a durable consumer good and is subject to mandatory warranty (depending on the product price, 1 year for up to HUF 100,000,-, 2 years between HUF 100,001,- and HUF 250,000,-, and 3 years for prices above HUF 250,001,-). The warranty undertaken by us applies to products with a purchase price below HUF 10,000,- or products not listed in the Regulation for the entire 24-month period, and for products listed in the Regulation with a purchase price of HUF 10,000,- or more but not exceeding HUF 100,000,-, it applies for the period between months 13-24. Furthermore, voluntary warranty applies to product components and accessories if the purchase price of the component or accessory listed in the Regulation does not reach HUF 10,000,-, or if the product itself is not listed in the Regulation.
The warranty claim (points 6(i) and 6(ii) below) can be exercised with the warranty card, within (i) 1 year from handover (if installation is relevant) - for products with a retail price not exceeding HUF 100,000,-; (ii) 2 years for products with a retail price not exceeding HUF 250,000,-; (iii) 3 years for products with a retail price exceeding HUF 250,000,-, at the seller of the product, at its registered office, any branch, or directly at the authorized service center for repair or replacement claims. In the case of the preceding point (i), i.e., for voluntary warranty for an additional year beyond the mandatory warranty period for products with a retail price not exceeding HUF 100,000,-, only replacement and repair can be claimed between the 13th and 24th month, and you can contact the seller or the authorized service center for these claims.
Improper issuance of the warranty card or failure to provide the warranty card to the consumer does not affect the validity of the warranty. In the absence of a warranty card, the conclusion of a consumer contract is considered proven if the consumer presents proof of payment for the product. For this reason, we kindly ask our valued customers to keep their proof of payment.
In case of defective performance, if the product malfunctions for the first time within the warranty period, the consumer may, at their choice, demand (i) free repair or replacement of the defective product, unless the chosen claim is impossible or would involve disproportionate additional costs for the obligor compared to fulfilling another warranty claim, taking into account the value of the goods in perfect condition, the severity of the breach of contract, and the interest of the consumer affected by the fulfillment of the warranty claim; or (ii) demand an appropriate price reduction commensurate with the severity of the breach of contract, or withdraw from the contract if: the obligor has not undertaken repair or replacement, or has refused to make the product compliant with the contract by citing the impossibility or disproportionate cost of repair or replacement, or if it is evident from the circumstances that the obligor cannot fulfill this obligation within a reasonable period, taking into account the consumer's interests or without causing significant detriment to the consumer, or if the defect has recurred despite the obligor's attempt to make the product compliant, or if the consumer's interest in repair or replacement has ceased, or if the severity of the defect justifies a price reduction or withdrawal from the contract. Withdrawal from the contract due to an insignificant defect is not permissible. The undertaking is obliged to prove that the defect is insignificant in case of consumer's withdrawal claim. The consumer may switch from their chosen right to another. The consumer must pay the costs incurred by the switch to the obligor of the warranty claim, unless the switch was caused by the obligor, or the switch was otherwise justified.
If the defect affects a specific part of the goods, and the conditions for exercising the right of withdrawal are met for that part, the consumer may only withdraw from the contract with respect to the defective goods; however, they may also withdraw with respect to any other goods acquired together with the defective goods if it is not reasonable to expect the consumer to keep only the goods that are compliant with the contract. The consumer may exercise their right of withdrawal by means of a declaration of intent addressed to the seller. In case of withdrawal, the consumer must return the goods in question to the seller at the seller's expense, and the seller must promptly refund the purchase price paid by the consumer for the goods in question upon receipt of the goods or proof of their return.
In case of mandatory warranty, the undertaking must draw up a record of the consumer's warranty claim reported to them, in accordance with the content specified by the legislation on the procedure for handling warranty and guarantee claims for goods sold within the framework of the contract between the consumer and the undertaking.
If the product cannot be repaired during its first repair within the mandatory warranty period, the product shall be replaced within 8 days of the determination, unless the consumer stipulates otherwise. If replacement is not possible, the purchase price indicated on the proof of payment presented by the consumer shall be refunded within eight days.
If the product malfunctions again after three repairs within the mandatory warranty period, the product shall be replaced within 8 days, unless the consumer stipulates otherwise, and if the consumer does not request a proportionate price reduction in accordance with the relevant legislation. If replacement is not possible, the purchase price indicated on the proof of payment presented by the consumer shall be refunded within eight days.
If the product is not repaired within 30 days from the notification of the repair request during the mandatory warranty period, the product shall be replaced within 8 days after the expiry of the 30-day period, unless the consumer stipulates otherwise. If replacement is not possible, the purchase price indicated on the proof of payment presented by the consumer shall be refunded within eight days after the expiry of the 30-day repair period.
The consumer must report the defect without delay upon discovery, but no later than two months after discovery. The consumer is responsible for any damage caused by delayed notification. Please note that the warranty claim can only be exercised within the warranty period (i.e., 24 or 36 months depending on the product price, or 12 months for components and accessories)! However, the mandatory warranty period is extended by the period from the date of handover for repair until the consumer could not use the product as intended due to the defect. If the obligor does not fulfill their warranty obligation within the prescribed period, the warranty claim can be enforced in court within 3 months from the expiry of the appropriate period set by the consumer's request, even if the warranty period has already expired. Failure to meet this deadline results in forfeiture of rights.
Costs incurred in fulfilling the warranty obligation shall be borne by the obligor of the warranty. The return of the opened packaging of the consumer good by the consumer cannot be made a condition for exercising rights arising from the warranty.
For durable consumer goods specified in Government Decree 151/2003 (IX.22.), in case of a replacement claim made within three working days from purchase (commissioning) due to a defect, the obligor cannot invoke disproportionate additional costs, but must replace the durable consumer good, provided that the defect prevents its intended use (and replacement is not impossible).
In case of repair, only new parts must be installed in the consumer good. The consumer must make the defective goods available to the obligor for repair or replacement. The repair or replacement must be carried out within a reasonable period, taking into account the properties of the goods and the expected intended use by the rightful owner, and in a manner that is considerate of the consumer's interests. In the case of repair or replacement claims under mandatory warranty, efforts should be made to complete the repair or replacement within 15 days (without prejudice to points 10, 11, and 12 above). If the duration of repair or replacement under mandatory warranty exceeds 15 days, the consumer must be informed of the expected duration of repair or replacement no later than the 15th day. The information shall be provided electronically with the prior consent of the consumer, or by other means that can certify the consumer's receipt.
Fixed-installation or consumer goods weighing more than 10 kg, or consumer goods that cannot be transported as hand luggage in public transport vehicles, must be repaired at the place of operation, with the exception of vehicles. If the repair cannot be performed at the place of operation, the seller or the service provider, in case of repair claims asserted directly with the service provider, is responsible for the removal and installation, as well as the return transport.
The undertaking is exempt from warranty liability if it proves that the cause of the defect arose after the undertaking's performance (handover of the product to the consumer), for example, due to non-intended use, failure to follow the user manual, improper transport or storage, dropping, damage, force majeure, external causes (e.g., voltage fluctuations exceeding permissible limits), improper installation by the consumer (or another person independent of the seller) (provided that improper installation is not due to a defect or omission in the user manual), unauthorized modification, intervention, uncertified repair by an unauthorized service center, failure to perform maintenance tasks by the consumer, normal natural wear and tear (e.g., battery depletion), or failure due to normal operational wear. If the consumer's failure to perform maintenance also contributed to the defect of the goods, the consumer must bear the costs incurred in fulfilling the warranty obligation in proportion to their contribution, provided that the consumer possessed the knowledge regarding the maintenance of the goods, or if the obligor fulfilled their information obligation in this regard. The warranty does not affect the consumer's rights arising from the law, particularly the rights of warranty for defects (Civil Code, sections 6:159 - 6:167) or product warranty (Civil Code, sections 6:168 - 6:170), and their free exercise as prescribed by law. The warranty does not affect the consumer's right to compensation for damages arising from defective performance.
Rights arising from the warranty can be exercised by the owner of the consumer good, provided that they qualify as a consumer.
We inform you that for the out-of-court settlement of consumer disputes defined by consumer protection law, you can also initiate proceedings before the mediation body operated by the county (capital city) Chamber of Commerce and Industry (mediation bodies' contact information and further information: https://bekeltetes.hu/index.php?id=testuletek, and https://www.fogyasztovedelem.kormany.hu/#/bekelteto_testuletek).
