LIMITED CONNECTED EQUIPMENT GUARANTEE

Best Buy or its authorized partner, sellers of Insignia branded products, provides this Limited Connected Equipment Guarantee ("Connected Equipment Guarantee") to you, the original purchaser ("Original Purchaser" or "you") of this new Insignia-branded surge protector product ("Surge Product"). The Connected Equipment Guarantee applies if your Surge Product was (i) purchased in the United States or Canada from a Best Buy branded retail store or online at www.BestBuy.com or www.BestBuy.ca, or from Best Buy's authorized online partner on Amazon.com, or a Insignia authorized partner, (ii) sold with this Connected Equipment Guarantee, and (iii) used only in the United States or Canada.

READ BEFORE USING YOUR SURGE PRODUCT

Please read the following terms and conditions carefully before using the Surge Product. The terms and conditions include specific details for proper use of the Surge Product; failure to follow proper use instructions may prevent you from qualifying for the Connected Equipment Guarantee.

By using the Surge Product you consent to be bound by the terms and conditions of the Connected Equipment Guarantee described in this document. If you do not agree to the terms and conditions of the Connected Equipment Guarantee, you should promptly return the Surge Product for a full refund prior to using it.

Scope of Connected Equipment Guarantee

Insignia provides you with a Connected Equipment Guarantee for the useful life of the Surge Product, beginning on the date you purchased the Surge Product or the date of delivery (if later than the date of purchase). Your purchase date is printed on the receipt you received with the Product.

The Connected Equipment Guarantee applies if (i) the Surge Product is defective in materials or workmanship and the defect caused the claimed damage; (ii) certain equipment that is directly and properly connected to the Surge Product (referred to as the "Connected Equipment") is damaged, subject to the terms and conditions provided herein; (iii) the Connected Equipment was damaged by a transient, spike, or surge ("Power Disturbance") on an AC Power Line on a properly installed, grounded, and code compliant 120 volt power line in the United States or Canada, or by a Power Disturbance on standard telephone land lines, PBX telephone equipment lines, Ethernet lines, or coaxial cables that are properly installed and connected; and (v) the Connected Equipment is directly plugged into and properly connected to the Surge Product in its original condition which is properly operated when a Power Disturbance passes through the Surge Product and (i) exhausts the protection capacity of the Surge Product or (ii) damages the Surge Product.

Because Insignia cannot control the quality of products sold by unauthorized sellers, this Connected Equipment Guarantee applies only to Surge Products that were purchased from Best Buy retail stores, www.BestBuy.com or www.BestBuy.ca, Best Buy's authorized online sales partner, or a Insignia Authorized Partner, unless otherwise prohibited by law. Insignia reserves the right to reject Connected Equipment Guarantee claims for Surge Products purchased from unauthorized sellers, including unauthorized websites. This Connected Equipment Guarantee gives you specific rights, and you may have other rights, which vary from State to State or Province to Province.

EXCLUSION OF DAMAGES FOR PERSONAL INJURY, CONSEQUENTIAL AND OTHER DAMAGES

THE SOLE AND EXCLUSIVE REMEDIES OF THE ORIGINAL PURCHASER FOR CONNECTED EQUIPMENT CLAIMS ARE THOSE PROVIDED BY THIS CONNECTED EQUIPMENT GUARANTEE. THIS EXCLUSION OF ANY OTHER EXPRESS WARRANTIES APPLIES TO WRITTEN AND ORAL EXPRESS WARRANTIES. INSIGNIA EXCLUDES ANY LIABILITY FOR PERSONAL INJURY UNDER THIS CONNECTED EQUIPMENT GUARANTEE. INSIGNIA EXCLUDES ANY LIABILITY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER FOR DAMAGE TO OR LOSS OF PROPERTY (EXCEPT FOR AND ONLY FOR THE SPECIFIC LIMITED AGREEMENT OF INSIGNIA TO PROVIDE CERTAIN WARRANTY BENEFITS REGARDING CONNECTED EQUIPMENT UNDER THE INSIGNIA CONNECTED EQUIPMENT GUARANTEE), LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION OR DATA. THIS EXCLUSION APPLIES EVEN THOUGH DAMAGE OR LOSS IS CAUSED BY NEGLIGENCE OR OTHER FAULT. NOTE: SOME STATES OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

COVERAGE EXCLUSIONS

Excluded Uses

The Connected Equipment Guarantee does not include coverage for use in environments requiring fail-safe performance, including without limitation the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, weapons systems, life support or medical equipment, space heaters, laser printers, appliances, salt lamps, aquariums or any other water-related products, or use in any circumstance in which the failure of the Surge Product could lead directly to death, personal injury, or severe physical or property damage, or that would affect operation or safety of any medical or life support device (collectively, "High Risk Activities”). ANY SUCH USE IS IMPROPER AND IS A MISUSE OF AN INSIGNIA SURGE PRODUCT.

COVERAGE LIMITS

Insignia's total liability under this Connected Equipment Guarantee is limited to an amount up to the maximum of the specified Aggregate Limit for the Surge Product. The Aggregate Limit of protection provided by the Connected Equipment Guarantee varies by model number, and can be found on the product page for your Surge Product at www.bestbuy.com or www.bestbuy.ca, or you can contact Insignia for additional information. The Aggregate Limit for each Surge Product is provided in the currency of the location where the Surge Product is sold.

This Connected Equipment Guarantee is not "first dollar" coverage. Insignia's obligation will be reduced by any amounts that the original purchaser is entitled to recover from other sources regarding the Surge Product or Connected Equipment, including insurance, other warranty, or extended warranty coverage, regardless of whether or not the original purchaser makes a claim for recovery, including but not limited to a claim under any applicable insurance, other warranty, or extended warranty.

HOW TO MAKE A CLAIM

To make a claim for damage to Connected Equipment under the Connected Equipment Guarantee, you must do the following:

  1. Call Insignia at (877) 467-4289 (toll free) within ten (10) days of the date of the event for which you wish to make a claim.
  2. Provide reasonable proof of purchase (for example, a sales receipt) that establishes you as the original purchaser of the Surge Product and Connected Equipment.
  3. When you contact Insignia, identify the Surge Product (by model number) and the item(s) of Connected Equipment (by manufacturer and model). Have information on all applicable insurance or other resources of recovery/payment that are available to the original purchaser and the name of the power utility supplier for the location of the Connected Equipment. Insignia will then send you additional instructions and the appropriate claim forms.

Insignia reserves the right to inspect the Surge Product, the Connected Equipment, and the site where the event occurred. All costs of shipping the Surge Product and the Connected Equipment to and from Insignia for inspection is the original purchaser's responsibility. Insignia reserves the right to negotiate the cost and choose the facility at which any repairs will take place, and Insignia must be notified and approve any repair facility before any Connected Equipment is serviced. You may be required to return the Surge Product to Insignia or ship the Connected Equipment to Insignia for inspection.

Any repair or modification of the Connected Equipment or Surge Product by a facility or entity not approved by Insignia voids this Connected Equipment Guarantee. If Insignia determines, in its sole discretion, that it is impractical to ship the damaged equipment to Insignia, Insignia may designate an equipment repair facility to inspect and estimate the cost to repair such equipment. The cost, if any, of shipping the equipment to and from such repair facility and of such estimate shall be paid by the original purchaser. The original purchaser shall prepay all shipping costs, must pay the cost of the repair estimate and is responsible for packaging and shipment. Insignia reserves the right to reject the shipped damaged Connected Equipment and not process the Connected Equipment Guarantee, if the shipped damaged Connected Equipment is damaged due to improper packing or shipping. Damaged Connected Equipment must remain available for inspection until the claim is finalized. Whenever claims are settled, Insignia reserves the right to be subrogated under any existing insurance policies the original purchaser may have.

Insignia's Duties Under the Connected Equipment Guarantee

Insignia will inspect and examine the Surge Product and the item(s) of Connected Equipment (or at Insignia's election, your written statement and repair cost estimate for those item(s)).

If the damage to Connected Equipment is covered by the Connected Equipment Guarantee, Insignia's sole obligation and the original purchaser's exclusive remedy is to: repair (or pay the cost of repair) or replace the Connected Equipment; or at the sole discretion of Insignia, as permitted by law, payment by Insignia to the original purchaser the Agreed Damage Amount for the Connected Equipment. The "Agreed Damage Amount" for all items of the original purchaser's Connected Equipment shall be the lesser of the amount determined under Clause (1) or (2) below, reduced by any amounts described in Clause (3) below:

  1. The fair market value of the Connected Equipment as established by the lower of (a) the average price the same or similar items are being sold for on eBay, (b) the price list of Orion Blue Book (or if such price list is no longer published, a published or announced price list reasonably selected by Insignia), or (c) the lowest price the same or similar items can be purchased for in the United States; or
  2. The Aggregate Limit for all Connected Equipment as set forth below, minus:
  3. The amount(s) of all payment you have or are entitled to receive from insurance, other warranties, extended warranties, or from other sources or persons for the Connected Equipment or damage to such equipment so that Insignia's maximum liability shall be reduced to reflect all such other payments or sources of recovery.

If Insignia replaces the Connected Equipment or pays the Agreed Damage Amount to the original purchaser, the original purchaser shall transfer all item(s) to Insignia without warranty by the original purchaser, but free of all liens or other interest.

Insignia may designate an authorized third party to administer the Connected Equipment Guarantee ("Third Party Administrator"), and the original purchaser may be required to contact the Third Party Administrator to file a claim. The original purchaser acknowledges and agrees to provide proof of the claim and other information to the Third Party Administrator.
