Remedies under the legal guarantee of conformity according to OUG no. 140/2021
(please refer to the provisions below)
ARCTIC guarantees all legal rights provided by OUG no. 140/2021 for the benefit of consumers regarding the legal guarantee of conformity. The provisions of this legal guarantee of conformity certificate are supplemented, as appropriate, by the provisions of OUG no. 140/2021.
In case of non-conformity, the consumer has the right to have the goods brought into conformity, to benefit from a proportional price reduction, or to terminate the contract, under the conditions of the law - Art. 11 (1).
Consumers may opt for a specific corrective measure if the non-conformity of the goods is found shortly after delivery, within 30 calendar days - Art. 11 (7).
For the goods to be brought into conformity, the consumer may opt between repair and replacement, unless the chosen corrective measure is impossible or, compared to the other available corrective measure, would impose disproportionate costs on the seller, taking into account all circumstances (e.g., the value of the goods if there had been no non-conformity, the severity of the non-conformity, or if the alternative corrective measure could be executed without significant inconvenience to the consumer) - Art. 11 (2).
Incorrect Installation of Goods (Art. 7)
Any non-conformity caused by incorrect installation of goods is considered a non-conformity of the goods in any of the following situations:
- a) installation is part of the sales contract and was carried out by the seller or under the seller's responsibility;
- b) installation, intended to be carried out by the consumer, was carried out by the consumer and the incorrect installation was due to deficiencies in the installation instructions provided by the seller or, in the case of goods with digital elements, by the seller or provider of digital content or digital service.
Proof of Non-conformity
Any non-conformity that is found within one year from the date the goods (including those with digital elements) were delivered is presumed to have already existed at the time of delivery of the goods, unless proven otherwise, or unless this presumption is incompatible with the nature of the goods or the nature of the non-conformity - Art. 10 (1).
In the case of goods with digital elements for which the sales contract provides for the continuous supply of digital content or digital services for a certain period, the burden of proof regarding the conformity of the digital content or digital service during the legal guarantee periods lies with the seller in case of non-conformity that is identified during this period - Art. 10 (3).
Remedy by Repair
If the non-conformity is remedied by repair, the legal guarantee periods are extended by the time the good is out of service, from the moment the non-conformity was reported to the seller until the effective delivery of the good in normal use condition to the consumer - Art. 12 (6).
Remedy by Replacement
If the non-conformity is remedied by replacement, for goods that replace non-conforming goods, the legal guarantee periods begin to run from the date of replacement with the new product - Art. 12 (7).
Price Reduction and Termination of Contract
The consumer is entitled to either obtain a proportional price reduction in accordance with the law, or to terminate the sales contract under the conditions of the law, in any of the following cases - Art. 11(4):
- a) the seller has not completed the repair or replacement or, as the case may be, has not completed the repair or replacement according to the law, or the seller has refused to bring the goods into conformity according to the law;
- b) non-conformity is established, despite the seller's efforts to remedy it;
- c) the non-conformity is of such gravity as to justify a price reduction or the right to immediate termination of the sales contract;
- d) the seller has declared that they will not bring the goods into conformity within a reasonable period or without significant inconvenience to the consumer, or this is clear from the circumstances of the case.
The consumer has the right to suspend payment of a part of the price of the goods or of a part thereof until the seller has fulfilled their obligations under the law - Art. 11(6). The price reduction is proportional to the decrease in the value of the goods received by the consumer compared to the value the goods would have had if they had been in conformity - Art.13.
Termination of Contract:
- a) cannot be requested if the seller proves that the non-conformity is minor;
- b) can be requested for all purchased and delivered goods, even if the reason for termination concerns only certain goods, if the consumer cannot reasonably be expected to accept to keep only the conforming goods;
- c) obliges the consumer to return the goods to the seller, at the seller's expense;
- d) obliges the seller to refund the consumer the price paid for the goods upon receipt of the goods or proof presented by the consumer that the goods have been returned; the seller will use the same payment methods as the consumer used for the initial transaction, unless the consumer has agreed to another payment method and provided that the consumer does not incur any fees as a result of the refund.
The legal guarantee for hidden defects is applicable under the law, according to OG no. 21/1992 (revised) on consumer protection, OUG no. 140/2021 and the Civil Code. A hidden defect is a qualitative deficiency of a delivered product or a provided service that was not known and could not have been known by the consumer through ordinary means of verification.
